Dear Tribal Chairman Marquez:

Thank you for inviting the City of San Bernardino to comment on this Draft Environmental
Study. The Cit)' has serious concerns with the casino and event center projects as proposed based
on the previous representations of tribal representatives regarding planned land uses and based on
what we believe is an inadequate analysis and mitigation measures contained in the Draft
Environmental Study.
In a letter to the Bureau ofIndian Affairs dated August I I, 1994, requesting "federalization"
of the 20 acres to the west of the San Manuel Reservation, then Tribal Chairperson Lynn Le Roy
stated:
"Please be advised that the San Manuel Band of Mission Indians ("Tribe"),
has been engaged in title clearance work in connection with 25 C.F.R. 9151.12 in
order to prepare for the acquisition into trust of approximately 20 acres of mixed
developed/undeveloped land contiguous to the western boundary of the San Manuel
Reservation (the "Property"). The Property shall be developed for tribal as well
as community purposes, namely, to construct a recreational/sports facility for
tribal members, including establishing baseball and other playing fields for the
Tribe and community, and to establish -a Serrano Indian Museum, which shall
hnf Serrano cultural items, offices and a learning center for the Tribe's
members and the community at large.

We believe the necessary title work has nearly been completed for the United
States to accept the Property into trust. This letter shall constitute a formal request
that the Property be accepted into trust by the United States for the benefit of the
Tribe for tribal and community recreational purposes.
The Tribe believcs this Property presents a rare opportunity for the
Tribe to provide benefits both to its members and the surrounding community,
which bas expressed a need for Little League and related facilities. The
Property would meet those nceds. The Tribe is excited about the opportunity
to construct an important recreational/sp.orts facilit)' for its tribal members and
the San Bernardino/Highland community. Tribal members have been active
supporters and participants with local residents in Little League and similar
activities. These kinds of facilities are critical to the community, and the Tribe
has strong support for this project within the communit)'." (Emphasis added, a
copy of Tribal Chairperson Le Roy's letter is attached as Exhibit "A")
After receiving notice on April 17, 1995, of the Tribe's request to federalize these 20 acres,
(also referred to as the Baker- Weber property), then Mayor Tom Minor wrote a letter dated July 6,
1995, to the Bureau of Indian Affairs requesting that federalization be approved only on condition

that "Area I [north of Marshall Boulevard and' South of Piedmont Drive] should be restricted to
either open space (including sports fields without lights or sound system, parks, etc.) ground level
parking or single family residential units that are compatible with the surrounding neighborhood.
Any development, other than single family residential shall necessitate the construction of a six foot
decorative wall between this site and the residences to the west. Area 2 [north of Marshall
Boulevard between Piedmont Drive and the northerly extension of Victoria A venue] should be
restricted to professional office type uses (including medical clinics, parking, open space, or
residential and should prohibit commercial development ( including retail and gaming). Gaming
shall be prohibited west ofYictoria Avenue." (Copy of Mayor Minor's letter dated July 6, 1995,
attached as Exhibit "B")
Following additional discussions with Tribal representatives, Mayor Minor wrote a letter
dated July 22, 1997 opposing this project. (Copy of Mayor Minor's letter dated July 22, 1997,
attached as Exhibit "B- I")
Since I 995, Tribal representatives have shown conceptual master plans and have repeatedly
assured City officials and the local community that this land would be developed with tribal
governmental administrative facilities, tribal recreational facilities, a day care center, and a church
or cultural center. These meetings with tribal leaders and a review of the Tribe's conceptual plans
caused Mayor Judith Valles to send a letter to the Bureau of Indian Affairs on June 30, 2000,
supporting the acquisition in trust. In the Bureau ofIndian Affairs Notice of Decision dated May 25,
200 I and addressed to Tribal Chairman Deron Marquez, the Bureau approved the Tribe's application

for the acquisition in trust of the 20 acre Baker-Weber property, and stated:
"The proposed land use is for tribal governmental facilities, including an administrative
facility, recreational facility, medical facility, and an access road. The parcels are directly adjacent
to the western boundary of the Reservation and will provide essential flat land upon which Tribe can
construct tribal governmental facilities and an access road. Upon conveyance, the San Manuel Tribe
plans to immediately construct tribal government facilities and an access road." (Copy ofBIA letter
attached as Exhibit "C")
Even as recently as this year, Tribal representatives continued to assure City officials and the
local community that this property would only be temporarily used as a ground level parking lot and
submitted site plans (copy attached as Exhibit "D") which convinced the Mayor and Council on
February 18 and March 17,2003, to approve the Tribe's applications for a General Plan Amendment
and the street vacation of portions of Piedmont Drive, Marshall Boulevard, and Victoria Avenue.
With this Environmental Study, which probably required at least several months to prepare,
the Tribe for the first time announces plans to construct a six level parking structure for up to 3,400
, cars, amajor casino expansion of 31 0,000 square feet, and an Event Center of 54,600 square feet,
) in place of the previously planned tribal governmental facilities, recreational facilities, day care
center, and church or cultural center. The Tribe now proposes to construct the six level parking
structure and part of the casino expansion project on the 20 acre Baker- Weber property. The
remainder of the casino expansion project and the event center project is to be constructed on land
previously designated by the Tribe for parking when the land was federalized.
City staff has reviewed the Draft Environmental Study and has enumerated the following
issues and recommendations regarding aesthetics, light and glare, traffic/circulation, public safety,
drainagelflooding, air quality, noise and cumulative impacts.
1. Aesthetics
The aesthetics section of the study indicates that the proposed projects would be designed
to match the neighborhood/community character. However, the proposed parking structure at 48-50
feet tall (six stories in height) is not compatible with a low density, single family neighborhood. The
proposed landscape buffer of 40-50 feet is not adequate to lessen the impact of the parking structure
on the residential neighborhood. A six-foot block wall is not adequate to shield the adjacent
residential neighborhoods from the noise of the vehicles and patrons or the visual impact: We believe
that the discussion of impacts on views has been grossly under-represented.
Recommendations
· Determine an alternative location to move the parking structure as far away from the residences
as possible, preferably in a commercial area on Highland Avenue.

. Minimize the negative visual impact of the parking structure by designing it to look like an office
building.
. Design the parking structure to include more subterranean parking levels, to reduce the overall
height at grade.
. Close the west and south sides of the parking structure that face the residential areas.
. Add considerably more mature, tall trees and other landscaping to help screen the structure from
view of the adjacent residential neighborhoods.
· Prepare a complete sectional review of the proposed location for the parking structure in relation
.to existing residential neighborhoods.
· Complete additional photo simulation vantage points to include parking structure.
· Revise the existing photo simulation to include the proposed surface parking area.
2. Light and Glare
The environmental study addresses some of the potential impacts that the proposed projects
would have on the ambient light in the area at night. It states that impacts would be mitigated by
directing the glare of the on-site lighting towards the ground, and minimizing the use of exterior
neon lighting. An electronic message sign is not compatible with residential neighborhoods. Patrons
can be directed to the facilities and parking areas through other signage that is not visually disturbing
to the neighboring residences. The analysis is not complete and the mitigation measures are
inadequate.
Recommendations
. Restrict all surface lighting to 20' in height.
. Require all lighting to be directed toward the ground, with no spillover.
· Restrict location and types of lighting allowed on the parking structure.
· Omit neon lighting (even on the structures), unless covered on the top and outside in some sort
of shade or hood to direct the light downward.
. Eliminate the electronic message sign.
3. Traffic/Circulation
Adequate traffic analysis information wasnot provided (all referenced technical appendices were
not included) and staff was unable to complete its final traffic analysis. Only intersection analysis
"summaries" appear in the Katz, Okitsu study as provided.
The text and tables in the traffic discussion are inconsistent and misleading. While the project
trip generation discussion addresses 7,581 daily trips, Table 3 shows that those trips are only for the
event center. Table 3 shows that a total of 17,967 total daily trips will be generated with the project. The
erroneous 7,58] trip figure is also shown in the Summary of Impacts: Trip Generation (p. 26).

The traffic distribution patterns (Figure 5) on Lynwood Drive show 15% ingress/egress to the
west from the access driveway shown on the Site Plan (Figure2). There is no mention of the remaining
85%. This figure conflicts with a previous discussion (p. 3) regarding site access. Figure 5 also shows
65% of the project traffic making eastbound left turns on Highland Avenue at Victoria Avenue.
Although this intersection is maintained by the City of Highland, we have concerns that casino clientele
, ,
could seek alternate routes as this left-turn becomes congested. The report does not discuss this
intersection as having a need for an additional left turn lane, yet the heavy left-turn volume projections
support such a need, based on Figure 8 (Year 2007 peak hour conditions with project) EBLT:
470/785/823 vehicles per hour.
Although the site plan (Figure 2) shows one driveway to the parking lot from Lynwood Drive,
the text discusses two main driveways that are "expected to provide full access for patrons, employees,
service traffic, and others." This discrepancy needs to be corrected.
As per the Street Vacation Agreement with the City of San Bernardino, the tribe is responsible
for the design and installation of a traffic signal at Lynwood DriveIVictoria Avenue, with the signal
being installed prior to the completion of the (on-site) project construction activities. The City agreed
to contribute 50% toward the cost of this signal. However, that agreement was reached.without prior
; knowledge of this expansion project, and the City is reevaluating the measures contained in that
j agreement.
It is the City's opinion that this expansion project meets the criteria for a Traffic Impact Analysis
(TlA) based on San Bernardino County Congestion Management Program (CMP). The purpose of the
CMP is to provide for coordination and cooperation on a regional basis to improve transportation
systems. Preparation of a TIA would analyze the proposed expansion project against existing conditions
and future conditions and identify adequate mitigation measures to address all impacts resulting from
the proposed project.
Recommendations
. The City of San Bernardino strongly requests that the tribe complete a Traffic Impact Analysis,
consistent with the San Bernardino County Congestion Management Program.
. Modify the striping and the traffic signal on Highland Avenue at Victoria Avenue to permit dual
eastbound left-turn lanes with a southbound right turn overlap signal modification.
. Install a cul-de-sac on Piedmont Drive at the westerly boundary of the reservation property.
· Identify traffic control measures that would allow eastbound through traffic on Lynwood Drive and
right-in/left out only movements from the parking lot to Lynwood Drive.
4. Public Safety
The environmental document does not address the fact that there are three public schools in
the immediate vicinity of the existing casino, and there is no analysis of impacts resulting from the

expansion project. Belvedere Elementary School is located within 1,000 feet, Barton Elementary
School is located within 4,000 feet, and Serrano Middle School is located within 1,000 feet. As you
know, children from the immediate neighborhoods attend these schools, Many of the children walk
to school, and others may be picked-up/dropped-offby parents, In addition, if one goes through any
of the surrounding neighborhoods, you would find lots of people walking and jogging,
Residents of the surrounding neighborhoods have noted that San Manuel security has
decreased considerably in recent months, leading to higher incidents of crime, loitering, and littering,
The City continuously receives calls regarding casino patrons drinking in the parking lots and public
streets, urinating on private property, littering throughout the area, loitering, breaking into vehicles,
and soliciting or threatening residents. The document does not address impacts of hazardous
materials storage, transport, and usage, either on a short-term or long-term basis. The environmental
document neglected to consider impacts to public safety,
Recommendations
. As mentioned previously, a Traffic Impact Analysis must be prepared consistent with the
Congestion Management Program, and should take into consideration the potential impacts to
pedestrians. .
. Analyze the desirability of a pedestrian bridge over Victoria Avenue at Lynwood Drive.
. Increase San Manuel security both on-site and off-site to provide more visibility in the area.
· Provide funding to the City of San Bernardino to pay the costs of at least one full time (24-hour)
police officer devoted exclusively to the surrounding neighborhoods.
5. Drainage/Flooding
The environmental document does not address how drainage will be handled and potential
impacts from flooding. As you know, in March of this year, City staffmet on-site with tribal
representatives to discuss concerns with flooding from the existing parking lot. The problems
identified at that meeting have not been fixed, nor has this document addressed them.
Recommendations
· Prepare a Storm Water Pollution Prevention Plan (SWPPP) consistent with National Pollution
Discharge Elimination System requirements, and file a Notice of Intent with the Santa Ana
Regional Water Quality Control Board.
6. Air Quality
The environmental study reviews air quality impacts, however, it does not identify any
impacts that would necessitate mitigation measures. This assessment is incomplete and needs to be
reviewed further due to the amount of proposed construction activity, the amount of traffic expected

to be generated, and reports from the neighborhood residents about the current impacts of the
existing facility. Additionally, the review that was used to assess potential impacts is based on yearly
thresholds and ignores the expecteddaily impacts that the projects will have on the local air quality.
Recommendations
· Revise the air quality analysis, consistent with South Coast Air Quality Management District
requirements.
. Incorporate standard air quality dust mitigation during construction including SCAQMD rules
402 and 403.
· Address the potential impacts on a daily basis by reviewing the proposed projects through daily
threshold requirements and assess any additional mitigation that is required to lessen the impacts.
. Add a landscaping buffer (r.;ontaining a variety of vegetation and large box trees - as mature as
possible for maximum effectiveness tipon planting) as a buffer between the project and the
neighborhood as well as the traffic corridors for ingress and egress and the existing
neighborhoods.
. Reduce/restrict delivery times, with no late evening/early morning deliveries.
. Replace all existing shuttles for remote parking facilities with low emission vehicles.
. Install advanced filtration systems in the kitchen to eliminate food odors from reaching the
adjacent'residences.
7. Noise
The environmental document "downJ9lays" potential noise impacts to the community. As
noted in the Public Safety discussion, the residents in the adjacent neighborhoods are constantly
plagued by noise from vehicles and patrons of the casino. These impacts occur on the facilities
owned by the tribe, and surrounding public streets~ The environmental study addresses the impacts
for noise on the residential neighborhood by calling for a fair share contribution to re-paving one
street segment and designing the 'parking structure to limit the light and noise. The proposed'
mitigation measures are inadequate to reduce impacts to a less than significant level. More than one
roadway segment will be impacted and the re-paving as proposed does not aqdress the impacts to
the specific properties along the traffic corridors.
Recommendations
· Revise the acoustical analysis to address all potential noise sources, including stationary and
mobile sources. Make sure the analysis is weighted accordingly for late evening/early morning
hours.
. We believe that the acoustical analysis will demonstrate the need for a sound wall to be
constructed along Victoria A venue and Lynwood Drive.
· Additional sound walls may be needed based on the ultimate placement of the parking structure.

· Limit the hours of construction to between 7:00 AM - 7:00 PM Monday through Friday.
8. Cumulative Impacts
The environmental study does not include any mitigation for cumulative impacts and focuses
its assessment of potential impacts on aesthetics, traffic, and noise, which have already been
addressed as being insufficient.
In summary, we find the environmental document lacking in many areas and request that the
tribe take no action on the proposed projects until all additional reviews/studies are completed, all
impacts have been evaluated, and mitigation measures are identified and approved.
