Description) Assessment District Deposits Finance: Council Notes: Agenda Item No. ---1l. ~/7/0~ CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report SUBJECT: Authorization to proceed --- formation of a Landscape Maintenance Assessment District in the Northpark Boulevard and Campus Parkway area (Tentative Tract No. 16509). BACKGROUND: The City of San Bernardino Municipal Water Department is in the process of selling a portion of land it holds in the vicinity of Northpark Boulevard, northwesterly of University Parkway, adjacent to the State University, to Watson & Associates, who is planning to develop the site as a residential development along with some commercial uses. This development will also include the construction of a portion of Campus Parkway (formerly known as Pepper-Linden Drive), which will connect the University from Northpark Boulevard to Kendall Drive. One of the conditions of approval for this development is the formation of an assessment district for the maintenance of landscaping, drainage wells, and certain hardscape improvements. In the anticipation of the closing of escrow and the conveyance of the property to Watson & Associates, the Water Department has requested the initiation of the formation of the assessment district. Watson & Associates has paid the formation fee of $4,000. Tract No. 16509 will consist of 153 single family lots, along with 6 larger lots that front Northpark Boulevard that will be developed for commercial use. The development will include open space areas, perimeter landscaping, 25 drainage wells, hiking trails, gazebos, and various hardscape improvements consisting of monument signs and lighting, a patterned concrete entryway, and drainage channels along the various slope areas. If authorization to proceed is given, staff will prepare an Engineer's Report, which will give full details as to the type and quantities of improvements to be maintained. The Report will also give an estimate of costs for the proposed maintenance, along with the formula for spreading these costs across the lots to be included in the assessment district. These costs, along with incidental and administrative costs, will be assessed to the various properties within the district and collected on annual property tax bills. The Report will also contain the proposed assessment for each specific parcel in the district, along with maps showing the location of improvements. The formation proceedings will also include a public meeting and a public hearing relative to the proposed district and an assessment ballot process, as required by law. It is anticipated that the developer will still own all, or the majority of the lots, at the conclusion of the formation proceedings, so a majority protest is not anticipated. Future potential property buyers will be given a disclosure form by the developer, advising them of the existence of an assessment district and the proposed annual costs. The notices by the developer will be given prior to the closing of escrow. FINANCIAL IMPACT: None. Applicant has paid the $4,000 processing fee and all subsequent work carried out in the district will be assessed back to properties within the assessment district.
