Staff Report
SUBJECT:
Authorization to Proceed and Approval of Plan No. 11409 - proposed vacation of portions of
19th Street and various alleys south of 20th Street, east of Guthrie Street.
BACKGROUND:
An application was received from David Evans and Associates for the vacation of McKinley
Street between Sunrise Lane and 20th Street; the east/west alley between Arden Avenue and
Guthrie Street; a portion of the alley east of Guthrie Street; and 19th Street east of Guthrie Street,
as shown on the attached plan. The request was submitted on behalf of the San Bernardino City
Unified School District in preparation for the proposed Emmerton II Elementary School
expansion which includes the construction of a playfield and parking lot. As shown on the
attached plan, the easterly portion of Sunrise Lane turning into McKinley Street will become a
cul-de-sac. Portions of Lots 8 and 9 north of Sunrise Lane will be dedicated for this purpose.
The final resolution ordering the vacation, which will be submitted at a later date, will not be
recorded, and thus not take effect, until the street improvements for the cul-de-sac are installed
by the School District and accepted by the City. Also shown on the map, a portion of the alley
just east of Guthrie Street which is proposed to be vacated will complete the vacation of the
entire alley, as the other portion of this alley was previously vacated.
According to PCR Architects, the firm managing this project, the school district has completed
the relocation of all residents located on the south side of 20th street, between Guthrie Street and
Arden Avenue and has purchased all of these properties. Additionally, the residents north of
Sunrise Lane will not be affected by the proposed alley vacation east of Guthrie Street because
they have access to their properties from Sunrise Lane.
The general location of the proposed vacations is shown on the vicinity map and the details are
shown on the plan map.
If authorization to proceed is given, staff will contact all city departments, the various utility
companies and adjacent property owners to determine if any conflicts or objections exist. The
results of the investigations will be presented prior to the legal proceedings of the vacations.
FINANCIAL IMPACT:
None. The petitioner has paid the full processing fee of$I,200.
RECOMMENDATION:
Staff recommends that authorization to proceed with the proposed vacation be given and that
Plan No. 11409 be approved.

The vacation is requested for the following reason(s):
To provide a playfield and parking for the proposed Emmerton II Elementary
School. Sunrise Lane will become a cul-de-Sac at its east end where it turns into
McKinley Street.
I understand that a total non-refundable fee of $ 1,200.00 shall be paid by me as a cost of the

payable after the investigative proceedings are complete and prior to the commencement of the legal
proceedings. I further understand that said fees are NOT payment for any real property or
improvements thereon, but for the costs of the vacation proceedings ONLY and that the City of San
Bernardino does NOT determine underlying ownership of the area to be vacated nor does it guarantee
title to any _ property involved and I have been advised to consult a title company to determine such
ownership.
I understand that at the conclusion of the investigative proceedings. the City will notify me of its
f'IDdings including and conflicts with City facilities now located in the area proposed to be vacated. or the
request by any utility company for the reservation of any existing easements and that such conflicts or
reservations may affect the intended use of the proposed area, once vacated, and that I may elect to terminate
or continue the proceedings. If I elect to continue. the remaining unpaid fees shall be paid by me prior to the
continuance of said proceedings.
I understand that the requested vacation is subject to the approval of the Mayor and Common Council
of the City of San Bernardino and that there is no guarantee that such approval will be made.
