Synopsis of Previous Council Action:
5/02105: Resolution 2005-99 was adopted requesting that the City's primary election be
consolidated with the November 8, 2005 consolidated election.
Recommended Motion:
1. Adopt Resolution and
2. That the Mayor and Common Council authorize the Director of Finance to
amend the FY 05/06 Budget and appropriate $290,000 from the General
Fund's undesignatedlunreserved fund balance to Account No. 001-032-5502

Subiect:
Resolution of the Mayor and Common Council of the City of San Bernardino
requesting that the Board of Supervisors of the County of San Bernardino permit
the County Registrar of Voters to render. services to the City of San Bernardino
relating to a General Municipal Election to be held on February 7, 2006.
Backl!round:
Elections Code Section 10002 provides that the governing body of any city may by resolution
request the County Board of Supervisors to permit the county elections official to render
specified services to the city relating to the conduct of an election.
The City's primary municipal election was consolidated with the Consolidated Special Statewide
Election held on November 8, 2005 and was conducted by the Registrar of Voters Office.
Section 10 of the City Charter states, in part, "...a general election shall be held in said City on
the first Tuesday in February of the following even numbered year for the election of City
Officers. ..." .
In 1999, Section 14-B was added to the Charter and it allows the City to consolidate the City's
General election with the County whenever a County-wide election is scheduled to be held
within sixty (60) days after the date which a City general election would otherwise be held
pursuant to the Charter. For the past five years, the City has been able to consolidate its runoff
elections, also known as general elections, with the State's primary election in March of the
even-numbered years. However, beginning in 2006, the State's primary elections will be moved
to June, thereby leaving us in a position where we will have to conduct a stand-alone election.
Consolidating elections allows us to share in the cost of conducting the election with all
participating jurisdictions; however, with a stand-alone election, the City has to bear the entire
cost. Perhaps it might behoove the Legislative Review Committee to begin looking at possible
Charter changes to our election cycle or consider eliminating runoff elections.
The last time we had a runoff (General) municipal election was on March 7, 2000 when we
consolidated with the County to hold the runoff election for the 7th Ward Council seat. The last
citywide runoff election took place in February 1998 for the Mayor's seat and at that time we
had 62,674 registered voters.

As of this date, November 22,2005, there are 71,671 registered voters in the City of San
Bernardino and the Registrar of Voters Office estimates that the runoff election will cost from
$3.25 to $4.00 per voter.
Financial ImDact: $232,930 to 286,684, calculated at $3.25 to $4.00 per voter. We budgeted
$95,900 in the FY 05/06 budget for the November 8, 2005 primary election; however, no funds
were appropriated for a runoff election and it was recommended that we wait to see the outcome
of the primary election and then request a budget amendment if one waS needed.
The cost of the primary election will be prorated among participating entities; however, as
previously noted, the City will have to bear the entire cost of the February 7, 2006 runoff
(General) election. The Registrar of Voters' Office estimates that it will be approximately six to
eight weeks before we receive the billing for the primary election.
Recommendation:
Adopt the following motions:

SERVICES TO THE CITY OF SAN BERNARDINO RELATING TO A GENERAL
MUNICIPAL ELECTION TO BE HELD ON FEBRUARY 7, 2006.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS;
SECTION 1. Request for Countv Services. As authorized by Section 10002 of the
Elections Code of the State of California, the Mayor and Common Council request that the
Board of Supervisors of the County of San Bernardino permit the County Registrar of Voters to
furnish services and supplies to this City for the General Municipal Election to be held on
February 7, 2006.
SECTION 2. Conduct of Election. The general municipal election shall be held in such
precincts and at such polling places as shall be determined by the City Clerk of the City of San
Bernardino and the Registrar of Voters ofthe County of San Bernardino.
The polls for said election shall be open from 7:00 a.m. of the day of said election and
shall remain open continuously from said time until 8:00 p.m. of the same day when said polls
shall be closed, except as provided in Section 14401 of the California Elections Code.
The Registrar of Voters shall prepare and furnish necessary services and supplies in
sufficient time to comply with all requirements of the California Elections Code, the California
Government Code, the Constitution of the State of California, the Charter of the City of San
Bernardino, and the San Bernardino Municipal Code.

The City shall reimburse the County of San Bernardino for services performed when the
work is completed and upon presentation of a properly approved bill.
SECTION 3. Services Requested. The Registrar of Voters is requested to provide the
following services:

SECTION 4. Canvass of Returns. The Registrar of Voters of the County of San
Bernardino is hereby authorized to canvass the returns of the general municipal election.
Results of the general municipal election shall be certified to the Mayor and Common
Council of the City of San Bernardino.
SECTION 5. Filing of Resolution. The City Clerk of the City of San Bernardino
shall transmit certified copies of this resolution to the Board of Supervisors and the
Registrar of Voters of the County of San Bernardino.
