Backl!round: In November 1989, voters approved Measure I authorizing San Bernardino Associated Governments (SANBAG), acting as the Transportation Authority, to impose a one-half of one- percent retail transaction and use-tax applicable throughout the county. This tax can only be used for transportation improvements and traffic management programs authorized in the expenditure plans set forth in Ordinance No. 89-1 of the authority. The referenced ordinance requires each local agency to expend funds based on a 5-year Capital Improvement Program and 20-year Transportation Plan adopted by resolution. The Expenditure Plan only relates to these funds and their expenditure; it is mandatory that each agency updates the plan and program once each fiscal year or more frequently if changes occur during the fiscal year. Each year SANBAG audits the City's fmancial records of the use of the Measure I local pass through funds. On June 30, 2003, SANBAG auditors completed an audit of The City's Measure I financial records and determined that the City is not in compliance because Measure I funds had been expended that were not indicated on the City's Measure I 5-year Capital Improvement Programs for fiscal years 2001-2006 and 2002-2007. SANBAG indicated that this is a minor issue of non-compliance and can be corrected by an action of the Mayor and Common Council amending the Measure I 5-year Capital Improvement Programs for FY 2001-2006 and 2002-2007. The proposed Amendment No. 1 to the 5- Y ear Program for Measure I Local Funds expenditures for Fiscal Years 2001-2006 is detailed in Attachment "A". Account No. 129-367-5504-7038 was erroneously entitled "SBIAA Terminal Road." It should have been entitled "State Street- Ninth Street to Base Line Street - construct new roadway." The proposed amendment corrects that error. Attachment "B" addresses the error discovered in the SANBAG audit of the City's Measure I Transportation funds for Fiscal Years ended June 30, 2003 and 2002. On August 19, 2002, the Mayor and Common Council authorized a CIP amendment and transfer of funds from Account No. 129-367-5504-7200 (9th Street - Pavement Rehab) to 129-367-5504-7222 (Waterman Avenue Pavement Rehab.). As part of this action, an amendment to the 5-Year Measure I CIP should have been included; however, it was inadvertently omitted. The proposed Amendment No.1 to the 5- Y ear Measure I Local Funds expenditures for Fiscal Years 2002-2007 corrects that omission. CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT (Continued) On May 17, 2004, the Mayor and Common Council adopted resolution no. 2004-128 approving Amendment No.1 to the Five-Year Capital Improvement Program (2003-2008) for Measure "I" Local Expenditures. The current action is being submitted separately because amendments are required to 5-Year Measure I CIP's for previous fiscal years. Financial Impact: The financial impact related to the adoption of the Expenditure Plan is reflected in the 5-year Capital Improvement Plan for the City. I TO THE FIVE-YEAR CAPITAL IMPROVEMENT PROGRAMS (FY's 2001-2006 & 2002-2007) FOR MEASURE "I" LOCAL EXPENDITURES. WHEREAS, San Bernardino County voters approved passage of Measure "I" in November, 1989, authorizing San Bernardino Associated Governments, acting as the San Bernardino County Transportation Authority, to impose a one-half of one percent retail transactions and use tax applicable in the incorporated and unincorporated territory of the County of San Bernardino; and, WHEREAS, revenue from the tax can only be used for transportation improvements and traffic management programs authorized in the Expenditure Plans set forth in Ordinance No. 89- I of the Authority; and, WHEREAS, Expenditure Plans of the ordinance require each local jurisdiction receiving revenue from the tax to expend those funds pursuant to a Five-year Capital Improvement Program and a Twenty-Year Transportation Plan adopted by resolution of the local jurisdiction; and, WHEREAS, Expenditure Plans of the ordinance also require that each local jurisdiction annually adopt and update the Five-Year Expenditure Plan, and WHEREAS, the Five-Year Capital Improvement Program for FY's 2001-2006 for Measure "I" Local Expenditures was approved by Resolution No. 2001-311 on October 2,2001, and, WHEREAS, the Five-Year Capital Improvement Program for FY's 2002-2007 for Measure "I" Local Expenditures was approved by Resolution No. 2002-289 on September 23, 2002, and, WHEREAS, an Amended Five-Year Capital Improvement Program (2001-2006) for Measure "I" Local Expenditures is necessary to add $21,780 in Measure I funds for the extension of State Street from Foothill Boulevard to 16th Street, and, WHEREAS, an Amended Five-Year Capital Improvement Program (2002-2007) for Measure "I" Local Expenditures is necessary to add $49,677 in Measure I funds for pavement rehabilitation at the intersection of Highland Avenue and Waterman Avenue. NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Amendments No. One to the Five-Year Capital Improvement Programs (CIP),for Measure "I" Program of Local Expenditures, for FY 2001 through 2006 and FY 2002- 2007, copies of which is attached hereto, marked Attachment "A" and Attachment "B" and incorporated herein as fully as though set forth at length, are hereby adopted.
