Staff Report
Subiect:
Resolution of the Mayor and Common Council of the City of San Bernardino ratifying the
execution of Amendment No. 1 to the Agreement for Consultant Services in Collaboration with
District for the CAPS Program between the City and the San Bernardino Unified School District.
Baclmround:
The Children's After-School Program for Success (C.A.P.S.) is a grant funded program
administered by the San Bernardino City Unified School District to provide before & after-
school programs at school sites. The city has been a sub-contractor to the school district in this
program since 1999. The schools provide teachers and aides to teach educational and tutorial
programs. The Parks, Recreation and Community Services Department has been asked to
provide arts and crafts and other recreational activities to the youth.
The CAPS Program was offered at nine elementary schools when first implemented. The
program expanded to 17 schools in 2003 - 04. The agreement in July 2004 (attached) provided
three additional sites for after-school programs and 10 before-school programs; a total of 30
programs at 20 school sites for a period beginning July 1,2004 through June 30, 2005.
The original Agreement was for $360,251 and the amendment increases the original Agreement
by an amount not to exceed $28,000 for a new aggregate total of $388,251. The term of the
original Agreement (July 1, 2004 through June 30, 2005) will remain the same. Therefore, the
department is requesting ratification of the Amendment No. 1 that was submitted to the San
Bernardino Unified School District on May 12, 2005.
Due to high attendance in this program, the additional funding is needed and will allow for
additional staff at each of the CAPS school locations.
Financial Imoact:
The original agreement amount was for $360,251 to cover 100 percent of costs for part-time
staff. This amendment will allow the department to provide additional staffing at existing
program sites, Monday - Friday. Supplies and equipment are provided by the district.
There is no financial impact to the City. The program supervision is provided by the existing
staff already covered in the department's general fund budget.
Recommendation:
Adopt the Resolution.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor and Common Council of the City of San Bernardino hereby
ratify the execution of an Amendment No.1, submitted to the San Bernardino Unified School
District on May 12,2005, on behalf of said City, an amended agreement for additional funding
with the San Bernardino City Unified School District to provide contractual services for before
& after-school recreation programs at school district sites. A copy of said agreement is hereby
attached hereto, marked Exhibit "A", and incorporated herein by reference as fully as though set
forth at length.
SECTION 2. The authorization granted hereunder shall expire and be void and of no
further effect if the agreement is not executed by both parties and returned to the Office of the
City Clerk within 120 days following effective date of the Resolution.

WHEREAS, the CI1Y is authorized under the terms and conditions of the original
Agreement entered into on the 16th day of June. 2004, to provide a variety of learning
experiences in the area of art. fitness and sports skills. and values through the
provisions of Recreational Aides at each school participating in the CAPS Program:

WHEREAS. the DISTRICT desires to add more participating schools and for the CI1Y
to provide varieties of learning experiences at these additional participating schools:

WHEREAS. any increase or revision in the Agreement is accomplished by means of an
amendment:
NOW. THEREFORE. the DISTRICT and the CI1Y mutually agree to amend the eXisting
Agreement as follows:
1. The CI1Y shall provide a variety of learning experiences in the area of art,
fitness and sports skills. and values through the provisions of Recreational
Aides at these additional schools participating in the CAPS Program. The
schools are listed as Attachment MBM and is incorporated herein by reference
and made a part hereto.
2. The amount payable to the CI1Y as specified in Section IV (A) City's Fee and
Payment Thereof. of the original Agreement shall be increased by an amount
not to exceed Twenty Eight Thousand Dollars ($28.000.00) for a new aggregate
total of not-to-exceed Three Hundred Eighty EIght Thousand Two Hundred Fifty
One Dollars ($388.251.00).
3. This Amendment is effective upon execution. In the event of any conflict or
inconsistency between the provisions of this Amendment and the original
Agreement, the provisions of this Amendment shall control. All other terms and
conditions of the original Agreement shall remain the same.

adopted Resolution No. 2005-138 - Resolution ratifying the execution of Amendment No.1 to the
Agreement for Consultant Services in collaboration with District for the CAPS Program between
the City and the San Bernardino Unified School District.
Attached is an original Amendment No. 1 and two (2) duplicate original amendments. Please
obtain signatures in the appropriate locations and return the ORIGINAL amendment to the City
Clerk's Office as soon as possible, to my attention. Please keep the fully executed copies for
your records and for the other party.
Please be advised that the resolution and contract will be null and void if not executed
within 120 days from the date of adoption.
