BACKGROUND
The applicant requests that the Mayor and Common Council approve Tentative Tract Map No.
16947 to subdivide approximately 6.78 acres into 29 single-family residential lots and
Development Permit (Type III ) No. 04-44 to construct 28 detached single-family homes. The
project site is located on the north side of 7th Street, between San Carlos Avenue and San Anselmo
Avenue in the RS, Residential Suburban land use district (Exhibit 1).
Specifically, approval of this tract map would authorize the City to initiate its eminent domain
proceedings pursuant to the Subdivision Map Act, Section 66462.5. The proceedings would
allow the City to utilize its power to acquire certain needed right-of-way from Ms. Kenia
Canales (Property owner of APN: 0142-032-03) for Cleveland Street extension. The needed
right-of-way, approximately 3,948 square feet (42' x 94'), is to allow Cleveland Street (60 feet in
width) to connect with the existing Cleveland Street east of the proposed tract. The needed right-
of-way from Ms. Kenia's backyard leaves her property with no setback problem and noise.
The City has 120 days (4 months) to acquire by negotiation the interest in the land that will
permit the improvements to be made. The 120 days starts at the time of filing of the final map
(presentation to the Mayor and Common Council for final approval). In the event that the City
fails to meet the time limitation, the applicant shall be required to construct a knuckle at the
intersection of Cleveland Street and San Benito Avenue. Please refer to the Planning
Commission Staff Report for additional discussion (Exhibit 2).
At their meeting of February 8, 2005, the Planning Commission opened the public hearing and
received public testimony on this matter. At the hearing, the project applicant stated that he
has been unsuccessful in attempts to acquire the needed right-of-way for extension of
Cleveland Street and is requesting that the City initiate its eminent domain power in order to
resolve and facilitate this matter.
Ms. Canales asserted that although the project applicant had made a few attempts to acquire the
needed right-of-way, a suitable offer price had not been put forth for her consideration. She was
also concerned that the eminent domain proceedings would remove her rights to a fair
compensation for her property.
Additionally, Ms. Charlesetta Jacobs, a local resident, spoke on drainage problems located
generally on 7th Street, approximately 60 feet south of the project site. Apparently, ponding
occurs quite often along 7th Street. She was concerned that this development could compound
the drainage problems and pose a serious public health and safety issue in this neighborhood.
Councilman Rikke Van Johnson told the Planning Commission that he was aware of the
drainage issues and had reported the problems the to City (See Exhibit C for details).
After considerable discussion, the Planning Commission made a motion to recommend approval
of Tentative Tract Map No. 16947 and Development Permit (Type III) No. 04-44, which
includes initiation of eminent domain proceedings. Commissioners Brown, Coute, Durr,
Heasley, Morris, and Sauerbrun voted 6 to 0 in support of the proposals. Commissioner Enciso
was absent.
In an effort to acquire the needed right-of-way, Mr. Kevin Roberts, project applicant, made
additional contacts with Ms. Canales after the Planning Commission hearing. To date, Mr.
Roberts has been unsuccessful and is requesting that the City utilize its power pursuant to the
Subdivision Map Act to help settle this matter.
FINANCIAL IMPACT
None. The applicant paid the Tentative Tract Map and Development Permit (Type III) filing
fees and will be required to pay all costs associated with the eminent domain proceedings.
RECOMMENDATION
That the hearing be closed and that the Mayor and Common Council:
I. Adopt the Mitigated Negative Declaration and the Mitigation Monitoring/Reporting Program
(Attachment F), and
2. Approve Tentative Tract Map No. 16947 and Development Permit (Type III) No. 04-44
based upon the Findings of Fact contained in the Staff Report and subject to the Conditions

REQUEST AND PROJECT DESCRIPTION
This request is for approval of Tentative Tract Map No. 16947 under the authority of
Development Code Section 19.66.070 to subdivide approximately 6.78 acres into 29 single-
family residential lots. The residential lots will have a minimum lot size of 7,205 square feet.
Development Permit No. 04-44 is for approval to construct 28 single-family homes. The site
contains one existi,ng single-family home for a total of 29 homes. The project site is located on
the north side of 7th Street, between San Carlo Avenue and San Anselmo Avenue in the RS,
Residential Suburban land use district (Attachment A).
The tract circulation has been designed to extend San Carlo Avenue and San Benito Avenue
northerly approximately 281 feet connecting to Cleveland Avenue to provide a through traffic
circulation pattern. The proposed project will be developed in one phase with the density of 4.3
units per acre (Attachment B).
The proposed project offers a I-story and 2-story housing style with 3 different model plans.
Each model plan offers 2 variations of finishes that includes a stucco look, masonry veneer,
stone veneer and other style for a total of 12 variety choices. A 6-foot vinyl fence will be
constructed for the perimeter fencing and for each house (Attachment B).
The layouts are as follows:

Plans 1, 2, and 3 offer some extra features for personal preferences to convert a loft into a
bedroom/retreat area or to convert a fireplace into a fountain. The homes are wood-
frame/stucco construction with concrete tile roofs. Architectural treatments include variations
in roof style, front entry projection and garage door designs. The homes include window
treatments on all four sides, metal roll up garage doors and fully landscaped front-yards for all
the houses.

SETTING/SITE CHARACTERISTICS
The project site is occupied with one residential structure located on Lot 20. The remainder is
vacant. Etiwanda Avenue forms the northern project site boundary. The site can be accessed
through Eitwanda Avenue, San Carlo Avenue, San Benito Avenue and Cleveland Street. The
site is located in the RS, Residential Suburban land use district and surrounded by single-
family residential pevelopment in all directions.
BACKGROUND
The Development/Environmental Review Committee (D/ERC) initially reviewed the proposed
tract on November 18, 2004. The D/ERC determined that the project applicant should make
every effort to obtain the right-of-way from the property identified as APN: 0142-032-03 for
Cleveland Street. The needed right-of-way is approximately 3,948 square feet (42' x 94'). The
right-of-way is to allow Cleveland Street (60 feet in width) to connect with the existing
Cleveland Street east of the proposed tract. Public Works also prefers Cleveland Street
extension to allow a through traffic flow. In the event that the project applicant is unable to
acquire the right-of-way, the City may file an eminent domain action against the property
owner of APN: 0142-032-03 pursuant to the State Subdivision Map Act or require the project
applicant to construct a knuckle at the intersection of Cleveland Street and San Benito Avenue.
To date, the project applicant has been unsuccessful in acquiring the right-of-way for
Cleveland Street from the property identified as APN: 0142-032-03 which is approximately .64
acres (27,730 square feet - 94' x 295'), and contains a single-family structure fronting
Etiwanda Avenue. The reduction of the 42' x -94' (3,948 square feet) area from the backyard
leaves the lot with .54 acres (23,782 square feet), with no setback problems and noise.
Several attempts were made including sending an offer letter and a personal visit. The owners
of APN: 0142-032-03 are not interested in selling part of their portion (Attachment G).
Pursuant to the Subdivision Map Act, Section 66462.5, the applicant is requesting that the City
initiate eminent domain proceedings against the property owner of APN: 0142-032-03-0000 to
permit the necessary improvements to be made. Per the above Section, the City has 120 days
(4 months) to acquire by negotiation the interest in the land that will permit the improvements
to be made. This time frame includes proceedings for immediate possession of the property.
The 120 days starts at the time of filing of the final map. In the event that the City fails to
meet the time limitation, the applicant shall be required to construct a knuckle at the
intersection of Cleveland Street and San Benito Avenue.
CEQA STATUS
Tom Dodson prepared an Initial Study on behalf of the project applicant. The Environmental
Review Committee independently reviewed, analyzed, and exercised judgement in reviewing
the Initial Study and mitigation measures and making its determination. Pursuant to the Public
Resources Code and CEQA guidelines, a Notice of Intent was filed with the County and the
Initial Study was made available to the public for review and comment beginning on November
24,2004, and ending on December 15, 2004. No comment was received on the Initial Study.

On December 16, 2004, the D/ERC determined that the proposed Initial Study adequately
addressed the environmental issues and recommended that a Mitigated Negative Declaration be
adopted and moved Tentative Tract Map No. 16497 to Planning Commission.
Additionally, the D/ERC first heard Development Permit (Type III) No. 04-44 for construction
of homes on DeceJUber 2, 2004, and moved the project to the Planning Commission. The
D/ERC determined that the Initial Study included action measures to properly mitigate and
monitor any potential significant negative intpacts relating to development and construction of
this site.
FINDINGS AND ANALYSIS
TENT A TIVE TRACT MAP
1. 1s the proposed map consistent with the General Plan?
Yes, the proposed map is consistent with the General Plan and Development Code as
shown in Table A below. The RS, Residential Suburban land use district allows single-
family residential units at a maximum density of 4.5 units per gross acre. The proposal
is for single-family development at 4.3 units per gross acre. All lots created meet the
minimum lot size, width and depth requirements.

2. 1s the design of the proposed subdivision consistent with the General Plan?
Yes, the proposal is consistent with the objectives and policies of the General Plan as
follows:

General Plan Objective 1.10 states: "Promote the development oflow-density,
large lot, high quality single-family detached residential units."
The proposed tract complies with Development Code requirements and will enhance the
existing residential development in this surrounding area. This project will promote
and implement the objectives and policies of the General Plan.
3. Is the site physically suitable for the type of proposed development?
Yes, the site of the proposed project is physically suitable for the proposed development
in that the division of land is consistent with the Subdivision Map Act. The tentative
tract map conforms to the subdivision design standar9s specified by the Development
Code in that it meets the minimum lot size for the RS, Residential Suburban land use
district. All of the proposed lots will have access to a dedicated roadway and
infrastructure that will provide water, sewer, power, gas, telephone, and cable to the
site.
4. Is the site physically suitable for the proposed density of development?
Yes, the site is physically suitable for the proposed development in that the division of
land is consistent with the Subdivision Map Act and the proposed lots will be
compatible in design with the existing residential lots in all four directions to the east,
north, west and south. The proposed subdivision is consistent with the RS development
standards. The proposed density at 4.3 units per gross acre is lower than that of the RS
district requirements at 4.5 units per gross acre.
5. Is the design of the subdivision likely to cause substantial environmental damage, or
substantially and unavoidably injure fish or wildlife or their habitat?
No, as described in the CEQA Section of this report, based on the Initial Study
prepared by Tom Dodson & Associates on November 2004, no evidence of sensitive
'habitats for plant or animal species were observed, and none were expected due to the
fact that no native or natUral habitat remains on the site.
6. Is the design of the subdivision likely to cause serious public health problems ?
No, all lots proposed to be created will have access to a dedicated street. The design of
the proposed subdivision meets all of the applicable requirements for the RS land use
district. The circulation layout has been reviewed by the City Engineer and designed to
accommodate the type of traffic forecast to be generated by the proposed subdivision
and is unlikely to result in any serious public health problems.

Additionally, should the right-of-way property acquisition for Cleveland Street proven
to be unsuccessful pursuant to the State Subdivision Map Act, the applicant shall be
required to construct a knuckle at the intersection of Cleveland Street and San Benito
A venue. Based on this, the design of the subdivision is unlikely to cause serious public
health problems.
7. Will the design of the subdivision or the type of improvements conflict with any
easements, acquired by the public at large, for access through or use of, property
within the proposed subdivision?
No, the easements identified in the Preliminary Title Report relate to electrical lines and
other utilities. The design of the subdivision and the proposed improvements will not
conflict with these easements, because any existing easements would be abandoned or
relocated as determined by the Public Works/Engineering Division through processing
of the Final Map.
DEVELOPMENT PERMIT
1. Is the proposed development permitted within the subject zoning district and does it
comply with all of the applicable provisions of the Development Code, including
prescribed development/site standards and any/all applicable design guidelines?
Yes, the proposed homes are consistent with the General Plan and Development Code,
in that the RS, Residential Suburban land use district allows single-family residential
units at a maximum density of 4.5 units-per gross acre. The proposal is for single-
family development at a density of 4.3 units per gross acre. All units created meet
minimum unit size, lot coverage, and setback criteria as shown in Table "A" below.

2. Is the proposed development consistent with the General Plan?
Yes, the proposal is consistent with the General Plan objective and policy as follows:
General Plan Objective 1.11 states: "Promote the development of single-family
detached units in a high quality suburban setting."
General Plan Policy 1.11.10 states: "Permit the development of single-family detached
residential units at a density of up to 4.5 units per gross acre........in areas designated as
"Residential Suburban (RS)"
This proposal is for single-family dwelling units located in the RS land use designation.
The development of the site will provide this area with needed improvements
surrounded by single family homes. The proposed single-family detached residential
units will be compatible with the adjacent residential units in the surrounding areas to
the east direction.
3. Is the proposed development harmonious and compatible with eXlstmg and ftl.ture
. developments within the land use district and general area, as well as the land uses
presently on the subject property ?
Yes, the proposed project is consistent with the residential character of the surrounding
land uses as well as future residential development. The proposed single-family units
are compatible with and will complement the existing single-family units in this area.
The residential character of the proposed development is similar to that ofrecently
completed single-family homes in this neighborhood.
The home designs and treatment elements are designed to provide continuity with
neighboring single-family structures. Architectural treattnents include variations in roof
style, entry area and garage door designs. All windows and doors and side and rear
elevations will be architecturally treated.

4. /s approval of the Development Permit for the proposed development in compliance
with the requirements of the California Environmental Quality Act and Section
/9.20.030(6) of the Development Code?
Yes, the Initial Study and Mitigated Negative Declaration that were prepared for Tract
No. 16947 included the development and construction of this site with 28 single family
dwellings. ; Approval of this Development Permit is in compliance with the
requirements of the California Environmental Quality Act and Development Code
Section 19.20.030 (6) pertaining to environmental resources and constraints. Approval
of the proposed project would not result in any significant effects relating to traffic,
noise, air quality or water quality. This is because all the necessary infrastructure is
already in place to handle the anticipated capacity resulting from this proposed project.
It is anticipated that the impacts relating to traffic, noise, air quality or water quality
will be less than significant.
5. Will there be potential significant negative impacts upon environmental quality and
natural resources that could not be properly mitigated and monitored?
No significant harmful effects on the quality of the environment or on natural resources
will exist as a result of this project. The project site is not located in geological hazard
area and occurs within city limits and the site has no habitat value for endangered or
threatened species. The site can be adequately served by all required utilities and
public services. The proposed project complies with the RS land use development
standards and is consistent with Development Code.
6. /s the subject site physically suitable for the type and density/intensity of use being
proposed?
Yes, the site is physically suitable for the type and density/intensity of the project being
proposed as evidenced by project compliance with all applicable Development Code
Standards as noted in Table" A". The proposed project complies with the density
requirement at 4.3 du/ac from 4.5 as permitted by the Code for the RS" district.
7. Are there adequate provisions for public access, water, sanitation, and public utilities
and services to ensure that the"proposed use would not be detrimental to public health
and safety?
Yes, all agencies responsible for reviewing access, and providing water, sanitation and
other public services have all had the opportunity to review the proposal, and none have
indicated an inability to serve the project. The proposal will not be detrimental to the
public health and safety in that all applicable Codes and will apply to the construction
of this project.

8. Are the location, size design and operating characteristics of the proposed development
detrimental to the public interest, health, safety, convenience, or welfare of the City?
No, the proposal is consistent with all provisions of the Development Code. The
proposed size and design of the units will be compatible with the single-family units
developed in the area. The location and operating characteristics of the proposed
project will not be detrimental to the public interest, health, safety, convenience, or
welfare of the City.
CONCLUSION
The proposals meet all applicable Findings of Fact for approval of Tentative Tract Map No.
16947 and Development Permit (Type III) No. 04-44.
RECOMMENDATION
Staff recommends that the Planning Commission independently review, analyze, and exercise
judgement in reviewing the Initial Study in making its determination and recommend that the
Mayor and Common Council:
1) Adopt the Mitigated Negative Declaration and the Mitigation Monitoring/Reporting
Program (Attachment F),
2) Approve Tentative Tract Map No. 16947 and Development Permit (Type III) No. 04-44

CONDITIONS OF APPROVAL
Tentative Tract Map No. 16947 &
Development Permit (Type III No. 04-44
1. This approval is for subdivision of Tentative Tract Map No. 16947 to subdivide
approximately 6.78 acres into 29 residential lots and Development Permit for construction of
28 dwellings on Tract No. 16947. The project site is located on the north side of 7th Street,
between San Carlos Avenue and San Anselmo Avenue in the RS, Residential land use
district.
2. Tentative Tract MaD No. 16947: Within two years of this approval, the filing of the final map
with the Council shall have occurred or the approval shall become null and void. Expiration
of a tentative map shall terminate all proceedings and no final map or parcel map shall be
filed without first processing a new tentative map. The City Engineer must accept the final
map documents as adequate for approval by Council prior to forwarding them to the City
Clerk. The date the map shall be deemed filed with the Council is the date on which the City
Clerk receives the map. The review authority may, upon application filed 30 days prior to
the expiration date and for good cause, grant an extension to the expiration date pursuant to
Section 19.66.170 of the Development Code and the State Map Act.
Expiration Date:.lfebruary 8, 2007
3. DeveloDment Permit (TvDe III) No. 04-44: Within two years of development approval,
commencement of construction shall have occurred or the permit/approval shall become null
and void. In addition, if after commencement of construction, work is discontinued for a
period of one year, then the permit/approval shall become null and void. However, approval
of this application does not authorize commencement of construction. All necessary permits
must be obtained prior to commencement of specified construction activities included in the
Conditions of Approval and Standard Requirements.
Expiration Date: February 8, 2007
4. The review authority may, upon application being filed 30 days prior to the expiration date
and for good cause, grant one time extension not to exceed 12 months. The review authority
shall ensure that the project complies with all current Development Code provisions.

5. In the event that this approval is legally challenged, the City will promptly notify the
applicant of any claim or action and will cooperate fully in the defense of the matter. Once
notified, the applicant agrees to defend, indemnify, and hold harmless the City, the Economic
Development Agency, the Redevelopment Agency, their affiliates, its officers, agents and
employees from any claim, action or proceeding against the City of San Bernardino. The
applicant further agrees to reimburse the City, the Redevelopment Agency and the Economic
Development Agency of any costs and attorneys' fees which the City, the redevelopment
Agency or the Economic Development Agency may be required by a court to pay as a result
of such action, but such participation shall not relive applicant of his or her obligation under
this condition.
The costs, salaries, and expenses of the City Attorney and employees of his office shall be
considered as "attorneys fees" for the purpose of this condition.
As part of the consideration for issuing this permit, this condition shall remain in effect ifthe
Tentative Tract Map and Development Permit are rescinded or revoked, whether or not at the
request of applicant.
6. The final map, grading plan, and site improvement plans shall be in substantial conformance
with the Tentative Map approved by the Planning Commission. Minor modifications to the
planes) shall be subject to approval by the Director of Development Services through a minor
modification permit process. Any modification which exceeds 10% of the following
allowable measurable design/site considerations shall require the re-filing of the original
application and a subsequent hearing by the appropriate hearing review authority if
applicable: -'_
a. On-site circulation and landscaping.
b. Placement and/or height of walls, fences and structures.
c. Minor lot line adjustments, provided the lot area of each approved lot shall not be
reduced below the minimum lot area permitted in the Development Code.
d. A reduction/increase in density, intensity or number of lots of a development project.
e. Reconfiguration or architectural features, including colors, and/or modification of the
finished materials that do not alter or comprise the previously approved -theme.
7. No vacant, relocated, altered, repaired or hereafter erected structure shall be occupied or no
change of use of land or structure( s) shall be inaugurated, or no new business commenced as
authorized by this permit until a Certificate of Occupancy has been issued by the
Development Services Department. A temporary Certificate of Occupancy may be issued by
the Development Services Department subject to the conditions imposed on the use, provided
that a deposit is filed with the Development Services Department prior to the issuance of the
Certificate. The deposit or security shall guarantee the faithful performance and completion
of all terms, conditions and performance standards imposed on the intended use by this
permit.

exterio.r lightning design and co.ntro.l; no.ise co.ntrol; o.do.r co.ntro.l; screening; signs, o.ff-street
parking and o.ff-street lo.ading; and, vibratio.n co.ntro.l. Screening and sign regulatio.ns
co.mpliance are impo.rtant co.nsideratio.ns to. the develo.per because they will delay the
issuance o.f a Certificate o.f Occupancy until they are co.mplied with. Any exterio.r structural
equipment, o.r utility transfo.rmers, bo.xes, ducts o.r meter cabinets shall be architecturally
screened by wall o.r structural element, blending with the building design and include
landscaping when o.n the gro.und.
9. At least o.ne tree shall be planted fo.r each tree remo.ved (o.f significant value as determined by
the City) in the co.urse o.f grading and co.nstructio.n, unless determined o.therwise through a
pre-approved tree replacement plan submitted to. the Parks, Recreatio.n and Co.mmunity
Services Department pursuant to. Develo.pment Co.de Sectio.n 19.28.090 REMOVAL OR
DESTRUCTION OF TREES.

1. Drainal!:e and Flood Control
a) A local drainage study will be required for the project. Any drainage
improvements, structures or storm drains needed to mitigate downstream
impacts or protect the development shall be designed and constructed at
the developer's expense, and right-of-way dedicated as necessary.
b) All drainage from the development shall be directed to an approved public
drainage facility. If not feasible, proper drainage facilities and easements
shall be provided to the satisfaction of the City Engineer.
c) If site drainage is to be outleU.~d into the public street, the drainage shall
be conveyed through a parkway culvert constructed in accordance with
City Standard No. 400. Conveyance of site drainage over the Driveway
approaches will not be permitted.
d) The applicant shall submit a Storm Water Pollution Prevention Plan
(SWPPP) and Water Quality Management Plan (WQMP). The City
Engineer, prior to issuance of any permits authorizing land:<Jisturbing
activities shall approve these plans. (Refer to the City's .web page at
www.ci.san-bernardino.ca.us - Departments - Development Services -
Public Works for templates of these plans).
e) A "Notice of Intent (NOl)" shall be filed with the State Water Quality
Control Board for construction disturbing I acre or more of land.
t) Prior to issuance of a grading permit, the City Engineer shall approve an
Erosion Control Plan. The plan shall be designed to control erosion due to
water and 'find, including blowing dust, during all phases of construction,
including graded areas which are not proposed to be immediately built
upon.

2. Grading and Landscapaing
a) If more than I' of fill or 2' of cut is proposed, the site/plot/grading and
drainage plan shall be signed by a Registered Civil Engineer and a grading
permit will be required. The grading plan shall be prepared in strict
accordance with the City's "Grading Policies and Procedures" and the
-City's "Standard Drawings", unless otherwise approved by the City
Engineer.
b) If more than 5 trees are to be removed from the site, a tree removal permit
conforming to the requirements of Section 19.28.090 of the Development
Code shall be obtained from the Department of Development Services-
Planning Division prior to issuance of any grading or site development
permits.
c) If more than 5,000 cubic yards of earthwork is proposed, a grading bond
will be required and the grading shall be supervised in accordance with
Section 7012(c) of the uniform Building Code.
d) If more than 1,000 cubic yards of earth is to be hauled on City Streets then
a special hauling permit shall be obtained from the City Engineer.
Additional conditions, such as truck route approval, traffic controls,
bonding, covering of loads, street cleaning, etc. may be required by the
City Engineer.
e) An on-site Improvement Plan is required for this project. Where feasible,
this plan shall be incorporated with the grading plan and shall conform to
all requirements of Section 15.04-167 of the Municipal Code (See
"Grading Policies and Procedures").
t) One 4' x II' PCC pad at least 4" thick shall be provided in the rear or side
yard area of each lot for storage of recycling containers. The pad shall be
screened from public view and a 3' wide concrete walkway shall be
provided from the driveway to the pad. All gates along the access way
shall have a clear width of 3'-6" minimum. A minimum clearance of 3
feet shall be provided around the pad.
g) Retaining walls, block walls and all on-site fencing shall be designed and
detailed on the On-site Improvement Plan. This work shall be part of the
On-site Improvement permit issued by the City Engineer.
h) The project Landscape Plan shall be reviewed and approved by the City
Engineer prior to issuance of a grading permit. Submit 5 copies to the
Engineering Division for Checking.

i) An easement and covenant shall be executed on behalf of the City to allow

neglect. The Real Property Section for execution by the property owner
and shall ensure that, if the property owner or subsequent owner(s) fail to
properly maintain the landscaping, the City will be able to file appropriate
liens against the property in order to accomplish the required landscape
maintenance. A document processing fee in the amount of $200.00 shall
be paid to the Real Property Section to cover processing costs. The
property owner, prior to plan approval, shall execute this easement and
'covenant unless otherwise allowed by the City Engineer.
3. Utilities
a) Design and construct all public utilities to serve the site in accordance with
City Code, City Standards and requirements of the serving utility,
including gas, electric, telephone, water, sewer and cable.
b) Each parcel shall be provided with separate water and sewer facilities so
the City or the agency providing such services in the area can serve it.
c) Backflow preventers shall be installed for any building with the finished
floor elevation below the rim elevation of the nearest upstream manhole.
d) Sewer main extensions required to serve the site shall be constructed at the
Developer's expense. -'"
e) This project is located in the sewer service area maintained by the City of
San Bernardino therefore, any necessary sewer main extension shall be
designed and constructed in accordance with the City's "Sewer Policy and
Procedures" and City Standard Drawings.
g) Utility services shall be placed underground and easements pmvided as
required.
h) A street cut permit, from the City Engineer, will be required for utility cuts
into existing streets where the street is not being repaved as part of the
required improvements.
j) All existing overhead utilities adjacent to or traversing the site on either
side of the street shall be undergrounded in accordance Section 19.30.110
(subdivisions) of the Development Code.
k) Existing Utilities which interfere with new construction shall be relocated
at the Developer's expense as directed by the City Engineer, except

overhead lines, if required by provisions of the Development Code to be
undergrounded. See Development Code 19.30.110 (subdivisions).
4. Mappin!!
a) A Final Map based upon field survey will be required.
b) All street names shall be subject to approval of the City Engineer prior to
.Map approval.
c) Additional survey and map information including, but not limited to,
building setbacks, flooding and zones, seismic lines and setbacks, geologic
mapping and archeological sites shall be filed with the City Engineer in
accordance with Ordinance No. MC-592.
5. Improvement Completion
a) Street, sewer, and drainage improvement plans for the entire project shall
be completed, subject to the approval of the City Engineer, prior to the
Map recordation.
a) If the required improvements are not completed prior to Map recordation,
an improvement security accompanied by an agreement executed by the
developer and the City will be required.
b) Street light energy fee to pay cost of street light energy for a period of 4
years shall be paid. Exact amount shall be determined and shall become
payable prior to map recording;
6. Street Improvement and Dedications-
a) All public streets within an adjacent to the development shall be improved
to include combination curb and gutter, paving, handicap ramps, street
lights, sidewalks and appurtenances, including, but not limited to traffic
signals, traffic signal modifications, relocation of public or private
facilities whi.ch interfere with new construction, striping;-shall be
accomplished in accordance with the City of San Bernardino "Street
Improvement Policy" and City "Standard Drawings," unless otherwise
approved by the City Engineer. Street lighting, when required, shall be
designed and constructed in accordance with the City's "Street Lighting
Policies and Procedures." Street lighting shall be shown on street
improvement plans except where otherwise approved by the City
Engineer.
b) For the streets listed below, dedication of adequate street right-of-way
(R.W.) to provide the distance from street centerline to property line and
placement dfthe curb line (C.L.) in relation to the street centerline shall be
as follows:

d) Cleveland Street shall be dedicated and constructed full width between
San Benito Avenue and the easterly subdivision boundary to join existing
Cleveland Street east of the tract. The subdivider shall make every effort
as required by the State Subdivision Map Act to obtain the right of way
from the property identified as Assessor's Parcel No. 0142-032-03.
e) In the event the subdivider is unable to acquire and dedicate right-of-way
for Cleveland Street from the above parcel, the City may file an eminent
domain action against the property owners or require construction of a
knuckle at the intersection of Cleveland Street and San Benito Avenue.
f) Construct 8" Curb and Gutter per City Standard No. 200 adjacent to the
site. Widen pavement adjacent to the site to match new curb and gutter.
Construct approach and departure transitions for traffic safety and
drainage as approved by the City Engineer.
g) Construct sidewalk adjacent to tlie site in accordance with City Standard
No. 202, Case "A" (6' wide adjacent to curb).
h) Construct Driveway Approaches per City Standard No. 203. Remove
existing driveway approaches that are not part of the approved plan and
replace with full height curb & gutter and sidewalk.
i) All Curb return radii shall be 25 feet minimum.
j) Construct all cul-de-sac's and knuckles in accordance with City Standard
Drawing No. 101. .
k) Install Street Lights adjacent to the site in accordance with City Standard
Nos. SL-I and SL-2.
8. Required Eneineerine Plans
a) The rough grading plan may be designed and submitted in combination
with the precise grading plan.
b) All plans submitted for plan check purposes shall be prepared on the
City's standard 24" X 36" sheets.

c) Provide the City with an electronic file of all improvement
plans/drawings. This file shall be compatible with AutoCAD 2000, and
shall be submitted with the plans for final approval.
d) Copies of the City's design policies and procedures and standard drawings

Collection Services
.
1. Residential refuse and recycling services are to be provided by the City of San Bernardino Refuse & Recycling
Division a minimum of once weekly.
2. The City shall provide upon request one set of a blue, green, and black 96 or 64-gallon automated service cart
to each single family unit, OR one set to every 2 units in multi-unit dwellings up to 8 units.
3. Commercial requirements shall apply to all multi-unit dwellings over 8 units, unless otherwise approved.
4. Nonresidential establishments such as small offices, shops, meeting halls, or churches, which generate 2 cubic
yards or less of non-bulky waste per week and are located on the same side of a residential block receiving
automated cart service shall meet residential rather than commercial requirements.
Automated Cart Storage & Access
5. Residential units shall construct a minimum 4 feet by 11 feet concrete pad located out of view of public right-
of-way for storage of each set of up to 4 automated carts. If visible from the public right-of-way, the storage
area shall be screened by landscaping, or masonry or-solid wood fencing. SHOW ON GRADING AND SITE PLANS.
6. The path of travel from the storage pad to street shall De continuously paved without step or curb with 4-foot
minimum gate openings in walls and fencing. The path of travel may include a paved driveway or patio area.

7. Projects shall meet City Engineering vehicle access requirements on all streets within a r~sidential tract. These

Curbside Service Area
8. A minimum 14-foot linear space on the street along the curb adjacent to the driveway of each residence must
be. clear for automated service carts, with a minimum 2-foot setback and 13-foot vertical clearance of all
obstructions such as structures, fences, and raised landscaping.
Gated Access
9. Gated properties that are locked and unmanned on service days anytime between the hours of 5 AM and 5 PM
Monday through Saturday shall provide access code or key to Public Services.

The proposed project is located within the Inland Empire Region of southern California in the City of San
Bernardino, San Bernardino County. The site is located east of Dallas Street, north of Seventh Street,
south of Etiwanda Avenue, and west of San Anselmo Avenue. Specifically, the project site is located within
the southwest corner of Section 6, Township 1 South, Range 4 West, in the San Bernardino meridian.

Implementation of the proposed project will result in the development of a 29 unit single-family residential
subdivision located within an already established residential community. The site encompasses about
6.78 acres and the allowable density is 4.5 units per acre, or 30 units. The proposed project also includes
the extension of San Carlo Avenue and San Benito Avenue north through the project site, and the
extension of Cleveland Street west across the project site. Construction activities are also to include the
provision of all project related appurtenances, including curb and gutter improvements, installation of water
and sewer lines, etc.
The 6.78-acre site lies within an already urbanized setting, and is contiguous with the surrounding
residential developments. The site i~ currently vacant, with no structures existing onsite. The site
presently slopes to the south with runoff from the site flowing to Seventh Street and then to the through
the area drainage system to the Lytle Creek channel. The northerly lots will be elevated through grading
so they will drain to Etiwanda Avenue. On existing home on the project site will remain on a newly created

lot (lot 20) in the subdivision. Based on existing grading calculations, about 250,000 cubic yards of grading
cut and fill will occur, with about 6,500 cubic yards of fill material needed to be imported to the project site
to accomplish the ultimate elevations of the project site. The grading for each pad will incorporate
sufficient detention to r'etain about three-quarters of an inch of rain over each parcel. Thus, retention will
occur on each of the 29 lots and will ensure that storm runoff will not increase when the project site is fully
developed.

portion of the project site. The remainder of the site is vacant. The site is surrounded by residential
development in all directions. Etiwanda Avenue forms the northern project site boundary. Currently,
access to the site exists at the northern, southern. an'(fMstern site boundaries from Etiwanda Avenue, San
Carlo Avenue, San Benito Avenue, and Cleveland Street, all streets located within the City of San
Bernardino.

Since the proposed development is greater than one acre, the developer must submit a Notice of Intent
(NOI) to the State Water Resources Control Board for a General Construction Permit, NPDES Permit
(National Pollution Discharge Elimination System) permit. This permit is granted automatically by submittal
of an NOI to the State Board, but is enforced through a Storm Water Pollution Prevention Plan (SWPPP)
that identifies construction best management practices for the site. The Regional Board enforces the
SWPPP. Other than this permit, no other permits have been identified for the development of this site.

d Air quality in the South Coast Air Basin (SoCAB) is currently in nonattainment for two pollutants: ozone and
particulates. The South Coast Air .Quality Management District (SCAQMD) adopted its most recent Air Quality
Management Plan (AQMP) is 2003, and it is designed to bring the SoCAB into attainment with all federal air
quality standards by 2010. It is in this context that emissions from individual projects are considered under
CEQA. The AQMP and related plans adopted by the Southem California Association of Governments (SCAG),
such as the Regional Comprehensive Plan and Guide (RCPG), are being implemented in such a manner that
existing emissions within the SoGAB, plus those emissions associated with forecast growth that is consistent
with these regional plans over the next six years, will allow the SoGAB to be in attainment by 2010.
The proposed project includes the development of approximately 6.78 acres of land owned by the project
proponent. Development of this property is proposed to include up to 29 units of single-family residential.
BUilding construction assumes the following structures will be built during the construction phase on the project
site: 29 single-family residential units and associated roadways.
The SGAQMD establishes a 177 acre quarterly area of disturbance. The proposed project will be graded over
a period of 30-60 days with an estimated total of 6.78 acres of disturbance. Assuming 26 Ibs/day of PM10
emissions per acre, seven acres would generate 182 Ibs. of PM10 emissions without any mitigation.
Implementation of the following measures can reduce fugitive dust emissions by at least 50%, or to 911bs/day
of PM10 emissions well below the threshold.

1/I.a-9 The project will comply with regional rules such as SCAQMD Rules 403 and 402 which
would assist In reducing short-term air pollutant emissions. Rule 403 requires that
fugitive dust be controlled with best available control measures so that the presence of
such dust does not remain visible in the atmosphere beyond the property line of the
emission source. Rule 402 requires dust suppression techniques to be implemented to
prevent fugitive dust from creating a nuisance off site. These dust suppressloll techniques
are summarized below.
a. Portions of the construction site to remain inactive longer than a period of three
months will be seeded and watered until grass cover is grown or otherwise stabilized
in a manner acceptable to the City.
b. All onsite roads will be paved as soon as feasible or watered periodically or chemically

securely covered to prevent excessive amounts of dust.
d. The area disturbed by clearing, grading, earth moving, or excavation operations will
be minimized at all times.
1/I.a-10 All material stockpiles subject to wind erosion during construction activities, that will not
be utilized within three days, will be covered with plastic, an alternative cover deemed
equivalent to plastic, or sprayed with a nontoxic chemical stabilizer.

The operation of the proposed development will result in a minimal increase air emissions. Increased criteria
pollutant air emissions will result from the following operational sources. SCAQMD uses 166 residential units
as being the threshold for potentially significant air emissions. The proposed project with 29 units would
generate a maximum of 290 vehicle trips per day and area source emissions would be very low for an infill
residential project of this site. No potential exists for significant project specific or cumulative air emissions to
be generated by this proposed project. No operational air pollutant mitigation measures will be required for this
project.
Both the construction and operation emissions of the proposed project will fall below SCAQMD significance
thresholds and will not individually or cumulatively Contribute to significant air quality impacts.
III.e During construction, the proposed project includes operations that will have diesel odors associated with
equipment and materials. None of these odors are permanent, nor are they normally considered so offensive
as to cause sensitive receptors to complain. Diesel fuel odors from construction equipment and new asphalt
paving fall into this category. Both based on the short-term of the emissions and the characteristics of these
emissions, no significant odor impacts are forecast to result from implementing the proposed project.

highly disturbed by grading and weed control in the past. No potential exists for adverse impacts to

Discussion:
Vl.a The proposed project site is relatively flat. No portion of the proposed project site exceeds a 15 percent slope.
Therefore, substantial cut and fill activities will be required to prepare this site for future residential development.
No significant impact can be identified snd no mitigation is required.

c According to the City's General Plan, the proposed project is located west of the San Jacinto Fault System,
which is an Alquist-Priolo Special Studies Zone. To date no site specific geotechnical investigation has been
conducted, but the City's Special Studies Zone map indicate that the site will not be SUbject to significant fault
rupture hazard. On the other hand the project will be exposed to significant groundshaking hazards from
regional seismic events, primarily on the San Jacinto and San Andreas Fault systems. To address this
potentially significant fault hazard on the property, the following mitigation measure will be implemented:

Construction ofthe new residences in conformance with the above mitigation measures is sufficient to reduce potential
environmental impacts to a less than significant impact level.

VlIl.a The proposed project Is not forecast to generate any wastewater, other than domestic wastewater. The
domestic wastewater will be delivered into the existing sewage system serving the existing residences. The
domestic sewage will be delivered to the City's regional wastewater reclamation facility located south of the
intersection of Arrowhead Avenue and Orange Show Road. This plant discharges to the RIX facility in south
Colton which currently operates in conformance with its existing discharge requirements. The proposed project
will not result in a potential for violating water quality standards or waste discharge requirements from the
domestic wastewater that will be generated by future residential development.
The second area where this project has a potential to cumulatively contribute to violation of water quality
standards is through the discharge of storm water runoff from a proposed urban residential development. The
proposed project will discharge storm water runoff (at least that not detained on individual lots) initially to the
local streets and ultimately to Lytle Creek and the Santa Ana River. Both during construction and after
occupancy, the proposed project has a potential to contribute urban pollutants (sediment, fertilizers, trace
metals, pesticides, oil, grease and trash and other materials) to these streams and cause violations of water
quality standards established for these streams in the Water Quality Control Plan (Basin Plan) adopted by the
Santa Ana Regional Water Quality Control Board in 1995. As for all new project, the proposed project must
comply with Storm Water Regulations for new developments. Construction-related water quality impacts are
regulated through the National Pollutant Discharge Elimination System (NPDES) program that is managed
through the implementation of a Storm Water PollutlQn Prevention Plan (SWPPP).
The SWPPP is a mandatory component for complying with the General Construction Permit (Permit) issues
through the State Water Resources Control Board through the submittal of a Notice of Intent. Since the SWPPP
is mandatory, a mitigation measure is not required to ensure that it is prepared. The SWPPP must include a
visual monitoring program, a chemical monitoring program for "non-visible" pollutants to be implemented if there
is a failure of BMPs, and a sediment monitoring plan. However, the specific best management practices (BMPs)
to control pollutant discharges during construction and the degree of control over pollutants, such as trash or
sediment, are not specified. Therefore, the following mitigation measure will be implemented to control potential
level of pollutant discharges from the project site to a less than significant level.
V111.a-1 The project proponent will select best management practices from the' City's standard
BMP measures. These BMPs.shall achieve an SO-percent reduction in sediment relative
to an uncontrolled condition. The SWPPP and specific BMPs shall be approved by the
City prior to ground disturbance.
Potential long-term water quality impacts generated from new urban development are regulated through a water
quality management plan implemented to conform with City and County requirements for the Middle Santa Ana
Watershed Management Area established by the Santa Ana Regional Water Quality Control Board (Regional
Board). If the proposed project contributes substantial urban pollutants to storm water runoff after it is
developed and occupied, it could cause a violation of the MS4 permit issued to the County and City for non point
source discharges. i.e., those discharges from the land, whether developed or not. To ensure thatthe proposed
project will not make a cumulatiVely considerable contribution of water pollutants after the site is developed and
occupied, the following mitigation measure will be implemented.

The proposed project will obtain water from the City of San Bernardino Municipal Water Department, which has
a water line adjacent to the property in Seventh Street. The project's use of domestic water from the
Department is not forecast to result in any significant effects on groundwater as the City must limit pumping to
allocated water rights, plus imported water offsets. At this time the City has adequate water supplies to ensure
that the groundwater table is not significant lowered. Further, the project site does not serve as a major
groundwater recharge site and the conversion of the site to residential use will not cause a substantial loss of
water recharge to the groundwater aquifer. No mitigation is required.
VlIl.c The project site is located in an upland area, so no potential exists for the implementation of the project to alter
the course of a stream or river. All on-site flows will be captured within the proposed lots or the curb and gutter
system. The Storm Water Pollution Prevention Plan (SWPPP) has been prepared and will be implemented to
ensure that both short- and long-term storm runoff discharges are not unacceptably degraded by sediment or
other pollutants.
VlIl.d The project will result in changes in absorption rates and the rate and amount of surface runoff from the project
site. With the introduction of concrete slabs and pavement, there will be a decrease in surface permeability by
impermeable surfaces. Design measures, includli11l the detention of rainfall on the individual lots and as
identified in the project SWPPP, will be incorporatedQn the site to ensure that downstream flows will not be
significantly increased, so that no significant impacts are anticipated as a result of this project. A portion of
Development Impact Fees will be utilized for required storm water management systems downstream. No

XlIl.a The project site is served by the City of San Bernardino Fire Department. The closest station to the project site
is Fire Station #9, located at 202 Meridian Avenue. This station is on the south side of Foothill Boulevard and
within three miles of the project site. Implementation of the proposed project will result in a less than significant
impact to fire services. The project will incrementally add to the existing demand for fire services. However,
an infill residential project constructed in accordance with current building standards is not forecast to cause a
cumulatively considerable significant impact on fire protection services in the City.
The City of San Bernardino and surrounding area have a high quality of emergency response resources that
can provide rapid medical aid should an accident occur at the project site. In addition, the area has several
hospitals that are equipped to provide emergency medical response. These include: Loma Linda Hospital;
Arrowhead Regional Medical Center; Community Hospital; and St. Bemardine's Hospital. All of these facilities
have adequate emergency response c!lpabilities to provide medical aid for residents without experiencing a
significant impact to their capacity to provide such aid. No mitigation is required. The City of San Bernardino
Police Department would provide law enforcement service to the project sRe. The proposed project is a
residential developmentto be located within an already urbanized community. The proposed project would have
law enforcement services available from the City of San Bemardino's Police Department. The project area is
served by the Community Services Office located on Foothill Boulevard. Implementation ofthe proposed project
will result in a less than significant impact to police services. The project will incrementally add to the existing
demand for police services and/or the need for new facilities. But the demand created by an infill residential
project is not forecast to cause significant adverse environmental impacts on the law enforcement service

trip generation would be 290 trips per day, with about 30 trips during the AM and PM peak hours. This volume

significant project specific or cumulative impact on the City's circulation system.

The proposed project will have four access points at the northern, southern, and eastern site boundaries from

the project site, and the extension of Cleveland Street west across the project site. These are logical
modifications in the roadways, so no disjointed pattern of roadway improvements will occur and no unusual
hazards will be created. More than adequate access will be provided by the local road system. Temporary
circulation impacts resulting from construction activities may occur. During construction activities. the traffic
flowwill be maintained to the highest level possible with the use of standard traffic control devices. The following
mitigation measure will be implemented.
xv.f-1 The City of San Bernardino shall require that a construction traffic management plan for
worle in public roads that complies with the Worle Area Traffic Control Handbook or other
applicable City standards to provide adequate traffic control and safety during
construction activities. The standard of measurement for the plan shall be the provision
of safe, albeit inconvenient, traffic flow during construction and the provision of adequate
access through construction areas, or adequate detour routes, to meet safety and
emergency vehicle access and transit through construction areas at all times when
construction is underway for any components of the proposed project.
Implementation of traffic control measures will provide guidance and navigational tools throughout the project
area in order to maintain traffic flow and levels of safety during construction.
XV.f The proposed project is not forecast to result in inallequate parking capacity. Each residence and the local
streets will provide adequate parking for single-family residences in accordance with Chapter 19.14 of the City
Development Code. No mitigation is required.

a-e Implementation of the project will result in an incremental system capacity demand for energy systems,
communication systems, water distribution systems, storm water drainage systems, street lighting systems,
maintenance of public facilities, including roads and potentially other governmental services. These impacts
are considered less than significant based on the availability of existing public faciltties (drainage facilities) that
support local systems. Specifically, adequate electricity, natural gas and communications systems are available
for the proposed project and the distribution systems are located in adjacent roadways. Water and sewer
distribution or collection systems are available in the adjacent streets and the regional treatment plant has

delivered to a landfill and incorporated into the County's green waste management program. The one structure
on the site will be demolished and the demolition waste will be recycled to the extent feasible. After developed,
the project will generate typical domestic solid waste that will be taken to existing landfills (MidValley and San
Timoteo) with capacity extending more that the five year planning period into the future. No significant solid
waste issues or impacts are posed by the proposed project. No mitigation is required as recycling requirements
are mandated by local jurisdictions in accordance with adopted Source Reduction and Recycling programs.
XII.g All required utility infrastructure is available either adjacent to the site or nearby. No major extension of utility
infrastructure will be required to support this project, so no adverse pattern of utility extensions can result from

a-c The City of San Bernardino is considering a 29-lot subdivision that will be constructed on an approximate 6.78
acre lot in southwest portion of the City. The site is surrounded by residential development (all directions) and
represents an infill parcel of residential development. Most of the impacts associated with the proposed project
are related to constructing the new subdivision. Once occupied it will be consistent with the surrounding
residential development. The potential impacts of implementing the proposed project have been evaluated in
this Initial Study. Based on the llonalysis in this document, Tentative Tract Map 16947 can be implemented
without causing significant adverse environmental effects with implementation of mitigation measures oullined
above. The City will require the implementation of all identified mitigation measures to ensure that potentially
significant impacts from constructing and occupying the proposed project will not impact any of the following
resource values or physical conditions that occur at the project site: earth resources, hydrology and water
quality, air quality, transportation/circulation, hazards, and noise.
With mitigation, the proposed project is not forecast to cause any significant adverse environmental impacts to
any ofthe environmental resource issues addressed in this Initial Study. The City proposes to issue a Negative
Declaration with mitigation as the appropriate environmental determination for this project to comply with the
. California Environmental Quality Act. A Notice of Intent to adopt a Negative Declaration will be published and
a 21 day public review will be conducted. After review and response to any comments, the City will adopt a
Negative Declaration unless the comments identify a significant adverse impact not yet identified in this Initial
Study. .

TENTATIVE TRACT MAP NO. 16947
MITIGATION MONITORING AND REPORTING PROGRAM
This Mitigation and Monitoring and Reporting Program has been prepared to implement the
mitigation measures outlined in the Environmental Assessment for Tentative Tract Map
16947, Subdivision 04-15. This program has been prepared in compliance with the California
Environmental Quality Act (CEQA) and the State of California and City of San Bernardino
CEQA Guidelines.
CEQA Section 21081.6 requires adoption of a monitoring and/or reporting program for those
measures or conditions imposed on a project to mitigate or avoid adverse effects on the
environment. The law states that the monitoring or reporting program shall be designed to
ensure compliance during project implementation.
The Mitigation Monitoring and Reporting Program contains the following elements:
1. The mitigation measures are recorded with the action and procedure necessary
to ensure compliance. The program lists the mitigation measures contained
within the Initial Study.
2. A procedure for compliance and verification has been outlined for each
mandatory mitigation action. Thi~ procedure designates who will take action,
what action will be taken and when, and to whom and when compliance will be
reported.
3. The program contains a separate Mitigation Monitoring and Compliance Record
for each action. On each of these record sheets, the pertinent actions and dates
will be logged, and copies of permits, correspondence or other data relevant will
be retained by the City of San Bernardino.
4. The program is designated to be flexible. As monitoring progresses, changes to
compliance procedures may be n necessary based upon recommendations by
those responsible for the program. If changes are made, new. monitoring
compliance procedures .and records will be developed and incorporated into the
program.

at least two times per day. On days where wind speeds are sufficient to transport fugitive
dust beyond the working area boundary. the City will require contractors to increase
watering to the point that fugitive dust no longer leaves the plOperty (typically a moisture
content of 12""), and/or the contractor will tenninate grading and loading operations.
lII.a-9 The PIOJect will comply with regional rules such as SCAQMD Rules 403 and 402 which
would assist in reducing short-tenn air pollutant emissions. Rule 403 requires that'
fugitive dust be controlled with best available control measureS so that the presence of
such dust does not remain visible in the atmosphere beyond the PlOperly line of the
emission source. Rule 402 requires dust suppression techniques to be.implemented to
prevent fugitive dust from creating a nuisance off site. These dust suppression techniques
are summarized below. .
a. Portions of the construction site to remain Inactive longer than a period of three
months will be seeded and ~atered until grass cover is glOwn or otherwise stabilized
in a manner acceptable to the City.
b. All onsite lOads will be paved as soon as feasible or watered periodically or chemically
stabilized.
c. All material transported flOm or to the site will be either sufficientiy watered or
securely covered to prevent excessive amounts of dust.
d. The area disturb;d by clearing. grading. earth moving. or excavation operations will
be minimized at ill times.
lII.a-10 All material stockpiles subject to wind elOsion during construction activities. that will not
be utilized within three days, will be covered with plastic, an alternative cover deemed
equivalent to plastic. or sprayed with a nontoxic chemical stabilizer.

project through the Public Works and Building Services Divisions. The applicant
will be required to comply with all Public Works and Building Services Standard

measure (notes 1 - 10) are incorporated as notes on the grading plans approved
for the project.
3. The City Engineer will review all grading plans prior to issuing a grading permit.

Spectra Homes' attempts to acquire land required for the completion of Cleveland Drive
on Tentative Tract Map 16947.
We have utilized two sources to contact Mr. Louis Loza and Ms. Kenia Canales, owners
of2423 Etiwanda Avenue, San Bernardino, our realtor representatives at Baldwin Realty
Services, as well as a representative from our. Civil Engineer, Law Offices of Loren
Philips/Phillips and Associates, Inc.
As you will see our first contact was in March 2004. Initially a letter was sent in early
March, then when no response was received, a personal visit to the owners in late March.
Then, after our meeting with the DER/C in November, an attorney of similar Hispanic
background visited and met with the owners in late November.
The results of all contact to date is consistent, the owners state they are not interested in
selling off a part of the rear portion of their lot, APN 0142-032-03.
We have not made any attempts to communicate with the owners since late November
and will await notification from the City on how they would like us to move forward.

On February 9, 2005, we received your e-mail advising that several residents
had voiced concern at the Planning Commission regarding drainage problems
along ih Street which they feel will be aggravated by construction of the
proposed tract.
We visited the site and talked with Ms. Jacob's, a resident at 2430 W. ih
Street. She pointed out ponding in the gutter in front of her house. Uplifting of
the curb by tree roots causes the ponding. She stated that the ponding never
goes away due to nuisance drainage from existing properties to the west. She
said the she fears the new subdivision, when completed, will compound the
problem.
I've asked the Public Services Department to review the problem and
determine if they can remove and reconstruct the curb and gutter at Ms.
Jacob's property so that is will drain properly.
ih Street is an existing residential street, which runs east west. It was
constructed in 1956 on a very flat grade of 0.30%. Current design standards
would require, a minimum grade of 0.50%; however, the desirable minimum
longitudinal street grade is 1.0%.
During our field review, ponding at various locations along the street was
observed. Ponding at some locations was worse than the ponding observed in
from of Ms. Jacob's house. The flatness of the street grade is such that tree
leaves or other debris in the gutter will cause ponding of the nuisance drainage
water.
I reviewed the Initial Study for proposed Tentative Tract No. 16947 and found
paragraph IV.I that states "No other hydrology or water issues are known to
affect the project site or to be affected by the proposed project". The City
Engineer concurred with this assessment since there is enough street capacity
available to carry drainage that will be generated by proposed Tentative Tract

No. 16947. It is possible that the street may be partially flooded during major
storms, however, that is not an unusual occurrence.
Based on the flatness of the street, there is no easy fix for the ponding
problems. The area-wide solution to the drainage problem is construction of
Master Plan storm drain Project No. 3-2 in 6th Street and in Meridian Avenue.
The cost of such a storm drain is estimated to be $3,600,000; however, the
nuisance ponding will still be a problem.
Unfortunately, ponding problems such as this are common in the older areas of
town where tree roots have uplifted the curbs. More frequent street sweeping
may alleviate the problem somewhat. It is usually requested that adjacent
residents along impacted streets assist by keeping the gutter cleaned of debris;
however, there is no easy permanent solution to the problem.

That the hearing be closed; that the Mayor and Common Council adopt the
Mitigated Negative Declaration and the Mitigation Monitoring/Reporting
Program; and that the Mayor and Common Council approve Tentative Tract Map
No. 16947 and Development Permit III No. 04-44, based upon the Findings of
Fact contained in the Planning Commission staff report dated February 8, 2005,
subject to the Conditions of Approval, amended to delete Condition No. 12
(block wall) and expand Condition No. 11 to include construction of a 6-foot
vinyl fence (both sides) along the rear property line of APN: 0142-032-03, if
Cleveland Street is extended, and Standard Requirements, which includes
initiation of eminent domain proceedings.
