2. Direct the Human Resources Department to update Resolution 6413 to reflect this
action.

Subject:
Reclassify the position of Workers' Compensation Supervisor to Workers' Compensation
Manager.
Background:
The City of San Bernardino's workers' compensation program is self-insured and self-
administered. The Workers' Compensation Supervisor manages this section which includes two
(2) Workers' Compensation Specialists and two (2) Workers' Compensation Claims Assistants.
The Workers' Compensation Supervisor assumes management responsibility for assigned
services and activities of the workers' compensation division. In addition, the position manages
and participates in the development and implementation policies and procedures to ensure
compliance with the state and federal mandates, assists the Director in the preparation of the
annual budget requests, monitors the Fitness-for-duty program, makes recommendations
concerning disability retirements, and coordinates the preparation of workers' compensation
settlement agreements with city employees.
The position is privileged to sensitive medical information regarding City employees and with
the recent enactment of the Health Insurance Portability and Accountability Act (HIPPA)
stringent requirements concerning the confidentiality and security of health data must be adhered
to. Under the new HIPP A regulations, maintaining confidentiality is imperative or the City
could face fines and/or penalties.
Due to the nature of the requirements of this position and based on a survey of the current job
market, it is recommended that this position receive the title of Workers' Compensation Manager
and that the position be placed in the Management Unit.
Financial Impact:
No additional salary cost will be incurred. The additional benefit cost to move this position into
the Management/Confidential Bargaining Group will be $3,600 annually (FY 2004/05 is
$1,800). The additional benefit cost will be absorbed in the Workers' Compensation 2004/05
budget.
Recommendation:
1. Reclassify the position of Workers' Compensation Supervisor, Range 2486, $5012, to $6092
per month to Workers' Compensation Manager, Range 4486, $5012 to $6092 per month.
2. Direct the Human Resources Department to update Resolution 6413 to reflect this action.

SUMMARY DESCRIPTION
Under administrative direction, supervises, plans, and coordinates the activities and operations of the
Workers' Compensation program within the Risk Management Division of the Human Resources
Department; coordinates assigned activities with other divisions, outside agencies and the general public;
provides highly responsible and complex staff assistance to the Director of Human Resources; and,
performs related work as required.
ORGANIZATIONAL RELATIONSHIPS
The class of Workers' Compensation Manager is a supervisory position in the Risk Management Division
of the Human Resources Department and works under the supervision of the Director of Human
Resources. Supervises subordinate technical and clerical personnel.
REPRESENTATIVE DUTIES
Thefollowing duties are typical.for positions in this classification. Any single position may not perform all of these
duties and/or may perform similar related duties not listed here:
I. Provides courteous and expeditious customer service to the general public and City department staffs.
2. Coordinates the organization, staffing and operational activities of the Workers' Compensation
program, including the administration of the workers' compensation claims program and the safety
officer industrial disability retirement program.
3. Participates in the development and implementation of goals, objectives, policies and priorities for the
Workers' Compensation program; identifies resource needs; recommends and implements policies
and procedures.
4. Selects, trains, motivates and evaluates program personnel; and, provides or coordinates staff training.
5. Directs, coordinates and reviews the work plan for the Workers' Compensation program, meets with
staff to identify and resolve problems; assigns work activities and projects; monitors work flow;
reviews and evaluates work products, methods and procedures.
6. Participates in the development and administration of the Workers' Compensation program budget;
directs the monitoring of and approves expenditures; recommends adjustments as necessary.
7. Ensures City compliance with pertinent rules and regulations governing workers' compensation
benefit and self-insurance administration; reviews, evaluates, interprets and applies established law to
Workers' Compensation and Safety Disability Retirement programs.
8. Develops, implements and monitors cost containment programs to reduce workers' compensation
liabilities; monitors and controls charges to industrial accident leave and light duty benefit accounts;
assesses facts and determines necessity for reporting claims to the excess insurance carrier.
9. Assists in the negotiation of settlements for controversial and high cost claims; interviews potential
witnesses; coordinates medical exams; coordinates defense with attorneys. May serve as hearing
representative for the City of San Bernardino to the Workers' Compensation Appeals Board.

] O. Coordinates the Safety Disability Retirement program, including preparing for formal hearings;
assists departments with the reassignment of safety employees to modified duty assignments within
their medical restriction.
11. Develops, establishes, updates and reviews medical examination policy standards; evaluates,
interprets and applies pertinent laws regarding the physical examinations of potential employees in
determining job suitability and fitness; negotiates contracts and monitors performance of medical
facility administering physicals.
12. Coordinates Workers' Compensation program activities and services with those of other divisions and
outside agencies and organizations; provides staff assistance to the Director of Human Resources;
prepares and presents staff reports and other necessary correspondence.
13. Routinely adheres to and maintains a positive attitude toward City and department goals.
14. Performs related work as required.
GENERAL QUALIFICATIONS
Knowledl!:e of:
Federal, state and local Workers' Compensation laws, regulations and claims practices;
Technical and medical terminology related to the cause and treatment of occupational injuries and
illnesses;
Modern office procedures, methods and equipment including computers and related software;
Basic methods of research and analysis;
Basic principles of public relations.
Ability to:
Plan, coordinate and administer a Workers' Compensation program;
Interpret and explain City Workers' Compensation policies and procedures;
Train, supervise and evaluate subordinate personnel;
Prepare and maintain a variety of technical reports and records;
Operate a variety of office equipment including a computer and applicable software applications;
Communicate effectively both orally and in writing;
Establish and maintain effective relationships with those contacted in the course of work.
Minimum Qualifications:
Associate of Arts Degree or equivalent in business or public administration or a related field and four
years responsible experience in workers' compensation claims examination and adjustment
experience, to include supervision of subordinate technical and clerical personnel. An additional two
years of the specified experience may be substituted for the required education.
License or Certificate:
Possession of a valid class "C" California Drivers' License and a State of California Self-Insurers'
Certificate in Workers' Compensation are required.
