BACKGROUND:
Per Health & Safety Code, Section 33413.5, the Agency is required to adopt a Replacement Housing Plan thirty
(30) days prior to undertaking redevelopment activities that will result in the removal of low or moderate
income housing units from the market.
CURRENT ISSUE:
The Agency is presently negotiating a Disposition and Development Agreement (DDA) with ANR Industries,
Inc. (Phases IA) to continue or expand redevelopment of the area bounded by Sierra Way, 2nd Street, Allen
Street and Rialto Avenue, within the IVDA Redevelopment Project Area boundaries. Under a proposed DDA,
the Agency will acquire various parcels and administer demolition and relocation activities. Accordingly, the
activities of the Agency will result in the removal of 4 occupied and 4 vacant residential units located on 7
separate parcels, for a total of 8 units, thereby prompting the need for a Replacement Housing Plan. The
existing Agreement with ANR Industries, Inc., requires them to build 23 new homes of which 10 will be sold to
low and moderate income buyers at affordable housing prices. The proposed DDA will add an additional 13
new homes and 1 rehabilitated home of which, a minimum of 9 homes will be sold to low and moderate income
buyers for a total of 37 homes to be built and 19 units to be set aside for low and moderate income buyers.
These units are included in the attached Replacement Housing Plan update.
The attached Plan also covers the Agency's housing activities commencing in 1994 through the anticipated
Meadowbrook Single-Family Housing Project ("Project") and was prepared in order to comply with the
provisions of the Health & Safety Code. The Plan sets forth the housing units demolished by the Agency's past
efforts, the proposed housing units to be demolished in connection with the Project, the total required
replacement units, the number of units the Agency has preserved or constructed, through various means, over
the years and the total unit deficit or credit.
In summary, the Agency has demolished 362 dwelling units; proposes to demolish 8 more units for a total
replacement housing requirement of 370 units; to date, the Agency has caused to be constructed, preserved or
will be constructed or preserved 712 units; therefore, the Agency currently has a surplus ofreplacement units of
342 which will be used as a credit to offset the loss of the 8 units contemplated under the DDA and to assist the
Agency in meeting its other housing obligations such as Inclusionary Housing.
Moreover, it should be noted that there are other housing units produced through the Agency's efforts that are
not included in the Plan because these units will be counted towards the Inclusionary Housing requirement
which will be addressed in early 2005.
ENVIRONMENTAL IMPACT:
No CEQA environmental analysis is required for adoption of this Replacement Housing Plan.
FISCAL IMP ACT:
None.

administer and implement all acquisitions, relocation and demolition activities. Accordingly, the activities of
the Agency pursuant to the DDA will result in the removal of approximately 4 vacant and 10 occupied
residential units, thereby prompting the need for a Replacement Housing Plan.
The attached Replacement Housing Plan covers the Agency's housing activities from 1994 to the present and
was prepared in order to comply with the provisions of the Health & Safety Code. The Plan sets forth the
housing units demolished by the Agency's past efforts, the proposed housing units to be demolished in
connection with the Meadowbrook Project, the total of required replacement units, the number of units the
Agency has preserved or constructed over the years and the total unit deficit or credit confronting the Agency. In
summary, the Agency up to the present time has demolished 362 dwelling units; the total replacement housing
requirement will increase to 376 as a result of the proposed Phase IA and II referenced above; to date, the
Agency has caused to be constructed or preserved 661 dwelling units; as a result, the Agency currently has a
surplus of replacement units (285) which can be used as a credit to offset the loss of the 14 units contemplated
under the DDA with ANR Industries.
ENVIRONMENT AL IMPACT:
No CEQA environmental analysis is required for adoption of this Replacement & Inclusionary Housing Plan.
FISCAL IMPACT:
Approval of the Replacement Housing Plan will not have a fiscal impact on the Agency
RECOMMENDATION:
That the Community Development Commission adopt the attached Resolution.

WHEREAS, Health and Safety Code, Section 33413.5 requires the Agency to prepare and
adopt a Replacement Housing Plan thirty (30) days prior to undertaking redevelopment activities that

will result in the removal of low or moderate income housing units from the market; and

WHEREAS, the Agency is negotiating a Disposition and Development Agreement
10
(DDA) with ANR Industries, Inc. for Phases IA of the Meadowbrook Area within the Inland
Valley Development Agency (IVDA) Redevelopment Project Area boundary; and
WHEREAS, under the proposed DDA, the activities will result in the removal of eight
(8) units, and the development of thirteen (13) new and one (1) rehabilitated unit of which nine

(9) of these units will be set aside for low and moderate income buyers at affordable housing

prices; and

WHEREAS, the Agency has prepared the Replacement Housing Plan to comply
with the requirements of the Health & Safety Code.

NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION OF THE
CITY OF SAN BERNARDINO DOES HEREBY RESOLVE, DETERMINE AND ORDER. AS

Section 1.
The Commission hereby approves the Agency's Replacement Housing Plan for

Meadowbrook Single-Family Housing Project attached hereto as Exhibit "A" and incorporated herein

by reference.

(MEADOWBROOK SINGLE FAMILY HOUSING PROJECn
INTRODUCTION
This document is the Replacement Housing Plan update for the Meadowbrook
Single Family Housing Project. Preparation of a replacement-housing plan is
required pursuant to Section 33413.5 of the California Health and Safety Code
whenever a redevelopment agency anticipates removing or destroying housing
units occupied by low or moderate-income persons. This Plan is different from
the Inclusionary Housing Plan required pursuant to Health & Safety Code
Section 33413(b)(4) that will be prepared for consideration by the Community
Development Commission in 2005 (the inclusionary housing provision, requires
Agencies, to set aside 15% of all new housing units or substantially
rehabilitated housing units within redevelopment project areas to persons or
families of low and moderate income at affordable housing prices. The
inclusionary housing unit requirement is not addressed in this Plan).
SECTION I - REPLACEMENT HOUSING REQUIREMENTS
A. Section 33413(a) of the Health and Safety Code requires that whenever
dwelling units housing persons and families of low or moderate-income
are destroyed or removed from the low and moderate-income housing
market as part of a redevelopment project, which is subject to a written
agreement with an agency or where financial assistance has been
provided by an agency, an agency shall, within four years of such
destruction or removal, rehabilitate, develop, or construct, or cause to be
rehabilitated, developed or constructed, for rental or sale to persons and
families of low to moderate-income, an equal number of replacement
dwelling units that have an equal or greater number of bedrooms as
those destroyed or removed units at affordable housing cost. The
replacement units may be located within the project area or within the
territorial jurisdiction of such agency.
Section 33413(a) requires that when dwelling units are destroyed or
removed after September 1, 1989, 75 percent (75%) of the replacement
units shall replace dwelling units available at affordable housing cost to
and occupied by persons in the same or an income level of very low
income households, lower income households, and persons and families
of low or moderate-income households, and persons and families of low
or moderate-income, as the persons displaced from those destroyed or
removed units.

Section 33413(a) requires that when dwelling units are destroyed or
removed after January 1, 2002, 100 percent (l00%) of the replacement
dwelling units shall be available at affordable housing cost to and
occupied by persons in the same or a lower income category (low, very
low, or moderate) as the persons displaced from those destroyed or
removed units. The Agency may choose to provide a one hundred percent
(l00%) match of income group affordability between the replacement
units and the destroyed units. This would result in all units being
affordable to very low and lower income households.
The definition of "replacement dwelling unit" requires that such unit
contain at least the same number of bedrooms and other living areas as
the dwelling unit destroyed or removed from the low and moderate-
income housing market. The Agency has and will continue to provide
replacement dwelling units containing at least the minimum number of
bedrooms and other living areas as the dwelling units destroyed by the
agency.
B. Section 33413.5 requires a redevelopment agency to adopt by resolution
a Replacement Housing Plan not less than 30 days prior to the execution
of any agreement for acquisition of real property, disposition and
development agreement, or owner participation agreement where those
agreements will lead to the removal of dwelling units from the low and
moderate-income housing stock. For a reasonable time prior to adopting
a replacement housing plan by resolution, the agency shall make
available a draft of the proposed replacement housing plan for review
and comment by the project area committee, or other public agencies,
and the general public. The replacement housing plan shall include (1)
the general location of housing to be rehabilitated, developed, or
constructed pursuant to Section 33413, (2) an adequate means of
financing such rehabilitation, development, or construction, (3) a finding
that the replacement housing does not require the approval of voters
pursuant to Article XXXIV of the California Constitution, or that such
approval has been obtained, (4) the number of dwelling units housing
persons and families of low or moderate income planned for construction
or rehabilitation, and (5) the timetable for meeting the plan's relocation,
rehabilitation, and replacement housing objectives. A dwelling unit
whose replacement is required by Section 33413 but for which no
replacement housing plan has been prepared, shall not be destroyed or
removed from the low- and moderate-income housing market until the
Agency has by resolution adopted a replacement housing plan. Nothing
in the section shall prevent an Agency from destroying or removing from
the low- and moderate-income hosing market a dwelling unit which the
Agency owns and which is an immediate danger to health and safety.
The Agency shall, as soon as practicable, adopt by resolution a
replacement housing plan with respect to such dwelling unit.

The term "persons and families of low or moderate-income" includes very low-
income households, lower income households, moderate-income households,
and middle income households. Section 50105 defines "very low income
households" as persons and families whose incomes do not exceed fifty percent
(50%) of area median income adjusted for family size. Section 50079.5 defines
the term "lower income household" as persons and families whose incomes do
not exceed eighty percent (80%) of area median income adjusted for family
size. Section 50093 defines "persons and families of low income" and "persons
and families of moderate-income" or "middle income families" as persons and
families whose incomes do not exceed one hundred and twenty percent (120%)
of area median income adjusted for size.
The Agency has diligently maintained an ongoing tracking of units produced,
reserved, removed and destroyed from the housing stock due to Agency
activities. The Agency is in the process of removing eight (8) low and
moderate-income dwelling units of which four (4) are occupied and four (4) are
vacant located on seven (7) separate parcels, which are identified in Table 2,
located in the Inland Valley Development Agency Project Area in conjunction
with the development of the Meadowbrook Single Family Housing Project
("Project"), located between 2nd Street to the north, Allen Street to the east,
Rialto Avenue to the south and Sierra Way to the west.
a. DESCRIPTION OF DWELLING UNITS TO BE DESTROYED OR REMOVED
FROM THE LOW TO MODERATE-INCOME HOUSING MARKET
This Replacement Housing Plan Update is therefore prepared to update the
Agency's previously approved 2001 Replacement Housing Plan and to address
pending projects that will necessitate the removal of 8 additional units and the
additional units the Agency intends to credit towards its pending replacement
housing obligation.
Table 1 identifies the 362 units previously removed by Agency activities
according to date of demolition, number of bedrooms, and income categories:

Table 2 identifies 8 housing units by the number of bedrooms, income and
whether they are occupied or vacant units located on 7 separate parcels that are
currently being considered for acquisition (or recently acquired by Agency) and
removal by the Agency within the Project. Assuming Project approval, it is
contemplated that these units would be removed from the low and moderate
income housing stock around December 2004 and/or prior to March 2005.

II. REPLACEMENT HOUSING PLAN APPROACH
The following programs are those developed and operated by the Agency to
address the Agency's housing obligations which may also include programs
aimed to fulfill the replacement housing requirement. Therefore, the programs
described below are incorporated by reference into this Replacement Housing
Plan.
The Agency's Housing Programs provides for a multifaceted approach to
meeting its housing replacement and inclusionary housing requirements
(although the inclusionary housing requirement is not contained in this Plan).
The following outlines the Agency's on-going Housing Programs, potential
future programs, and programs which the Agency may sponsor with other
housing agencies:
a. Home Imorovement Proqram
This program is designated to financially assist low and moderate-
income single-family homeowners with rehabilitation/restoration of their
property. In order to improve San Bernardino's "quality of life" and
housing stock, the Home Improvement Program offers financial
incentives to upgrade single-family homes and neighborhoods. High-
quality rehabilitation projects serve as an impetus for increased
neighborhood pride and maintenance. The Home Improvement Program
has two components, one for targeted neighborhoods with
concentrations of substandard housing and property conditions and the
other available citywide. The targeted neighborhood component
concentrates available resources within designated neighborhoods. The
overall objective of this approach is to change the economics of each
targeted neighborhood and stimulate increased neighborhood pride and
stability. Programs within these neighborhoods are available to
households earning up to 120 percent of median income.
The second component of the Home Improvement Program is a citywide
home improvement grant. This component allows for rehabilitation on a
case-by-case basis for income-eligible households.
b. Rental Assistance Proqram
The Rental Assistance Program is a safety net program offered to tenants
who are living in substandard housing conditions. Under the Program,
the Redevelopment Agency assists evacuees with first- and last-month's
rent and a security deposit. The replacement rental unit must be in
sound, sanitary and safe condition.

c. Section 8 Rental Assistance Certificate ProQram
Through the Section 8 program administered by the San Bernardino
County Housing Authority, landlords agree to a specific rent for one year,
with a rent increase possible after the first year. These federal Section 8
payments cover the difference between the contract rent of a rental unit
and what the tenant is required to pay (no more than 30 percent of
income). Initial gross rent (contract rent plus utility allowance) cannot
exceed fair market rents for the area.
Because of the size and diversity of San Bernardino County, the fair
market rents defined by HUD for the entire metropolitan statistical area
exceed the actual market rents in several cities and communities
throughout the County. In areas with lower market rents (such as in the
City of San Bernardino) the Fair Market Rent structure can allow
participants to rent housing that may be considered luxury housing or
with more amenities than intended by program regulations. At this time,
HUD is not receptive to permitting sub-market rents to alleviate this
concern.
d. Section 8 Rental Assistance Voucher Program
The Housing Authority provides voucher assistance that may be used to
rent any unit to eligible low to moderate or extremely-low income San
Bernardino residents. The Voucher Program operates much the same as
the Section 8 Program in that it provides financial assistance paid directly
to the property owner on behalf of participating families residing in
privately-owned and managed dwelling units. The basic differences are:
1) the term "payment standard" (which determines the amount of
assistance to be paid on behalf of the family) is used instead of "fair
market rent"; 2) annual increases in the amount of the payment standard
are not provided for, although two increases per five-year period may be
made; 3) any rent negotiation would be between the voucher holder and
the owner; and 4) the tenant is permitted (at his/her option) to pay rent
in excess of 30 percent of adjusted income, although HUD considers such
a payment to be a "rent burden."
e. Preservation of Assisted Rental Housing
The Housing Authority administers the Section 8 Moderate Rehabilitation
Program, which provides affordable rents for fifteen years to owners of
existing multifamily housing who rehabilitate their properties and agree
to rent the assisted units to low- and moderate-income households at
affordable rents. The guaranteed rents make it possible to secure
favorable financing terms for the rehabilitation work.

f. EmerQency Shelter Grant
The Emergency Shelter Grant Program benefits homeless individuals and
families through services and shelter, coupled with employment, job
training, and additional support services to deal with drug and alcohol
abuse. The City receives funds from the federal Emergency Shelter Grant
Program to assist and provide emergency shelter and supportive services
to approximately 3,000 homeless individuals and/or households yearly.
Four facilities have benefited from these funds in the past and will likely
receive funds again in the future: Salvation Army, Option House, Inc.,
Mary's Mercy's Table, Inc., and the Central Lutheran Mission.
g. Transitional HousinQ
The Redevelopment Agency funded its first transitional housing project in
FY 1994 that was designed to help persons to make the transition from
homelessness back into society. The transitional program provides
housing accommodations and supportive services for up to 24 months to
qualified persons. The Agency worked with Frazee Community Center,
the County Community Action Group, Central City Lutheran Mission to
produce: Frazee Community Center, 23 Units; County Community Action
Group (Obershaw House), 10 Units; and Central City Lutheran Mission, 10
Units; for a total of forty-three (43) transitional housing units in the City.
h. Battered Women's Shelter ProQram
The Agency will continue to provide CDBG and ESG funds to battered
women's shelters to assist women and children who are homeless or the
indigent and are in need of special services such as counseling,
employment, financial planning, and/or housing. These shelters provide
a safe environment during case management for individual situations, as
required. The service providers include the House of Ruth, Option House,
and New House, Inc.
i. First-Time Homebuver's Mortqaqe Assistance Proqram (MAP)
This program is designed to assist first-time, income eligible,
home buyers with the purchase of an existing home within the City of San
Bernardino. Eligible properties include condominiums, town homes,
single-family detached homes, and multi-plexes (up to four units). The
Agency provides a subordinate second mortgage loan to use for down
payment and closing costs of up to 10 percent but no more than 20% of
the purchase price. The loan is repaid when the home is sold or
refinanced within the first ten years. During the period of ownership, the
program participant has lower property tax payments, has accrued equity
to purchase another home, and acquired home ownership and

management experience. This program has produced a number of
affordable single family housing units since its inception in 1989 as
noted in Appendix 1.
j. Homebuver Lease-to-Own Proqram
Through a joint powers authority with other cities, a lease-to-own
program is available to low- and moderate-income renters who want to
purchase single-family homes but do not have the ability to immediately
take on that financial responsibility (due to income, credit, down
payment, or other factors). A participating renter may lease a single-
family home for up to five years, with the rental payments credited
toward the purchase of the home. After five years, the renter receives
title to the property.
k. Homebuver Education and Financial Counselinq
This program, operated by a non-profit organization under contract with
the Agency, (Neighborhood Housing Services of the Inland Empire, Inc.)
provides financial counseling and services to low- and moderate-income
households embarking on the purchase of a home. The counseling
teaches participating families about the basic household budgeting, the
importance of savings for major repairs, and regular household
maintenance and its importance in the upkeep of the family home. As a
result, a list of potential pre-qualified homeowners will be available to
the City for inclusion in its home buying program initiatives. All
participants under the MAP are required by the Agency to obtain this
education prior to the closing of escrow.
I. New Senior Housinq Development and Rehabilitation of Existinq Senior
Housing
The Agency has utilized its low-and moderate-income housing set-aside
funds and/or HOME federal funds to facilitate the construction of new or
rehabilitation of affordable/multiple units for the elderly. Among the
projects assisted by the Agency, were the Casa Ramona (44 units) and
Highland Senior Housing Complexes (50 Units). The Agency assisted the
development entities by issuing redevelopment housing bonds to provid~
resources for the development of these 94 senior housing units. Several
of these units are set aside for very low and low income seniors ( see
Appendix 1). There are other senior housing developments the Agency
has assisted in the past or recently (i.e. Telacu I, II, and III; St. Bernardine
,San Bernardino Senior Housing on Baseline and the Plaza) which are not
addressed in this Plan as those units were developed or rehabilitated
within redevelopment project areas and therefore, the Agency plans on
crediting these units towards its Inclusionary Housing requirement which

will be addressed as part of a mandated Inclusionary Housing Report due
in 2005.
m. In-Fill Housinq Development Proqram
This Program was designed to create high quality housing on unimproved
(vacant) infill sites, located within established neighborhoods throughout
the City of San Bernardino. The Redevelopment Agency works with local
developers and lending institutions interested in joint ventures to create
housing opportunities for homebuyers. The program has been designed
and implemented in such a way to ensure that these homes serve to
significantly improve/enhance the surrounding residential community,
while also offering homeownership opportunities. In the Meadowbrook
Single Family Housing Project, 23 homes are under construction under an
agreement between the Agency and ANR Industries out of which 10
homes will be restricted and sold to low and moderate income buyers.
An additional 13 homes will be constructed and 1 rehabilitated (Phase
1 A) under a proposed Development Agreement. This Project will produce
9 units that will be sold to low and moderate income buyers; therefore a
total of 37 units will be produced and 19 will be income restricted at
affordable housing costs. The units are identified in Appendix 1 of this
Plan.
Habitat for Humanity constructed 3 homes with Agency HOME funds and
these homes were sold to low income families ( see Appendix 1).
The Agency provides resources to these types of projects in a variety of
ways, such as: offsetting building permits and construction costs; land
write downs, clearance and relocation costs, etc. which assistance is
usually needed in order to restrict such new units at affordable housing
prices for a period of not less than 45 years as required by
redevelopment law.
III. FINANCING FOR REPLACEMENT HOUSING UNITS
The Agency in accordance with the Law sets aside 20% of all tax increment
funds received by its eleven (11) Project Areas and placed into the Agency's Low
and Moderate-Income Housing Fund ("Housing Fund"). The replacement
housing units provided to date or in the future will be funded in whole or in
part by the Agency's Housing Fund and to the extent possible private resources
in concert with partnership with developers.
Other funding sources in addition to housing set-aside funds may include the
following federal programs; funds annually from IVDA's low/mod income
housing fund, the federal HOME Program, Lead Based Paint Abatement
Program, Supportive Housing Program, HOPE 3 Program, Section 8 Moderate

Rehabilitation Program for Single Room Occupancy, Section 8 Certificates
Program, Section 8 Voucher Program, Supportive Housing for the Elderly
(Section 202) Program, Emergency Shelter Grants Program, Surplus Housing for
Use to Assist the Homeless, and Housing Opportunities for Persons with AIDS
Program (HOPWA).
The Agency and City may occasionally utilize State funded programs offered by
the California Housing Finance Agency (CHFA) and California Department of
Housing and Community Development (HCD). State Funded programs include;
Mortgage Credit Certificates, Multifamily Housing Program, Urban
Predevelopment Loan Program, Emergency Housing Assistance Program, Mobile
Home Park Ownership Program, and California Low Income Housing Tax Credit
Program
a. Proiections of Aqencv Twentv Percent (20%) Low and Moderate-Income
Housinq Set-Aside Funds
As required by Section 33334.2 of the Law, the Agency sets twenty percent
(20%) of tax increment revenue allocated to the Agency into a separate housing
fund to accomplish its housing obligations.
Table 3 below, sets forth the Agency's, anticipated resources for the next five
years (employing a conservative 2% growth factor).

IV. TIMETABLE FOR IMPLEMENTATION OF THIS REPLACEMENT HOUSING
PLAN-SUMMATION OF REPLACEMENT HOUSING REQUIREMENTS AND
COMPLIANCE
The Agency will employ a number of tools to insure that replacement-housing
units are made available in the housing market within the 4-year time frame.
The Agency will meet its obligations by: purchasing affordable housing
covenants, facilitating the construction of new affordable units, or rehabilitation
of existing housing units; joint venturing with private enterprise to insure that a
certain percentage of housing units developed or rehabilitated within or outside
redevelopment project areas are set aside for low and moderate income
households at affordable housing prices in accordance with redevelopment law.
As previously noted, although the Agency has embarked on assisting with the
development of the Meadowbrook Single Family Housing Project ("Project")
which will result in the removal of 8 housing units from the housing market, 37
new housing units will be produced by the Project and 19 of these new single
family homes will be set aside for low and moderate income buyers at
affordable housing prices. The timetable for this Project to occur will
commence in 2004 and completed by no later than 2006.
Table 5 below, summarizes the Agency's previously approved 2001
Replacement Housing Plan and those replacement housing obligations
occurring as a result of the Project described above. The table identifies the
number of housing units removed and replaced by bedroom and income
category. This summary is derived from Appendix 1.

In conclusion, as shown in Table 1, the Agency has previously demolished a
total of 362 low to moderate-income units since 1994 thru 2001. The Agency
now proposes implementing redevelopment activities which will result in the
demolition of an additional 8 units (see Table 2).
Specifically, the Agency has previously demolished 362 units and proposes to
demolish 8 additional units of which 4 are occupied and 4 are vacant, with a
total of lJi bedrooms for a total of 370 replacement units needed with 724
bedrooms. The Meadowbrook Single Family Housing Project will produce 18
New single family homes and 1 rehabilitated home, containing 48 bedrooms,
for occupancy by low and moderate income households at affordable housing
prices. Appendix 1 establishes that the Agency has produced or reserved 712
replacement housinq units with a total of 1561 bedrooms. In conclusion, the
Agency currently has a surplus of 342 replacement units with 837 bedrooms.
V. ARTICLE XXXIV EXEMPTION
The City of San Bernardino, pursuant to a general election on March 6, 1979
obtained voter approval for the development, construction or acquisition of low
rent housing units pursuant to Article XXXIV of the California Constitution.
Housing developed pursuant to Article XXXIV shall not exceed 5% of the total
dweiling units within the City.
Sections 37000 through 37002 of the Law, and specifically Section 37001,
provide for specific exemptions from the Article XXXIV requirements. The
Agency may also provide replacement housing in accordance with one or more
of these exemptions.

VI. PROVISION FOR PUBLIC REVIEW AND COMMENT
In accordance with the Law, this Replacement Housing Plan update Project has
been made available for public review and comment.
VII. MONITORING LOW AND MODERATE INCOME AFFORDABLE HOUSING
UNITS - REQUIRED REPORTS BY PROPERTY OWNERS
Under State Redevelopment Law the Agency is required to ensure that all
affordable units created as a result of the Agency's redevelopment activities
shall be annually monitored.
Listed below are the provisions from the Redevelopment Law that states forth
the specific requirements the Agency is to undertake with regards to
monitoring affordable units:
a. An Agency shall monitor on an ongoing basis any housing affordable to
persons and families of low or moderate income developed or otherwise
made available pursuant to any provisions of this part. As part of this
monitoring, an agency shall require owners or managers of the housing
to submit an annual report to the Agency. The annual reports shall
include for each rental unit the rental rate and the income and family size
of the occupants, and for each owner-occupied unit whether there was a
change in ownership from the prior year and, if so, the income and family
size of the new owners. The income information required by this Section
shall be supplied by the tenant in a certified statement on a form
provided by the Agency.
b. The data specified in subdivision (a) shall be obtained by the Agency from
owners and managers of the housing specified therein and current data
shall be included in any reports required by law to be submitted to the
Department of Housing and Community Development or the Controller.
The information on income and family size that is required to be reported
by the owner or manager shall be supplied by the tenant and shall be the
only information on income or family size that the owner or manager
shall be required to submit on his or her annual report to the Agency.
c. The Agency shall adequately fund its monitoring activities as needed to
ensure compliance of applicable laws and agreements in relation to
affordable units. For purposes of defraying the cost of complying with
the requirements of this section and the changes in reporting
requirements of Section 33080.4 enacted by the act enacting this Section,
an agency may establish and impose fees upon owners of properties
monitored pursuant to this Section.
