CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
Subject:
Adopt Negative Declaration for the acquisition of right-of-way and construction of street
improvements to extend Giovanola Avenue approximately 180 lineal feet from its current
northerly terminus at 2nd Street to 3rd Street.
Back2round:
The California Environmental Quality Act (CEQA) guidelines dictate that the acquisition of
right-of-way, construction of a new roadways, or substantial improvements to existing
roadways such as lane widening, etc., require an environmental approval by the authorizing
agency.
This Public Works project (SS 04-34) consists of right-of-way acquisition and construction of
street improvements to extend Giovanola A venue approximately 180 lineal feet from its current
terminus at 2nd Street to 3rd Street. The project will include installation of curbs, gutters,
sidewalks, asphalt paving, street lights and related improvement for a 4-lane collector street
within a 6O-foot wide right-of-way. The extension of Giovanola A venue will function as a
realignment of existing Viaduct Boulevard between 2nd and 3rd Streets. The excess right-of-
way within Viaduct Boulevard will be vacated upon completion of the proposed improvements
An Initial Study was prepared for the project and reviewed by the Development/Environmental
Review Committee (D/ERC) on September 9, 2004. The Initial Study was made available for
public review from September 16, 2005 to October 6, 2004. No comments were received
from members of the public or responsible agencies.
At its meeting of October 14, 2004, the D/ERC recommended that the Mayor and Common
Council adopt a Negative Declaration.
After adoption of a Negative Declaration, staff will file a Notice of Determination (NOD) with
the Clerk of the Board of the County Board of Supervisors. The filing of the NOD will enable
staff to proceed with the necessary steps to acquire street right-of-way for the extension of
Giovanola A venue. Staff will recommend to the Mayor and Common Council that design and
construction funding be included in the FY 2005/06 Capital Improvement Program.
Financial Impact:
There is no financial impact.
RecommendatiOd::
That the Mayor and Common Council adopt a Negative Declaration for the acquisition of
right-of-way and construction of street improvements to extend Giovanola Avenue
approximately 180 lineal feet from its current northerly terminus at 2nd Street to 3rd Street.

INITIAL STUDY
The California Environmental Quality Act (CEQA) requires the preparation of an Initial Study when a
proposal must obtain discretionary approval from a governmental agency and is not exempt from
CEQA. The purpose of the Initial Study is to determine whether or not a proposal, not exempt from
CEQA, qualifies for a Negative Declaration or whether or not an Environmental Impact Report (EIR)
must be prepared.

appurtenances. The ultimate right-of-way width is to be 60 feet; 4 travel lanes of 12 foot each (2 in
each direction); 6 foot sidewalk on both sides of street. Giovanola A venue will be extended
approximately 180 lineal feet from its current northerly terminus at 2nd Street. This will eliminate
the need for the existing Viaduct Boulevard to the west, which will be vacated. The project is
essentially a realignment of the existing connection between 2nd and 3rd Streets provided by
Viaduct Boulevard. The extension of Giovanola Avenue will provide for a 4-way intersection at
2nd Street (to be signalized in the future), a 3-way intersection at 3rd Street, and additional area to

b & d: Particulate Ulatter will be disturbed on a short-term basis during construction, but the impact will
be less than significant. Excavation and grading necessary for the street extension of approximately 180
lineal feet will be'minimal. Standard Public Works Grading Requirements will minimize generation of
fugitive dust. The South Coast Air Quality Management District Rule 403 and standard construction
practices will be implemented during all operations capable of generating fugitive dust. These practices

include frequent watering of the site for dust control and immediate resurfacing or landscaping of graded
areas.
c: Although the South Coast Air Basin is a non-attainment area for criteria pollutants monitored by the
South Coast Air Quality Management District (AQMD), the cumulative air quality impact of the
proposed project will be beneficial. The extension of Giovanola Avenue will replace an existing
roadway (Viaduct Boulevard), which does not function optimally. This project will improve the traffic
circulation pattern around the Santa Fe Depot, a multi-modal transportation center. The benefits are two-
fold: (1) traffic will flow more smoothly, thereby reducing vehicle idling; and (2) improved access to the
Depot will encourage use of the Metrolink commuter rail service.
e: No significant odors are anticipated as a result of the proposed street extension.

a: As a permittee under the Santa Ana Regional Water Quality Control Board (RWQCB) Area-wide
Urban Storm Water Runoff permit program, the City has authority to control discharge into its MS4
storm drain system, subject to its own grading and erosion control standards and other Best Management
Practices (BMP's) for minimizing the impact of urban storm water runoff on water quality. The project
will be implemented in accordance with all water quality standards and requirements of the RWQCB
and the National Pollutant Discharge Elimination System (NPDES).
b: The proposed project is a minor street improvement that will not affect groundwater supply.
c - d: The proposed project is a minor roadway realignment which will alter existing drainage patterns,
but will not create a significant adverse impact. The street improvements for the proposed extension of
Giovanola Avenue will be designed to drain to the City storm drain system, and to avoid any potential
off-site erosion or flooding.

e - f: Surface runoff from pavement of the proposed street extension would drain into the City's storm
drain system, but any impacts on storm drain capacity or water quality would not be significant. Most of
the site (approximately Y2 acre) where the new street segment would be constructed is already paved.
The site is currently used for parking, and already drains to City streets and storm drains. Any additional
runoff associated with the proposed project will not be significant, and the City's NPDES compliance
measures, as described in section "a", above, will ensure a less than significant impact on water quality.
g - j: The project site is located in Zone X of the Federal Emergency Management Agency (FEMA)
Flood Insurance Rate Map, indicating areas outside the 500-year floodplain. No significant risk of
flooding or exposure of the public to flood hazards can be anticipated to result from the proposed
project. Due to the location of the site, there is no foreseeable risk of inundation by dam or levee failure,
seismic seiche, tsunami or mudflow.

a: The extension of Giovanola Avenue is proposed as a relocation of the existing roadway connection
between 2nd and 3 rd Streets currently provided by Viaduct Boulevard. Extending Giovanola Avenue
approximately 180 lineal feet from its current northerly terminus at 2nd Street and eliminating the
existing alignment of Viaduct Boulevard will improve access to and circulation around the Santa Fe
Depot, a regional transportation center. No impacts on any other public services are anticipated.

XVII. MANDATORY FINDINGS OF
SIGNIFICANCE
a) Does the project have the potential to degrade 0 0 0 ~
the quality of the environment, substantially
reduce the habitat of a fish or wildlife species,
cause a fish or wildlife population to drop
below self-sustaining levels, threaten to
eliminate a plant or animal community,
reduce the number orrestrict the range of a
rare or endangered plant or animal or
eliminate important examples of major
periods of California history or prehistory?
b) Does the project have impacts that are 0 0 0 ~
individually, limited, but cumulatively
considerable? ("Cumulatively considerable"
means that the incremental effects of a project
are considerable when viewed in connection
with the effects of past projects, the effects of
other current projects, and the effects of
probable future projects.)
c) Does the project have environmental effects 0 0 0 ~
which will cause substantial adverse effects
on human beings, either directly or indirectly?
Discussion:
a: The proposed project does not have the potential to degrade the quality of the environment. No
sensitive plant or animal habitat will be affected by the project, and there is no evidence to suggest
potential impacts on cultural or paleontological resources.
b: All potential impacts identified in this Initial Study are less than significant, and there is no indication
that such impacts would be cumulatively considerable. The project is proposed as a circulation
improvement that will enhance environmental conditions, considering future cumulative development.
c: The project will have no significant adverse effects on human beings, as substantiated throughout this
Initial Study. The project is proposed as a circulation improvement that will benefit human daily life and
ease of travel.
