Synopsis of Previous Council Action:
July 19, 2004: Resolution 2004-234 authorizing the Mayor and Common Council to execute a
Services Agreement between the City of San Bernardino and Boys and Girls Club of San
Bernardino, Inc. to provide community services at the Delmann Heights Community Center was
approved.

Staff Report
Subject:
Resolution authorizing the Mayor or her designee to execute Amendment No. 1 to the Service
Agreement between the City of San Bernardino and Boys and Girls Club of San Bernardino Inc.
to provide community services at the Delmann Heights Community Center.
Background:
In FY 2004/2005 the Council approved a service agreement (attached) between the City and the
Boys and Girls Club to provide services at the Delmann Heights Community Center. The first year
of the agreement concluded successfully, through networking to further the provision of recreation
services to the community. The Club has indicated an interest in a one-year extension to the
Service Agreement as provided for in the agreement.
Services at the Center have varied over the years based on communi,y's needs and currently
include the City's only Headstart Program, an after-school program, computer classes, senior
. nutrition programs, sports programs, summer pool operation, and several large scale special
events.
Based on the Boys and Girls Club of San Bernardino's strong background in program development
and delivery, it is prudent for the City to continue to contract with the Boys and Girls Club of San
Bernardino for the provision of recreation services.
The agreement terms include a payment of $85,000 to be paid in monthly increments over this one-
year extension. This plan will allow these valuable services to continue.
Financial Impact:
The budget for this program will remain the same as the adopted FY 04-05 budget and is
included in the proposed FY05-06 budget.
Recommendation:

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino or her designee is hereby
authorized and directed to execute on behalf of said City Amendment No. I to the Services.
Agreement with the Boys and Girls Club of San Bernardino Inc. providing community services .1
at the Delmann Heights Community Center for the period of August I, 2005 through July 31,
2006, a copy of which is attached hereto, marked Exhibit "An and incorporated herein by

reference as fully as though set forth at length.
SECTION 2. The authorization to execute the above referenced agreement is
rescinded if the parties to the agreement fail to execute it within sixty (60) days of the passage
of this resolution.

AMENDMENT NO.1
TO THE
SERVICES AGREEMENT
This Amendment No. I to the Services Agreement is entered into this day of
, 2005, by and between the City of San Bernardino ("CITY") and Boys and Girls
Club of San Bernardino Inc., ("CONSULTANT") relating to retain the services of the
CONSULT ANT for the purpose of management and operation of social, recreation and
community services at Delmann Heights Community Center located at 2969 N. Flores St., San
Bernardino, California.
I. The Section entitled "SCOPE OF SERVICES" CONSULTANT shall do, perform, and
carry out in a good and professional manner the following services subject to the provisions
of Section (l A-F) below.
A. Operate the community center from Monday through Friday 8am to 7pm exclusive of the
following holidays: September 5, November 11, November 24&25, December 23&26,
December 30, 2005, January 2, 2006 January 16, 2006, February 20, 2006, May 29,
2006, July 4, 2006.
B. Plan and implement the Senior Nutrition Program - Monday through Friday - 8am to
Ipm exclusive of holidays listed in item IA.
C. Plan and implement youth and teen programming - Monday through Friday - 3pm to
7pm exclusive of holidays listed in item lA. Programming will include tutoring, life
skills development, conflict resolution, sports and other general recreation activities.
D. Deleted.
E. Deleted.
F. Plan and implement annual events to include:
I. Unity of Choirs - Third Saturday in February
2. Annual Easter Egg Hunt - Saturday before or the Sunday prior to Easter
Sunday
3. Boys and Girls Club and City Parks, Recreation and Community Services Annual
Track Meet - First Saturday in June
4. Del Fest - Third Saturday in SeptemberFacility Management and Maintenance
J. The CITY will retain responsibility for major building maintenance and repair
(including graffiti removal), building alarm system maintenance, utilities bills (water,
gas, electric, rubbish), and routine custodial services at the Center. The CITY will retain
and pay for, at its own expense, two regular phone lines, one for the general phone and
one for the pool operations. Any additional phone, fax, computer, or other
telecommunication line shall be the responsibility of the CONSULTANT to provide and
maintain. CONSULT ANT will be responsible for providing access to other facility users
including the Head Start program and Senior Nutrition program. CONSUL T ANT shall
furnish at his own expense, all labor, equipment, and materials associated with

office/room furnisbings, Center/Park security, cable/satellite/digital/television reception
services, and pool safet)' equipment (ropes and buoys, rescue tubes and throw lines,
lifeguard towers, bandrails, first aid supplies, flotation devices and otber similar items)
toward the satisfactory performance of tbe work set fortb in tbis Agreement.
CONSUL T ANT will scbedule and accommodate after hours rental use of the facility.
All payments for after hours rental use will follow the City fee schedule and be made to
the CITY. CONSULANT shall be reimbursed all staff cost associated with each after
bours rental. Facility layout identifying defined use of each space inclusive of outdoor
facilities is located in Appendix "A" & "B".
3. The Section entitled "RECORDS AND INSPECTIONS" is hereby amended in the last
sentence to now read as follows:
"Consultant shall provide a montbly report of services provided and number of
persons served by the first business day of each month.
4. The Section entitled "TERM; SEVERABILITY" is hereby amended to now read as
follows:
"The term of this Services Agreement shall be August 1,2005 through July 31,
2006 period.
All other terms and conditions of said Services Agreement is uncbanged and shall remain
in full force and effect.

At the Mayor and Common Council meeting of July 18, 2005, the City of San Bernardino
adopted Resolution No. 2005-245 - Resolution authorizing the Mayor or her designee to execute
an Amendment No. 1 to the service agreement between the City of San Bernardino and Boys and
Girls Club of San Bernardino, Inc. to provide community services at the Delmann Heights
Community Center.
Attached is one (1) original agreement and two (2) duplicate original agreements. Please obtain
signatures in the appropriate locations and return the ORIGINAL agreement to the City Clerk's
Office as soon as possible, to my attention. Please keep the remaining two (2) fully executed
copies for your records and for the other party.
Please be advised that the resolution and contract will be null and void if not executed
within six' (60) days from the date of adoption, or returned to our office by September 16,
2005.
