ERAF REDEVELOPMENT PROJECT AREA PLAN AMENDMENTS
BACKGROUND:
For the fiscal year 2004-05, State legislation was passed that required redevelopment agencies to shift to the
Education Revenue Augmentation Fund ("ERAF") $250 million in property tax revenues for K-12 schools
and community colleges. Each redevelopment agency, on or before May 10,2005, must remit to the county
auditor its ERAF amount as determined by the State Director of Finance. If any agency fails to transmit the
full amount of funds required, if it is precluded by court order from transmitting the amount, or it is
otherwise unable to meet its full obligation, the county auditor, no later than May 15,2005, shall transfer any
amount necessary to meet the obligation from the loca1legislative body's property tax allocation, including
the City's allocation. The Economic Development Agency's ("Agency") ERAF obligation for the fiscal year
2004-05 is $1,828,023. In order to meets its obligation, the Agency will borrow from the Low-and Moderate
Income Housing Fund as allowed by State legislation as previously authorized by the Community
Development Commission ("Commission") on December 20, 2004.
CURRENT ISSUE:
Senate Bill 1045, approved on September 1, 2003, amended California Health and Safety Code Section
33333.6 to provide that the legislative body (in this case, the Mayor and Common Council) may enact an
ordinance to extend by one year the time limit on the effectiveness of a redevelopment plan adopted prior to
January 1, 1994, and the time limit for payment of indebtedness and the receipt of property taxes (tax
increment), when the Agency is required to make an ERAF payment for that redevelopment project area.
The following chart illustrates the current and proposed time limits on the effectiveness of the redevelopment
plans adopted prior to January 1, 1994, along with the current and proposed time limits for payment of
indebtedness and the receipt of tax increment.

By enacting ordinances for each of the above redevelopment project areas, the effectiveness (expiration) of
the redevelopment plans and the time limits for the receipt of tax increment revenues and the payment of
debt will be extended by one year. Senate Bill 1045 further allows that such ordinances may be adopted
without normal compliance procedures for redevelopment plan amendments. These plan amendments will
allow the Agency an additional year to recoup its ERAF obligation.
ENVIRONMENTAL IMPACT:
None.
FISCAL IMPACT:
The Agency will receive tax increment for one additional year beyond the current time limit to receive
property taxes and pay debt.
RECOMMENDATION:
That the Mayor and Common Council adopt the attached Ordinances.

WHEREAS, the Redevelopment Agency of the City of San Bernardino ("Agency") is

and exercise its powers, all under and pursuant to the California Community Redevelopmen

Law (the "CRL") codified under Division 24, Part 1 of the California Health and Safety Cod

commencing at Section 33000; and
WHEREAS, the Agency is engaged in activities necessary and appropriate to carry ou
the Redevelopment Plan ("Redevelopment Plan") for the State College Redevelopment Projec
Area ("Project Area"), which was adopted by the Agency's legislative body, the San Bernardin
City Council ("City Council"), by Ordinance No. 3067 on April 27, 1970; and
WHEREAS, pursuant to California Health and Safety Code Section 33333.6, a tim
limit on the effectiveness of the Redevelopment Plan and a time limit on the period for paymen
of the indebtedness and receipt of property taxes under the Redevelopment Plan have bee

Agency, under such a plan, is required to make a payment to the Educational Revenu
Augmentation Fund pursuant to California Health and Safety Code Section 33681.9; and
WHEREAS, SB 1045 further provides that such ordinance may be adopted withou
compliance with the normal procedures for redevelopment plan amendments (see Californi
Health and Safety Code Section 33333.6(d)(2)); and
WHEREAS, the City Council desires' to adopt this Ordinance to amend and exten
certain time limitations of the Redevelopment Plan, as more piuticularly set forth below, i
accordance with Section 33333.6 as amended by SB 1045; and
WHEREAS, the enactment of this Ordinance is exempt for the California Environmenta
Quality Act codified under California Public Resources Code Section 21000 et. seq. (hereinafte
referred to as "CEQA") pursuant to CEQA Guidelines Section 15378(b)(4) because it is a fisca
activity which does not involve any commitment to any specific project which may result in
potentially significant physical impact on the environment.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CIT
OF SAN BERNARDINO, AS FOLLOWS:

SECTION 1. The current time limit on the effectiveness of the State Colleg

Redevelopment Plan is hereby extended by one year from the existing time limit of April 27
222010 to April 27, 2011 and the Redevelopment Agency of the City of San Bernardino is hereh

authorized to act with respect to the Redevelopment Plan at any time during which th
24
Redevelopment Plan is effective.

SECTION 2. The current time limit on paying indebtedness or receiving property taxe
26
27
pursuant to the State College Redevelopment Plan and the Community Redevelopment Law i
hereby extended by one year from the existing time limit of April 27, 2020 to April 27, 2021 an

the Redevelopment Agency of the City of San Bernardino is hereby authorized to act wit
respect thereto during such extended period.
SECTION 3. Except with respect to the amendments set forth herein, the State Colleg
Redevelopment Plan, as amended, is and shall remain unchanged and in full force and effect i
accordance with its terms.
SECTION 4. The City Clerk is hereby authorized to file a Notice of Exemption with th
County of San Bernardino pursuant to CEQA Guidelines Section 15094.
SECTION 5. This Ordinance shall go into effect and be in full force and operation fro
and after thirty (30) days after its final page and adoption. The City Clerk shall certify to th
passage and adoption of this Ordinance and shall cause this Ordinance to be published as se
forth below.
SECTION 6. Following adoption, the City Clerk shall see that this Ordinance
publicized in conformity with Government Code Section 36933.
SECTION 7. Inconsistent Provisions. Any provision of the City of San Bernardin
Municipal Code or appendices thereto inconsistent with the provisions of this Ordinance, to th
extent of such inconsistencies and no further, is hereby repealed or modified to the exten
necessary to effect the provisions of this Ordinance.
SECTION 8. Constitutionality. In any section, subsection, sentence, clause, or phras
of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of an
court of competent jurisdiction, such decision shall not affect the validity of the remainin
portions of this Ordinance. The City Council hereby declares that it would have passed thi
Ordinance and each and every section, subsection, sentence, clause, or phrase not declare

certain time limitations of the Redevelopment Plan, as more particularly set forth below, i
accordance with Section 33333.6 as amended by SB 1045; and
WHEREAS, the enactment of this Ordinance is exempt for the California Environmenta
Quality Act codified under California Public Resources Code Section 21000 et. seq. (hereinafte
referred to as "CEQA") pursuant to CEQA Guidelines Section I 5378(b)(4) because it is a fisca
activity which does not involve any commitment to any specific project which may result in
potentially significant physical impact on the environment.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CIT
OF SAN BERNARDINO, AS FOLLOWS:
SECTION 1. The current time limit on the effectiveness of the Central
Redevelopment Plan is hereby extended by one year from the existing time limit of August 6
2013 to August 6, 2014 and the Redevelopment Agency of the City of San Bernardino is hereb
authorized to act with respect to the Redevelopment Plan at any time during which th
Redevelopment Plan is effective.
SECTION 2. The current time limit on paying indebtedness or receiving property taxe
pursuant to the Central City North Redevelopment Plan and the Community Redevelopment La
is hereby extended by one year from the existing time limit of August 6, 2023 to August 6, 202

SECTION 7. Inconsistent Provisions. Any provision of the City of San Bernardin
Municipal Code or appendices thereto inconsistent with the provisions of this Ordinance, to th
extent of such inconsistencies and no further, is hereby repealed or modified to the exten
necessary to effect the provisions of this Ordinance.
SECTION 8. Constitutionality. In any section, subsection, sentence, clause, or phras
of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of ~m
court of competent jurisdiction, such decision shall not affect the validity of the remainin
portions of this Ordinance. The City Council hereby declares that it would have passed thi

WHEREAS, the Redevelc;>pment Agency of the City of San Bernardino ("Agency") is

and exercise its powers, all under and pursuant to the California Community Redevelopmen

Law (the "CRL") codified under Division 24, Part I of the California Health and Safety Cod

WHEREAS, the Agency is engaged in activities necessary and appropriate to carry ou

Project Area ("Project Area"), which was adopted by the Agency's legislative body, the S

SECTION 1. The current time limit on the effectiveness of the Northwes
Redevelopment Plan is hereby extended by one year from the existing time limit of July 6, 202
to July 6, 2023 and the Redevelopment Agency of the City of San Bernardino is hereb
authorized to act with respect to the Redevelopment Plan at any time during which th
Redevelopment Plan is effective.
SECTION 2. The current time limit on paying indebtedness or receiving property taxe

SECTION 7. Inconsistent Provisions. Any provision of the City of San Bernardin
Municipal Code or appendices thereto inconsistent with the provisions of this Ordinance, to th
extent of such inconsistencies and no further, is hereby repealed or modified to the exten
necessary to effect the provisions of this Ordinance.
SECTION 8. Constitutionality. In any section, subsection, sentence, clause, or phras
of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of an
court of competent jurisdiction, such decision shall not affect the validity of the remainin
portions of this Ordinance. The City Council hereby declares that it would have passed thi
Ordinance and each and every section, subsection, sentence, clause, or phrase not declare

WHEREAS, the Redevelopment Agency of the City of San Bernardino ("Agency") is
community redevelopment agency duly created, established and authorized to transact busines
and exercise its powers, all under and pursuant to the California Community Redevelopmen
Law (the "CRL") codified under Division 24, Part I of the California Health and Safety Cod

commencing at Section 33000; and
WHEREAS, the Agency is engaged in activities necessary and appropriate to carry ou
the Redevelopment Plan ("Redevelopment Plan") for the Tri City Redevelopment Project Are
Council ("City Council"), by Ordinance No. MC-283 on June 20, 1983; and
("Project Area"), which was adopted by the Agency's legislative body, the San Bernardino Cit
WHEREAS, pursuant to California Health and Safety Code Section 33333.6, a tim

limit on the effectiveness of a Redevelopment Plan adopted prior to January I, 1994 and the tim
limit for payment of indebtedness and the receipt of property taxes under the same when th

Agency, under such a plan, is required to make a payment to the Educational Revenu
Augmentation Fund pursuant to Californi.a Health and Safety Code Section 33681.9; and
WHEREAS, SB 1045 further provides that such ordinance may be adopted withou
compliance with the normal procedures for redevelopment plan amendments (see Californi
Health and Safety Code Section 33333.6(d)(2)); and
WHEREAS, the City Council desires to adopt this Ordinance to amend and exten
certain time limitations of the Redevelopment Plan, as more particularly set forth below, i
accordance with Section 33333.6 as amended by SB 1045; and
WHEREAS, the enactment of this Ordinance is exempt for the California Environmenta
Quality Act codified under California Public Resources Code Section 2]000 et. seq. (hereinafte
referred to as "CEQA") pursuant to CEQA Guidelines Section I 5378(b)(4) because it is a fisca
activity which does not involve any commitment to any specific project which may result in
potentially significant physical impact on the environment.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CIT
OF SAN BERNARDINO, AS FOLLOWS:

WHEREAS, the Redevelopment Agency of the City of San Bernardino ("Agency") is

community redevelopment agency duly created, established and authorized t6 transact busines

and exercise its powers, all under and pursuant to the California Community Redevelopmen

Law (the "CRL") codified under Division 24, Part I of the California Health and Safety Cod

commencing at Section 33000; and
WHEREAS, the Agency is engaged in activities necessary and appropriate to carry ou
Redevelopment Plan ("Redevelopment Plan") for the Mount Vernon Corrido

Redevelopment Project Area ("Project Area"), which was adopted by the Agency's legislativ

body, the San Bernardino City Council ("City Council"), by Ordinance No. MC-733 on June 25

1990; and

WHEREAS, pursuant to California Health and Safety Code Section 33333.6, a tim

limit on the effectiveness of the Redevelopment Plan and a time limit on the period for paymen

of the indebtedness and receipt of property taxes under the Redevelopment Plan have bee

WHEREAS, Senate Bill 1045, approved on September 1, 2003 and chaptered 0

September 2, 2003 ("SB I 045"), amended Health and Safety Code Section 33333.6 to provid
that the legislative body of the Agency may enact an ordinance to extend by one year the tim
limit on the effectiveness of a Redevelopment Plan adopted prior to January 1, 1994 and the tim

Agency, under such a plan, is required to make a payment to the Educational Revenu
Augmentation Fund pursuant to California Health and Safety Code Section 33681.9; and
WHEREAS, SB 1045 further provides that such ordinance may be adopted withou
compliance with the normal procedures for redevelopment plan amendments (see Califomi
Health and Safety Code Section 33333.6(d)(2)); and
WHEREAS, the City Council desires to adopt this Ordinance to amend and exten
certain time limitations of the Redevelopment Plan, as more particularly set forth below, i
accordance with Section 33333.6 as amended by SB 1045; and
WHEREAS, the enactment of this Ordinance is exempt for the California Environmenta
Quality Act codified under California Public Resources Code Section 21000 et. seq. (hereinafte
referred to as "CEQA") pursuant to CEQA Guidelines Section I 5378(b)(4) because it is a fisca
activity which does not involve any commitment to any specific project which may result in
potentially significant physical impact on the environment.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CIT
OF SAN BERNARDINO, AS FOLLOWS:

Redevelopment Plan is hereby extended by one year from the existing time limit of June 25
2030 to June 25, 2031 and the Redevelopment Agency of the City of San Bernardino is hereby
authorized to act with respect to the Redevelopment Plan at any time during which th
Redevelopment Plan is effective.
SECTION 2. The current time limit on paying indebtedness or receiving property taxe
pursuant to the Mount Vernon Corridor Redevelopment Plan and the Communit

WHEREAS, the Redevelopment Agency of the City of San Bernardino ("Agency") is a

community redevelopment agency duly created, established and authorized to transact business
11
and exercise its powers, all under and pursuant to the California Community Redevelopment
12
Law (the "CRL") codified under Division 24, Part 1 of the California Health and Safety Code
13
commencing at Section 33000; and
WHEREAS, the Agency is engaged in activities necessary and appropriate to carry out
the Redevelopment Plan ("Redevelopment Plan") for the Central City East Redevelopment
Project Area ("Project Area"), which was adopted by the Agency's legislative body, the San
Bernardino City Council ("City Council"), by Ordinance No. 3571 on May 3, 1976; and
WHEREAS, pursuant to California Health and Safety Code Section 33333.6, a time
limit on the effectiveness of the Redevelopment Plan and a time limit on the period for payment
of the indebtedness and receipt of property taxes under the Redevelopment Plan have been

established; and

WHEREAS, Senate Bill 1045, approved on September 1, 2003 and chaptered on
25
September 2,2003 ("SB 1045"), amended Health and Safety Code Section 33333.6 to provide
26
that the legislative body of the Agency may enact an ordinance to extend by one year the time
27
limit on the effectiveness of a Redevelopment Plan adopted prior to January 1, 1994 and the
time limit for payment of indebtedness and the receipt of property taxes under the same when

the Agency, under such a plan, is required to make a payment to the Educational Revenue
Augmentation Fund pursuant to California Health and Safety Code Section 33681.9; and
WHEREAS, SB 1045 further provides that such ordinance may be adopted without
compliance with the nonnal procedures for redevelopment plan amendments (see California
Health and Safety Code Section 33333.6(d)(2)); and
WHEREAS, the City Council desires to adopt this Ordinance to amend and extend
certain time limitations of the Redevelopment Plan, as more particularly set forth below, in
accordance with Section 33333.6 as amended by SB 1045; and
WHEREAS, the enactment of this Ordinance is exempt for the California
Environmental Quality Act codified under California Public Resources Code Section 21000 et.
seq. (hereinafter referred to as "CEQA") pursuant to CEQA Guidelines Section 15378(b)(4)
because it is a fiscal activity which does not involve any commitment to any specific project
which may result in a potentially significant physical impact on the environment.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF SAN BERNARDINO, AS FOLLOWS:
SECTION 1. The current time limit on the effectiveness of the Central City East
Redevelopment Plan is hereby extended by one year from the existing time limit of May 3,
2016 to May 3, 2017 and the Redevelopment Agency of the City of San Bernardino is hereby
authorized to act with respect to the Redevelopment Plan at any time during which the
Redevelopment Plan is effective.
SECTION 2. The current time limit on paying indebtedness or receiving property taxes
pursuant to the Central City East Redevelopment Plan and the Community Redevelopment Law
is hereby extended by one year from the existing time limit of May 3, 2026 to May 3, 2027 and

the Redevelopment Agency of the City of San Bernardino is hereby authorized to act with
respect thereto during such extended period.

SECTION 3. Except with respect to the amendments set forth herein, the Central City

East Redevelopment Plan, as amended, is and shall remain unchanged and in full force and
6
effect in accordance with its terms.

SECTION 4. The City Clerk is hereby authorized to file a Notice of Exemption with
8
the County of San Bernardino pursuant to CEQA Guidelines Section 15094.

SECTION 5. This Ordinance shall go into effect and be in full force and operation
11
from and after thirty (30) days after its final page and adoption. The City Clerk shall certify to
12
the passage and adoption of this Ordinance and shall cause this Ordinance to be published as set
13
forth below.
SECTION 6. Following adoption, the City Clerk shall see that this Ordinance IS
publicized in conformity with Government Code Section 36933.
SECTION 7. Inconsistent Provisions. Any provision of the City of San Bernardino
Municipal Code or appendices thereto inconsistent with the provisions of this Ordinance, to the
extent of such inconsistencies and no further, is hereby repealed or modified to the extent
necessary to effect the provisions of this Ordinance.
SECTION 8. Constitutionality. In any section, subsection, sentence, clause, or phrase
