No.) Finance: Council Notes: CJW ./Jrn(._ /I"'~ -#/(0 fjI6/0r; DCA 04-01 & CUP 04-07 RFCA Page 2 CITY OF SAN BERNARDINO - REOUEST FOR COUNCIL ACTION STAFF REPORT SUBJECT: DEVELOPMENT CODE AMENDMENT NO. 04-01 CONDITIONAL USE PERMIT NO. 04-07 Owner/ Applicant: Steve Felderman SBT Partners 1117 Second Street Santa Monica, CA 90403 310-260-2425 BACKGROUND: The applicant is requesting that the Mayor and Common Council approve Development Code Amendment No. 04-01 to modify Development Code Chapter 19.22 (Sign Regulations), Sections 19.22.030, 19.22.150 and Table E.022.01 to allow for up to six tenants on monument and pylon signs for projects over 20 acres and to modify the definitions of tenants. Also requested for approval is Conditional Use Permit No. 04-07 to construct a second freeway pylon sign to match an existing sign. The project site is located along both sides of Harriman Place west of Tippecanoe A venue in the CR-3, Commercial Regional land use district (Exhibit A). Please refer to the Planning Commission Staff Report (Exhibit B) for additional discussion. Attachment C to the Planning Commission Staff Report outlines the proposed Development Code Amendment changes. At its meeting on June 22, 2004, the Planning Commission opened the public hearing and received public testimony on this matter. After considerable discussion, the Planning Commission made a motion to recommend approval of Development Code Amendment No. 04-01 and Conditional Use Permit No. 04-07. The Planning Commission voted 4 to 2 to recommend approval. Commissioners Durr, Thrasher, Heasley, and Sauerbrun voted in favor of the motion for approval and Commissioners, Coute, and Brown voted against the motion for approval. Commissioners Enciso and Morris were absent. The Planning Commission members who were opposed to the proposals expressed two main concerns as follows: " DCA 04-01 & CUP 04-07 RFCA Page 3 . The wording of definition of major tenant is vague and allows for the center owner to determine which tenants should go on the sign, taking control away from the City. Staff believes that the center owner/operator should make the determination of who gets signage. . Questions regarding the number of centers this could apply to, because the City only ~~~~~~~W~~~~~~~~~~ Corridor signage study. Any new center meeting the criteria would be eligible. The 1-10 Corridor Study was prepared for the County of San Bernardino and includes the west valley cities only. FINANCIAL IMPACT: None, the applicant has paid all fees associated with the Development Code Amendment and Conditional Use Permit. RECOMMENDATION: That the Mayor and Common Council close the hearing and: That the ordinance be laid over for final adoption and approve Conditional Use Permit No. 04-07 based upon the Findings of Fact contained in the Planning Commission Staff Report (Exhibit B), subject to the Conditions of Approval (Exhibit B, Attachment D). The applicant also requests approval of a Conditional Use Permit under the authority of Development Code Section 19.06.020, to construct a second freeway adjacent pylon sign at the southeast comer of the site (adjacent to the 1-10 freeway and Tippecanoe Avenue). The second freeway sign is proposed to stand about 74' tall (50' above freeway grade) and be identical to the existing sign. The project site is located on both sides of Harriman Place west of Tippecanoe A venue in the CR-3, Commercial Regional land use district (Attachments A & B). The Hub Shopping Center is a 24-acre site currently under development. The center has an existing Sam's Club and In-n-Out. Approved uses for the center area two full service restaurants (BI's and Elephant Bar), two hotel/motels (Residence Inn and Fairfield Inn both by Marriott), Tweeters (stereos, etc.) and two pad shell buildings for smaller restaurants and retail shops. One use in the center is yet to be approved, but the proposal is for a drive-through restaurant. (Attachment C). SETTING/SITE CHARACTERISTICS The site is basically rectangular in shape consisting of approximately 24-acres in total size. To the north and west of the site is commercial retail in the CR-3, Commercial Regional land use district. To the east the site-is abutted by Tippecanoe Avenue with retail commercial in the CG-1, Commercial General land use district. On the south the site is abutted by the 1-10 Freeway with the City of Lorna Linda to its south. The freeway is approximately 25' above the site of the grade at Tippecanoe Avenue. BACKGROUND The proposed project was submitted on March 18, 2004. The project was deemed complete on April 17, 2004. The applicant, EDA staff, and City staff worked together regarding the proposal in May 2004. CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) STATUS Planning staff reviewed the project under the requirements of the California Environmental Quality Act and the project has been found to be Categorically Exempt under Section 15311, as an accessory structure. Is the praposed amendment consistent with the General Plan? Yes, the proposed use is consistent with the General Plan objective: General Plan Objective 5.5 states: "Develop a consistent and well-designed program of public informational signage." The proposed amendment reflects current standards in numerous cities throughout Southern California. This proposal will allow Chapter 19.22 to be modified and updated to provide an opportunity for larger (>20 acres), regional commercial shopping centers to advertise up to six of their major tenants, rather than be limited to three as they are under current code regulations. The proposed amendment will be internally consistent with the General Plan and will accomplish the following: . Update the Sign Code to allow up to six tenants on pylon and monument signs for centers of over 20 acres, and change the definitions related to major tenants. . Provide for distinctive signage that identifies the Hub Center. 2. Would the proposed amendment be detrimental to the public interest, health, safety, convenience, or welfare of the City? No, the proposed amendment would allow regional shopping centers greater than 20 acres in size to advertise up to six major tenants on a pylon or monument sign. This proposal will be in the public interest and welfare of the City in that it will implement the objectives and policies of the General Plan. FINDINGS AND ANALYSIS FOR THE CONDITIONAL USE PERMIT 1. Is the proposed use conditionally permitted within the subject land use district, would it impair the integrity and character of the subject land use district, and does it comply with all of the applicable provisions of this Development Code? Yes, pursuant to Development Code Section 19.14.030(6), a project over five acres in size with more than 1,000 feet of freeway frontage may be permitted 2 freeway adjacent signs at the discretion of the Commission. The proposed project is accessory to a developing center that has numerous approved uses. Provided that the Conditional Use Permit is approved the proposed sign complies with all Conditional Use Pennit No. 04-07 & Development Code Amendment No. 04-01 Meeting Date: 06-22-04 Page 4 applicable provisions of the Development Code as shown below in Table" A" below. Is the approval of the Conditional Use Permit for the proposed use in compliance with the requirements of the California Environmental Quality Act and Section 19.20.030(6) of the Development Code? Yes, the proposed project has been found to be Categorically Exempt from the California Environmental Quality Act under Section 15311, as an accessory structure. Are there potentially significant negative impacts upon environmental quality and natural resources that could not be properly mitigated and monitored? No, as noted in Finding No.3, this project complies with CEQA and Development Code requirements. 5. Are the location, size, design, and operating characteristics of the proposed use compatible with the existing and future land uses within the general area in which the proposed use is to be located and will it create significant noise, traffic or other conditions or situations that may be objectionable or detrimental to other permitted uses in the vicinity or adverse to the public interest, health, safety, convenience, or welfare of the City? Yes, the proposed project will be an accessory structure to an existing center that is currently under development via a variety of land use entitlements including Conditional Use Permits and Development Permits. The proposed second sign will compliment the existing sign and allow for added visibility for the shopping center. Based upon the proposed location on-site and the architectural design of the sign the proposed project will not be adversely detrimental to the adjacent surrounding uses. The shopping center is a community and regional serving conglomeration of retail and restaurant uses, and the proposed signage will help the uses attract patrons. Since the proposed project is consistent with the General Plan and Development Code, no land use conflict or adverse environmental impacts will result from the construction and operation of the proposed project. 6. Is the subject site physically suitable for the type and density/intensity of use being proposed? Yes, the site is physically suitable for the type and density/intensity of the project being proposed as evidenced by project compliance with all applicable Development Code Standards as discussed in Finding No.1 above and illustrated in Table" A." 7. Are there adequate provisions for public access, water, sanitation, and public utilities and services to ensure that the proposed use would not be detrimental to public health and safety? Yes, all agencies responsible for reviewing access, and providing water, sanitation and other public services have had the opportunity to review the proposed shopping center, and all have indicated an ability to serve the project. The proposal will not be detrimental to the public health and safety in that all applicable Codes will apply to the construction of this project. Conditional Use Permit No. 04-07 & Development Code Amendment No. 04-01 Meeting Date: 06-22-04 Page 6 CONCLUSION The proposal meets all necessary Findings of Fact for approval of the Development Code Amendment and the Conditional Use Permit. RECOMMENDATION Staff recommends that the Planning Commission recommend that the Mayor and Common Council: . Approve Development Code Amendment No. 04-01 based upon the Findings of Fact contained in this Staff Report and subject to the Conditions of Approval (Attachment D); and . Approve Conditional Use Permit No. 04-07 based upon the Findings of Fact contained in this Staff Report and subject to the Conditions of Approval (Attachment D). Conditional Use Permit No. 04-07 & Development Code Amendment No. 04-01 Meeting Date: 06-22-04 Page 9 ATTACHMENT D CONDITIONS OF APPROVAL DEVELOPMENT CODE AMENDMENT NO. 02-10 & CONDITIONAL USE PERMIT NO. 02-29 1. The Development Code Amendment requested is to change Sections 19.22.150, Table 22.01, and 19.22.030 to allow up to six tenants on freeway signs for projects over 20 acres in size and to modify the definitions of tenants. The Conditional Use Permit is a request to construct a second freeway adjacent pylon sign at the southeast comer of the site (adjacent to the 1-10 freeway and Tippecanoe Avenue). The second freeway sign is proposed to stand about 74' tall (50' above freeway grade) and be identical to the existing sign. 2. Within two years of development approval, commencement of construction shall have occurred or the permit/ approval shall become null and void. In addition, if after commencement of construction, work is discontinued for a period of one year, then the permit/ approval shall become null and void. However, approval of the Development Code Amendment and Conditional Use Permit does not authorize commencement of construction. All necessary permits must be obtained prior to commencement of specified construction activities included in the Conditions of Approval and Standard Requirements: Expiration Date: Two years from Mayor & Common Council approval. 3. The review authority may grant a one-time extension, for good cause, not to exceed 12 months. The applicant must file an application, the processing fees, and all required submittal items, 30 days prior to the expiration date. The review authority shall ensure that the project complies with all Development Code provisions in effect at the time of the requested extension. 4. In the event this approval is legally challenged, the City will promptly notify the applicant of any claim, action or proceeding and will cooperate fully in the defense of this matter. Once notified, the applicant agrees to defend, indemnify and hold harmless the City of San Bernardino (City), the Economic Development Agency of the City of San Bernardino (EDA), any departments, agencies, divisions, boards or commission of either the City or EDA as well as predecessors, successors, assigns, agents, directors, elected officials, officers, employees, representatives and attorneys of either the City or EDA from any claim, action or proceeding against any of the foregoing persons or entities. The applicant further agrees to reimburse the City for any costs and attorneys' fees which the City may be required by a court to pay as a result of such action, but such participation shall not relieve applicant of his or her obligation under this condition. Conditional Use Permit No. 04-07 & Development Code Amendment No. 04-01 Meeting Date: 06-22-04 Page 10 The costs, salaries, and expenses of the City Attorney and employees of his office shall be considered as "attorneys fees" for the purpose of this condition. As part of the consideration for issuing this permit, this condition shall remain in effect if the General Plan Amendment and/ or the Conditional Use Permit is rescinded or revoked, whether or not at the request of applicant. 5. This permit or approval is subject to all the applicable provisions of the Development Code in effect at the time of approval. This includes (but is not limited to) Chapter 19.20 - Property Development Standards, and includes: dust and dirt control during construction and grading activities; emission control of fumes, vapors, gases and other forms of air pollution; glare control; exterior lighting design and control; noise control; odor control; screening; signs, off-street parking and off- street loading; and, vibration control. Screening and sign regulations compliance is important considerations to the developer because they will delay the issuance of a Certificate of Occupancy until they are complied with. Any exterior structural equipment, or utility transformers, boxes, ducts or meter cabinets shall be architecturally screened by wall or structural element, blending with the building design and include landscaping when on the ground. 6. If the color of any of the signs or other exterior finish material is to be modified, the revised color scheme and/ or finish materials shall be reviewed and approved by the Planning Division prior to commencement of work. ATTACHMENT E CHAPTER 19.22 SIGN REGULATIONS Specifically, the proposed amendment will modify the following: I. Section 19.22.030, Definitions, will be modified to change the definitions as follows: Existing: Anchor Tenant - A shopping center key tenant, usually the largest or one of the largest tenants located within the shopping center, which serves to attract customers to the center through its size, product line, name, and reputation. The term anchor tenant is interchangeable with the term major tenant. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO . DO ORDAIN AS FOLLOWS: SECTION 1. Chapter 19.22, Sections 19.22.030, and 19.22.150, Table 22.01(C)(3)(a-c) of the Municipal Code (Development Code) is amended to modify the sign requirements for regional and local shopping centers and freeway multi-tenant signs as shown in Attachments I and 2 attached hereto and incorporated herein by reference. SECTION 2. Severability. In the event that any provision of this Ordinance, or any part thereof, or any application thereof to any person or circumstance, is for any reason held to be unconstitutional or otherwise invalid or ineffective by any court of competent jurisdiction on its face or as applied, such holding shall not affect the validity or effectiveness of any of the remaining provisions of this Ordinance, or any part thereof, or any application thereof to any person or circumstance or of said provision as applied to any other person or circumstance. It is hereby declared to be the legislative intent of the City that this Ordinance would have been adopted had such unconstitutional, invalid, or ineffective provisions not been included herein.
