10/29/2003 - Mayor and Common Council approved Resolution # 2003-288 designating area
burned by the Old Waterman Canyon fire as disaster.

CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
Subiect:
Resolution of the Mayor and Common Council of the City of San Bernardino confirming the
existence of a local emergency and ratifying the Mayor's issuance of a proclamation declaring
the existence of a local emergency.
Baclmround:
Due to intense rains during early January, some damage occurred throughout the City to storm
drain channels, debris basins, and to City streets. In the event that State or Federal funding
becomes available to reimburse the City for costs incurred as a result of the storm, it was
necessary to proclaim the existence of a local emergency within seven (7) days of the incident.
The proclamation also provides support to the Governor's request for a Presidential Declaration.
Staff is in the process of estimating damage costs. Once that information is available it will be
forwarded to the Mayor and Council.
Fiscal Impact:
None.
Recommendation:
Adopt Resolution.

6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

WHEREAS, on January 17,2005, the Mayor issued a Proclamation, copy of which is
attached as Exhibit "A," declaring the existence of a local emergency caused by the intense

10 rains; and

WHEREAS, the Mayor and Common Council do hereby confirm that conditions
of peril to the safety of persons or property have arisen within the City of San Bernardino
caused by intense rains, including damage to storm drain channels, infrastructure, building
() 15 structures, and from the accumulation of debris within roadways at multiple locations; and

WHEREAS, the aforesaid conditions of extreme peril warranted and necessitated the
proclamation of the existence of a local emergency; and
WHEREAS, The Mayor and Common Council do hereby ratify the Mayor's issuance of
a Proclamation declaring the existence of a local emergency; and
WHEREAS, IT IS FURTHER ORDERED that said local emergency shall be deemed to
continue to exist until its termination is proclaimed by the Mayor and Common Council; and

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO CONFIRMING THE EXISTENCE OF A LOCAL EMERGENCY AND
RATIFYING THE MAYOR'S ISSUANCE OF A PROCLAMATION DECLARING
THE EXISTENCE OF A LOCAL EMERGENCY
WHEREAS, IT IS HEREBY ORDERED that a copy of this Resolution be forwarded to
the County of San Bernardino Office of Emergency Services with the request for a Governor's
state of emergency declaration; and
WHEREAS, IT IS FURTHER RESOLVED that Fred Wilson, City Administrator, is
hereby designated as the authorized representative for public assistance and Rick Blackburn,
Disaster Preparedness Coordinator, is hereby designated as the authorized representative for
individual assistance of the City of San Bernardino for the purpose of receipt, processing, and
coordination of all inquiries and requirements necessary to obtain available state and federal
assistance.

PROCLAMATION OF THE CITY OF SAN BERNARDINO DECLARING THE
EXISTENCE OF A LOCAL EMERGENCY
WHEREAS, Chapter 2.46 of the Municipal Code of the City of San Bernardino
empowers the Mayor to proclaim the existence or threatened existence of a local
emergency when said City is affected or likely to be affected by a public calamity and the
Common Council is not in session; and
WHEREAS, at the time ofthe issuance of this Proclamation, the Mayor and
Common Council are not in session, therefore, the undersigned, as Mayor of the City of
San Bernardino do hereby find that conditions of peril to the safety of persons or property
have arisen within the City of San Bernardino caused by intense rains, including damage
o to storm drain channels, infrastructure, building structures, and from the accumulation of
debris within roadways at multiple locations; and
WHEREAS, the aforesaid conditions of peril warrant and necessitate this
proclamation of a Local Emergency;
NOW, THEREFORE, IT IS HEREBY PROCLAIMED that a local emergency
now exists throughout said City commencing on or about 9:00 a.m. on January 7, 2005;
and
IT IS FURTHER PROCLAIMED AND ORDERED that during the existence of
said local emergency the powers, functions, and duties of the emergency organization of
this City shall be those prescribed by state law, by ordinances, and resolutions of this
City, and by the City of San Bernardino Emergency Plan.
