Authorization for the Director of Development Services to Execute Change Order No. One to
Contract with Bonadiman McCain, Inc. for Timber Creek Improvements from East Twin Creek to
4,016.93 feet East, per Plan No. 10069.
Background:
A project to concrete line Timber Creek from Twin Creek to Lena Road was bid in October of 2000.
Unfortunately, due to change in policy of the Santa Ana Regional Water Quality Control Board, the
City was unable to obtain a Water Quality Certification Waiver for the project. The Board
contended that significant water quality impacts would result from concrete lining Timber Creek
from Lena Road to East Twin Creek and insisted that the City commit to creating a riparian area
upstream of the Lena Road to replace the impacted area between Lena Road and East Twin Creek.
This riparian creation area consists of a graded trapezoidal natural dirt channel, "turf
reinforcement" material installed so as to limit erosion, an irrigation system, tree and shrub species
maintained for 3 years and native weeds and grasses seeded as directed by the project biologist.
While improving storm drains at Timber Creek Channel it was found that a box culvert, where the
channel ties into Twin Creek, had to be realigned; rip-rap lining needed to be removed and
reconstructed; engineering calculations for culvert falsework designs needed to be updated and
submitted to the County Flood Control District to maintain compliance with County permit; sewer
lines needed to be repaired and protected and one line specifically at station 20 + 50 had to be
removed since it was no longer serving any properties and was above the redesigned channel floor; a
silted culvert required clean out for proper functioning; and a section of curb and paving needed to
be removed because it encroached into the work area. All these activities are the subject of Contract
Change Order No. One. The total cost of these activities totals $61,318.83, however, the owner of
an adjacent parking lot agreed to reimburse the City $557.59 for reconstruction of a small portion of
his parking lot that had to be removed and replaced to facilitate construction of the channel.
Most of the changes indicated above were the result of modifications required after the start of
construction by the San Bernardino Flood Control District. Our Consultant Civil Engineer, Joseph
E. Bonadiman, submitted plans to the District and a permit was obtained to authorize work in the
District's right-of-way. However, additional requirements, as described above, were imposed after
the contractor started work and, as a result, the contractor requested additional compensation.
Also, lack of reliable utility records from the old Norton Air Force Base resulted in the need to
repair and existing sewer line that was inadvertently damaged and to install protection for a waterline
that is located just below the flowline of the channel. These utilities were identified during the design
process.

In FY 2002/03, $648,900 was appropriated for this project. Of this amount approximately $9,600
was expended and $631,800 was carried over to FY 03/04 for encumbrances and continuing
appropriations. As part of the FY 03/04 budget an additional $440,000 was budgeted for this project
as Inland Valley Development Agency's (IVDA) share of the cost. All of these funds are budgeted
in the Storm Drain Construction Fund in account number 248-368-5504-7141. Total funding
available for this project $1,081,400, which is sufficient to cover the cost of this change order.
Recommendation:
Authorize the Director of Development Services to execute Change Order No. One to contract with
Bonadiman-McCain, Inc. for Timber Creek improvements from East Twin Creek to 4,016.93 feet
East, per Plan No. 10069.

Justification
1-1 ReaIiRDJllent of Box Culvert
The plans show Twin Creek Channel where Timber Creek box culvert ties into Twin Creek
Channel as being straight whereas, in reality, the Channel is on a radius. The Contractor had to
make adjustments in the field for this variance and the claim is based on the cost for 24 man
and equipment hours over two working days. For the work required, this claim is reasonable.
1-2 Falsework Em!ineerinl! and Desil!n
The San Bernardino County Flood Control permit called for submission of calculations and
design offalsework for the box culvert at St. 0 + 40. The permit was received after contract
was awarded and thus, its cost was not anticipated. The cost per invoice submitted is
$1,200.00.
Removal of A-Curb and Asphalt Pavlnl! (St. 10 + 00 to St. 12 + 00)
On the south side of the channel, between St. 10 + 00 and St. 12 + 00 (approximately), the
1-3 parking lot of property belonging to Mr. Joseph Bonadirnan encroached into City's right-of-
way. The removal was done by contractor on T & M basis at a cost of$557.59. Mr. Joseph
Bonadiman has agreed to reimburse this amount.
Repair 8-inch Sewer Line at St. 40 + 40
1-4 While rough grading near St. 40 + 40, the grading contractor damaged an unmarked 8-inch
sewer line. Repairs were made on a T & M basis at a cost of$518.28.
Remove a Portion of Rip-Rip and Extend St. 14 + 00
Existing rip-rap at a storm drain outlet located at St. 14 + 00 (approximately) was designated
to be "protected in place." However, its width and invert elevation did not match the profile of
1-5 the new channel. The engineer recommended that a section of the rip-rap be removed so a new
portion could be built to match the new channel profile. The contractor priced this work at
$18,147.00. A review of the back-up data indicates this to be a fair price.
Install Cut-Off Walls For 6-inch Steel Pipe at St. 28 + 00 (Approximatelv per Detail)
During rough grading of the channel, an unmarked 6-inch steel pipe (believed to be a sewer
pipe) was found to be above the redesigned channel floor elevation. It is proposed to protect
1-6 this pipe in place by building cut-off walls in front of and behind it and to cap these walls with
a y." thick steel plate. The contractor estimates that the cost of this work to be $8,412.90.
Based on back-up information, the cost is considered reasonable.
Remove Existinl! Concrete. Invert. and Reconstrue! Rip-Rap at St. 38 + 00

An existing concrete invert and slope protection structure at St. 38 + 00 was found to be higher
1-7 than the designed channel floor elevation and not as wide. It is proposed to remove part of the
concrete step and rebuild a suitable rip-rap pad in its place. The contractor's estimated cost of
$23,630.20 is considered reasonable based on cost break-down data.

A sewer line crosses the channel at St. 20 + 50. It is above the channel floor elevation and is
concrete encased. The work end ties into a man-hole and the south end appears to be under
1-8 Kohl's parking lot. The line is not serving any property. It is proposed to remove the portion of
sewer line lying along the full width of the channel and to plug the ends. The contractor's
estimated cost of $4,646.15 is considered reasonable for this work.

The existing box culvert under Lena Road is silted to a depth of about two feet, and needs to
be cleaned out. The estimated cost for cleaning is $2750.40 and is reasonable for this task.
