Recommended Motion:
That the Director of Development Services and the City Clerk be authorized to proceed under
SBMC 12.90, with the establishment of a Landscape Maintenance Assessment District in the
Belmont Avenue and Magnolia Avenue area (Tract No. 13630), to be known as Assessment
District No. 1037.

SUBJECT:
Authorization to proceed --- formation of a Landscape Maintenance Assessment District in the
Belmont A venue and Magnolia A venue area (Tract No. 13630).
BACKGROUND:
On May 17,2004, Tract No. 13630, located at the northeasterly comer of Belmont Avenue and
Magnolia Avenue was approved. Harwood Homes, the developers of the tract, submitted a
petition for the formation of a landscape maintenance assessment district, as one of the
conditions of approval. The formation of the district will assign the costs of maintaining the
landscaping to the owners of the properties most benefiting from the landscape area. The area to
be maintained by the district will be landscaping along portions of the north side of Belmont
Avenue, the east side of Magnolia Avenue and Lot 34, located at the southeast comer of
Magnolia A venue and Meyers Road, all within the boundaries of the tract. The developer has
paid the required $4,000 formation fee.
Tract No. 13630 consists of 33 single family lots. The annual cost of maintenance and
incidentals will be spread across these 33 lots. Part of the formation proceedings includes the
preparation of an Engineer's Report, which will detail the costs necessary to carry out the
ongoing maintenance of landscaping and will be presented with the Resolution of Intention at a
future meeting. Although actual costs have not been determined, it is anticipated that the
analysis that will be contained in the yet to be prepared Engineer's Report will identify an annual
assessment in an amount not exceed $366.04 per single family lot. Approval of this district will
be subject to an assessment ballot process, which requires a majority approval by the property
owners within the proposed district boundary. Since all of the properties are currently under one
ownership, no protests are anticipated. Future homeowners will purchase the homes subject to
the assessment district. All potential home buyers will be given a disclosure notice by the
developer, advising them of the existence of an assessment district and the proposed annual cost.
FINANCIAL IMPACT:
None. Applicant has paid the $4,000 processing fee and all subsequent work carried out in the
district will be assessed back to property owners.
RECOMMENDATION:
Staff recommends that authorization be given to proceed with the formation of a Landscape
Maintenance Assessment District in the Belmont Avenue and Magnolia Avenue area (Tract No.
13630).
