I , , '" 1 2 3 RESOLUTION NO. 2005-272 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINIO AUTHORIZING THE CITY OF SAN BERNARDINO FIRE DEPARTMENT TO EXTEND THE AGREEMENT WITH THE COUNTY OF SAN BERNARDINO TO PROVIDE FIRE PROTECTION AND PARAMEDIC SERVICES TO COUNTY UNINCORPORATED AREAS WITHIN THE CITY OF SAN BERNARDINO'S SPHERE OF INFLUENCE FROM JULY 1,2005, THROUGH JUNE 30, 2006. 4 5 6 7 8 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The San Bernardino County Fire Department (County Fire) and the San Bernardino City Fire Department wish to renew their agreement for fire protection and paramedic 9 services to County unincorporated areas; 10 11 SECTION 2. The Mayor or her designee is hereby authorized and directed to execute said agreement, a copy of which is attached as Attachment A; 12 13 14 15 SECTION 3. Said agreement will be for fire protection and paramedic services for the period of July 1, 2005, through June 30, 2006. Said services will be provided in the eight (8) San Bernardino County unincorporated areas, most commonly referred to as "county islands", located 16 within the City of San Bernardino's sphere of influence; 17 18 SECTION 4. Said agreement amount shall be for two hundred fifty thousand dollars and no cents ($250,000), with the caveat that the new higher rate being negotiated for future years will be retroactive to July 1,2005. 19 20 SECTION 5. HILLS, Fire Chief/Fire Warden San Bernardino County Consolidated Fire District SUBJECT: AMENDMENT NO. 3 TO AGREEMENT 01.738 BETWEEN COUNTY SERVICE AREA 38, IMPROV~MENT ZONE L, AND THE CITY OF SAN BERNARDINO RECOMMENDATION: Acting as the governing body of County Service Area 38, Improvement Zone L (Highland Paramedic), approve Amendment No.3 to Agreement 01-738 with the City of San Bernardino, in the amount of $250,000, extending the term for an additional one-year period, effective July 1, 2005 through June 30, 2006, which provides County Service Area 38, Improvement Zone L with fire protection, emergency medical services, and automatic aid. BACKGROUND INFORMATION: Originally, on July 10, 2001, the Board of Supervisors approved an Agreement with the City of San Bernardino to provide fire protection, emergency medical and automatic aid services to areas within CSA 38, Improvement Zone L, from July 1, 2001 through June 30, 2003, in the amount of $250,000 per year. The terms of the Fire Protection Services Agreement have a provision authorizing the parties to extend the Agreement for additional one-year periods on the same terms and conditions. The Board approved an additional one-year period on September 14, 2004 extending the agreement thru June 30, 2005. From July 1, 2005 to the present time, the San Bernardino County Fire Department and the City of San Bernardino had mutually agreed that the City would continue to provide, on a hold over basis, fire protection and paramedic services to the County unincorporated areas ("county islands") located within the City of San Bernardino's sphere of influence that are currently under the jurisdiction of CSA 38, Zone L until a formal contract amendment could be presented for approval. On September 13, 2005, the City of San Bernardino approved the one-year period extension of service delivery, effective July 1, 2005 thru June 30, 2006, under the same terms and conditions of the existing contract that expired June 30, 2005. The retroactive coverage is necessary to continue these services for the entire one-year period. Approval of this recommendation will authorize Amendment No.3 to Agreement 01-738 approving the effective dates of the Agreement to extend from July 1, 2005 through June 30, 2006. All other terms and conditions of this Agreement will remain the same unless this Agreement is amended or terminated. REVIEW BY OTHERS: This item has been reviewed by County Counsel (L. Thomas Krahelski, Deputy, 387-5436) on November 8, 2005; and reviewed by the County Administrative Office (Wayne Thies, Administrative Analyst, 387-5409) on November 28,2005. FINANCIAL IMPACT: Under the terms of the agreement, the City of San Bernardino is paid an annual amount of $250,000 by CSA 38 and CSA 38, Improvement Zone L, collectively. The FY 05/06 cost of this agreement is funded within the CSA 38 District budget (SGP 290 A78 2400), in the amount of $123,097 and funded within the CSA 38, Improvement Zone L District budget (SHV 290 290 2400), in the amount of $126,903. The annual service fee will remain the same during the one-year period extension. There is no impact to the County General Fund.
