"E" Street, located at the southwest comer of 48th Street and "E" Street. BACKGROUND: In January, 2002, this office received a request to hookup to City sewer, from Mr. Armand "Buck" Edelman, owner of 4180 N. "E" Street, relative to a proposed construction of four single-family residences. On April 15, 2002, Resolution No. 2002-106 was adopted, making application to the Local Agency Formation Commission (LAFCO) for providing City sewer services to property within unincorporated territory located at 4180 N. "E" Street. On February 17,2004, authorization to proceed was given for the proposed annexation of 4180 N. "E" Street, located at the southwest comer of 48th Street and "E" Street. Mr. Edelman applied to the County for a development permit for single-family lots. Since the County's minimum lot size for the area is 10,000 square feet, Mr. Edelman would only be allowed to develop three (3) single-family lots in the County. Since the City's minimum lot size is 7,200 square feet for this area, the owner has submitted a letter requesting to annex into the City. The proposed development would then be consistent with the City's General Plan. Pursuant to Section 99 of the Revenue and Taxation Code, agencies affected by a change of jurisdictional boundaries must negotiate the re-distribution of property taxes for property within the affected area and respond with a resolution. This must be accomplished within 60 days of receiving a response from the Auditor-Controller. In this case, the negotiations consist of the implementation of a formula that was established by the County in 1983. A copy of the action taken by the County Board of Supervisors relative to this formula is attached. Attached for your consideration is a resolution determining the amount of tax transfer that is to occur between the County and the City upon annexation of this territory. A detail of the amount to be transferred, by tax rate area, is attached as Exhibit "A" to the resolution. The deadline for submitting the resolution to LAFCO is July 9, 2004. Upon annexation, the total property tax to be transferred to the City for this parcel to be annexed is $220.00. FINANCIAL IMP ACT: Property tax revenues in the amount of $220.00 will be received for the first year after annexation. Subsequent year's revenue would increase or decrease pursuant to Proposition 13. "E" STREET, LOCATED AT THE SOUTHWEST CORNER OF 48TH STREET AND "E" STREET. 6 7 8 9 10 11 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals. That the Mayor and Common Council of the City of San Bernardino hereby find and determine that: A. Pursuant to Section 99 of the Revenue and Taxation Code, prior to the 12 issuance ofa certificate of filing by the Local Agency Formation Commission Executive Officer, 13 the governing bodies of all local agencies whose service area or service responsibilities will be 14 altered by a proposed jurisdictional change shall negotiate and determine by resolution the 15 amount of property tax revenues to be exchanged between and among such local agencies. 16 17 18 19 20 B. Except as provided in Section 99.1 of the Revenue an Taxation Code, in the event that a jurisdictional change would affect the service area orservice responsibility of one or more special districts, the Board of Supervisors of the County of San Bernardino shall, on behalf of the district or districts, negotiate any exchange of property tax revenues. 21 22 C. The Mayor and Common Council of the City of San Bernardino and the Board of Supervisors of the County of San Bernardino have determined the amount of property 23 24 25 26 27 28 tax revenues to be exchanged as a result of jurisdictional change described by LAFCO 2961, for 4180 N. The annual tax increment generated in the area subject to the jurisdictional change and attributable to the local agencies whose service area or service responsibilities will be 11 altered by the proposed jurisdictional change shall be allocated in the future years pursuant to the 12 13 provisions of Section 99 of the Revenue and Taxation Code. SECTION 4.
