Resolution awarding a contract to Guzman Construction Company for Rialto A venue Storm Drain (SD04-
09) per Plan No. 10311 and authorization for the Finance Director to amend the FY 04/95 Budget.
Backl!round:
On September IS, 2003, the Mayor and Common Council allocated, as part of the FY 2003/04 Capital
Improvement Program (CIP), $72,700 in Storm Drain Construction Funds for Project No. SO 04-09 "Rialto
Avenue Storm Drain (SO 04-09)". The project was carried over into the FY 04/05 CIP.
This project consists ofthe following:
I. Removal of the failing storm drain crossing Rancho Avenue along Rialto Avenue.
2. Construction of new catch basins and reinforced concrete pipe (RCP) and connection to an existing
RCP traveling to Lytle Creek.
3. Repair of damaged asphalt disturbed by contractor's operations.
The purpose of this project is to reduce flooding problems on Rancho Avenue at Rialto Avenue.
The Plans and Specifications for this project are complete. The project was advertised locally in the San
Bernardino County Sun Newspaper, F. W. Dodge, Construction Data Hot Sheet, Reed Construction Data and
Bid America, Construction Bid Source, the City's web sites, and with the San Bernardino Area Chamber of
Commerce.

Staff Report (Continued)
Based on review of the sealed competitive bids received, staff has determined that Guzman Construction
Company of San Bernardino, the apparent low bidder, has met the minimum requirements of the
specifications and bid guidelines; and therefore, recommends that the Mayor and Common Council award
the referenced contract to Guzman Construction Company.
The estimated project costs are as follows:
Construction Cost (basic bid) $74,090

Inspection and Contract Administration $12,210

Estimated Total Proiect Cost $131,700
If approved, this project is expected to begin construction in November of 2004 and be completed by January
of2005.
Financial ImDact:
Funds for this project are available in FY 2004/2005 CIP in Account No. 248-368-5504-7255, (SD04-09)
"Rialto Storm Drain" in the approximate amount of $55,000, leaving a shortfall of approximately $59,000.
Staff is proposing that supplemental funding in the amount of $59,000 be transferred from unallocated storm
drain funds to provide a total construction funding amount of $114,000 (Contract amount + Potholing +
Inspection and Contract Administration + Contingencies), which is adequate to construct the project.
Recommendation:
I. Adopt Resolution.
2. Authorize the Finance Director to amend the FY 04/05 budget by transferring $59,000 in unallocated
Storm Drain Funds to Account No. 248-368-5504-7255 "Rialto Avenue Storm Drain (SD 04-09)".

COMPANY, FOR STORM DRAIN IMPROVEMENTS IN RIALTO AVENUE FROM
RANCHO AVENUE TO PENNSYLVANIA AVENUE (S004-09) PER PLAN NO. 10311.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Guzman Construction Company, at 1264 S. Waterman Avenue, San
Bernardino, CA 92408, is the lowest responsible bidder for Storm Darin Improvements in

10 Rialto Avenue from Rancho Avenue to Pennsylvania Avenue (SD 04-09), per Plan No.
10311. A contract is awarded accordingly to said bidder in a total amount of $74,090.00,

12 with a contingency amount of $11,700.00, but such award shall be effective only upon being
13
fully executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is

hereby authorized and directed to execute said contract on behalf of the City; a copy of the

contract is on file in the office of the City Clerk and incorporated herein by reference as fully
as though set forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not
take effect or become operative until fully signed and executed by the parties and no party

shall be obligated hereunder until the time of such full execution. No oral agreements,
amendments, modifications or waivers are intended or authorized and shall not be implied
from any act or course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute
it within sixty (60) days of passage of the resolution.

Office by December 3. 2004.
