Approve request for continuance for Tentative Tract 14112-located northeasterly of the
intersection of Foothill Drive and Sterling Avenue.
Backeround:
On November 7, 1990, the Planning Commission approved the Teniative Tract No. 14112, a 55-
lot, single family, residential subdivision.
On May 18, 1994, the Planning Commission authorized an extension of the time limit for
approval of the tentative tract map. An automatic two-year extension was granted according to
the provisions of Section 66452.11 of the Subdivision Map Act, which extended the approval date
to May 18, 1996. An additional extension was granted according to the provisions of Section
66452.13 of the Subdivision Map Act, extending the approval date to May 18, 1998. The
Planning Commission approved the final extension, extending the tentative map to May 18, 1999.
The Developer/owner requested that staff schedule Tentative Tract 14112 for final map approval
by the Mayor and Common Council for the meeting of May 17. 1999. Because the final map and
subdivision securities had not been submitted as of the date of the meeting, the Mayor and
Common Council approved a motion to continue the Resolution approving the final map to
August 16, 1999.

Fred Brooks representing Sterling Heights, LLC has advised the City by letter dated October 27,
2005, (copy attached) that they are now the owners of the property and are anxious to move
forward with development of this site into an upscale-gated community on half-acre lots in
accordance with the approved tentative map.
The following documents are required for approval of the final map:

I. Bonds - Faithful Performance Bond - $2,293,000.00, Labor Material - $1,146,500.00,
Guarantee and Warranty Bond - $573,250.00, Monumentation Bond - $17,000.00, Grading
Bond - $1,073,500.00;

2. Fees - Street Light Electrical Energy Fee - $14,656.80, Street Improvement Plan Checking
Fee - $61,152.00, Final Map - $2,650.00, Grading Plan Checking Fee - $1,295.50, Traffic
Signal Modification Fee - $20,000;
3. Three executed originals of the Subdivision Agreement;
4. Three mylar originals of the Final Map executed by the subdivider/owner and other required
signatories, the Engineer, and the County, together with the final Subdivision Guarantee;
5. Off-site improvement plans, including landscape and irrigation plans for the landscape
maintenance district all approved by the City Engineer.
The original bond amounts and fees were estimated in 1999 without benefit of approved
infrastructure improvement plans. The bonding and fee amounts have been increased by 26%
from the amounts calculated in 1999 based on the increase in the Engineering News Record cost
of construction index. Subsequent to the approval of the infrastructure improvement plans, a new
"Recording Requirements" letter will be sent to Sterling Heights, LLC indicating the actual
bonding and fee amounts. These actual amounts may vary significantly from the amounts
estimated above.
The $75.00 continuance fee has been paid.
This map has been before the Council for the last six years and the previous developer/owner
made no attempt to provide anv of the items required for Council approval and recordation of the
map. However, Mr. Brooks has assured 'us that Sterling Heights, LLC is serious about
developing this site and will pursue the five items listed above to completion as required for
approval of the final map.
If this request for continuance is not approved, Tentative Tract No. 14112 will expire and the
Developers will be required to submit a new tentative tract application if they wish to proceed.
Financial Imoact:
There is no financial impact to the City.
Recommendation:
That the Mayor and Common Council approve the request for continuance of the Final Map for
Tentative Tract No. 14112 for an additional six months to May 15,2006.

for Tentative Tract 141I 2
Dear Mr. Grubbs,
Thank you for your time and interest in the Sterling Heights Estates Project Sterling
Heights, LLC has recently purchased the property underlying Tentative Tract 14112 and
is anxious to move forward with the development of this site into an upscale-gated
community on half-acre lots in accordance with the approved Tentative Map No. 14112. I
have attached the Grant Deed showing that Sterling Heights, LLC is the current legal
Owner of the property and anticipate receiving your full support in enhancing the City of
San Bernardino through the development of high quality residential estates.
We have reviewed and intend to comply with the conditions of approval for the approved
map. We have retained the services of Gary Rasmussen as our Georec;hnical Consultant,
Tom Dodson as our Environmental Consultant, and Associated Engineers as our Civil
Engineer. We have selected this team based on their reputation as professionals, their
specific knowledge of the project, and the positive working relationship they have with
the City of San Bernardino.
We have developed the attached project schedule reflecting an action plan for obtaining
the necessary grading permits within the next six (6) months..
The actions that we have taken so far include:
I. Commissioning Gary Rasmussen for geotechnical investigation to validate the
fault zones shown on the approved map.
2. Commissioning Associated Engineers for development of a new site boundary
and topographic survey to document the changes that have occurred since the
existing topographic survey was developed.
3. Commissioning Tom Dodson and Associates for Jurisdictional Delineation of the
drainage area on site, and to verifY if there are any threatened or endangered
speCies habitat existing within the site boundaries.

The actions we anticipate perfonning immediately upon notification of approval of this
extension of time will include:
. Submitting the existing map and conditions to each department to begin the
process of finalizing improvement plans and obtaining an updated fee schedule
for the project
. Mapping the results of the environmental, geotechnical, and physical surveys
mentioned above and identifying any impacts that these surveys will have to the
approved tentative map layout.
. Processing the updated layout through the Development Review Committee and
initiating all appropriate public review periods.
. Submitting all appropriate environmental approval applications including the 401,
404, and 1600 permits required by the California Environmental Quality Act
(CEQA).
Over the next few months, we anticipate completing the final design of the project and
obtaining the appropriate approvals in order to begin the rough grading in May 2006.
We appreciate your ongoing support for this project and we look forward to creating a
community in Sterling Heights that everyone can be proud of.
