Subject:
Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the
Mayor or her designee to execute Amendment No. 1 to the Senior Nutrition Contract No. 04-886
between the City of San Bernardino and County of San Bernardino Department of Aging and
Adult Services (DAAS) for Senior Nutrition Services.
Background:
The Senior Nutrition Contract No. 04-886 is an agreement between the City and the County of
San Bernardino DAAS to provide Senior Nutrition Services for the County of San Bernardino
for the period of September 1, 2004 through June 30, 2005. During fiscal year 2003-04, the
Senior Nutrition Program served over 70,000 total meals for a daily average of 280 meals at 7
nutrition sites. The program has served 46,124 meals over the last ten months. The cost per meal
is a voluntary donation and donations received this year have decreased.
The county has funds available from the Nutrition Services Incentive Program and has requested
to amend the original agreement to provide an additional $3,350 to help fund raw food cost for
this program. The contract amount was $179,729 and with this increase the amount will be
$183,079. There are no other changes to the contract. Attached is the revised budget summary
from June 2004 and the revised budget summary for March 2005 contract with the County of
San Bernardino Department of Aging and Adult Services and the revised budget sheets. This
program provides meals, nutritional education and counseling and companionship for seniors 60
years or older. The Parks, Recreation and Community Services Department has provided
nutrition services to seniors for 27 years.
Financial Impact:
For the last several years there has been a budget shortfall for this program of about $25,000.
This shortfall is covered by the Grant Match money that is included in the Parks, Recreation and
Community Services (PRCS) General Fund budget. It is anticipated that the FY 05/06 year will
have a $25,000 to $30,000 shortfall, which again will have to be covered by the PRCS Grant
Match budget in their General Fund budget.i

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor and Common Council of the City of San Bernardino hereby

authorizes the Mayor or her designee to execute Amendment No. 1 to the Senior Nutrition
Contract No. 04-886 \'lith the County of San Bernardino Department of Aging and Adult
Services (DAAS) to amend Section III Contractor General Responsibilities Paragraph V and
Paragraph A and D, a copy of which is attached hereto, marked Exhibit "A" and incorporated
herein by reference as fully as though set forth at length.
SECTION 2. The authorization to execute the above referenced amendment is
rescinded if the parties to the amendment fail to execute it within one hundred twenty (120)
days of the passage of this resolution.

cause the amounts payable to Contractor in subsequent months to be reduced to the amount determined by
dividing the balance left by the number of months remaining in the Contract term. No advance will increase
the amount shown in Section V, Paragraph A.

Transmitting Documents for Signature - Resolution 2005-140
At the Mayor and Common Council meeting of June 6, 2005, the City of San Bernardino
adopted Resolution No. 2005-140 - Resolution authorizing the Mayor or her designee to execute
Amendment No. 1 to the Senior Nutrition Contract No. 04-886 between the City of San
Bernardino and County of San Bernardino Department of Aging and Adult Services (DAAS) for
Senior Nutrition Services.
Attached is one (1) original agreement with three (3) duplicate original agreements. Please
obtain signatures in the appropriate locations and return the ORIGINAL agreement to the City
Clerk's Office as soon as possible, to my attention. Please keep the fully executed copies for
your records and for the other party.
Please be advised that the resolution and contract will be null and void if not executed
within 120 days, or by August 28, 2005.
