Resolution of the City of San Bernardino ratifying the submittal of a grant application and
authorizing the police department to administer the Alcohol Beverage Control Grant funds in
accordance with the grant expenditure plan.
BACKGROUND
The State of California Department of Alcohol Beverage Control will award $1.5 million in
grants in Fiscal Year 2005/06 to local law enforcement agencies to fight alcohol-related crimes.
The grants are part of an ABC program to provide grant assistance to local law enforcement to
target liquor license locations that generate alcohol-related crime problems in their communities.
The deadline for grant applications was March 31,2005.
In mid-March, the Vice & Narcotics Unit learned of this grant opportunity and submitted a grant
application by the March 31, 2005 deadline. Their proposal targets the problem of underage
drinking stemming from both on and off sale liquor license establishments, by the use of
educational and enforcement programs.
If awarded, the grant will provide $99,900 for overtime to complete the grant goals and
objectives. Grant funds will provide 1,036 hours of overtime for police officers, 444 hours for
detectives and 272 hours for sergeants to perform educational and enforcement programs.
FINANCIAL IMPACT
There will be no impact on the City's General Fund. The Police Department will be using a total
of $99,900 in Alcohol Beverage Control Grant funds, if awarded, to perform enforcement and
educational programs in support with grant goals and objectives.

Overtime
Overtime will be worked by investigators and supervisors assigned to Vice & Narcotics and
police officers assigned to Patrol to perform various enforcement and educational programs in
furtherance of the grant goals and objectives. A total of $99;900 in grant overtime has been
requested which is sufficient to perform the following programs.
. Provide updated training on ABC laws to approximately 1 00 patrol officers, vice
investigators, and supervisors.
. Meet with owners and operators of the three most problematic ABC licensed
establishments to educate them on ABC laws.
. Continue working with officials from California State University San Bernardino and San
Bernardino Valley College regarding underage drinking problems.

PROJECT NARRATIVE
BACKGROUND
Established in 1850, the San Bernardino Police Department currently has an authorized strength
of 460 personnel, including 301 sworn and 159 non-sworn. The department provides municipal
law enforcement services for the City of San Bernardino. The department has adopted a
Community Oriented Policing and Problem Solving (COPPS) philosophy. To support the
COPPS philosophy the City of San Bernardino has been divided into five geographic Patrol
Districts and 21 patrol beats.
The department is divided into three divisions: Patrol, Investigations and Administrative
Services. The enforcement of ABC laws and regulations is the responsibility of the Vice Unit,
part of the Investigations Division, which consists of two full time investigators who are
supervised and evaluated by a police sergeant. In addition to the enforcement of ABC laws and
regulations, the unit is responsible for the enforcement of all vice related crimes, to include street
level prostitution, escorts, motel prostitution, massage parlors, gaming and carnivals, gambling,
animal fighting, lewd act investigations, and adult book stores. Investigators also work directly
with city hall, particularly the Business Registration Department and the Planning Department to
address administrative vice issues. The vice officers that are currently assigned have years 0 f
experience in the identification of violations and also a very good working relationship with the
local ABC officials. T hey are highly proactive and realize that through their hard work and
efforts, that a significantly improved quality of life can be established and maintained in the city.
The department has a long history of conducting minor decoy, shoulder tap and other
enforcement and educational programs designed to achieve compliance with ABC laws and
regulations. During the two-year period from January 1,2003 through December 31, 2004, a
total of 18 shoulder-tap and decoy operations were conducted, resulting in 46 arrests. During the
FY 2003/2004 ABC grant period, two LEAD training sessions were held, with 11 persons
trained. Additionally, one roll call ABC training session was conducted with 40 patrol officers
attending. 44 new police officers have been hired and assigned to the Patrol Division since the
roll call training session was held. Consequently, a majority of the current patrol force has not
received any formal ABC training since graduating from the Basic Police Academy.
The vice investigators and supervisor will be responsible for the successful implementation of
grant objectives.
PROBLEM STATEMENT
The City of San Bernardino which is located 60 miles east of Los Angeles is the county seat for
San Bernardino County. The city encompasses 60 square miles with an estimated population of
194,100. According to the United States economic forecast, the Inland Empire, which
incorporates the city of San Bernardino, is one of the top ten growth areas in the nation with the
fastest developing urban area. The city is ethnically diverse, with 29% of the population of
Anglo descent, 15% African American, 8% Asian, and 47% Hispanic. In addition recent
analysis has shown that approximately 30% of the city's population is under the age of 18. We
are home to the California State University San Bernardino, where more than 15,000 students are
enrolled.

PROJECT NARRATIVE
In 2004, the police officers responded to 1 05,334 c aIls for service from the public and made
10,101 arrests. City reported 13,901 Part I crimes to the Department of Justice, including 2,600
violent crimes and 11,301 property crimes. The City's crime rate has been adversely impacted by
a number of related factors: low cost of rental housing, 1,400 parolees residing in the City, 56%
of the community is receiving state or federal aid, and a high number of families living below the
poverty 1 evel. These factors pose a daily challenge to our ability to provide adequate safety
measures and law enforcement for the residents of the city. This workload dramatically limits
the department's ability to respond to misdemeanor and social order crimes.
There are approximately 347 ABC licensed premises (101 type 20, 74 type 21, 10 type 40, 60
type 41,3 type 42,69 type 47, 16 type 48, 7 type 51, 5 type 52, 1 type 57, and 1 type 59) in San
Bernardino for residents and non-residents to access alcoholic beverages. Underage drinking at
ABC licensed establishments has been identified as the primary alcohol related problem faced by
the department problem and a significant drain of police services. The secondary problem is
drinking in public, public intoxication, intoxicated patrons fighting in the parking lots of licensed
establishments or the surrounding area. Collectively these problems have a deleterious affect on
the general quality of life for business owners and residents that are in close proximity to the
problem establishments.
During the calendar years 2004 and 2005, there have been significant problems with three large
night club type establishments that draw underage patrons from as far away as San Diego and
Los Angeles. The identified problems include juvenile drinking, public intoxication, fighting,
loitering, driving under the influence, vandalism, etc. In 2004, officers responded to 630 calls
for service and made 204 arrests that these establishments. These problems have been
determined through calls for service, public complaints, arrests, traffic collisions, information on
the businesses provided by ABC, and surveillance of the locations. Problems at these
establishments spill over into the surrounding neighborhoods impacting the quality 0 f 1 ife for
residents and causing nearby businesses to suffer economically. Oftentimes businesses are
forced to close when the patrons of the problem establishment loiter and prevent them from
carrying on the normal operations. There are two additional bar/nightclub facilities in the
process of opening.
With only two fulltime investigators assigned to the Vice Unit and the large number of licensed
establishments, it is very difficult to adequately ensure that licensed establishments are in proper
compliance with all applicable ABC laws, as well as local statutes. Our efforts to resolve these
problem locations have been primarily active surveillance, arrests of violators, and meetings with
establishment owners in an attempt to obtain their voluntary compliance with ABC and City
imposed conditions placed on the ABC license, conditional use permit, or entertainment license.
The grant funds would allow the San Bernardino Police Department to continue to have a
definite impact on the identified problems.
Both the City Attorney who handles the City of San Bernardino Municipal Code violations, and
the District Attorney's Office which prosecutes state law violations, are highly supportive of the
enforcement, educational and prevention aspects of our grant application and are dedicated to the
successful prosecution of alcohol related crimes.

PROJECT NARRATIVE
PROJECT OBJECTIVES
The department proposes to implement the following objectives and activities that we believe ~
will successfully mitigate the problem of underage drinking in the City.
Objective 1 - To open effective lines of communication with community members, elected
officials and the media.
Objective 2 - Train approximately 100 patrol officers, vice investigators and supervisors to
identify disruptive and disorderly retail alcoholic beverage outlets and implement fast-track
enforcement action to remedy or eliminate problem-creating operations from the community.
Patrol beat officers will be a "force multiplier", by monitoring compliance and working hand-in-
hand with the Vice Unit in resolving any identified violations.
Objective 3 - The two vice investigators will identify the three most problematic ABC licensed
establishments in the City by the following means:
· Reviewing RMS and CAD crime and arrest data and calls for service.
· With the assistance of the five-person Crime Analysis Unit, utilize ArcView mapping
software to prepare comprehensive visual analysis of data to aid in deployment.
· Review complaints from community members and input from patrol officers.
Objective 4 - To meet with owners and employees of the three most problematic ABC licensed
establishments and educate them on ABC laws and local regulations in an effort to secure their
voluntary compliance and support.
Objective 5 - Continue the partnerships that were developed as part of the California State
University Partnership Program (a prior ABC funded grant) with CBUSB and San Bernardino
Valley College through quarterly meetings will key college stakeholders. The two vice
investigators and a patrol officer will meet quarterly with officials at CSUSB and SBVC to
monitor underage drinking problems and implement education and enforcement programs.
Objective 6 - Vice investigators will conduct at least 20 undercover surveillance programs at the
three most problematic ABC licensed establishments to target offenders who consume alcohol in
the parking lots of ABC licensed establishments prior to entering the businesses.
Objective 7 - To conduct at least four "Cops in Shops" programs in the City of San Bernardino
during the grant period using crime analysis data and input from community members, elected
officials and patrol officer.
Objective 8 - To implement a proactive enforcement program designed to reduce DUl's and
traffic collisions involving DUl drivers.
· Vice investigators will deploy at six OTS grant-funded DUl checkpoints and six DUl
saturation patrols to immediately investigate underage drinking by drivers and
passengers.
· With the assistance of the department's Traffic Unit, copies of all DUl arrests will be
routed to ABC on a weekly basis. ABC will send warning letters to ABC licensed
establishments when they are determined to be the proximate source of intoxicating

alcohol. Subsequent arrest report identifications will lead ABC to initiate an
investigation of the establishment for sales to obviously intoxicated persons.
Objective 9 - The Vice Unit will conduct the following enforcement programs at ABC licensed
establishments with the overarching goal of gauging the level of voluntary compliance at the
establishments. All violations will be submitted either the City Attorney or District Attorney's
Office for prosecution as well and the Riverside ABC Office for administrative action.
· At least ten "Underage Decoy" programs using underage minors to try to illegally
purchase alcohol for themselves.
· At least ten "Shoulder Tap" programs using undercover operatives to try to have others
purchase the alcohol for them.
· At least four "Trap Door" programs where vice officers will pose as employees stationed
at entrance doors of ABC licensed establishments checking the identification of patrons
seeking admittance. The goal of these programs is to apprehend underage minors using
fraudulent identification and recover the false ID's.
· At least four "Impact" programs where vice investigators team up with ABC
investigators to reinforce compliance at ABC licensed establishments by training
operators on ABC laws and their responsibilities and accountability associated with the
sale of alcohol.
Objective 10- Vice investigators will conduct at least two LEAD (Licensee Education on
Alcohol and Drugs) training sessions for retail licensees, their employees, and applicants. The
goal is to train at least SO persons.
Objective 1 J - By the end of the first quarter, vice investigators will develop a grant Evaluation
plan to track progress made on achieving project objectives and activities.
Objective J 2- Attend at least four Community Crime Briefings inform the public on ABC grant
objectives and activities and receive information from the public on underage drinking problems.
METHOD OF PROCEDURE

Objective J - The PIO will distribute a press release announcing the grant award, duration, major
objectives and activities and involved agencies and solicit the media's ongoing support and
involvement in reporting on grant activities and results.
Objective 2 - The following training activities will be completed:
· ABC investigators will train three Vice Unit investigators on ABC laws, enforcement
strategies and tactics, community resources and the administrative accusation process.
· Vice investigators will develop a two hour block of roll call training for patrol officers on
ABC laws, enforcement strategies and tactics as well as the operating conditions in place
for identified problem ABC licensed establishments.
· The two vice investigators and their supervisor will attend the ABC grant conference.

Recommended Activities for Ouarter 4
Objective 1 - The PIO will continue to develop and distribute press releases on grant activities
and reinforce the media's support and involvement in grant activities. A final press release at the
conclusion of the grant will provide the media and community members with the achievements
made with grant funds and announce ongoing programs.
Objective 3 - The list of the three most problematic ABC licensed establishments in the City will
be updated.
Objective 4 - Objective 4 - The Vice Unit will meet with owners and employees at the three
most problematic ABC licensed establishments. An estimated 45 owners and employees will
receive progress reports on migrating underage drinking, updates on enforcement activities and
training updates.
Objective 5 ..:. The vice investigators will attend a quarterly meeting with officials at California
State University San Bernardino and San Bernardino Valley College to discuss underage
drinking problems on the campuses and surrounding neighborhoods.

Objective 9 - The Vice Unit will conduct the following enforcement programs:

Objective 10- The Vice Unit will coordinate the scheduling of one LEAD (Licensee Education
on Alcohol and Drugs) training session. The attendance at the training is projected to be 25
persons.
Objective 12 - Attend at least two Community Crime Briefings.
METHOD OF EVALUATION
The vice investigators will work closely with the Crime Analysis Unit to monitor the outcomes
of grant activities and to shift resources as needed to address emerging alcohol related problems.
This regular examination will allow them to focus the proper assets on the locations that have the
highest incidence of violations, so that we can get the most impact from our limited resources.
Additionally and of equal importance, the vice investigators will track the progress made on
grant objectives and activities. A written Evaluation plan will be developed by the end of the
first quarter and used to track this progress. The plan will include questions developed from
project objectives such as "Did the vice investigators receive training on ABC laws from ABC
investigators?" as well as identify the data used in evaluating the success of project activities,
and, wherever possible, measure cost effectiveness.
ABC LIAISON
The San Bernardino Police Department has had a long history of working closely with
investigators from the Riverside ABC; both during periods when funded by grant funds, and
those without. With the large volume of licensed locations in our city and the problems we have
experienced with them, these close ties have been extremely beneficial to both organizations, and
will continue to be so. the g rant funds w ill allow the S an Bernardino Police D epartmentt 0
continue building on this close working relationship and ultimately allow a successful use of the
grant funds.
STATEMENT OF INTENT
Underage drinking and the types of crimes that follow from it have been and will continue to be
a high priority for the San Bernardino Police Department. We have had great success so far in
our partnership with ABC and the department is committed to maintaining this relationship in the
future. The training provided to ourpatrol officers on ABC laws and enforcement will allow the
department to have a positive impact on alcohol related crimes long after the conclusion of this
grant.
