MELLO-ROOS COMMUNITY FACILITY DISTRICT (CFD) NO. 1033 - CITY VERDEMONT FIRE
STATION
BACKGROUND:
The Mayor and Common Council of the City of San Bernardino ("City") have previously conducted
proceedings pertaining to the formation of Community Facilities District No. 1033 ("CFD No. 1033")
pursuant to the terms and provisions of the "Mello-Roos Community Facilities Act of 1982," as
amended (the "Act"), Chapter 2.5 of Part I of Division 2 (commencing with Section 53311) of the
California Government Code.
The purpose of CFD No. 1033 is to pay for a portion of the continued operation and maintenance of
the City's Verdemont Fire Station, including, but not limited to, payment of compensation of
employees, including salaries and benefits, maintenance and operation of fire safety vehicles and fire
station structures, any other expenses required to keep such equipment and improvements in fit
operating condition and any incidental expenses (collectively referred to as the "O&M Expenses").
As part of the proceedings for the establishment of CFD No. 1033, the Mayor and Common Council,
by way of the approval of the pertinent "Resolution of Formation", have called for a special election
("Special Election") to take place on September 20, 2004, relating to the levy of the special tax of CFD
No. 1033 ("Special Tax") to pay for a portion of the O&M Expenses in accordance with the Rate and
Method of Apportionment of the Special Tax (the "Rate and Method" is set forth as an exhibit to the
Resolution of Formation, which was approved by the City on June 21, 2004), pursuant to the Act.
CURRENT ISSUE:
Since the territory within CFD No. 1033 is uninhabited, Section 53326 of the Act provides that the
qualified electors of the special election are the landowners within CFD No. 1033. Among the
landowners of property within CFD No. 1033 is the Redevelopment Agency of the City of San
Bernardino ("Agency") (owner of approximately 90 acre property "commonly referred to as the Bice
Property-see attached Map Exhibit "A"). In accordance with Section 53326 of the Act, votes are to be
cast in the Special Election by such landowners or their authorized representatives, each having one
vote for each acre or portion thereof that such landowner owned in CFD No. 1033 as of the close of the
formation hearing held by the City on June 21, 2004.
The Community Development Commission of the City of San Bernardino (the "Commission"), as the
governing board of the Agency, must designate an "authorized representative" to vote on behalf of the
Agency in the Special Election relative to CFD No. 1033.
Accordingly, it is recommended that the Chairperson of the Commission, participate in the Special
Election for CFD No. 1033 and cast the votes of the Agency as the landowner in favor of the levy and
collection of the Special Tax.

ENVIRONMENTAL IMPACT:
None.
FISCAL IMPACT:
The action of the Mayor and Common Council pursuant to the direction of the Resolution of
Formation will approve the imposition and levy of the Special Tax in accordance with the applicable
Rate and Method of Apportionment, which will result in a special tax lien on all non-exempt property
owned by the Agency within the boundaries of CFD No. 1033 in the amount of $2,445 per acre for
land zoned Commercial/Retail/Office/lndustrial, and/or $350 per dwelling unit for residential property,
during the initial year that the Special Tax is imposed. The Special Tax is intended to remain in effect
for a period of thirty (30) years.
RECOMMENDA nON:
That the Community Development Commission adopt the attached Resolution.

WHEREAS, the Redevelopment Agency of the City of San Bernardino ("Agency") is a
public body, corporate and politic, organized and existing under the California Community
Redevelopment Law (Health and Safety Code Section 33000 et seq.); and
WHEREAS, the Community Development Commission of the City of San Bernardin
(the "Commission") is the governing board of the Agency; and
WHEREAS, the Mayor of the City of San Bernardino ("City") is the Chairperson of th
Commission; and
WHEREAS, the Mayor and Common Council of the City have previously conducted
proceedings pertaining to the formation of Community Facilities District No. 1033 ("CFD No.
1033") pursuant to the terms and provisions of the "Mello-Roos Community Facilities Act 0
1982," as amended (the "Act"), Chapter 2.5 of Part I of Division 2 (commencing with Section
533(1) of the California Government Code, including the approval of the rate and method 0

WHEREAS, as part of such proceedings the City held a hearing on the proposed

formation of CFD No. 1033 on June 21, 2004 and, at the close of the hearing, established the

formation of CFD No. 1033 and called for an election ("Special Landowner Election") to be
