from California Street to Wilson Street (SW04-04), Wilson Street from Base Line Street to II th Street
(SW04-04), "I" Street from Marshall Boulevard to Bussey Street (SW04-30) and 35th Street from Del
Rey Drive to Harrison Street (SW04-31) per Plan No. 10890.
Backnound:
On September 15,2003, the Mayor and Common Council approved the FY 2003/04 CIP, allocating
$609,600 in Account No. 245-365-5504-7317, Base Line Street, California Street to Wilson Street and
Wilson Street, Base Line Street to 11th Street - Replace Sewer Main; $76,000 in Account No. 245-365-
5504-7427, "I" Street, Marshall Boulevard to Bussey Street - ReplacelParallel Sewer Main; $34,000 in
Account No. 245-365-5504-7428, 35th Street, Del Rey Drive to Harrison Street - ReplacelParallel
Sewer Main for replacing approximately 2,700 linear feet of existing 8" sewer main with 14" sewer
main in Base Line Street and Wilson Street and replacing or paralleling 8" sewer main with 10" sewer
main in "I" Street (approximately 162 linear feet) and 35th Street (approximately ISO linear feet). All
the aforementioned existing sewer mains have been identified as exceeding I 00% of their designed
capacity. The Sewer Collection System Master Plan (SMP) identified these improvements as priorities
in comparison to other areas.
Plans and Specifications, for the Sewer Improvements on Base Line Street from California Street to
Wilson Street (SW 04-04), Wilson Street from Base Line Street to II th Street (SW 04-04), "I" Street
from Marshall Boulevard to Bussey Street (SW 04-30) and 35th Street from Del Rey Drive to Harrison
Street (SW 04-31) per Plan No. 10890, have been approved. Bids have been received and the
construction project is ready to be awarded.
This project was advertised locally in the San Bernardino County Sun Newspaper, F. W. Dodge
Company, Reed Construction Data, High Desen Plan Room, Bid America online plan room,
Construction Data (Hot Sheet), Construction Bid Source, the City's web site, and with the San
Bernardino Area Chamber of Commerce. The following companies responded:

If the project is awarded, it is anticipated that construction can start in August of 2004, and be
completed by October of 2004.
Financial Impact:
Sufficient funding is available for this project in Account No. 245-365-5504-7317, "Base Line Street
and Wilson Street - Replace Sewer Main (SW 04-04)" and in Account No. 245-365-5504-7427, "I
Street - Replace/Parallel Sewer Main (SW 04-30)". A estimated amount of $9,315.00 is available in
excess in Account No. 245-365-5504-7317 for transfer into Account No. 245-365-5504-7428, "35th
Street - Replace/Parallel Sewer (SW 04-31 )".
Recommendation:
I. Adopt Resolution.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AWARDING A CONTRACT TO NIKOLA CORPORATION
FOR THE SEWER IMPROVEMENTS ON BASE LINE STREET AND WILSON
STREET (SW 04-04), "I" STREET ( SW 04-30) AND 35TH STREET ( SW 04-31 )
PER PLAN NO. 10890.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Nikola Corporation, at 18012 Cowan, Suite #290, Irvine, CA 92614 is
the lowest responsible bidder for the Sewer Improvements on Base Line Street and Wilson
Street ( SW 04-04 ), "I" Street (SW 04-30 ) and 35th Street ( SW 04-31 ), per Plan No. 10890.
A contract is awarded accordingly to said bidder in a total amount of $323,166.00, with a
contingency amount of $48,500.00, but such award shall be effective only upon being fully
executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby
authorized and directed to execute said contract on behalf of the City; a copy of the contract is
on file in the office of the City Clerk and incorporated herein by reference as fully as though set
forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not take
effect or become operative until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
within sixty (60) days of passage of the resolution.
