STAFF REPORT
SUBJECT
Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the
execution of a lease renewal option to the San Bernardino County Sheriff's Search and
Rescue, located at 3250 Harrison Avenue.
BACKGROUND
The City of San Bernardino is the property owner of a fire station located at 3250 Harrison
Avenue. The facility was taken out of service years ago and the County of San Bernardino
Sheriff's Search and Rescue has leased the building for their operation. On November 17,
1997, the City and the County signed a five-year lease for this site with an effective date of
November 1, 1997, and an end date of October 31, 2002. The lease had an option for one five-
year renewal, which the county would like to exercise. The term of the new lease would be
retroactive back to November 1, 2002, and end on October 31, 2007. In lieu of rent, the County
would be responsible for all interior and exterior maintenance and repairs on the building,
including the parking lot and grounds. Staff recommends that the lease renewal option be
approved.

None.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor ofthe City of San Bernardino is hereby authorized and

directed to execute on behalf of said City a first amendment to the lease with the County of San

A copy of the lease amendment is attached hereto as Exhibit "A" and made a part hereof.

SECTION 2. This resolution is rescinded if the parties to the contract fail to execute it
within 60 days ofthe passage of this resolution.

THIS CONTRACT is entered into in the State of California by and between the County of San Bernardino, hereinafter called

WHEREAS, the COUNTY and CITY have previously entered into a Lease Agreement, Contract No. 97-
970, wherein CITY agreed to lease certain real property to the COUNTY; and,
WHEREAS, the COUNTY desires to exercise its one (1) five-year option to extend the term.
NOW, THEREFORE, in consideration of mutual covenants and conditions, the parties hereto agree the
Lease Agreement, Contract No. 97-970, is amended as follows:
1. EXTEND the term of the lease pur~uant to Paragraph 5, OPTION TO EXTEND TERM, from
November 1, 2002 through October 31,2007.

DELETE the existing Paragraph 4, RENT, and REPLACE it with the following:

4. RENT. COUNTY shall be responsible for all interior and exterior repairs and maintenance of
the building, including the parking lot and grounds, in lieu of monetary rent and as consideration for

Our office has not received the lease renewal with the County of San Bernardino Sheriffs
Search and Rescue located at 3250 Harrison Avenue. This agreement was approved at the
Mayor and Common Council meeting held on August 2, 2004, and will be null and void if not
executed and returned to the City Clerk's Office by October 1, 2004.
Please forward the executed agreement to the City Clerk's Office, to my attention, as soon as
