Recommended Motion:
That the public meeting relative to the formation of the Belmont Avenue and Magnolia
Avenue area Landscape Maintenance Assessment District No.1 037 be closed, and protests
and ballots, if any, be carried over to the public hearing on February 7, 2005, at 4:00 p.m.

Staff Report
SUBJECT:
Public meeting - 4:00 p.m. : formation of a landscape maintenance assessment district in the
Belmont Avenue and Magnolia Avenue area (AD 1037 - Tract No. 13630).
BACKGROUND:
On September 7, 2004, authorization was given to proceed with the formation of a landscape
maintenance assessment district within Tract No. 13630, located at the northeasterly comer of
Belmont Avenue and Magnolia Avenue. The District is being formed as a condition of approval
for this tract, and pursuant to a petition field by Harwood Homes, the developer of this tract. The
areas to be maintained include the north side of Belmont Avenue, the east side of Magnolia
Avenue and open space area Lot 34 of said tract. The developer has also paid the required
formation fee of $4,000.00.
Tract No. 13630 consists of 33 single family lots. The annual cost of maintenance and
incidentals, which is estimated to be $11,342.43, will be spread across these 33 lots. As stated in
the Engineer's Report, on file in the office of the City Clerk, the annual assessment for each
single family lot within the District is estimated to be $342.71. The Report also contains
additional information including the method of determining benefit and the method of
assessment spread.
On December 20, 2004, Resolution No. 2004-389 was adopted, preliminarily approving the
Engineer's Report and setting a public meeting for January 24, 2005 and a public hearing for
February 7,2005. All owners of record were given mailed notice relative to the public meeting
and hearing and were also sent assessment ballots, to indicate their support or opposition to the
formation of the Assessment District. Since all of the properties are currently under one
ownership, no protests are anticipated. Future homeowners will purchase the homes subject to
the assessment district. All potential home buyers will be given a disclosure notice by the
developer, advising them of the existence of an assessment district and the proposed annual cost.
The public meeting is only an informational meeting and no action can be taken regarding the
formation of the assessment district until the public hearing. At the conclusion of the hearing, the
results of the assessment ballots returned will be submitted. Ballots are weighted in proportion to
the assessment amount. The formation of the district requires that at least 50% of the ballots
returned show support for the proposed district or that protests submitted, be 50%, or less, of the
total assessment. Formation of the assessment district will require the adoption of a resolution
and will require a four-fifths (4/5th) affirmative vote of the council members present and voting.

FINANCIAL IMPACT:
Applicant has paid the $4,000 processing fee. The costs of all maintenance carried out in the
district will be assessed back to property owners.
RECOMMENDATION:
Staff recommends that the public meeting be closed and that any protests or ballots submitted be
carried forward to the public hearing on February 7, 2005.
