Synopsis of Previous Council Action:
On December 11, 2003, the Mayor and Common Council adopted Resolution No. 2003-
364, approving a side letter to Resolution No. 2003-239, amending Section I, PERS,
Safety Employees, Subsection 5, for Police Safety Management.
Recommended Motion:
1. Adopt Resolution.
2. Authorize the Director of Finance to amend the FY 2005-06 Budget and transfer
funds from Account #001-092-5011 to various Poli e Division sala Ibenefit
accounts.

Subiect:
Resolution of the City of San Bemardino approving a side letter to Resolution No. 2001-94,
establishing a compensation and benefits plan for the Management/Confidential & Unclassified
Employees, for the Police Safety Management Employees.
Back2round:
On December 11, 2003, the Mayor and Common CounCil adopted Resolution No. 2003-364,
approving a side letter to Resolution No. 2003-239, amending Section I, PERS, Safety
Employees, Subsection 5, for the Police Safety Management employees to provide a
supplemental retirement benefit program based on the difference between PERS 3% @ 55 Plan
and 3% @ 50 Plan. The qualification period is from January 1, 2004, to December 31,2005.
The PARS Retirement Enhancement Plan (REP) will expire on December 31,2005, and the
Police Management employees requested to meet with the Human Resources Director to discuss
the extension of the REP benefit.
The Human Resources Department reviewed both the cost of the City's current PARS Plan, as
well as the cost to modify our current PERS contract to maintain the 3% @ 50 retirement
equivalent benefit for Police Management employees. With consideration to the City's budget, it
is much more cost effective at this time to extend the City's current PARS agreement. Therefore,
it is our recommendation to extend the current PARS agreement for the period of January 1,
2006, through December 31,2008.
As part of the newly adopted MOU's for the General and Mid-Management Units, the City
agreed to consider a holiday as a nine-hour day accrual instead of the current eight-hour day
accrual. The Police Management Association is requesting to increase holiday pay from an eight
(8) hour to nine (9) hour accrual per holiday, and to allow a cap of 126 hours in the holiday bank.
Due to the 9/80 majority work schedule, it is recommended that we increase the holiday accrual
to nine hours per holiday.
Financial Impact:
The original Council Action approved on December 11,2003 reflected the amortization schedule
presented for this benefit. The cost to extend the REP from January 1, 2006, through December
31, 2008 (3 years) will utilize the same amortization schedule with an increased cost of
approximately $43,300 per year. The increase in holiday accrual is a cost of $13,300 per year.
The total cost for this proposal is $56,600 annually.

The following sets forth a Side Letter to Resolution No. 2001-94, for full-time, regular active
Police Safety Management Employees to amend the language in Section 2, I, PERS, Safety
Employees, of the Management and Confidential Employee Compensation and Benefits Plan,
extendine the effective period January 1. 2006 to December 31. 2008, and adding a section
for Safety Employees in Section 2, X, Holidays, granting 9-hour holiday accruals for Safety
Employees.
Section 2. L PERS. Safetv Emoloyees:
(AMEND)
To qualify for supplemental retirement benefits based on the difference between CalPERS 3% @
55 Plan and 3% @ 50 Plan, employees must meet all of the following qualifications between
January 1, 2006 and prior to December 31,2008. The extension to this benefit will be effective
January 1, 2006.
. Must be 50 years of age;
. Have 20 or more years of service with the City of San Bernardino; and
. Be eligible for retirement and concurrently retire with PERS; or
. Meets the eligibility requirements for an industrial disability retirement with the City of
San Bernardino
When retiring, employees must retire from the City of San Bernardino.
Section 2. X. Holidavs:

Safety EmDloyees:
Effective January 1, 2006, safety employees will accrue nine (9) hours per holiday. Holidays
earned in any twelve-month period are not accumulative beyond the total number of holidays
allowed each year by this pay plan. Employees may not exceed a balance of 126 hours at any
time.
