Staff Report
Subject:
Resolution awarding a contract to MCC Equipment Rentals, Inc. for Storm Drain Improvements at Serrano
Middle School, (SD06-0 1), per Plan No. 11555.
Background:
On August 15, 2005, the Mayor and Common Council allocated funds, as part of the FY 2005/06 Capital
Improvement Program (CIP), for Storm Drain Improvements at Serrano Middle School, (SD06-01), per Plan
No. 11555.
This project consists of the following:
1. Removal of turf and corrugated metal pipe.
2. Construction of reinforced concrete pipe, concrete collars, and a manhole.
3. Replacement of turf and existing improvements.
An existing underground 24-inch Corrugated Metal Pipe (CMP) storm drain conveys drainage from a catch
basin in Piedmont Drive at Central Avenue across the grounds of Serrano Middle School. The storm drain has
failed at some locations on the school grounds. The City has a drainage easement through the property, and
school officials have requested that the storm drain be replaced.
The plans and specifications for this project have been completed and the project opened to public bidding on
October 11, 2005. The project was advertised locally in the San Bernardino County Sun Newspaper, F. W.
Dodge, High Desert Plan Room, Construction Bid Board, Reed Construction Data, Bid America, Construction
Bid Source,Bid Ocean and the City's web sites, and with the San Bernardino Area Chamber of Commerce.

Based on review of the sealed competitive bids received, staff has determined that MCC Equipment Rentals,
Inc. of Beaumont, the apparent low bidder, has met the minimum requirements of the specifications and bid
guidelines; and, therefore, recommends that the Mayor and Common Council award the referenced contract to
MCC Equipment Rentals, Inc.
Financial Impact:
The estimated project costs are as follows:
TOTAL
Construction Bid $ 91,350.00
Contract Management and Inspection(Approx. 15%) $ 13,702.50
Contingencies (Approx. 15%) $ 13,947.50
Estimated Total Project Cost $119,000.00
If approved, this project is expected to begin construction in late December of 2005 and be completed by
February of 2006.
Adequate funding for this project is available in FY 2005/2006 CIP, SD06-01, "Storm Drain Improvements at
Serrano Middle School".
Recommendation:
Adopt Resolution.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
3 BERNARDINO AWARDING A CONTRACT TO MCC EQUIPMENT RENTALS, INC.
4 FOR STORM DRAIN IMPROVEMENTS AT SERRANO MIDDLE SCHOOL, (SD06-
01), PER PLAN NO. 11555.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
6 CITY OF SAN BERNARDINO AS FOLLOWS:
7 SECTION 1. MCC Equipment Rentals, Inc., 484 "B" Street, Beaumont, CA 92223, is
8
the lowest responsible bidder for Storm Drain Improvements at Serrano Middle School, (SD06-01),
9
per Plan No. 11555.

11 A contract is awarded accordingly to said bidder in a total amount of 591,350.00, with a
12 contingency amount of $13,947.50, but such award shall be effective only upon being fully
13 executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby
14 authorized and directed to execute said contract on behalf of the City; a copy of the contract is
15 on file in the office of the City Clerk and incorporated herein by reference as fully as though set
16 forth at length.

18 SECTION 2. This contract and anv amendment or modifications thereto shall not take
19 effect or become operative until fully signed and executed by the parties and no party shall be
20 obligated hereunder'until the time of such full execution. No oral agreements, amendments,
21 modifications or waivers are intended or authorized and shall not be implied from any act or
22 course of conduct of any party.
23 SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
24
within sixty (60) days of passage of the resolution.
