Backf!round: On September 7, 2003, the Mayor and Common Council adopted the FY 2004/09 Capital Improvement Program (CIP). The CIP contains a total of 17 traffic control projects to be designed and constructed in FY 2004/05. Of those 17 projects, staff has identified the installation of a Fully Actuated Traffic Signal and Street and Storm Drain improvements at the intersection of Highland and Central Avenues as a project that can best be accomplished by a consultant. With the complexity and time constraints of this project and current staffing limitations, a consultant would have greater resources to complete the design needed in a timely manner. The consultant selected for this project will follow the City's design standards and prepare a complete working set of specifications and drawings ready for bidding. The City-funded projects to be designed by an engineering consultant are as follows: 1. TC04-27 - "Highland Avenue at Central Avenue". Install a fully-actuated traffic signal. The installation of the traffic signal should have a "spread-spectrum" interconnect capability to Orange Street (easterly) and the signalized main entrance to Patton State Hospital to the west. Widen Central Avenue to add a left turn for northbound traffic at the intersection. Install sidewalk and ramps that are ADA compliant as required. 2. SD04-15 - "Highland Avenue Storm Drain". Modify as necessary the existing storm drain facilities surrounding the intersection. The design should include modifications to the inlets and outlets of the reinforced concrete box culverts located under Highland and Central Avenues. Requests for Proposals (RFP) for Professional Services were sent to 11 civil and traffic engineering firms. Three (3) firms responded to the RFP. Proposals were received from the following consultant entities: Company Location Proposed Fee Transtech Engineering, Inc. A selection committee interviewing the three (3) consultant firms consisted of: Development Services Director, James Funk; Deputy Director/City Engineer, Mark Lancaster; Engineering Manager/Field Engineer, Mike Grubbs; Senior Civil Engineer, Robert Eisenbeisz and Senior Civil Engineer, Byron G. Montalvo. The reviewers/evaluators selected the team of FPL and Associates, Inc. based on their qualifications, completeness of the proposal, understanding of the project, and other criteria established in the City Council's approved evaluation criteria and rating system. FPL and Associates, Inc. is a traffic and civil engineering, DBE firm specializing in traffic design for freeways, streets, stations, and traffic signals for various agencies in Southern California. FPL and Associates Inc. has designed numerous traffic control projects of similar scope for local municipalities and also has extensive experience in managing and inspecting the construction of these types of projects. The team's response to the RFP and the evaluation interview conducted by City Staff demonstrated experience with similar projects and specific knowledge of the proposed new traffic signal, street and storm drain improvements at the intersection of Highland Avenue and Central Avenue. Financial Impact: Sufficient Funding for this project is available in the following accounts in the 2004/05 Capital Improvement Program Budget. ATTACHME:\T "A" AGREEMENT FOR PROFESSIONAL SERVICES Design of Traffic Signal, Street and Storm Drain Improvements at Highland A venue and Central Avenue, TC04-27 and SD04-15 (City Funded Project). This AGREEMEJ\T is made and entered into this day of 2004, by and between the City of San Bernardino, California, a municipal corporation, hereinafter referred to as the "City" and FPL and Associates, Inc., hereinafter referred to as "Consultant." WITl\"ESSETH: A. WHEREAS, City ha~ need for Civil/Traffic Engineering Services; and, B. WHEREAS, Consultant is competent. experienced and able to perform said services: and, C. WHEREAS, Consultant has provided the most advantageous and best proposal for the provision of such services; l\OW THEREFORE, the parties hereto agree as follows: I. SCOPE OF SERVICES Consultant shall perform those services specified in the Request for Proposal (RFP), dated September 16, 2004. to provide Civil/Traffic Engineering Services for the Design of Traffic Signal. Street and Storm Drain Improvements at Highland Avenue and Central Avenue, TC04-27 and SD04-15, (City-Funded Projects) and Consultant's proposal dated October 15, 2004, all of which are attached hereto and incorporated herein as Attachments Band C. ') TER.\I OF AGREEME:\'T The services of Consultant are to commence after the City has authorized work to start by issuance of a Notice to Proceed. This Agreement shall expire one year from the date of this Agreement, unless extended by written agreement of the parties. 3. STAl\"DARD OF PERFORl\IAl\CE Consultant shall complete all work product and design in conformance with City of San Bernardino Standard Specifications and Standard Drawings. 4. CHA:\GES/EXTRA SERnCES A. Performance of the work specified in the Proposal is made an obligation of Consultant under this Agreement, subject to any changes made . I. Agreement for Professional Services with FPL and Associates. Inc. subsequently upon mutual written agreement of the parties. Any change, \vhich has not been so incorporated, shall not be binding on either party. 5 CO\fPE:\'SA TIO:\' A. The City shall reimburse the Consultant for actual costs (including labor costs, employee benefits. overhead, profit. other direct and indirect costs) incurred by the Consultant in performance of the work, in an amount not to exceed 534.900.00, except that reimbursement shall not include courier services, mileage or reimbursement for travel to the City to attend meetings or conduct the activities. Actual costs shall not exceed the estimated wage rates and other costs as set forth in the Proposal. See Attachment D for Consultant's cost breakdown attached and incorporated herein. B. Said compensation shall not be altered unless there is significant alteration in the scope, complexity or character of the work to be performed. Any adjustment of the total cost of services will only be permitted when the Consultant establishes and City has agreed, in writing, that there has been, or is to be, a significant change. C. The Consultant is required to comply with all Federal, State and local laws and ordinances applicable to the work. 6. PAYMENT BY CITY A. The billings for all services rendered pursuant to this Agreement shall be submitted monthly by Consultant to City and shall be paid by City within thirty (30) days after receipt of same, excepting any amounts disputed by City. City retains the right to challenge all or any part of an invoice. All tasks as specified in Proposal shall be completed prior to final payment. 7. SUPERVISION AND ACCEPTANCE OF SERVICES A. The Director of Development Services of City or his designee, shall have the right of general supervision over all work performed by Consultant and shall be City's agent with respect to obtaining Consultant's compliance hereunder. No payment for any selTices rendered under this Agreement shall be made without prior approval of the Director of Development Services or his designee. - 2 - Agreement for Professional Services with FPL and Associates. COMPLIA~CE WITH CIVIL RIGHTS LAWS Al'ID A:VIERICANS WITH DISABILITIES ACT Consultant hereby certifies that it will not discriminate against any employee or applicant for employment because of race, color, religion, sex, marital status, national origin or disability. Consultant's hiring practices and employee policies shall comply \vith applicable Federal, State and local laws. Such action shall include, but not be limited to, the following: Recruitment and recruitment advertising. employment, upgrading and promotion. 9. TERMINATION OF AGREEMENT A. This Agreement may be ternlinated by either party upon thirty (30) days written notice in the event of substantial failure of the other party to perform in accordance with the terms of this Agreement. Each party shall have twenty (20) days following date of such notice within which to correct the substantial failure giving rise to such notice. Consultant hereby covenants and agrees that upon termination of this Agreement for any reason, Consultant will preserve and make immediately available to City, or its designated representatives. maps, notes, correspondence, or records related to work paId for by the City and required for its timely completion, and to fully cooperate with City so that the work to be accomplished may continue. Any subsequent use of such incomplete documents shall be at the sole risk of the City and City agrees to hold harmless and indemnify Consultant from any claim, losses, costs, including attorney's fees, and liability arising out of such use. B. This Agreement may be terminated for the convenience of the City upon thirty (30) days written notice to Consultant. Upon such notice, Consultant shall provide work product to City and City shall compensate Consultant in the manner set forth above. C. Following the effective date of termination of the Agreement pursuant to this Section, the Agreement shall continue until all obligations arismg from such termination are satisfied. 10. COl'\TIl\'GENCIES In the event that, due to causes beyond the control of and without the fault or negligence of Consultant. Consultant fails to meet any of its obligations under this Agreement, and such failure shall not constitute a default in performance. the City may grant to Consultant such extensions of time and make other arrangements or dditions, excepting any increase in payment, as may be reasonable under the circumstances. Increases in payment shall be made only under the "changes" provision of the Agreement. - 3 - Agreement for Professional Sef\ices with FPL and Associates. Inc II. INDEPEXDE:\'T CO:'\TRACTOR Consultant shall act as an independent contractor in the performance of the services provided for under this Agreement. Consultant shall furnish such services in its own manner and in no respect shall it be considered an agent or employee of the City. 12. ASSIGNMEl\T OR SUBCONTRi\CTING Neither this Agreement. nor any portion thereof, may be assigned by Consultant w'ithout the \vritten consent of City. Any attempt by Consultant to assign or subcontract any performance of this Agreement without the written consent of the City shall be null and void and shall constitute a breach of this Agreement. 13. INDEMNITY Consultant shall indemnify, defend and hold CITY, its officers, employees and agents harmless from and against any and all claims, demands. suits. actions. proceedings, judgments, losses, damages, inj uries, penalties, costs, expenses (including attorney's fees) and liabilities, of, by, or with respect to third parties, which arise from Consultant's negligent performance of services under this Agreement. Consultant shall not be responsible for, and City shall indemnify, defend and hold harmless Consultant from and against, any and all claims, demands. suits. actions, proceedings, judgments. losses. damages, injuries, penalties. costs, expenses (including attorneys' fees) and liabilities of. by or with respect to third parties. which arise from the City's negligence. LIABILITY/INSUR-\l\'CE Consultant shall maintain insurance policies meeting the minimum requirements set forth herein. All insurance maintained by the Consultant shall be provided by insurers satisfactory to the City. Certificates evidencing all insurance coverage required herein shall be delivered to the City prior to the Consultant performing any of the services under the Agreement. All insurance certificates required herein shall name the City as an additional insured and provide for thirty (30) days written notice from the insurer to the City prior to cancellation of any insurance policy of the Engineer. A. ERRORS & OMISSIONS - The Consultant shall maintain errors and omissions insumnce with a combined single limit of not less than One Million DollaL . S 1,000,000.00) per occurrence. B. VALIDITY Should any provision herein be found or deemed to be invalid, this Agreement shall be construed as not containing such provision, and all other provisions which are otherwise lawful shall remain in full force and effect, and to this end the provisions of this Agreement are declared to be severable. 18. E:\'TIRE AGREEMEi'lT This Agreement represents the entire and integrated understanding between the parties hereto and supersedes all prior and contemporaneous negotiations, representations, understandings and Agreements, whether written or oral, with respect to the subject matter thereof. INTRODUCTION The City of San Bernardino (City) intends to engage the services of a consulting engineering firm (Consultant) to prepare plans, specifications and cost estimates (PS&E) for the installation of a new traffic signal, street, intersection and storm drain improvements at the intersection of Highland Avenue and Central Avenue as part of the City of San Bernardino Capital Improvements Program (CIP). II. BACKGROUND The intersection of Highland Avenue and Central Avenue is a 3-leg intersection in form of a T' located in the north east side of the City of San Bernardino. See Attachment "A". The intersection is currently a non-signalized intersection. It does not have curb and gutters or sidewalks. Along the south side of Highland Avenue there is a rock- lined channel. Another channel located north of Highland Avenue conveys storm water from the Baldridge Creek drainage area under Highland Avenue in a box culvert to the channel on the south side of Highland Avenue. III. SCOPE OF SERVICES 1. Consultant shall prepare and complete all required construction documents, including plans, specifications, and cost estimates for the following items: a) Installation of new fully actuated traffic signal at the intersection of Highland Ave. and Central Ave. The installation of the traffic signal should have a "spread-spectrum" interconnect capability to Orange Street (easterly) and the signalized main entrance to Patton State Hospital to the west. b) Review the San Bernardino County Flood Control District Comprehensive Storm Drain plan (CSDP) No. 6 (see Attachment "B", sheets 1 to 10) to determine any modifications that may be necessary to the existing storm drain facilities surrounding the intersection. The design should include modifications to the inlets and outlets of the reinforced concrete box culverts located under Highland and Central Avenues. It should also include improvements (if any) to the existing open channel just south of Highland Ave. All improvements for this intersection are to be constructed within the allocated budget. The CIP budget for fiscal year 2004/05 for the traffic signal is $ 200,000 and for the storm drain $ 247,900. The budget includes administration, design and construction. Traffic poles shall be designed at the ultimate (build out) locations to avoid any relocation of the poles in the future. Due consideration shall be given to the design for storm drainage at the intersection when locating the poles. However the goal of this project is to install a traffic signal at the intersection, therefore it Page 2 of 8 may not be possible to design the signal for full build out and remain within the available budget. The consultant shall be sensitive to this issue. c) Widen Central Ave. to add a left turn for northbound traffic at the intersection. This will likely require modifications to the existing culverts. 2. Consultant shall prepare the improvement plans, specifications, and cost estimates for the intersection identified above in conformance with City of San Bernardino standards, Caltrans standards, and the requirements of the Manual on Uniform Traffic Control Devices (MUTCD) and California Supplement, latest edition. The consultant shall prepare the plans, specifications, and estimates for the traffic signals, drainage structures and street widening in conformance with the following design requirements: a) The plans shall be prepared at a scale of 1 inch = 20 feet on standard 24" by 36" sheets, using the City of San Bernardino standard title block. b) The plans shall clearly show existinq conditions, including but not limited to, the location and type of signing and striping, pavement markings, storm drain facilities and street condition. c) Consultant shall be responsible for survey; research and other data or work needed to establish existing conditions. d) The traffic signal plans shall clearly show the location and type of the proposed improvements, including but not limited to, the type and location of signal poles, loop detectors, wiring, signing and striping, pavement markings, curb markings, storm drain and street improvements. Proposed signing and striping plans shall be shown on a separate sheet. e) The traffic signal plans shall include pole schedules that clearly specify the types and locations of all signal poles including, but not limited to signal and luminaire mast arm lengths; the types, locations, and attachments of pedestrian and vehicle displays; locations of pedestrian push buttons; and street name signs. f) The traffic signal plans shall include phasing diagrams that reflect phase sequences adhering to National Electrical Manufacturers Association (NEMA) phasing standards. g) In addition, the traffic signal plans shall clearly indicate: . the type and location of existing and proposed signing and striping, including but not limited to lane striping, stop bars, cross walks, pavement markings, and any other traffic control devices. Page 3 of 8 . the type and location of existing and proposed storm drain and street improvements, including but not limited to curbs, gutters, curb ramps, and cross gutters and open channel. . the type and location of existing and proposed vehicle detection, signal indications, wiring, conduit systems, and electrical service (including identification of the power source). h) All improvements shall be designed in compliance and accordance with the Americans with Disabilities Act (ADA). i) The street improvement plans for the proposed widening shall include, but not be limited to, curbs, gutters, berms, and curb ramps. Limits of pavement, sawcuts, removals and construction should also be shown. The extend of the improvements shall be based upon the widening needed to add a left turn lane for north bound traffic at the intersection. Plan and profiles should be included in the plans. j) The plans for the culvert modifications needed to accommodate the street widening and traffic signals installation shall include, but not be limited to all structural details, plan and profiles, design calculations, and all information needed to construct the modifications. k) The plans, specifications and cost estimates shall be signed and sealed by a The civil engineer, licensed to practice civil engineering in the State of California. Legal descriptions and plats shall be signed and sealed by a civil engineer or land surveyor, licensed to practice surveying in the State of California. 3. Consultant should meet and confer with City staff during the preliminary design phase to resolve design issues and ensure continuity with City standards and preferences. 4. Consultant shall conduct utility research and identify the location and depth of all existing utilities within the limits of the proposed improvements. Consultant shall be responsible for identifying and resolving utility conflicts both overhead and underground. Copies of all written communication (including maps) between the consultant and utility companies shall be provided to the City. 5. Consultant shall conduct the necessary research to determine the existing public right-of- way and identify the required right-of-way that must be acquired to construct the subject improvements. A preliminary study conducted by City Staff indicates that additional right of way will be required. Consultant shall prepare the appropriate legal descriptions and plats describing the property to be acquired. 6. Consultant shall identify any additional improvements that are required to construct the traffic signal intersection improvements. Additional improvements may include but not be limited to curb and gutter, drainage improvements, storm drains, street widening, curbs, curb ramps, and channelization. If additional improvements are required, consultant shall include the design of those improvements in the scope of the proposal and incorporate them into the plans, specifications and cost estimates. Page 4 of 8 7. Consultant shall submit an updated project schedule within 1 week of receiving a notice to proceed, indicating the design tasks and project timing from start to submittal of final PS&E. The Consultant shall estimate two (2) City plan reviews for each plan set. Each review should be estimated to take three (3) weeks for schedule purposes. Consultant shall provide an updated schedule showing progress and timing every two weeks. Upon completion of the consultant's work, the City shall have in hand, both an electronic, and a hard copy of an approved and signed set of completed plans, technical specifications, quantities, estimates and special provisions ready for bidding including all supporting data, calculations, utility locations, utility notices, survey data, permits and other details necessary to complete this project in a format acceptable to the City. Consultant should expect to meet with the City on a bi-weekly basis for updates on project progress, concerns, problems and accomplishments. The project design must be completed within four (4) months after the notice to proceed is issued. IV PROPOSAL REQUIREMENTS A. Responsive proposals will present a Scope of Services that includes at a minimum the above described services and any other tasks necessary to achieve completion of design (PS&E) needed for the successful construction of the proposed improvements. 2. Identify the professional, technical and support staff that will be performing the work associated with the proposed scope of services. Short resumes may be included, but extensive resumes should be limited to key personnel only. 3. Include a timeline indicating project milestones for the delivery of final plans, specifications, and cost estimates ready for public bid, including but not limited to a flow chart showing project tasks and timing. Include a list of similar projects recently completed by the Consultant, identifying the location, date, agency and contact person name, and address and phone number. 5. Previous obligations with other projects (related to time and availability of staff) . 6. Name of sub-consultants to be used for specific aspects of the project, including a summary of previous working arrangements on similar types of work. 7. Statement of local preference eligibility, including identification of any office located in the City of San Bernardino and the number of employees stationed at the office, the number of employees doing business inside the City limits, and a machine copy of your firm's City of San Bernardino Business License. 8. Items, actions or information the Consultant expects to be provided by the City. 9. Any comments or suggestion that the Consultant believes necessary to improve the finished project or to comply with the requirements of this RFP. 10. Separate sealed envelope. Fixed fee or not-to-exceed fee for the work required by this RFP, together with an hourly rate sheet applicable to this project for classifications above, including all materials and expenses, shall be submitted in a separate sealed envelope. Please note that the City will not payor compensate for travel time, courier services, mileage or reimbursement for travel to the City of San Bernardino to attend meetings or conduct the activities necessary to complete tasks required to be performed as part of consultant services. The fee proposal shall include the total fee and a separate fee breakdown for the traffic signal improvements and another one for the street and drainage improvements. This is necessary for cost tracking within the City's Capital Improvement Program. V. SELECTION PROCESS The selection process will be based on a point system and will consist of three phases as follows: 1. First phase selection shall consist of an evaluation by staff (including the Development Services Director, City Engineer, a Senior Engineer and Project Manager) of proposals based on the above items identified in Section IV B (except No. 10). An additional five (5) points will be given to City of San Page 6 of 8 Bernardino based consultants. In order to be deemed as "City of San Bernardino Based Consultant, the company shall have an office with a minimum of one (1) owner or employee doing business inside the City limits and shall possess a City Business License. The three (3) consultants with the highest points will continue to the interviews. A maximum of 100 points can be achieved in this phase of the selection process. The three consultants with the highest numerical scores will be invited to continue with the second phase of the selection process. 2. Second phase of the selection process will consist of staff evaluation of a presentation by the three consultants with the highest numerical score from the first phase selection. The interview will be detailed questions on this specific project, including, but not limited to, personnel, schedule, project staging, and knowledge of the project. Five (5) points of local preference will also be awarded in this phase of the selection process for Consultants that meet the requirements identified in paragraph 1 above. A maximum of 100 points can be achieved in this phase of the selection process. 3. The third and final phase of the selection process will consist of staff submitting a final package to the Mayor and Council for consideration approval. Final scores of the top three consultants will be submitted to the Mayor and Common Council with a recommendation to award an Agreement for Professional Services to the consultant with the highest numerical score. However, the Mayor and Common Council have the prerogative to award an Agreement for Professional Services to any of the top three consultants or reject all proposals. 4. If the Mayor and Common Council award an Agreement for Professional Services, the selected consultant will be requested to execute an Agreement for Professional Services (draft copy attached). Failure of the consultant to execute the Agreement within 60 days of approval by the Mayor and Common Council will void the approval. VI GENERAL This "Request for Proposal" does not commit the City to award a contract, pay any costs incurred in the preparation of a proposal in response to this request, procure or contract for any services. All proposals submitted in response to this request will become the property of the City and may be used by the City in any way deemed appropriate. The City reserves the right to accept or to reject, in part or in its entirety, the response to the request for proposal if such action is deemed to be in the best interest of the City. Any contract entered into as a result of this proposal shall be considered to include the items of work detailed in this proposal unless specifically deleted in the proposal at the request of the City. VII PAYMENT Page 7 of 8 The Consultant that is recommended by Staff and approved by Mayor and Common Council shall attend the pre-design meeting to establish the start date. Once the Notice to Proceed has been given, the Consultant can submit for payments. The City will release funds at percentages with receipt of Plans. Notices. or Specifications. No payment shall be given above the percentage of completed work accepted by the City. The City shall hold 15% of the total cost for 360 calendar days after acceptance of plans and specifications by the City, or 45 calendar days after the City issues a Notice of Completion for the project, whichever occurs first. Page 7 of 14 Safe - Route - To - School projects, Street and Signal projects for City of Downey - F PL provided a civil engineering design to improve the sidewalk along Brookshire A venue from Stewart and Gray to Gardendale to bridge missing sidewalk sections along both sides of Brookshire. Short retaining walls were designed where grading onto private property was not feasible. Wheelchair ramps were designed at intersections to meet ADA requirements. FPL prepared plans for the intersection traffic signal modification at Imperial Highway, and to install a pedestrian crosswalk with flashing beacons. FPL also completed a similar project on De Palma Avenue to improve the sidewalk from Paramount Boulevard to Downey Avenue, designed a new traffic signal, and a pedestrian crosswalk with flashing beacons. Other projects include (I) Paramount Boulevard Gateway Project, I-mile raised median with landscaping improvement to convert Paramount Boulevard as the gateway to the City of Downey in which FPL also provided design to improve sidewalk and traffic signing and striping for local circulation and (2) Lakewood Boulevard signal system - FPL provided a complete field check and base plan for 14 signals as a subconsultant. Arbor Vitae Street Improvement and Waterline Replacement, Inglewood - FPL prepared the PS&E to widen the street from 1-405 to Oak Street, modify the intersection configuration due to the change on the right-of-way take, redraft the improvement plans by AutoCAD for Arbor Vitae Street from Oak Street to Inglewood A venue made by hand by previous consultant, and prepare waterline replacement from 1-405 to Inglewood Avenue. FPL also designed a new traffic signal at Pradera Drive for a safe and efficient access to the High School. San Fernando Road Landscaping Improvement, City of Glendale - San Fernando Road is abutted on one side by Metrolink rail tracks, with a wide buffer between the tracks and the road which detracts from the attractiveness of the area. This project provides major landscaping within the Metrolink right of way, including planting, berms, landscaping, fencing, etc. FPL's tasks included coordination with utility agencies, relocation and reconstruction of several bus stops, survey and aerial mapping, drainage and grading work, and electrical service for irrigation controllers. Grand Avenue Realignment Conceptual Design and PS&E, Downtown LA - FPL prepared schematic plans for the realignment of Grand A venue from Temple Street to 2nd Street to allow a more curvilinear alignment, variable street widths, and enhanced pedestrian accessibility to facilitate the pedestrian activities in the vicinity of the Music Center and the Walt Disney Concert Hall. In the final PS&E, FPL designed a temporary signal, traffic handling plans, and permanent lighting plans. FPL coordinated with LADOT, Bureau of Street Lighting (BSL) and acquired the electrical service from the Los Angeles Department of Water and Power (LADWP). Joe Devlin was the main assistant. SCOPE of WORK - The project is to prepare plans, specifications and cost estimates (PS&E) for the intersection widening, installation of a new traffic signal, and storm drain improvements at the intersection of Highland Avenue and Central Avenue as part of the City of San Bernardino Capital Improvements Program (CIP) with the following scope items: .ntersection Widening - It is proposed to widen Central A venue to add a left turn lane for the Northbound traffic at the "T" intersection. Additionally, FPL believes it may be necessary to widen Highland Avenue to add a westbound left turn pocket for better traffic operations if allowed by the budget. The intersection does not have curb and gutters or sidewalks. Along the south side of Highland A venue there is a rock -lined channel. Another channel located north of Highland Avenue conveys storm water from the Baldridge Creek drainage area under Highland A venue in a box culvert to the aforementioned channel on the south side of Highland Avenue. The intersection widening will require modifications to the existing culverts. · Installation of a New Traffic Signal - A new fully actuated traffic signal is proposed. Signal poles will be designed at the ultimate (build out) locations to avoid any relocation of the poles in the future. FPL will give due considerations to the design of storm drain improvem~pts at the intersection when locating the poles. However, the project goal is to install a traffic signal at the intersection, therefore, it may not be possible to design the signal for full build out and remain within t he available budget. F PL willi ook into this issue and p resent the solution for City's review and a pproval A SAP. The proposed signal will bee quipped with a "spread-spectrum" interconnect capability to the traffic signal on Highland A venue at Orange Street to the east and the traffic signal on Highland A venue at the entrance to Patton State Hospital to the west. ~~ .~ ~ · Storm Drain Improvements - The inlets and outlets of both culverts, including the headwalls, will be modified to allow for the intersection widening. The widening of Central Avenue will :quire the culvert south of Highland Avenue be extended on both sides of Central Avenue. The widening of Highland Avenue will require the culvert north of Highland A venue be extended to FPL and Associates, Inc. Page 10 of 14 the north. The open channel south of Highland A venue will be improved to remove the vegetation with appropriate rgcket lining to the extent budget allows. The San Bernardino County Flood Control District Comprehensive Storm Drain Plan (CSDP) will be reviewed to determine any modifications that may be necessary to the existing storm drain facilities surrounding the intersection. · Budget Restraint - All improvements for this intersection are to be constructed within the allocated budget of $447,900 ($200,000 for the traffic signal and $247,900 for the storm drain). The $447,900 budget includes administration, design and construction. Therefore, at each submittal, FPL will include a probable construction estimate based on the extent of Central Avenue widening, the extent of Highland Avenue widening, and the extent of open channel improvements for City's review and approval of the extent of approval. For instance, the length of left turn pocket on Central Avenue and on Highland Avenue will be design factors approved in the preliminary engineering level. FPL has visited the site. Photos of the site are attached. The street improvement plans will show the type and location of existing and proposed street improvements, including but not limited to curbs, gutters, berms, curb ramps, cross gutters, guard rails, drainage improvements, storm drains, street widening, channelization, and utility relocation. All curb ramps will be designed in compliance and accordance with the Americans with Disabilities Act ~ (ADA). The storm drain improvement plans will show the plan and profile of the concrete culvert improvements of existing open channels to be covered by the intersection widening, the associated concrete lining improvements at the new locations of inlets and outlets. FPL will design the new headwalls and the associated structural details for the new inlets and outlets. The traffic signal plan will include pole schedules that clearly specify the types and locations of all signal poles including, but not limited to signal and luminaire mast arm lengths, the types, locations, and attachments of pedestrian and vehicle displays, locations of pedestrian push buttons, and street name signs. The plans will include phasing diagrams that reflect phase sequences adhering to National Electrical Manufacturers Association (NEMA) phasing standards. The type and location of proposed FPL and AssOcIates. Inc. Page 11 of 14 vehicle detection, signal indications, wiring, conduit systems, and electrical service (including identification of the power source) will also be included. The signing and striping plan will show the type and location of existing and proposed signing and striping, including but not limited to lane striping, stop bars, cross walks, pavement markings, and any other traffic control devices. FPL will meet and confer with City staff during the preliminary design phase to resolve design issues and ensure continuity with City standards and preferences. .- ~': ..' S. PROJECT APPROACH: Be Responsive - Through the vanous on-call contracts with the Cities of Santa Ana, Irvine, Mission Viejo, Laguna Woods and Downey and on-call contracts with Vandenberg AFB and Edwards AFB, FPL has learned responsiveness is the No. I requirement and the very first step toward project success. FPL will respond to the City immediately once the notice to proceed is given. FPL's in-house accounting is always ready for audit. Project Initiation - As the project manager, once the NTP is given, Ron Fromknecht will collect all the pertinent information including reports, as-builts, conceptual plans, contact the stakeholders per City's direction, and visit the site. Within three (3) business days he will arrange the kick-off meeting to meet all the stakeholders. The meeting is to get all the stakeholders familiar with the project, on-board, as well as to identify issues as early as possible. Team Assignment - The next management step is to select the appropriate design staff, and assure each team member has a clear understanding of his role and responsibilities. FPL will develop a conceptual design 0 f t he proposed improvements after examining the project site, evaluating the condition of the existing street improvements and walking with the CITY staff to re-assure there are no missing elements. The conceptual will include major pole location, phasing designation, controller location and major conduits. Any special conditions, particularly based on traffic operation, safety issues and conflicts, will be made note of and included into the design. Data Collection and Field Verification - FPL will collect the as-built plans for the entire project. .-. FPL will research and identify all aboveground and underground utilities and their clearance from the proposed design facility. Utility Notices (in CITY format) will be sent to all utility companies having facilities in the area within the first week of the project. The Southern California Edison service planner for the area will be contacted to coordinate the location and design of the electrical services for the proposed traffic signal. A two-person crew will be sent to the subject location to survey curb and gutter, sidewalk, driveway approaches, trees, street signs, fire hydrants, manholes, water meters, gas valves, storm drains, storm inlets, news racks, power poles, anchor poles, traffic signal equipment, street light poles, pull boxes, to cover the topographic features and cross sections from curb face to 5- 10' beyond the public right-of-way line. Cross sections depicting existing conditions will be obtained at 25' intervals where required for street improvement designs. The cross sections and as-built information will be used to develop base maps for the project. A photo log of the project area will be prepared. Project Manager will visit the site. FPL and Associates, Inc. Page 12 of 14 Utility Clearance - FPL will conduct a detailed utility research within project limits (location and depth of all underground utilities, and location and depth of all aboveground utilities) and send Utility Notices to all utility companies and agencies with facilities located in the area of proposed improvements. Copies of all written communication (including maps) between FPL and utility companies will be provided to the City. FPL will incorporate the pertinent utility's comments into design and avoid conflicts. Flood Control District Coordination - FPL will coordinate with San Bernardino County Flood Control District to identify any issues beyond the design scope identified in the proposal. FPL will conduct a detailed research of Line 6-SD-04 (along the south side of Highland Avenue) and Line 6- SD-05 (intersects Line 6-SD-04from the north) within project limits. Copies of all written communication (including maps) between FPL and Flood Control District will be provided to the City. FPL will incorporate the District's comments into design and avoid conflicts. -"', Right-or-Way - FPL will conduct a detailed research within project limits to determine the existing public Right-of-Way and identify any additional Right-of-Way that must be acquired to construct the proposed improvements. FPL and California Survey will prepare the legal descriptions and plats describing the property to be acquired. Design Meetings - FPL would like to establish biweekly meeting to discuss issues and examine progress. If regular meetings are not available, FPL will request the CITY project manager to invite the appropriate agencies to discuss issues and present F PL's recommendations. Ron Fromknecht will develop meeting minutes for record of actions and CITY manager's filing system. Fast-Track Assignment - For a "fast-track" assignment, FPL will have the submittal dates and the review time by the approval agency committed at the kick-off meeting to enable the success of the "fast-track" project. As professional engineers, FPL staffs are trained to solve last minute surprises. Overcome Potential Resistance - Bureaucracy and lack of as-built information, FPL believes, are the major resistance factors. The strategies to overcome them are the initial scope report to clearly define the project scope as early as possible and providing sufficient communications between FPL and CITY's project managers. Ron Fromknecht has strong verbal and written communication capabilities and technical knowledge to clarify the gray area. Sufficient communication will avoid last minute surprises. If, due to some reason, change of the design course does occur, FPL team has strong technical manpower to manage the change. As the principal-in-charge, Fong-Ping Lee will work with Ron Fromknecht to reflect the reasons why the change occurred, after the crisis, to the CITY project manager to prevent the next incident from occurring. Internal Tracking of Cost and Schedule - As the project manager, Ron Fromknecht will review the time card of each staff on the project versus their progress. CJ will provide the monthly report of budget consumption including hours charged and expenses spent for Ron to review. Ron will talk with staff daily to verify the status of project. Ron will work with staff to compile the construction bids to validate the construction cost estimation database. For each CITY assignment, Rein will provide an initial construction estimate at the initial report stage and will update the construction estimate during the life of design. The status of cost and schedule will be reviewed at each progress report. FPL and Associates. Inc. Page 13 of 14 Monthly Progress Report - As the project manager, Ron Fromknecht will provide the following information to CITY's project manager: . Activities and meetings over the last period, . Scheduled activities for next period, . Issues and suggested remedies, and financial status. Design Drawing Check! Quality Control - Quality control is a step by step program from conceptual design through the construction details delineation. FPL asks the design engineers to self check to assure that materials, equipment, and elements of the work have been designated satisfactorily for the purpose intended, conform to Review Agency's requirements, consistent with adjacent design sections or adjacent projects, assure that previous comments have been addressed, meet constructability requirements, satisfy applicable health, safety, aesthetic, environmental and regulatory requirements, and are legible, complete, well organized and technically and grammatically accurate. The supervising engineer will check the Check Prints based on the same criteria, and mark additions or changes in Red, deletions in Green, notes in blue. Any major comments must be approved by the Project Manager. The marked-up Check Print will be reviewed by the supervising engineer and the design engineer together. The design engineer will make corrections ifh e concurs with the changes. The supervising engineer will make a final check to ensure all the corrections have been properly made. If the corrections have been properly made, the check print will be marked in orange and signed and dated. If not, the drawings will be returned to the design engineer for additional corrections. The project manager will conduct the overall drawing review before each submittal. 6. COST - FPL's fee is identified in the attached envelope. .~ 7. SCHEDULE - FPL understands the importance of the project and would like to expedite the project as quick as possible with FPL's resources available. We understand that the City desires to solicit bids for construction within four months after the notice to proceed (NTP) is issued. Assuming the NTP is given on November 22, and consideration of holidays of Thanksgiving, Christmas and New Year, FPL would like to submit for the first plan check by January 24,2005. Then FPL will submit for the second plan check by March 7 and expect City approval on March 24 and advertises for bid by March 29, 2005. FPL will submit an updated project schedule within 1 week of receiving the notice to proceed. 8. LOCA nON - FPL is located in Irvine. In 1990's FPL had operated a satellite office at Victorville Then the Victorville operation was consolidated to the Irvine office due to the business fluctuation.
