Recommended Motion:

Staff Report
Subject:
Resolution of the Mayor and Common Council of the City of San Bernardino requesting that the
City of San Bernardino's Primary Election be consolidated with the Novernber 8, 2005
Consolidated Election conducted by the County of San Bernardino.
Background:
The following City offices are up for election in November 2005: Office of the Mayor and
Council seats in the First, Second and Fourth Wards.
In 1992, City Charter Section 10 was amended to change the dates of the City's primary election
from March of odd-numbered years to November of odd-numbered years and the general
election dates from May to February. As a result of this change, the City has been able to
consolidate its primary elections with the County's UDEL (Uniform District Election Law)
elections and thereby save considerable expense by not having to conduct stand-alone elections.
A couple of changes have taken place that will impact our next municipal election. First of all,
15 school districts, including San Bernardino Unified School District, petitioned the County
Board of Supervisors to allow their fall elections to be postponed until 2006. Their request was
approved on AprilS, 2005. As a result of this change, our next regular municipal election will
be consolidated with a fewer number of jurisdictions thereby increasing our cost for the
November election by an estimated 40 percent.
Additionally, the State's primary has been moved from March of the even numbered years to
June,and that change takes effect in 2006. This means that if a runoff election is required in any
of our City races, it will have to be conducted as a stand-alone election and it will take place on
the second Tuesday after the first Monday in February (2/7/06), pursuant to Article II, Section 10
of the City Charter. Newly-elected or re-elected officers will assume office on Monday, March
6, 2006.
Elections Code Section 10403 requires that a resolution requesting consolidation must be filed at
least 88 days prior to the date of the election. The 88th day prior to the November 8, 2005
election falls on August 12, 2005.
Nomination papers will be issued by the City Clerk's Office; however, the County Registrar of
Voters Office will designate polling places, issue absentee ballots, conduct the election, tally
votes, and conduct the canvass. The nomination period opens Monday, July 18, 2005, and closes
on Friday, August 12,2005. Elections Code Section 10225 requires that if an incumbent officer
does not file nomination papers by the 88th day prior to an election, then the nomination period
for that office is extended to the 83rd day before the election.
Financial Impact:
Cost of the primary election was originally estimated at approximately $68,500; however, with a
40 percent increase in cost, the estimated cost is now $95,900, and we will request funding in the
FY 2005/2006 budget for that primary election. Estimated cost for a runoff election will depend
on whether it is a city-wide runoff election and/or how many wards are involved in the runoff
election.

A.
On June 2, 1992, the voters of the City of San Bernardino voted to amend City
numbered years to November of odd-numbered years and the general election dates from May
to the following February.
B.
Section 2.56.010 B of the San Bernardino Municipal Code provides that a
primary election shall be held on the first Tuesday after the first Monday in November 1997,

four years thereafter, in the City for the nomination of candidates for the following offices:
1. Mayor;
2. Member of the Common Council from the First Ward;
3. Member of the Common Council from the Second Ward;
4. Member of the Common Council from the Fourth Ward.

It is desirable that the City of San Bernardino's primary election be consolidated
November 8, 2005; that within the City of San Bernardino the precincts, polling places and
election officers for the two elections be the same; that the Registrar of Voters of the County

SECTION 2. Primary Election Called. A primary election is called and will be held
in the City of San Bernardino on Tuesday, November 8, 2005, for the purpose of nominating

8 candidates for the following offices:

I. Mayor;
2. Member of the Common Council from the First Ward;
3. Member of the Common Council from the Second Ward;
4. Member of the Common Council from the Fourth Ward.

SECTION 3. Request for Consolidation of Elections.
Pursuant to Section 10400 of
that the Board of Supervisors of the County of San Bernardino consolidate the City's primary
17 election with the consolidated election to be held on Tuesday, November 8,2005.

The polls for said election shall be open from 7 a.m. of the day of said election and
shall remain open continuously from said time until 8 p.m. of the same day when said polls
21 shall be closed, except as provided in Section 14401 of the California Elections Code.

SECTION 4. Canvass of Returns.
The Registrar of Voters of the County of San
23 Bernardino is hereby authorized to canvass the returns of the primary election called by this
24 resolution and to conduct the primary election in all respects as if there were only one election
25
with only one form of ballot. Results of the primary election shall be certified to the Mayor
26
and Common Council of the City of San Bernardino.

3 SECTION 5. Notice of Election. The City Clerk is hereby directed to publish a

B. The offices to be filled, specifying full term or short term.
C. The hours the polls will be open.
SECTION 6. Conduct of Election.
The primary election called by this resolution

Registrar of Voters of the County of San Bernardino. The Board of Supervisors of the County
of San Bernardino is hereby requested to issue instructions to the Registrar of Voters to take all
steps necessary for the holding of the consolidated election. The Mayor is hereby authorized

C 15 to execute a contract for the services necessary for conducting the primary election. The City
16 of San Bernardino recognizes that additional costs will be incurred by the County by reason of

this consolidation and agrees to reimburse the County for any such costs.
SECTION 7. Filing of Resolution.
The City Clerk of the City of San Bernardino is
directed to file a certified copy of this resolution with the Board of Supervisors of the County
