Subject:
Resolution of the City of San Bernardino approving Professional Services Agreements with
Transtech Engineers, Inc. and Willdan for Professional Civil Engineering Plan Checking
Services.
Background:
The Development Services Department is responsible for development plan review and plan
checking for various land development and capital improvement projects. This program
consists of the review and plan checking of roads, bridges, buildings, grading, drainage,
landscaping, traffic signals, on-site improvements, handicap ramps, etc.
Contract plan checking is essential to providing a continually improving level of service to the
development community and adequate quality control in the design process for capital
improvement projects. The level of development activity is by its nature highly variable and
having the services of a consultant firm helps to balance the workload.
The engineering land development activities have increased over the last five years
consistently.
On May 4, 2004, a request for proposals (RFP) to provide Professional Public Works Plan
Review Services was sent to 13 consulting engineers in the local area. A copy of the RFP was
also sent to the San Bernardino Chamber of Commerce and a copy was posted on the City's
website. The Mayor and Common Couocil previously approved the format, evaluation criteria
and evaluation procedure used in the RFP on September 2,2003.
Four proposals were received from the following firms: Transtech Engineers, Inc., Willdan,
Engineering Resources of Southern California (ERSC), and Brian A. Stirrat & Associates.
Staff evaluated the four proposals and determined that the proposals best meeting the
requirements of the RFP were submitted by Transtech Engineers, Inc., Willdan, and
Engineering Resources of Southern California (ERSC).
Under the selection process, which was completed on July 1, 2004, and consisted of the
evaluation by City staff of proposals and an interview with the top three consultants. Transtech
Engineers, Inc. and Willdan were found to be the firms most capable of providing the services
being sought.
Attached is a copy of the combined results of the ratings from the review of proposals and the
interview.
Staff is requesting approval of a contract, not to exceed $200,000.00 in services with Transtech
Engineers, Inc. (see Rate Attachment B to Agreement with Transtech Engineers Inc.) as the

selected primary consultant and another $150,000.00 with Willdan (see Rate Attachment B to
Agreement with Willdan) as a secondary firm.
Transtech Engineers, Inc. has a proven track record of bringing projects on time and has
committed to meet the City's turnaround schedule. Transtech has quoted the lowest rate for
services of the two selected consultants. Therefore, staff is recommending that a larger portion
of the plan checks be directed to Transtech Engineers, Inc.
Financial Impact:
All of the associated costs shall be paid upon request of the developer for expedited plan
check. Therefore, there will be no cost to the City for development plan checking and
development review.
Recommendation:
Adopt Resolution.

SECTION I. Transtech Engineers, Inc. and Willdan are firms that are competent,
experienced, and able to perform requested services and have provided the most advantageous
and responsible proposal for provision of Consultant Engineering Plan Checking Services for
purchase order amounts totaling up to $350,000 (up to $200,000 with the primary engineering
12 firm, Transtech Engineers, Inc. and up to $150,000 with Willdan) in the aggregate. Pursuant to
13 this determination, the Purchasing Manager is hereby authorized and directed to issue the

Purchase Orders for said services to said firms; but such award shall only be effective upon the
issuance of a Purchase Order by the Purchasing Manager; and all other proposals are hereby
rejected. The Mayor,is hereby authorized and directed to execute Agreement for Services on

EXHIBIT A
AGREEMENT FOR SERVICES
This AGREEMENT is made and entered into this day of , 2004,
by and between Willdan. ("Contractor") and the CITY OF SAN BERNARDINO ("CITY").
WITNESSETH:
A. WHEREAS, CITY has need for plan checking services within the City and,
B. WHEREAS, CONTRACTOR is competent and able to perform said services,
and,
C. NOW, THEREFORE, the parties hereto agree as follows:
1. CONTRACTOR shall furnish plan checking-related services to CITY in
accordance with Attachment A.
2.
Over the term of this Agreement, CONTRACTOR shall be paid for such
services an amount not to exceed $150,000, in accordance with
Attachment A. This Agreement may be canceled by two weeks written
notice by either party.
3.
CONTRACTOR shall provide the Director of Development Services
with a weekly statement of hours worked in arrears and shall be provided
payment within thirty (30) days therefrom. CITY retains the right to
challenge all or any part of the statement.
4. The term of this agreement shall begin August 2, 2004, but shall not
exceed one year.
5. CONTRACTOR shall indemnify, defend and hold CITY, its officers,
employees and agents harmless from any claim, demand, liability, suit,
judgement or expense (including, without limitation, reasonable costs of
defense) arising out of or related to CONTRACTOR'S performance of
this agreement, except that such duty to indemnify, defend and hold
harmless shall not apply where injury to person or property is caused by
CITY'S willful or sole negligence.
6.
CONTRACTOR shall perform work tasks as directed by the Director of
Development Services or his designee, but for all intents and purposes
CONTRACTOR shall be an independent contractor and not an agent or
employee of the CITY and, as such, shall not be entitled to any benefits,
including but not limited to, medical insurance, retirement and workers'
compensation.

7.
In the performance of this Agreement contractor shall not discriminate on
the basis of race, creed, color, religion, sex, physical handicap, ethnic
background or country of origin.
8. Any notice to be given pursuant to this Agreement shall be deposited with
the United States Postal Service, postage prepaid and addressed as

Nothing in this paragraph shall be construed to prevent the giving of
notices by personal service.

CONTRACTOR shall maintain insurance policies meeting the minimum
requirements set forth herein. All insurance maintained by the Contractor
shall be provided by insurers satisfactory to the City. Certificates
evidencing all insurance coverage required herein shall be delivered to the
City prior to the Contractor performing any of the services under this
Agreement. All insurance certificates required herein shall name the City
as an additional insured and provide for thirty (30) days written notice
from the insurer to the City prior to cancellation of any insurance policy of
the CONTRACTOR.

A. Comprehensive General Liabilitv and Automobile Insurance - The
Contractor shall maintain comprehensive general liability and
automobile liability insurance with a combined single limit of not
less than One Million Dollars ($1,000,000.00) per occurrence.
B. Worker's Compensation Insurance - The Contractor shall maintain
worker's compensation insurance in accordance with the laws of
the State of California for all workers employed by the Contractor.

Willdan is pleased to submit this proposal for professional public works plan check
services. While our exceptional are presented in the proposal, listed below are reasons
why Willdan is qualified to perform this service to the City of San Bernardino.
. Willdan provides plan check and inspection services for over 40 cities and
counties in the State of California.

Willdan currently provides engineering and building and safety plan check

Willdan differs from most other
engineering consulting firms in that we specialize in offering consulting services
primarily to city, county and other governmental entities thereby alleviating any
possibility for conflict of interest. Each Willdan office is staffed with highly qualified

National, State and local codes and regulations and who are in a position to respond to
the particular needs of specific geographic areas. All of our key staff members were
previously employed by public agencies and have strong backgrounds in all aspects of

SCOPE of WORK/SCHEDULE
ENGINEERING PLAN CHECKING
Willdan will provide the City with qualified engineering plan checkers, and plan check
engineers to perform "red line" review to ensure compliance with the City's standards,
standard requirements, policies and procedures. Engineering plan checking services
will be coordinated with building and safety plan checking, landscape plan checking,
planning division staff, and others. At all times, an attitude of service to the applicant
will be kept in the best traditions of public service, In our work for other Southern
California cities, we have plan checked private developments and have required
developers to construct adjacent off-site improvements, such as street, sidewalk, curb
and gutter, and parkway improvements. All work must comply with General Plan,
Development Permit, and Public Works requirements,
Our civil engineers review private development improvement plans, such as streets,
storm drains, sewers, water lines, and traffic signals, checking for sewer loads and
connections, roadway widths, cul-de-sac turning radius, fire flows, and street light
spacing, When appropriate, our traffic engineers will assist in the review of
improvement plans to develop approaches to reduce impacts to traffic and ensure
public safety. A significant item typically included in plan checking process is the
identification of the need for traffic control plans and review of such plans. Other
reviews include access and circulation issues and their impact on traffic safety. These
reviews typically involve the review of sight distance, vehicle storage and access
requirements.
Improvement plan checking will include, but not be limited to, precise and rough
grading, street, sewer, traffic, street lighting, striping, and erosion control and drainage
plans. Hydrology and hydraulic calculationswill be checked for sufficiency to verify that
the drainage plans are adequate to provide for design runoff. Drainage plans and
hydrology calculations will also be coordinated with the Flood Control District where
necessary. Structural calculations, when submitted, will be checked by our in-house
structural engineers. Plans will be checked against soil and geotechnical reports.
Sewer, water, and other utility plans prepared for other agencies will be reviewed for
conflict/consistency with City street and drainage plans,
Subdivision maps, including parcel and final tract maps, will be checked to assure
compliance with applicable provisions of the Subdivision Map Act, the City of San
Bernardino Conditions of Approval, Land Surveyor's Act and any other applicable
ordinances. There will be detailed checks made up of such maps, including, but not
limited to, review of survey documentation and title reports, lot and boundary closure,
dedications and easement provisions, legal descriptions, completeness, and accuracy
of data notation, and necessary certifications of City staff.

Private Parking Lot Plans will be reviewed for all the above items and in addition will
be checked to verify compliance with Title 24 accessibility requirements of the State
Building Code, as well as the requirements of the Santa Ana Regional Drainage Area
Management Plan, Supplement "A". Quantity calculations will be reviewed for all
projects to assure accuracy and completeness to verify appropriate bonding amounts.
Rough Grading Plans will be reviewed to assure conformance with City codes, written
policies and standard specifications. The review will also assure conformance with the
approved tentative map and conditions of approval for the project. Hydrology and
hydraulic calculations will be reviewed for conformance with San Bernardino City Flood
Control District methodology for any proposed storm drain systems and detention
basins.
Grading Plans will be reviewed for compliance with the recommendations,
specifications and details contained in the submitted soils report and to assure that all
appropriate details are shown on the plans. Quantity calculations will be reviewed to
assure accuracy and completeness.

Erosion Control Plans will be reviewed to assure erosion and sedimentation measures
comply with the Best Management Practices listed in the Stormwater Pollution
Prevention Plans.
Precise Grading Plans will be checked to verify positive drainage to an approved
outlet. Where deepened footings are required due to the lot grading, the extent and
depth of the needed deepened footing will be clearly noted on each footprint. Erosion
control measures for manufactured slopes will be reviewed to verify that the
landscaping and irrigation measures are adequate. In addition, we will assure any
interim measures to control erosion until such time as the landscaping is viable and
shown on the plan.

In addition, we will review each plan critically to assure the proposed design can be
constructed using normal construction methods, and that the proposed design does not
create either maintenance or liability issues for the upon completion of construction.
SPECIAL STUDIES REVIEW
The review of special studies prepared by developers will be performed by our office
engineers to assure that they are conceptually sound and conform to City of San
Bernardino standards, County or State standards, where applicable, and accepted
engineering practices. These studies include drainage studies, traffic impact studies,
parking studies, and access and circulation studies.

PERFORMANCE SCHEDULE
Willdan will perform the first plan check on each submittal within ten (10) working days
of receipt of notice from the City to pick up maps/plans for review. The second plan
check shall be done within seven (7) working days and all subsequent checks within five
(5) working days of receipt of plans/maps from the submitting engineer.

RONALD L. ESPALlN
Senior Vice President/Office Manager
PROFESSIONAL EXPERIENCE
Mr. Espalin is a Senior Vice President and the Regional Office Manager of the San
Bernardino Office. Mr. Espalin has extensive experience in managing engineering and
technical staff and has served as the responsible engineer for plan check and
inspection services for numerous cities and counties. He has served as on-site Building
official overseeing all aspects of building and safety operations for cities in the Inland
Empire, Coachella Valley and other regions in Southern California. Mr. Espalin is
currently acting as Building Official for the City of Indian Wells and the City of Palm
Desert. His duties in this capacity include reviewing proposed legislation affecting
Building Code enforcement, arbitrating disputes on code interpretations, and resolving
the more difficult and complex engineering and code problems.
Prior to joining Willdan, Mr. Espalin was the Assistant Director of Building and Safety for
the County of Riverside. He was responsible for the day-to-day operations of the
department and was responsible for 130 employees providing services in plan review,
permit issuance, inspection services, rehabilitation and code enforcement and land use
zoning enforcement.
In the private sector, Mr. Espalin was a structural design engineer. His design
responsibilities included calculations and design for structural steel and reinforced
concrete moment frame structures, industrial structures, dynamic and static analysis,
soil-structure interaction analysis and seismic qualification of equipment and systems in
essential facilities. Mr. Espalin maintains a lifetime teaching credential in Engineering
with the California Community College system.

Vice President
Mr. Elroy L. Kiepke serves as a Vice President for Willdan, where he is currently
assigned as the Public Works Director and City Engineer to the City of Calimesa and as
City Engineer in La CaZada Flintridge. Mr. Kiepke has served as City Engineer for the
Cities of Agoura Hills, Alhambra, and La Habra Heights, as well as Acting Public Works
Director for the City of Agoura Hills. He joined Willdan in July 1979 to assist in the

JAMES DOUGHERTY

Mr. Dougherty has provided civil plan check, civil design and mapping support for
numerous assessment district projects throughout Southern California. He has
experience with parcel, tract and tax assessor's maps as well as legal descriptions and
other property record information.
Mr. Dougherty came from an experience in surveying prior to his joining Willdan. With
Willdan, he has more than sixteen years of experience in civil and building plan check,
project design, project coordination and computer aided drafting. He possesses
working knowledge of architectural and environmental design, and local, state and
federal building codes, as well as contract documentation preparation and processing.
As a project coordinator, he is responsible for budgeting, cost estimating, funding
source applications and environmental processing. He has worked with Caltrans, Los
Angeles County Metropolitan Transportation Authority, the Environmental Protection
Agency and other county and city agencies.

WITNESSETH:
A. WHEREAS, CITY has need for professional civil engineering plan checking
services within the City and,
B. WHEREAS, CONTRACTOR is competent and able to perform said services,
and,
C. NOW, THEREFORE, the parties hereto agree as follows:
I. CONTRACTOR shall furnish plan checking-related services to CITY in
accordance with Attachment A.
2.
Over the term of this Agreement, CONTRACTOR shall be paid for such
services an amount not to exceed $200,000, in accordance with
Attachment A. This Agreement may be canceled by two weeks written
notice by either party.
3. CONTRACTOR shall provide the Director of Development Services
with a weekly statement of hours worked in arrears and shall be provided
payment within thirty (30) days therefrom. CITY retains the right- to
challenge all or any part of the statement.
4. The term of this agreement shall begin August 2, 2004 but shall not
exceed one year.
5. CONTRACTOR shall indemnify, defend and hold CITY, its officers,
employees and agents harmless from any claim, demand, liability, suit,
judgement or expense (including, without limitation, reasonable costs of
defense) arising out of or related to CONTRACTOR'S performance of
this agreement, except that such duty to indemnify, defend and hold
harmless shall not apply where injury to person or property is caused by
CITY'S willful or sole negligence.
6.
CONTRACTOR shall perform work tasks as directed by the Director of
Development Services or his designee, but for all intents and purposes
CONTRACTOR shall be an independent contractor and not an agent or
employee of the CITY and, as such, shall not be entitled to any benefits,
including but not limited to, medical insurance, retirement and workers'
compensation.

In the performance of this Agreement contractor shall not discriminate on
the basis of race, creed, color, religion, sex, physical handicap, ethnic
background or country of origin.
8. Any notice to be given pursuant to this Agreement shall be deposited with
the United States Postal Service, postage prepaid and addressed as
follows:

Nothing in this paragraph shall be construed to prevent the giving of
notices by personal service.
9.
CONTRACTOR shall maintain insurance policies meeting the minimum
requirements set forth herein. All insurance maintained by the Contractor
shall be provided by insurers satisfactory to the City. Certificates
evidencing all insurance coverage required herein shall be delivered to the
City prior to the Contractor performing any of the services under this
Agreement. All insurance certificates required herein shall name the City
as an additional insured and provide for thirty (30) days written notice
from the insurer to the City prior to cancellation of any insurance policy of
the CONTRACTOR.

A. Comprehensive General Liabilitv and Automobile Insurance - The
Contractor shall maintain comprehensive general liability and
automobile liability insurance with a combined single limit of not
less than One Million Dollars ($1,000,000.00) per occurrence.
B. Worker's Compensation Insurance - The Contractor shall maintain
worker's compensation insurance in accordance with the laws of
the State of California for all workers employed by the Contractor.

Philosophy
Transtech Engineers, Inc. believes that the plan check services should be provided in
manner that is as applicant friendly as possible. Between various State and County
agencies, and the associated bureaucracy; it has become very difficult for the average
business person to develop their own property. Meeting the needs of these individuals,
through education and patient plan review, and inspection is a high priority. We believe
that the City is far better served by a consultant who ensures that the applicants are not
alienated by the whole process of obtaining and finaling a permit.

Our services are founded on the principals of Total Quality Management. We start by
working with the applicant during plan review to help him or her prepare a set of plans
which have all the required information clearly and logically presented. Additionally, we
never hesitate to make suggestions which help eliminate complicated details, reduce
construction costs, and/or provide details which are easy to verify in the field.
Experience has taught us well that inspection time and applicant frustration can both be
substantially reduced, while increasing overall compliance, by producing a better set of
plans during plan review process. And in the case of applicants, this policy often
demonstrates early on that the City really is here to help.
Administrative Policies
Plan review corrections are written clearly, and are fully detailed to explain the Code
deficiency. To help the applicant better understand the problem, Transtech Engineers,
Inc. provides as much information during plan.review as possible. We believe that if the
applicant has a clear understanding of the problem, he or she can take the necessClry
steps to correct the condition. This policy reduces the number of plan review rechecks
required, allows the applicant to obtain a permit much sooner, and reduces the overall
time our staff is required to spend on that particular plan. Unclear and/or cryptic
corrections are never written, and all correction lists typed.
Fast Tracking of Plans
Transtech Engineers, Inc. understands the importance of being able to expedite certain
projects through the plan review process. This also, is included as a normal part of our
service.

The City shall provide 2 copies of plans for each plan check submittal. When the City
requests plan check service from Transtech, a request e-mail shall be sent to our
designated e-mail (which would be named sbowocheckreauesttCi>.transteche.com or
similar) specifying a plan check request number. Transtech will pick-up the plans within
48 hours of the receipt of the request, and return the comments to the City within a
specified time frame.

Subject:
Resolution of the City of San Bernardino approving Professional Services Agreements with
Transtech Engineers, Inc. and WiIldan for Professional Civil Engineering Plan Checking
Services.
Background:
The Development Services Department is responsible for development plan review and plan
checking for various land development and capital improvement projects. This program
consists of the review and plan checking of roads, bridges, buildings, grading, drainage,
landscaping, traffic signals, on-site improvements, handicap ramps, etc.
Contract plan checking is essential to providing a continually improving level of service to the
development community and adequate quality control in the design process for capital
improvement projects. The level of development activity is by its nature highly variable and
having the services of a consultant firm helps to balance the workload.
The engineering land development activities have increased over the last five years
consistently.
On May 4, 2004, a request for proposals (RFP) to provide Professional Public Works Plan
Review Services was sent to 13 consulting engineers in the local area. A copy of the RFP was
also sent to the San Bernardino Chamber of Commerce and a copy was posted on the City's
website. The Mayor and Common Council previously approved the format, evaluation criteria
and evaluation procedure used in the RFP on September 2, 2003.
Four proposals were received from the following firms: Transtech Engineers, Inc., Willdan,
Engineering Resources of Southern California (ERSC), and Brian A. Stirrat & Associates.
Staff evaluated the four proposals and determined that the proposals best meeting the
requirements of the RFP were submitted by Transtech Engineers, Inc., WiIldan, and
Engineering Resources of Southern California (ERSC).
Under the selection process, which was completed on July I, 2004, and consisted of the
evaluation by City staff of proposals and an interview with the top three consultants. Transtech
Engineers, Inc. and WiIldan were found to be the firms most capable of providing the services
being sought.
Attached is a copy of the combined results of the ratings from the review of proposals and the
interview.
Staff is requesting approval of a contract, not to exceed $200,000.00 in services with Transtech
Engineers, Inc. (see Rate Attachment B to Agreement with Transtech Engineers Inc.) as the

selected primary consultant and another $150,000.00 with WilIdan (see Rate Attachment B to
Agreement with Willdan) as a secondary firm.
Transtech Engineers, Inc. has a proven track record of bringing projects on time and has
committed to meet the City's turnaround schedule. Transtech has quoted the lowest rate for
services of the two selected consultants. Therefore, staff is recommending that a larger portion
of the plan checks be directed to Transtech Engineers, Inc.
Financial Impact:
All of the associated costs shall be paid upon request of the developer for expedited plan
check. Therefore, there will be no cost to the City for development plan checking and
development review.
Recommendation:
Adopt Resolution.
