fee, public park development and recreation fee, and planned local drainage facilities fee;
and to establish new impact fees for police department facilities, equipment, and vehicles
and fire department facilities, equipment and vehicles
Back2round:
Development continues to move ahead at a record pace throughout the City. At this time,
approximately 2,000 new homes are in various stages of development, along with a large
amount of commercial development. This rate of growth continues to drive the demand
for municipal services, which in turn generates the need for expansion of the City's
public facilities in order to provide those services.
Years ago, the State recognized the need for cities to be able to meet infrastructure
demands created by development, and passed AB 1600. This bill specifically authorizes
the imposition of impact fees. In order to justify these impact fees, a nexus study is
required to demonstrate the connection between development and the need for capital
projects.
The City has charged impact fees for traffic systems, park and recreation, and storm
drains for many years. These fees have not been adjusted for a considerable amount of
time. It is staff s belief that a new nexus study will demonstrate a need to increase these
fees in order to provide funds for capital projects necessitated by development throughout
the community. In addition, new impact fees for police and fire facilities and equipment
may be proposed to help fund capital equipment related to the provision of public safety
services, which are also strained by new development
To that end, a consultant is being retained to develop the study, and the study is
scheduled to begin in July. The study will likely be completed in the fall. Development
Services staff is also finalizing a survey of development impact fees charged by other
cities in this area. In the meantime, the Council may wish to consider adopting a
resolution that will allow any revised impact fees to apply to new tract developments that
are currently in the pipeline.
The State Subdivision Map Act provides that the City may apply only those ordinances,
policies, and standards in effect on the date the City determined a development
application to be complete, unless the City initiated proceedings to modify an ordinance,
policy, or standard and provided notice of that fact pursuant to Government Code
S66474.2(b). By providing that notice and adopting a resolution, the City can notify
interested parties that it intends to apply any new and/or revised impact fees to any new
tract development that occurs during the interim time period.
Adoption of this resolution will ensure that revised impact fees can be captured back
from any tract development that is occurring during this time until the nexus study is

completed. Please note that this resolution does not increase any fees nor obligate
the Mayor and Council to increase fees in the future. Instead, it provides the ability to
collect any increased development impact fees on tract development that occurs during
the interim period, if the Mayor and Council approve fee increases in the coming months.
Financial Impact:
There is no direct impact by this action. Adoption of the resolution will provide the
ability to capture increased development impact fees that might otherwise not be
collected, if the resolution is not adopted.

WHEREAS, the City of San Bernardino has contracted with a consultant to perform a
"Development Impact Fee Calculation Nexus Study" in order to develop a capital facilities
planning structure and growth financing policy; and
WHEREAS, the Study includes analysis of existing development impact fees related to
traffic systems, public park development and recreation, and local drainage facilities; and
WHEREAS, the Study also includes analysis of new impact fees for Police Department
and Fire Department facilities, equipment, and vehicles; and
WHEREAS, the State Subdivision Map Action provides that the City may apply only
those ordinances, policies, and standards in effect on the date the City determined a
development application to be complete, unless the City initiated proceedings to modify an
ordinance, policy, or standard and provided notice of that fact pursuant to Government Code
S66474.2(b); and
WHEREAS, the City expects that one or more development applications are likely to
be filed and completed within the next several months, before the proposed new fees are
adopted and take effect; and
WHEREAS, the City intends to apply the proposed new and revised fees to such new
development; and
WHEREAS, the City published notice describing these proposed changes 10 days
'before the Council meeting, as Government Code S66474.2(b) requires;

and recreation, and local storm drainage facilities; and to establish new impact fees for Police
Department and Fire Department facilities, equipment, and vehicles.

This letter is to inform you that the Mayor and Common Council of the City of San Bernardino will hold a
public hearing on Monday, July 18,2005, at 4 p.m. in the Council Chambers of City Hall, 300 North "D"
Street, San Bernardino, to consider adopting a resolution initiating proceedings to adjust the traffic systems
fee, public park development and recreation fee, and planned local drainage facilities fee; and to establish
new impact fees for police department facilities, equipment, and vehicles and fire department facilities,
equipment and vehicles.
The City of San Bernardino has contracted with a consultant to perform a "Development Impact Fee
