Back2round: On September 15, 2003, the Mayor and Common Council allocated as part of the FY 2003/04 Capital Improvement Program (CIP), $319,800 in Yz Cent Sales Tax Funds $286,500 of which was approved to carry over to FY 2004/2005. An additional amount of $250,000 was allocated in Yz-cent sales tax monies in the FY 2004/05 CIP to provide a total amount of $536,500. This project consists of installation of ADA access ramps and sidewalk at various locations per the attached Exhibit A. The details of the work are as follows: 1. Removal of curb, gutter, sidewalk, and roadway improvements. 2. Construction of new ADA access ramps, sidewalk, driveways, and pavement. 3. Repair of irrigation and landscaping, which are disturbed by the Contractor's operations. The Plans and Specifications for this project are complete. The project was advertised locally in the San Bernardino County Sun Newspaper, F. W. Dodge, Construction Data Hot Sheet, Reed Construction Data, Bid America, Construction Bid Source, the City's web sites, and with the San Bernardino Area Chamber of Commerce. Therefore, staff recommends that the Mayor and Common Council award the referenced contract to Kalban, Inc. 2 CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION STAFF REPORT (Continued) The estimated project costs are as follows: Construction Cost (basic bid) $368,037.50 Inspection and Contract Administration $ 36,800.50 Contingencies $ 55,162.00 Estimated Total Project Cost $460,000.00 If approved, this project is expected to begin construction in January of 2005 and be completed by June of 2005. FOR THE CONSTRUCTION OF ADA ACCESSIBILITY RAMPS AND SIDEWALK AT VARIOUS LOCATIONS, PHASE VI, (SS-B), PER PLAN NO.I0992B. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Kalban, Inc. at 9075 Glenoaks Boulevard, Sun Valley, CA 91352, is the lowest responsible bidder for the Construction of ADA Accessibility Ramps and Sidewalk at 9 Various Locations, Phase VI, (SS-B), per Plan No. 10992B. A contract is awarded 10 accordingly to said bidder in a total amount of $368,037.50, with a contingency amount of 11 $55,162.00, but such award shall be effective only upon being fully executed by both parties. 12 13 All other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to 14 execute said contract on behalf of the City; a copy of the contract is on file in the office of the 15 City Clerk and incorporated herein by reference as fully as though set forth at length. 16 17 SECTION 2. This contract and any amendment or modifications thereto shall not take 18 effect or become operative until fully signed and executed by the parties and no party shall be 19 obligated hereunder until the time of such full execution. No oral agreements, amendments, 20 21 modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. 22 SECTION 3.
