SUBJECT: General Plan Amendment No. 02-10 and Conditional Use Permit No. 02-09 - to
change the land use district from OIP, Office Industrial Park to CG-l,
Commercial General and to expand a used vehicle car lot. The project site is
located at the northeast comer of Mill Street and Waterman Avenue.

BACKGROUND
Sami & Sami, Inc. own A-I Auto, located at 299-333 S. Waterman Avenue. They are requesting
General Plan Amendment No. 02-10 to change the land use designation on approximately 5-
acres ofland from OIP, Office Industrial Park to CG-l, Commercial General. Conditional Use
Permit No. 02-29 is a request to expand the used vehicle lot to include a new display building,
service area, and a retail and restaurant building. The project sites are located on the east side of
Waterman Avenue, north of the Twin Creek Flood Control Channel. (Exhibit 1)
At their meeting of March 3, 2004, the Planning Commission considered the applications for the
General Plan Amendment and Conditional Use Permit. After hearing testimony some of the
Commissioners were concerned about on-site parking and maintaining it and the drive aisles free
of display vehicles and other obstructions. Staff explained that the 150 stalls were adequate to
meet the requirements of the Development Code related to parking for both patrons and
employees. An additional Condition of Approval was added to address this concern. The
Planning Commission voted unanimously to recommend approval of the project. Commissioners
Durr, Enciso, Lockett, Sauerbrun, and Thrasher recommended approval. Commissioner Morris
was absent, and Commissioner Coute abstained.

FINANCIAL IMPACT
None. The applicant paid the Development Code Amendment and Conditional Use Permit filing
fees.

RECOMMENDATION
Staff recommends that the Mayor and Common Council close the hearing and that said
resolution be adopted, the Mitigated Negative Declaration and Mitigation Monitoring/Reporting
Program be adopted, and Conditional Use Permit No. 02-29 be approved based on the Findings
of Fact in the Planning Commission Staff Report, subject to the Conditions of Approval
(Attachment C) and Standard Requirements (Attachment D).

REOUEST AND LOCATION
The applicant requests approval of a General Plan Amendment under authority of
Development Code Section !l19.50.050 to change the land use district of a 5-acre parcel
from DIP, Office Industrial Park to CG-1, Commercial General. The applicant also
requests approval of a Conditional Use Permit under the authority of Development
Code Section 19.06.020, to construct an auto sales showroom/ service center and
retail/ restaurant structure on this 5-acre parcel. Additionally, the applicant requests
approval to remodel their existing facilities on the approximately 1.7 acre adjacent lot in the
CG-1, Commercial General land use district. The 6.7 acre site, is located on the east side
of Waterman Avenue north of Mill Street, at 295,297,299,305, and 333 South Waterman
Avenue (Attachment A).
The proposed auto sales showroom/ service center and retail/ restaurant structure will
be constructed on a 5-acre parcel, which is partially vacant and partially being used as a
parking lot under Temporary Use Permit No. 03-74. The existing used car dealership
known as A-One Automotive will be remodeled to match the architecture proposed for
the new showroom/ service center and retail/ restaurant building (Attachment B). The
proposed hours of operation are from 9:00 AM to 9:00 PM in conjunction with the
existing A-One auto dealership. The restaurant is being reviewed in concept only;
when an actual tenant is selected they will be required to process a Development
Permit.
SETTING/SITE CHARACTERISTICS
The site is basically triangular in shape consisting of approximately 6.7-acres in total
size. To the north of the site is commercial retail in the DIP, Office Industrial Park land
use district. To the west the site abuts by Waterman A venue with an existing self-
storage facility in the OIP, Office Industrial Park land use district on the west side of
Waterman Avenue. To the south and east the site is abutted by the San Bernardino
County Flood Control Channel in the PFC, Public Flood Control land use district with
self-storage in the OIP land use district and a retail strip center in the CG-l, Commercial
General land use district to its south.
BACKGROUND
The project was submitted on December 16, 2002, however the application was deemed
incomplete on January 14, 2003. Staff worked with the applicant through October 2003
to be able to take the project to the Development/Environmental Review Committee for
review and consideration.
The Development/Environmental Review Committee first reviewed the project on
November 20, 2003 when the Initial Study was approved for public review and
comment. The Development/Environmental Review Committee (D/EDRC) last heard

this project on January 8, 2004, at which time the project was moved to the Planning
Commission for review and determination.
CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) STATUS
Planning staff reviewed the project and found potential environmental impacts related
to the specific use. An Initial Study was prepared with a Mitigated Negative
Declaration and circulated for public review from November 27, 2003 through
December 16, 2003. No comments were received during the public review period.
FINDINGS AND ANALYSIS FOR THE GENERAL PLAN AMENDMENT
1. Is the proposed amendment internally consistent with the General Plan?
The proposed amendment would be internally consistent with the General Plan
in that it would allow for the expansion of an existing commercial facility and the
creation of new commercial facilities to serve the local and the regional public.
2. Would the proposed amendment be materially detrimental to the public interest, health,
safety, convenience or welfare of the City?
No, the proposed amendment would not be materially detrimental to the public
interest, health, safety, convenience or welfare of the City. It would actually be
beneficial to the city in that the applicant demolished some structures that had
become run-down and he proposes to construct new development with a unified
architectural theme. Additionally the applicant proposes to provide the
appropriate landscaping and amenities-to give that area of Waterman Avenue a
'face-lift' of sorts while bringing it into compliance with the standards in the
Development Code. The face lift to that area of Waterman Avenue can only
occur if the General Plan Amendment and the Conditional Use Permit
applications are approved, thus the approval of the amendment would be
beneficial in that it will result in the revitalization of that area through proposed
development.
3. Would the praposed amendment maintain the apprapriate balance of land uses within the
City?
The proposed amendment would maintain the appropriate balance of land uses
within the City as it would be affecting a small project site area (approximately 5
acres),representing a fraction of the overall land within each land use category.
4. Is the subject parcel physically suitable (including, but not limited to, access, provision of
utilities, compatibility with adjoining land uses, and absence of physical constraints) for
the requested land use designation(s) and the anticipated land use develapment?

The subject parcel is physically suitable for the requested land use designation
and the anticipated land use development in that it will be providing access
through existing streets, all utilities would be provided as part of the
development of the project site, it would be an expansion of the land use to the
south, it would be compatible with the surrounding land uses, and the land is
absent of physical constraints.
FINDINGS AND ANALYSIS FOR THE CONDITIONAL USE PERMIT
1. Is the proposed use conditionally permitted within the subject land use district,
would it impair the integrity and character of the subject land use district, and
does it comply with all of the applicable provisions of this Development Code?
Yes, pursuant to Development Code Section 19.06.020 Table 06.01 (B)(4), used
vehicle sales are permitted in the CG-1, Commercial General land use district,
subject to the approval of a Conditional Use Permit. The proposed project
complies with all applicable provisions of the Development Code as shown
below in Table" A" below.

existing site. The proposed development will meet all minimum setback
requirements for landscaping as per the Development Code requirements, while
the existing site will be modified to meet Development Code standards.

2. Is the proposed use consistent with the General Plan?
Yes, the proposal is consistent with the General Plan as follows:
General Plan Goal1B states: "Provide employment opportunities for existing and
future residents of the City and those of adjacent communities"
General Plan Policy 1.19.10 states: "Permit a diversity of community-serving
retail and service uses....in areas designated as Commercial General".
The proposed project will provide employment and retail service opportunities
for local residents and the surrounding community. The project has been
designed and conditioned to ensure compatibility with adjacent uses.
3. Is the appraval of the Conditional Use Permit for the proposed use in compliance
with the requirements of the California Environmental Quality Act and Section
19.20.030(6) of the Development Code?
Yes, the proposed project complies with the CEQA requirements via the
Mitigated Negative Declaration and the Development Code. The hours of
operation and the type and placement of the communication system will be
regulated by conditions of approval to mitigate the potential impacts on the
adjacent uses. In addition, all grading and construction activities will be
implemented and monitored in accordance with the Public Works standard
requirements to ensure that the project would not cause any substantial adverse
construction impacts. Furthermore the potential impacts from drainage will be
mitigated through the Storm Water Pollution Prevention Plan (SWPPP) and the
Notice of Intent and permitting process through the Santa Ana Regional Water
Quality Control Board (RWQCB).
4. Are there potentially significant negative impacts upon environmental quality
and natural resources that could not be properly mitigated and monitored?
No, as noted in Finding No.3, this project complies with CEQA and
Development Code requirements.
5. Are the location, size, design, and operating characteristics of the proposed use
compatible with the existing and future land uses within the general area in

which the proposed use is to be located and will it create significant noise, traffic
or other conditions or situations that may be objectionable or detrimental to other
permitted uses in the vicinity or adverse to the public interest, health, safety,
convenience, or welfare of the City?
Yes, the proposed project will be located in an existing CG-l Commercial
General land use district (provided the General Plan Amendment is
approved), which is intended to serve the surrounding community. The
proposal will operate in a manner consistent with the regulations of the
CG-lland use district, as well as the noise standards of the General Plan.
It is anticipated that construction of the new showroom/ service center
and retail/ restaurant building will not create any conditions that are
detrimental to public health. The proposed project complies with all
applicable provisions of the Development Code in that all activities will be
conducted within enclosed structures.
The proposed project will be a complementary land use to the
surrounding community. Based on the project design layout, the
proposed project will not adversely impact adjacent surrounding uses.
The proposal is a community-serving retail facility, which will attract
people from within the City and the surrounding area. Since the
proposed project is consistent with the General Plan and Development
Code, no land use conflict or adverse environmental impacts will result
from the construction and operation of the proposed project.
Access
Vehicular access to the proposed project site will be via two new driveways on
Waterman Avenue, as well as interior access between the two properties.
Additionally, the two existing driveways will still be used to access the existing
site area from Waterrnan Avenue.
Parking
The Development Code Section 19.24.040 requires 150 parking spaces for this
project. The proposal complies with parking requirements with 146 standard
and 4 handicap for a total of 150 stalls.
Landscaping
The proposed landscaping of 15% meets Development Code requirements of
15%.
6. Is the subject site physically suitable for the type and density/intensity of use
being proposed?
Yes, the site is physically suitable for the type and density/intensity of the
project being proposed as evidenced by project compliance with all applicable
Conditional Use Pennit No. 02-29 & General Plan Amendment No. 02-10

Development Code Standards for lot coverage, height limitation, setbacks,
landscaping and parking requirements as discussed in Finding No.1 above and
illustrated in Table" A."
7. Are there adequate provisions for public access, water, sanitation, and public
utilities and services to ensure that the proposed use would not be detrimental to
public health and safety?
Yes, all agencies responsible for reviewing access, and providing water,
sanitation and other public services have had the opportunity to review the
proposed project, and all have indicated an ability to serve the project. The
proposal will not be detrimental to the public health and safety in that all
applicable Codes will apply to the construction of this project.

CONCLUSION
The proposal meets all necessary Findings of Fact for approval of the General Plan
Amendment and the Conditional Use Permit.
RECOMMENDATION
Staff recommends that the Planning Commission recommend that the Mayor and
Common Council:
. Adopt the Mitigated Negative Declaration and Mitigation Monitoring/Reporting
Program;
. Approve General Plan Amendment No. 02-10 based upon the Findings of Fact
contained in this Staff Report and subject to the Conditions of Approval
(Attachment C) and Standard Requirements (Attachment D); and
. Approve Conditional Use Permit No. 02-29 based upon the Findings of Fact
contained in this Staff Report and subject to the Conditions of Approval
(Attachment C) and Standard Requirements (Attachment D).

CONDITIONS OF APPROVAL
GENERAL PLAN AMENDMENT NO. 02-10 &
CONDITIONAL USE PERMIT NO. 02-29
1. The General Plan Amendment requested is to change the land use designation on
approximately 5-actres from OIP, Office Industrial Park to CG-1, Commercial
General. The Conditional Use Permit is a request to construct 49,380 square feet
mixed retail facilities including a vehicle sales showroom/ service center totaling
39,945 square feet, a retail/restaurant structure totaling 9,435 square feet, and a
remodel of the existing A-One auto dealership.
2. Within two years of development approval, commencement of construction shall
have occurred or the permit; approval shall become null and void. In addition, if
after commencement of construction, work is discontinued for a period of one year,
then the permit/ approval shall become null and void. However, approval of the
General Plan Amendment and Conditional Use Permit does not authorize
commencement of construction. All necessary permits must be obtained prior to
commencement of specified construction activities included in the Conditions of
Approval and Standard Requirements:
Expiration Date: Two years from Mayor & Common Council approval.
3. The review authority may grant a one-time extension, for good cause, not to exceed
12 months. The applicant must file an appljcation, the processing fees, and all
required submittal items, 30 days prior to the expiration date. The review authority
shall ensure that the project complies with all Development Code provisions in
effect at the time of the requested extension.
4. In the event this approval is legally challenged, the City will promptly notify the
applicant of any claim, action or proceeding and will cooperate fully in the defense
of this matter. Once notified, the applicant agrees to defend, indemnify and hold
harmless the City of San Bernardino (City), the Economic Development Agency of
the City of San Bernardino (ED A), any departments, agencies, divisions, boards or
commission of either the City or EDA as well as predecessors, successors, assigns,
agents, directors, elected officials, officers, employees, representatives and attorneys
of either the City or EDA from any claim, action or proceeding against any of the
foregoing persons or entities. The applicant further agrees to reimburse the City for
any costs and attorneys' fees which the City may be required by a court to pay as a
result of such action, but such participation shall not relieve applicant of his or her
obligation under this condition.
The costs, salaries, and expenses of the City Attorney and employees of his office
shall be considered as "attorneys fees" for the purpose of this condition.

As part of the consideration for issuing this permit, this condition shall remain in
effect if the General Plan Amendment and/ or the Conditional Use Permit is
rescinded or revoked, whether or not at the request of applicant.
5. This permit or approval is subject to all the applicable provisions of the
Development Code in effect at the time of approval. This includes (but is not limited
to) Chapter 19.20 - Property Development Standards, and includes: dust and dirt
control during construction and grading activities; emission control of fumes,
vapors, gases and other forms of air pollution; glare control; exterior lighting design
and control; noise control; odor control; screening; signs, off-street parking and off-
street loading; and, vibration control. Screening and sign regulations compliance is
important considerations to the developer because they will delay the issuance of a
Certificate of Occupancy until they are complied with. Any exterior structural
equipment, or utility transformers, boxes, ducts or meter cabinets shall be
architecturally screened by wall or structural element, blending with the building
design and include landscaping when on the ground.
6. If the color of any of the buildings, walls or fences or other exterior finish material is to
be modified, the revised color scheme and/ or finish materials shall be reviewed and
approved by the Planning Division prior to commencement of work.
7. Signs are not approved as a part of this permit. Prior to establishing any new signs,
or replacing existing signs, the applicant shall submit an application, and receive
approval, for a sign permit from the Planning Department. Signs painted on the
outside of the building are prohibited
8. No painted window signs, roof signs, permanent sale or come-on signs will be
permitted at this site per SBMC ~ 19.22.060
9. Signs/banners may not be placed on or over the roof or within landscaped areas.
Banners and other signs for special events (i.e., grand opening) will require a
Temporary Sign Permit to be approved by the Planning Division prior to
installation/hanging.
10. No signs/banners shall encroach into the public right of way per SBMC ~
19.22.060(N).
11. If public/pay telephones are located on the site, they shall be located inside the
building and fixed for outgoing calls only.
12. All vandalism and graffiti must be repaired/ removed within 24 hours of its
occurrence. The management shall take a photograph of the graffiti and provide it to
the Police Department before removing the graffiti.

13. All exterior lighting shall be energy efficient with the ability to lower or reduce usage
when the store is closed. Signage may be required to be turned-off when the store is
closed. No spill over is permitted.
14. All setback landscaping along Waterman Avenue shall be 10' (minimum). The
existing site landscaping shall be modified to meet current setback requirements of 10'
(minimum).
15. Any/all speakers, buzzers, and similar devices onsite shall be maintained so that no
sound/ noise is audible beyond the property line.
16. Hours of operation shall be limited to 9:00 a.m. - 9:00 p.m.
17. The proposed restaurant shall meet all Development Code standards, and may be
required to obtain separate entitlements depending upon the proposed use onsite.
18. If any entertainment activities are proposed at this location a separate Conditional
Use Permit will be required.
19. Loading/ unloading of vehicles shall occur on-site only and shall not be permitted
on Waterman Avenue.
20. No vehicles shall be parked/ displayed on the sidewalk or any other right of way or
required path of travel, or on any landscaped areas.
21. All drive aisles shall remain clear and unoJ:>structed at all times.
22. A bond an amount to cover the cost of the irrigation, landscaping, and other
required improvements shall be posted with the Public Works Division in order to
serve as a performance guarantee as stated in Development Code Section 19.44.120
23. No final Certificate of Occupancy shall be issued until all conditions of approval
have been completed.
24. This permit or approval is subject to the attached conditions or requirements of the
following City Departments or Divisions:
a. Public Works, Engineering Division
b. Fire Department
c. Public Services Department
d. Building and Safety Division
e. Municipal Water Department

. NOTE TO APPLICANT: Where separate Engineering plans are required, the applicant is

may be submitted prior to submittal of Building Plans.
1. Drainage and Flood Control
a) All necessary drainage and flood control measures shall be subject to
requirements of the City Engineer, which may be based in part on the
recommendations of the San Bemardino County Flood District. The
developer's Engineer shall fumish all necessary data relating to drainage
and flood control.
b) A permit will be required from the Department of Transportation and Flood
Control, if any work is required within the Flood Control District's right-of-
way.
c) A local drainage study will be required for the project. Any drainage
improvements, structures or storm drains needed to mitigate downstream
impacts or protect the development shall be designed and constructed at
the developer's expense, and right-of-way dedicated as necessary.
d) All drainage from the development shall be directed to an approved public
drainage facility. If not feasible, proper drainage facilities and easements
shall be provided to the satisfaction of the City Engineer.
e) If site drainage is to be outletted into the public street, the drainage shall
be conveyed through a parkway culvert constructed in accordance with
City Standard No. 400. Conveyance of site drainage over the Driveway
approaches will not be permitted.

f) Applicant shall mitigate on-site storm water discharge sufficiently to
maintain compliance with the City's NPDES Storm Water Discharge
Permit Requirements. A "Notice of Intent (NOI)" shall be filed with the
State Water Quality Control Board for construction disturbing 1 acre or
more of land.
g) The City Engineer, prior to grading plan approval, shall approve an
Erosion Control Plan. The plan shall be designed to control erosion due
to water and wind, including blowing dust, during all phases of
construction, including graded areas which are not proposed to be
immediately built upon.
2. Grading and Landscaping
a) If more than l' of fill or 2' of cut is proposed, the site/plot/grading and
drainage plan shall be signed by a Registered Civil Engineer and a
grading permit will be required. The grading plan shall be prepared in
strict accordance with the City's "Grading Policies and Procedures" and
the City's "Standard Drawings", unless otherwise approved by the City
Engineer.
b) If more than 5,000 cubic yards of earthwork. is proposed, a grading bond
will be required and the grading shall be supervised in accordance with
Section 7012(c) of the uniform Building Code.
c) If more than 1,000 cubic yards of earth is to be hauled on City Streets
then a special hauling permit shall be obtained from the City Engineer.
Additional conditions, such as truck route approval, traffic controls,
bonding, covering of loads, street cleaning, etc. may be required by the
City Engineer.

d) A liquefaction evaluation is required for the site. This evaluation must be
submitted and approved prior to issuance of a grading permit. Any
grading requirements recommended by the approved liquefaction
evaluation shall be incorporated in the grading plan.
e) An on-site Improvement Plan is required for this project. Where feasible,
this plan shall be incorporated with the grading plan and shall conform to
all requirements of Section 15.04-167 of the Municipal Code (See
"Grading Policies and Procedures").
f) A refuse enclosure constructed in accordance with City Standard Drawing
No. 508. The minimum size of the refuse enclosure shall be 8 feet x 15
feet, unless the Public Services Department, Refuse Division, approves a
smaller size, in writing.
g) Retaining walls, block walls and all on-site fencing shall be designed and
detailed on the On-site Improvement Plan. This work shall be part of the
On-site Improvement permit issued by the City Engineer.
h) The on-site improvement plan shall include details of on-site lighting,
including light location, type of poles and fixtures, foundation design,
conduit location and size, and the number and size of conductors.
Photometry calculations shall be provided which show that the proposed
on-site lighting design will provide 1 foot-candle of illumination uniformly
distributed over the surface of the parking lot during hours of operation
and 0.25 foot-candles security lighting during all other hours.
i) . The design of on-site improvements shall also comply with all
requirements of The California Building Code, Title 24, relating to
handicap parking and accessibility, including retrofitting of existing
building access points for handicap accessibility, if applicable.

j) A handicap accessible path of travel shall be provided from the public way
to the building entrance. All pathways shall be concrete paved and shall
provide a minimum clear width of 4 feet. Where parking overhangs the

g) As an alternative to undergrounding required by Section 19,20.030 (non-
subdivision) of the Development Code, the developer will provide a letter
of agreement for participation in an assessment district, if one is formed,
to fulfill the requirement for undergrounding utilities. Prior to issuance of

1.7 acres ofland with 18,745 square feet of buildings on the site. The expansion onto the five-acre site
would include an additional 35,953 square feet of constructed buildings. When the project is
completed, it would be located on 6.7 acres of land with approximately 54,700 square feet of buildings
on-site. Included in the project is construction of a showroom with executive offices, a
retail/commercial building, extensive landscaping, service and detail centers, and vehicle display areas.
Landscaped areas would occupy fifteen percent of the five-acre expansion site with remaining areas
covered by buildings, asphaltic concrete or stamped Portland cement concrete.
8. Surrounding Land Uses and Setting: The project site is currently vacant, but is fenced around its
peri~eter. Existing commercial buildings have been demolished. The surface has been overlaid with
gravel and is being used temporarily to store vehicles. A Temporary Use Permit (TUP) was applied
for and denied. The applicant is appealing the decision. South of and adjacent to the five-acre site are
the existing ~ - One sales and service buildings with various display areas for purchasable cars. The

DISCUSSION OF IMPACT LEVELS AND MITIGATION MEASURES
I. LAND USE AND PLANNING
a) The project site is located at 295, 297, 299, and 305 South Waterman Avenue. This five-acre parcel is
currently zoned Office Industrial Park (OIP) with the adjacent southern property zoned General
Commercial (CG-I). The planned use of the five-acre parcel is the expansion of the existing auto
dealership located south of the project site at 33J South Waterman A venue. Past uses of the project
site included an auto repair shop and various office and retail uses. According to the OIP zoning in the
City of San Bernardino General Plan, car sales and repair are not permitted uses within the OIP zone.
The applicant has requested a General Plan Amendment and zone change to redesignate the property
from OIP to CG-l in order to expand the Auto Center. A Conditional Use Permit for auto sales and
service has also been requested by the project applicant to consolidate their current land holdings into
one single property zoned for General Commercial uses. Upon approval of the CUP, General Plan
Amendment, and zone change, no impacts to land use and zoning would occur.
b) The proposed project is not within "an Airport District as identified in the City of San Bernardino's
Development Code. The closest airport is the San Bernardino International Airport (former Norton Air
Force Base) located approximately 1.1 miles to the east. The project site is also offset to the north of
the runway flight pattern. There are no significant project-related impacts associated with airports or
airfields.
c) The project site is not located in a Fire Hazard Zone as shown on City's General Plan Figure 61;
therefore no impact is expected.

II. POPULATION AND HOUSING
a) No housing currently exists on-site. The site is currently designated as Office Industrial Park. No
impact would occur to existing housing.
b) The expansion of an auto dealership would not be expected to generate demand for additional housing.
The proposed project would not produce significant employment opportunities requiring the demand
for construction of additional housing. The auto related uses of the site are expected to increase
employment by fourteen persons and the commercial uses would employ an estimated sixteen persons.
The maximum of thirty new employees would not impact housing.
c) The project site is located in an urban area, so required infrastructure already exists as local electrical
and water providers served previous businesses. The expansion would not induce substantial growth.
III. EARTH RESOURCES
a-b) The project site is located on a previously graded area that had been developed with commercial uses
in the recent past. Minimal grading would take place to prepare the area for construction. No slopes
greater than fifteen percent occur in the general area; therefore no impact is expected.
c) No unstable soil conditions would occur due to excavation, grading, or fill activities. However, during
the construction phase of the project dust may be generated due to the operation of machinery on-site
or high winds. Additionally, erosion of soils CQuld occur due to a storm event. According to Figure
59 of the City's General Plan the site location iSflot in a high wind area diminishing the potential for
soil erosion arising from high winds. To avoid the erosion of soils due to water the site contractor
would be required to implement a Storm Water Pollution Prevention Program (SWPPP) to comply
with the National Pollutant Discharge Elimination System (NPDES) permit. This is addressed more
completely in the Water section of the Initial Study. To avoid soil erosion due to unforesee~ high
winds and construction traffic, mitigation measures would be implemented that would control soil loss
and also contribute to the reduction in air contaminates associated with minute soil particles ten
microns in diameter or less, referred to as PM,.. See the Air Quality section for a further discussion of
the control of blowing soil and mitigation measures used to inhibit their migration off-site.
d) The project location north of the intersection of Waterman A venue and Mill Street, at the addresses of
295,297,299,305 South Waterman Avenue is outside of an Alquist-Priolo Special Studies Zone as
depicted on Figure 47 of the City of San Bernardino's General Plan. Although the site is outside of an
Alquist-Priolo Special Study Zone, it could potentially be affected by three nearby faults, which could
produce significant ground shaking during an earthquake event. The faults listed by their proximity to
the project site are the Glen Helen Fault, the San Jacinto Fault, and the San Andreas Fault; each is
discussed below.
A splay of the Glen Helen Fault appears to be approximately two tenths of a mile south of the site,
inferred from magnetic surveys and other seismic evidence, but shows no surface expression. The
Glen Helen Fault believed to be a branch of the San Jacinto Fault zone, is the only fault within the

eastern San Gabriel Mountains that has a variety of more or less continuous youthful fault features,
such as sag ponds and scarps. Possible magnitudes for rupture on the Glen Helen Fault are not known.
The San Jacinto Fault is a right-lateral strike-slip, minor right-reverse fault located 1.7 miles southwest
of the site. The San Jacinto Fault is 130 miles long affecting communities including San Bernardino,
Lorna Linda, Hemet (in Riverside County), and Ocotillo Wells (in Imperial County). The last major
earthquake on the San Jacinto was on April 9, 1968 when a 6.5 Mw occurred on the Coyote Creek
segment. A possible earthquake occurring on the San Jacinto Fault could be 7.5 Mw.
The San Andreas Fault located 4.4 miles north of the project site is a right-lateral strike-slip fault
extending from southern California into northern California. The last major rupture of the San Andreas
Fault on the southern California segment occurred on January 9, 1857. Expected magnitudes of
earthquake strength are between 6.8 and 8.0 Mw.
Earthquakes, due to their ground acceleration and shifting, can cause major damage to buildings and
create dangerous hazards to people through injury or death. Development in the seismically active
southern California region must mitigate these potential hazards through strict adherence to the
California Building Code (CBe) and recommendations by geotechnical engineers. The proposed
project is located outside of an Alquist-Priolo Special Studies Zone, and would implement established
building construction requirements. The impact from earthquake hazards is therefore deemed less than
significant.
e) The project area does not contain any unique geologic or physical features.
f) The project area is not located in an area identified as having High Potential for Water or Wind erosion
(reference Figure 53 of the General Plan).
g) The planned project is located next to the Warm Creek concrete lined drainage channel. San
Bernardino County Flood District maintains this water way and consequently, has made improvements
to ensure its functional operation including the concrete channelization and fencing along the channel
to prohibit trespass. In addition, at the top of the channel embankments are dirt access roads for Flood
Control personnel. The new five-acre portion of the project incorporates a ten-foot setback for an
easement owned by the Southern California Edison Company (SCE). The easement would allow
access for SCE personnel. The project would also implement a nine-foot high block wall to separate
day-to-day operations from the SCE easement. No modification of the Warm Creek Channel would
occur due to the project.
h) The site is located in an area that is affected by subsidence as shown in Figure 5 I in the General Plan .
for the City of San Bernardino. As noted in III. D above, the City of San Bernardino is influenced by
several different faults within its boundaries, which could lead to subsidence during a seismic event.
Subsidence is caused by subsurface mining or the pumping of oil or groundwater, which is followed
by a settling or sinking of soils in the vicinity of the pumping activity. In the City of San Bernardino it
is groundwater. Normally, groundwater levels must drop several hundred feet for subsidence to occur.
As noted in the City of San Bernardino General Plan, the historic area of subsidence was within the

thick, poorly consolidated alluvial and marsh deposits of the artesian area north of Lorna Linda. Since
1972, the San Bernardino Municipal Water District has maintained groundwater levels from recharge
basins and problems with subsidence have not been identified since the program began. City
maintained groundwater recharge programs would keep the impact from subsidence less than
significant.
i) The proposed project site is located in an area subject to liquefaction according to Figure 48 of the
General Plan. Liquefaction is the process by which cyclic stresses produced by earthquake induced
ground motion create excess pore pressures in soils which can cause various kinds of ground failure at
or near the surface leading to property damage or structural failure. Groundwater saturated sediments
are required for liquefaction to occur and the closer to the surface the saturated sediments are, the
greater the susceptibility to liquefaction: According to the Phase I site assessment entitled, Report of
Findings Phase / Environmental Site Assessment Approximately Five (5) Acres of Commercial
Property 295, 297, 299, and 305 S. Waterman A venue San Bernardino, California, conducted in 2002
and revised on May 14,2003, groundwater was encountered at 47.5 feet below ground surface and
historical high groundwater levels have been as close as ten feet below ground surface. The site has
previously been developed and used for commercial uses and auto repair facilities. Due to the seismic
activity in the southern California region and the high groundwater levels in the area, liquefaction
would remain a potentially significant impact at the project site. The following mitigation measures
should be implemented to minimize property damage and structural failure.
ER-l. All building specifications shall adhere to the California Building Code to ensure building
strength and safety.
ER-2. All engineering designs shall incorporate construction techniques which maximize seismic
safety for on-site buildings.
ER-3. The project proponent will be required to submit site.specific geotechnical reports to the
City engineer prior to the issuance of grading permits. These reports will be required to
detail the appropriate soil excavation techniques required to ensure that the proposed
buildings are located on properly compacted pads.
IV. WATER
a-b) The project site is currently relatively flat, and has been covered with gravel. It is temporarily being
used for the storage of cars. Development of the site includes buildings, stamped Portland cement
concrete, asphalt, and landscaped areas. Approximately sixty-eight percent of the site would be
covered in impervious surfaces such as pedestrian walkways, decorative vehicular hardscape, or
asphalt. Stormwater runoff will occur from the project site due to the hardscape surfaces. Design ofthe
project would include the implementation of on-site storm drains to convey on-site flows to the
underground drain system as per current City policy requirements. San Bernardino County has also
prepared a comprehensive storm drain plan for planning purposes and the City of San Bernardino uses
the storm drain plan for development of the storm drain system. The additional impervious surfaces

would increase surface run-off, but proper design of the project site and the adequate planning,
construction, maintenance, and funding for storm drain and flood control facilities reduces the impact
to less than significant.
c-d) To avoid alteration of surface water quality and groundwater quality the A - One Auto Center would
be expected to implement Best Management Practices (BMP's) which work to reduce, to the
maximum extent practical, discharge of pollutants to the storm drain system. BMP's in place during
operations normally include worker education, landscape management, catch basins, lot sweeping, and
the placing of hazardous materials under covered storage areas. All uses of motor oils, greases,
solvents, etc., would be contained on-site in drum containers and hauled away by approved hazardous
waste haulers as currently occurs at the existing site. No construction vehicle maintenance would
occur at the site. The addition of concrete and landscaping for on-site surfaces would reduce the
amount of loose sediments available to be washed off-site.
The State of California is authorized to administer various aspects of the National Pollution Discharge
Elimination System (NPDES). Construction activities covered under the State's General Construction
permit include removal of vegetation, grading, excavating, or any other activity that causes the
disturbance of one acre or more. The General Construction permit requires recipients to reduce or
eliminate non-storm water discharges into storm water systems, and to develop and implement a Storm
Water Pollution Prevention Plan (SWPPP). The Regional Water Quality Control Board (RWQCB),
Santa Ana Region has issued an area-wide NPDES Storm Water Permit for the County of San
Bernardino, the San Bernardino County Flood Control District, and the incorporated cities of San
Bernardino County within the Santa Ana Region. The City of San Bernardino then requires
implementation of measures for a project to comply with the area-wide permit requirements. The
SWPPP will include BMPs to prevent the project from polluting surface waters. This is a standard
condition of approval applicable to most urban projects. BMPs would include, but are not limited to
street sweeping of paved roads during construction, and the use of hay bales or sand bags to control
erosion during the rainy season. Mitigation measures will be implemented to ensure impacts from
water runoff and erosion are less than significant.
A final grading plan will be prepared in accordance with City standards to show how storm water
runoff will be handled both during construction and post-construction. Grading must establish a
gradient on-site that would cause stormwater run-off to drain away from the Warm Creek Channel and
toward storm drains in Waterman Avenue. Stormwater entering the City's storm drain would be
treated prior to leaving the site. Approval of grading plans and conditions applied to the project by the
City Engineer to ensure adequate site drainage and adherence to BMPs identified in the SWPPP will
make this impact less than significant.
e) The project area does not occur within a IOO-year Flood Plain as shown on Figure 62 of the City's
General Plan.
W-I. The project shall be conditioned to establish a storm system on-site that would intercept
run-off and trap sediments. The applicant shall prepare a Water Quality Management

Plan for the project that includes a description of the proposed drainage system and the
various components that would be in place such as containment systems around storage
areas, to contain any spills or leaks; and grease separators that would filter the stormwater
before it enters the storm drain system.
W -2. Prior to the issuance of a grading permit, a site-specific drainage study, which meets the
standards of the City of San Bernardino Public Works division will be prepared by a Civil
Engineer who is registered in the State of California. All recommendations from this
analysis, including facilities necessary to mitigate drainage impacts, maximize percolation
and groundwater recharge to the extent feasible shall be incorporated in all grading and
site improvement plans.
W -3. The applicant shall mitigate on-site storm water discharge sufficiently to maintain
compliance with the City's NPDES Storm Water Discharge Permit Requirements. A
"Notice of Intent (NOI)" shall be filed with the State Water Quality Control Board for
construction disturbing one acre or more of land. Prior to the issuance of a grading
permit, the applicant shall submit a Storm Water Pollution and Prevention Plan (SWPpp)
specifically identifying Best Management Practices (BMP's) that will be used on-site to
reduce the pollutants into the storm drain system to the maximum extent practical.
W -4. An erosion control plan shall be prepared and implemented for the proposed project that
identifies specific erosion control measures to control on-site and off-site erosion from the
time of ground disturbing activities are initiated through completion of grading. This
erosion control plan shall include the foRo wing measures at a minimum.
a) Specify the timing of grading and construction to minimize soil exposure to rainy
periods experienced in southern California.
b) An inspection and maintenance program shall be included to insure that any erosion
which does occur either on-site or off-site as a result of this project will be corrected
through a remediation or restoration program within a specified time frame.
c) Filing a Notice ofIntent and obtaining a project permit will be required through the
Water Quality Control Board relating to a National Pollution Discharge Elimination
System (NPDES) standards prior to beginning of grading work.
V. AIR QUALITY
a) The proposed project was screened using the Urban Emission Model 2001 (URBEMIS 2(01) prepared
by Jones & Stokes under the guidance of the San Joaquin Valley Unified Air Pollution Control
District, the Ventura County Air Pollution Control District, and the South Coast Air Quality
Management District (SCAQMD). The program generates emissions estimates for land use
development projects. The criteria pollutants screened for included: reactive organic gases (ROO),

nitrous oxides (NO,), carbon monoxide (CO), and particulates (PM 10). Two of these, ROO and NO"

To ensure air pollutant emissions remain below threshold levels during construction, standard mitigation
measures are required by City's and County's to be used by developers and contractors. Mitigation

measures included at the end of this section will ensure less than significant impacts and protection of air
quality standards.
b) As noted in the air quality modeling tables, all pollutant levels would remain below significant threshold
levels for both construction and operation. Sensitive receptors, such as hospitals, homes, or daycare
centers, are not located within the vicinity of the planned project area and therefore would not be affected
by pollutants emitted from the project site.
c) The proposed project would not alter air movement, moisture, temperature, or cause a change in climate.
No impact is expected. .
d) Substantial industrial operations would not occur on-site that would be associated with offensive
chemical emissions. Sensitive receptors are not located in the area as the land use designation in the
vicinity is Office Industrial Park or General Commercial. The lack of sensitive receptors relieves impacts
associated with objectionable odors.
AQ-I The project shall comply with the requirements of the SCAQMD Rules 402 and 403,
fugitive dust, which requires the implementation of Reasonable Available Control Measures
(RACM) for all fugitive dust sources, and the Air Quality Management Plan (AMCP), which
identifies Best Available Control Measures (BACM) and Best Available Control
Technologies (BACT) for area sources and point sources, respectively. This would include,
but not be limited to the following:
I. The project proponent shall ensure that construction equipment shall be properly
maintained and serviced to minimize exhaust emissions.
2. The project proponent shall ensure that existing power sources are utilized where
feasible via temporary power poles to avoid on-site power generation.
3. The project proponent shall ensure that any portion of the site to be graded shall be
pre-watered to a depth of three feet prior to the onset of grading activities.
(a) The project proponent shall ensure that watering of the site or other soil
stabilization method shall be employed on an on-going basis after the initiation
of any grading activity on the site. Portions of the site that are actively being
graded shall be watered regularly to ensure that a crust is formed on the
ground surface, and shall be watered at the end of each workday.
(b) The project proponent shall ensure that all disturbed areas are treated to
prevent erosion until the site is constructed upon.

(c) The project proponent shall ensure that landscaped areas are installed as soon
as possible to reduce the potential for wind erosion.
(d) The project proponent shall ensure that SCAQMD Rule 403 is adhered to,
insuring the clean up of construction-related dirt on approach routes to the
site.
(e) The project proponent shall ensure that all grading activities are suspended
during first and second stage ozone episodes or when winds exceed 25 miles
per hour.
(f) All buildings on the project site shall conform to energy use guidelines in Title
24 of the California Administrative Code.
AQ-2 To reduce emissions all equipment used in grading and construction must be tuned
and maintained to the manufacturer's specification to maximize burning of vehicle
fuel.
AQ-3. The contractor shall utilize (as much as possible) pre-coated building materials, water
based or low VOC coating, and coating transfer or spray equipment with high
transfer efficiency, such as high volume, low pressure (HVLP) spray method, or
manual coatings application such as paint brush, hand roller, trowel, dauber, rag, or
sponge.
AQ-4. The project proponent shall, prior to the issuance of grading permit, receive approval
of an erosion control plan and PMt. plan from the Public Works Division of the
Development Services Department.
AQ-S. The project shall be required to obtain any required permits from the South Coast
Air Quality Management District (SCAQMD), and will be subject to rules 402 and
403 to regulate short-term air pollutants.
AQ-6. The project will be required to submit grading plans and obtain grading permits from
the City of San Bernardino. Cut and fill quantities shall be balanced on-site as per
the proposed plans. The grading plans shall include a notation that all construction
equipment shall be tuned and maintained in accordance with manufacturer's
specifications and requirements of the National Pollutant Discharge Elimination
System (NPDES).

VI. TRANSPORTATION
a-c) A Traffic Study was conducted by Hernandez. Kroone. and Associates in August of 2003 for the
expansion of the A - One Auto Center onto the parcel immediately north of its existing site. The
analysis was prepared using generally accepted professional traffic engineering standards and
practices. The intersections of Waterman A venue and Mill Street. and Waterman A venue and Rialto
A venue were analyzed to evaluate the project' s traffic impacts to existing conditions and ten years in
the future (2013). The City of San Bernardino has established a Level of Service (LOS) C to be the
lowest acceptable LOS at most city intersections.
The concept of Level of Service (LOS) IS used to describe the operating characteristics of the street
system in terms of the level of congestion or delay experienced by traffic. Service levels range from A
through F with each level defined by a range of volume-to-capacity (V IC) ratios. LOS of A. B. or C
are considered good operation conditions with only minor delays being experienced by motorists.
The Traffic Study showed that the Waterman A venue and Rialto A venue intersection operates at an
acceptable LOS for all analyzed scenarios and the expansion of the A - One Auto Center would not
impact this intersection.
Under existing conditions the intersection of Waterman Avenue and Mill Street requires
improvements in order to achieve a LOS of C or better. According to the LOS analysis. the
intersection of Waterman A venue and Mill Street functions poorly due to the total volumes using the
intersection. The change in LOS from the existing scenario to the future scenario is a reduction in
Level of Service due to the anticipated growth in the area. which would include the A - One Auto
Center project. A reduction in Level of Service means a more congested intersection at Waterman and
Mill. The Traffic Analysis showed that congestion could be improved by making improvements to the
intersection. The Traffic Analysis proposed the addition of another westbound left turn lane at the at
the intersection of Waterman and Mill funded by a Fair Share contribution from business
development. The mitigation would make project traffic to this intersection less than significant.
d) The proposed expansion of the A - One Auto Center would not impact air or rail traffic. The nearest
airport is the San Bernardino International Airport l.l miles to the east with air traffic patterns offset
south of the site. The site does not use rail service. No impact is expected to air or rail traffic.
e) Due to the mixed-use design of the project several different parking standards apply to the project. The
total number of spaces required by the development would be 143 spaces. The applicant has designed
150 total spaces into the project exceeding Development Code requirements. No impact from insufficient
parking is expected.
fog) The siie is located on Waterman A venue a major arterial street used for travel between the north and
south portions of the City. Speeds in the vicinity of the project are posted at 45 m.p.h. Bicyclists and
pedestrians are rarely found on Waterman Avenue and no bike lane is provided. Most segments of
Waterman Avenue contain bus stops to take city travelers to various destinations. Project

implementation would not increase hazards to bicyclists or pedestrians. nor would it conflict with
alternative transportation.
h) The existing site is currently served by two driveways providing a separate entrance and exit. The
expanded site would be developed with two additional driveways. The new driveways would be thirty-
six feet wide allowing for ample ingress and egress. Interior roadways provide a minimum of twenty-
four feet of access for vehicles and allow travel to all interior destinations. No impact to inadequate
emergency access is expected. Waterman A venue is a designated state highway. The development of
additional driveways will require an encroachment permit from Caltrans.
TR-t. Prior to issuance of building permits, the developer will be required to pay a fair share contribution
to mitigate significantly impacted intersections under year 2010 with project conditions. These
improvements with the project's fair share contribution to improvement costs are as follows:
a. Waterman A venue and Mill Street - Addition of a westbound left turn lane - total cost
of $50,000, with the projects fair share being $3,500.
TR-2. The contractor shall time construction activities so as not to interfere with peak hour traffic and so
as to minimize obstruction through traffic lanes adjacent to the site. If determined necessary by
the Public Works Division a nag person shall be retained to maintain safety adjacent to existing
roadways.
VII. BIOLOGICAL RESOURCES
a-c) The proposed project does notlie within the Biological Resources Management Overlay (Figure 41 of
the City of San Bernardino General Plan), and according to Figure 40, Known Sensitive Elements, no
sensitive plants or animals occur in the vicinity ofthe site. The expansion of the A - One Auto Center
would occur on adjacent land, which has been previously disturbed by past construction and
operations. The site would not be suitable habitat for any plant or animal species because of its
previous land uses and proximity to other urban uses such as Waterman Avenue, the Warm Creek
Channel and existing development north and south of the site. The location of the site next to a major
arterial street such as Waterman A venue eliminates its use as a wildlife corridor. No impact to
sensitive biological species or their migration is expected.
d) The project area does not contain wetland or riparian habitat.
e) The site has been previously developed with office and commercial uses, which have been
subsequently demolished and cleared; no trees or shrubs exist on site.
VIII. ENERGY AND MINERAL RESOURCES
a-b) The proposed project will be required to meet building code requirements for energy conservation.
All constructed elements would be compatible with adopted policies regarding energy conservation.

c) The planned expansion of the A - One Auto Center does not lie within a Regionally Significant
Aggregate Sector as defined in Figure 42 of the San Bernardino City General Plan. A California
Department of Mines and Geology designated sector F for resources is depicted east of the proposed
site but, as stated in the General Plan, the area is highly urbanized and does not have direct freeway
access, which could cause safety concerns for City residents. No loss of mineral resources would occur
by project approval.
IX. HAZARDS
a) The A _ One Auto Center uses hazardous materials such as oils and solvents in daily operations of its
service facilities. The facility offers car detailing, repair, and other car related services. Currently, the
site contracts with Safety Kleen to dispose of solvent wastes generated during normal business
operations. The A - One Auto Center also has obtained a permit from the Department of Health
Services and the City Fire Department registering the use of certain hazardous materials on site in
compliance with the Tanner Act. The use or storage of hazardous wastes is less than significant and
would remain so, as the facility is expanded because the same precautions and regulations would be
followed.
b-c) The proposed project would not discharge hazardous materials into the air or soils. All hazardous
materials that would be used on site, such as solvents and oils, would be contained in 55-gallon drums
and transported off-site for required disposal procedures. An environmental assessment was performed
on December 13, 2002 and updated and revised on May 14,2003. The assessment entitled, Report of
Findings Phase I Environmental Site Assessment Approximately Five (5) Acres of Commercial
Property 295, 297, 299 and 305 S. Waterman Avenue San Bernardino, California, found Norton Air
Force Base, which is east and up-gradient from the site, listed in many federal hazardous waste
databases, but the project site is not listed in federal hazardous waste databases and no underground
storage tanks were observed on-site. Recommendations made by Independent Geo-Environmental
Consultants consisted of the abandonment of a water well in the northeast comer of the site in
accordance with the requirements of the Santa Ana Regional Water Control Board, and observation,
environmental sampling, and testing of the soil beneath the waste oil storage area of the previous
tenant of the demolished auto repair shop at 305 South Waterman. Current daily operations follow
required protocols regarding hazardous materials and no change due to expansion of the current
operations is proposed. The release" or exposure of people to hazardous materials is not significant.
The following mitigation measures would be enforced on the new development project.
H-l. The private water well near the northeast corner of the site should be abandoned according
to requirements of the Santa Ana Regional Water Control Board.
H-2. Observation, environmental sampling, and testing ofthe soil should be performed beneath
the once existing Auto Repair Shop and in the vicinity of it's waste oil storage unit.
H-3. If during construction of the project, soil and/or ground water contamination is suspected,
construction in the area shall cease and appropriate Health and Safety procedures shall be
implemented. If it is determined that contaminated soil and/or remediation will be

necessary, such activity will conform to the California Hazardous Waste Control law and
the contractor will contact the government agencies to provide appropriate regulatory
oversight.
X. NOISE
a-b) The proposed project would be developed in an area of the City zoned for General Commercial and
Industrial uses. No housing or other noise sensitive uses are proposed within the area. Operations at the
auto sales center are not associated with loud or obtrusive noises. No impact to noise sensitive uses or
peoples would occur.
XI. PUBLIC SERVICES
a-c) The planned project would not place additional demands on fire. medical. or police services. There
are two fire stations in the vicinity of the project site. Station One. approximately one mile away, is
located on Third Street north of the project site and Station Ten, under one mile away, is located west
of the project on Arrowhead A venue according to Figure 33 of the General Plan. Sheriffs offices
exist on Rialto A venue less than a mile away from the project site, and in the vicinity of Third Street
and Sierra Way about a mile from the planned project site as listed on Figure 32 of the City's General
Plan. Several hospitals exist short distances from the planned project. Saint Bernardine Medical
Center is located at the intersection of Highland A venue and Waterman A venue north of the project
site and Lorna Linda Hospital is located southeast of the project site on Anderson Street in Lorna
Linda.
d-e) The proposed commercial project would not generate a significant amount of jobs requiring additional
schools or the need for increased recreational facilities. Employees for the project can be obtained
from the local area and who are currently served by established schools and parks. No impact to
schools or recreation would occur.
f) The existing A - One Auto Center is served by a solid waste provider and the additional property for
operations would not generate additional significant amounts of solid waste. The existing solid waste
provider could accommodate the increase in service. No impact on solid waste services is expected.
g) The Traffic Study completed by Hernandez, Kroone and Associates showed that the expanded project
would generate additional amounts of traffic to the site. The additional amount of traffic was not
significant and would not lead to depressed levels of service at local intersections. The increased
traffic at the proposed location would use local streets and therefore impact on their deterioration. The
project applicant would be required to pay fees established by the Public Works division to minimize
impacts to public roads. The impact is considered less than significant for the maintenance of local
roads.
h) The expansion of the A - One Auto Center would not require the use of governmental services beyond
the approval and permitting process; therefore no impact would occur.

any statutorily required school impact fees have been paid to the affected school district(s)

PS.2. Prior to issuance of a certificate of occupancy the contractor shall provide all required
Fire Safety improvements (including but not limited to on-site hydrants, buildings
sprinkler systems, and Knox-box entry systems).
XII. UTILITIES
a) The Southern California Gas Company provides natural gas service to the project area. The previously
developed nature of the site would not require the extension of infrastructure or cause an inability to
serve the project site. No impact would occur to natural gas service.
b) Electricity is provided to the project area by Southern California Edison (SCE). An auto repair shop
and other offices. which used electrical services, previously occupied the site. The project would not
require substantial amounts of additional electricity beyond what has been used in the past. A less than
significant impact would be expected.
c) The project area is within the service area of Verizon. The service can be readily extended to sites
without any significant impact to existing service in the area. No impact is expected on phone service
in the area.
d) Water supply is provided by the City of San Bernardino Municipal Water Department and water
service has already been established at the project site. The infrastructure needed to supply water is
also accessible at the site. The payment of appropriate water connection fees to reconnect the site,
established by the Public Works Department, would result in a less than significant impact..
e) The project area is within the City of San Bernardino sewage service area. The previous development
of the site required sewage service so no extension of infrastructure would be needed. The project
would not be expected to generate significant amounts of sewage which would require treatment, such
as a housing tract. The payment of the appropriate sewer connection fees established by the Public
Works Department would result in a less than significant impact.
f) The storm water drainage facilities within the project area would be sufficient to serve the site
adequately. Substantial amounts of run-off would not be expected beyond past experienced levels of
run-off as the site has been previously developed with concrete and landscaped areas. As a standard
condition of approval developed by the Public Works Department the payment of Drainage Impact
Fees would be required. No impact is expected on the ability to be served by storm water drainage
facilities.
g) The previously developed nature of the site combined with the urban setting would preclude the
proposed project from contributing to a disjointed pattern of utility extension. All required
infrastructure is in place for operation of a commercial or industrial property. No impact on utility

extension is expected.
U-l. Proof that buildings conform to energy use guidelines in Title 24 of the California
Administrative Code must be submitted with initial building plan check submittal.
XIII. AESTHETICS
a-b) The expansion of the A - One Auto Center is located in an area zoned for commercial and industrial
development. The newly constructed facilities would include additional landscaping, water features,
and hardscape elements on a currently vacant site. The expanded auto center would complement and
increase the aesthetic value of the area according to Development Code standards. No impact to
aesthetics is expected at the site.
b) Additional lighting would be added to the area if the project were approved. The increased lighting
would add to safety in the area. All lighting would be directed onto the site to illuminate automobiles
for sale and other services located on-site. Light features would be implemented according to
Development Code standards and installed to avoid off-site impacts. No impact from light or glare
would occur because there are no sensitive receptors (homes, schools, etc.) nearby.
A.l. Lighting plans shall be submitted for review and approval with all site lighting being
installed prior to issuance of a certificate of occupancy. All on.site lighting shall conform
to regulations within SBMC Section 19.20.14.
XIV. CULTURAL RESOURCES
a-c) The proposed project site is currently vacant. The previous occupied auto repair shop and commercial
uses have been removed from the site. According to Figure 8 of the City of San Bernardino's General
Plan, the site is not located in an area of concern for Archaeological Resources or in an Urban
Archaeological District containing Historical Archaeological Resources. No impact to cultural
resources is expected. However, if any sensitive historic or pre-historic artifacts are uncovered during
anyon-site activities a qualified archaeologist should be contacted for evaluation of the deposits. The
standard condition of approval would relieve any impacts to cultural resources.
CR-l. In the event that cultural resources are unearthed during construction activities, all
construction activities shall be suspended until the deposits are evaluated by a qualified
archaeologist. Any such deposits found are not to be disturbed after discovery until done
so by a qualified archaeologist. If human remains of any kind are found during
construction activities, all activities must cease immediately and the County Coroner
and/or a qualified archaeologist must be notified. Clearance from these authorities must
be obtained before work can continue.
XV. RECREATION
a-b) The proposed project would not increase the demand for neighborhood or regional parks as the project

would not generate significant amounts of new employees or induce growth in the surrounding areas.
The expansion of the A - One Auto Center is expected to increase employment at the site by a
maximum of thirty employees, all of which could be hired from the local area. Furthermore, within
close proximity of the planned project are two neighborhood parks and one community park. The Mill
Center located south of the project on Central Avenue encompasses 14.1 acres and provides many
activity opportunities including baseball and football fields, basketball courts, and swimming. Two
community parks northwest of the planned site offer a combined 19 acres of recreational opportunities
including children's play areas and ball fields. The development of the five-acre expansion for the A-
One Auto Center would not impact these recreation facilities. No additional recreation facilities would
be required, and existing facilities would not be adversely affected by implementation ofthe proposed
project.
XVI MANDATORY FINDINGS OF SIGNIFICANCE
a) The expansion of the A - One Auto Center would be constructed on previously developed and
disturbed lands. The site is not located within the Biological Resources Management Overlay nor is it
located near known sensitive plant or animal areas (Figures 40 and 41). The project area does not
contain riparian habitat. The location of Waterman A venue, a major arterial street, would preclude the
site from being used as a migration corridor. The site is not located in Areas of Concern for
Archaeological Resources or an Urban Archaeological District according to Figure 8 of the General
Plan. No impact is expected on plant or animal communities or cultural resources.
b) The proposed project would not affect environmental goals adversely. Operations at the A - One Auto
Center would not affect air quality goals and all hazardous materials would be disposed of or recycled
in accordance with environmentally safe practices. No significant impacts to long-term environmental
goals would occur. Incremental impacts associated with the development would be mitigated through
impact fees or specific performance to alleviate adverse environmental affects. The project would be
consistent with surrounding development upon approval of the applicants General Plan Amendment.
The project would not conflict with the policies or goals established by the City of San Bernardino.
c) Impacts associated with the proposed auto center expansion would not be considered adverse or
unfavorable. The car sales lot does not generate significant amounts of air pollutants and all hazardous
wastes are disposed of in accordance with Department of Environmental Health Services regulations.
The addition of landscaping and lighting at the A - One Auto Center would enhance public safety in
the area and abide by regulations set forth in the City's Development Code. Other planned projects in
the area are distribution businesses and would be compatible with the auto center. No cumulative
adverse impacts are expected with implementation of the A - One Auto Center.
d) No substantially adverse effects on human beings are foreseen by expansion of the A - One Auto
Center.

MITIGATION MONITORING/REPORTING PROGRAM
This Mitigation Monitoring and Reporting Program has been prepared to implement
the mitigation measures outlined in the Initial Study for the expansion of the A - One
Auto Center. This program has been prepared in compliance with the California
Environmental Quality Act (CEQA) and the State and City of San Bernardino CEQA
Guidelines.
CEQA Section 21081.6 requires adoption of a monitoring and/or reporting program for
those measures or conditions imposed 'on a project to mitigate or avoid adverse effects
on the environment. The law states that the monitoring or reporting program shall be
designed to ensure compliance during project implementation.
The Mitigation Monitoring and Reporting Program contains the following elements:
1. The mitigation measures are recorded with the action and procedure
necessary to ensure compliance. The program lists the mitigation
measures contained within the Initial Study.
2, A procedure for compliance and verification has been outlined for each
mandatory mitigation action. This procedure designates who will take
action, what action will be taken and when, and to whom and when
compliance will be reported.
3. The program contains a separate Mitigation Monitoring and Compliance
Record for each action. On each of these record sheets, the pertinent
actions and dates will be logged, and copies of permits, correspondence or
other data relevant will be retained by the City of San Bernardino.
4. The program is designed to be flexible. As monitoring progresses, changes
to compliance procedures may be necessary based upon
recommendations by those responsible for the program. If changes are
made, new monitoring compliance procedures and records will be
developed and incorporated into the program.
The individual measures and accompanying monitoring/reporting actions follow. They
are numbered in the same sequence as presented in the Program EIR.

ensure building strength and safety.
ER-2. All engineering designs shall incorporate construction techniques which
maximize seismic safety for on-site buildings.

reports to the City engineer prior to the issuance of grading permits.
These reports will be required to detail the appropriate soil excavation
techniques required to ensure that the proposed buildings are located on
properly compacted pads.

IV. WATER
W-l. The project shall be conditioned to establish a storm system on-site that
would intercept run-off and trap sediments. The applicant shall prepare a
Water Quality Management Plan for the project that includes a description
of the proposed drainage system and the various components that would be
in place such as containment systems around storage areas, to contain any
spills or leaks; and grease separators that would filter the stormwater before
it enters the storm drain system.
W-2. Prior to the issuance of a grading permit, a site-specific drainage study,
which meets the standards of the City of San Bernardino Public Works
division will be prepared oy a Civil Engineer who is registered in the State
of California. All recommendations from this analysis, including facilities
necessary to mitigate drainage impacts, maximize percolation and
groundwater recharge to the extent feasible shall be incorporated in all
grading and site improvement plans.
W-3. The applicant shall mitigate on-site storm water discharge sufficiently to
maintain compliance with the City's NPDES Storm Water Discharge Permit
Requirements. A "Notice of Intent (NOI)" shall be filed with the State
Water Quality Control Board for construction disturbing one acre or more
of land. Prior to the issuance of a grading permit, the applicant shall submit
a Storm Water Pollution and Prevention Plan (SWPPP) specifically
identifying Best Management Practices (BMP's) that will be used on-site to
reduce the pollutants into the storm drain system to the maximum extent
practical.
W-4. An erosion control plan shall be prepared and implemented for the
proposed project that identifies specific erosion control measures to control
on-site and off-site erosion from the time of ground disturbing activities are
initiated through completion of grading. This erosion control plan shall
include the following measures at a minimum.
a) Specify the timing of grading and construction to minimize soil
exposure to rainy periods experienced in southern California.
b) An inspection and maintenance program shall be included to
insure that any erosion which does occur either on-site or off-site as
a result of this project will be corrected through a remediation or
restoration program within a specified time frame.

c) Filing a Notice of Intent and obtaining a project permit will be
required through the Water Quality Control Board relating to a
National Pollution Discharge Elimination System (NPDES)
standards prior to beginning of grading work.

V. AIR QUALITY
AQ-l The project shall comply with the requirements of the SCAQMD Rules
402 and 403, fugitive dust, which requires the implementation of
Reasonable Available Control Measures (RACM) for all fugitive dust
sources, and the Air Quality Management Plan (AMCP), which identifies
Best Available Control Measures (BACM) and Best Available Control
Technologies (BACT) for area sources and point sources, respectively.
This would include, but not be limited to the following:
1. The project proponent shall ensure that construction equipment shall be
properly maintained and serviced to minimize exhaust emissions.
2. The project proponent shall ensure that existing power sources are
utilized where feasible via temporary power poles to avoid on-site power
generation.
3. The project proponent shall ensure that any portion of the site to be
graded shall be pre-watered to a-depth of three feet prior to the onset of
grading activities.
(a) The project proponent shall ensure that watering of the site or other
soil stabilization method shall be employed on an on-going basis after
the initiation of any grading activity on the site. Portions of the site that
are actively being graded shall be watered regularly to ensure that a
crust is formed on the ground surface, and shall be watered at the end
of each workday.
(b) The project proponent shall ensure that all disturbed areas are treated
to prevent erosion until the site is constructed upon.
(c) The project proponent shall ensure that landscaped areas are installed
as soon as possible to reduce the potential for wind erosion.

(d) The project proponent shall ensure that SCAQMD Rule 403 is adhered
to, insuring the clean up of construction-related dirt on approach
routes to the site.
(e) The project proponent shall ensure that all grading activities are
suspended during first and second stage ozone episodes or when
winds exceed 25 miles per hour.
(f) All buildings on the project site shall conform to energy use guidelines
in Title 24 of the California Administrative Code.
AQ-2 To reduce emissions all equipment used in grading and construction must
be tuned and maintained to the manufacturer's specification to maximize
burning of vehicle fuel.
AQ-3. The contractor shall utilize (as much as possible) pre-coated building
materials, water based or low Vex:: coating, and coating transfer or spray
equipment with high transfer efficiency, such as high volume, low
pressure (HVLP) spray method, or manual coatings application such as
paint brush, hand roller, trowel, dauber, rag, or sponge.
AQ-4. The project proponent shall, prior to the issuance of grading permit,
receive approval of an erosion control plan and PMIO plan from the Public
Works Division of the Development Services Department.
AQ-5. The project shall be required to obtain any required permits from the
South Coast Air Quality Management District (SCAQMD), and will be
subject to rules 402 and 403 to regulate short-term air pollutants.
AQ-6. The project will be required to submit grading plans and obtain grading
permits from the City of San Bernardino. Cut and fill quantities shall be
balanced on-site as per the proposed plans. The grading plans shall
include a notation that all construction equipment shall be tuned and
maintained in accordance with manufacturer's specifications and
requirements of the National Pollutant Discharge Elimination System
(NPDES)

VI. TRANSPORT A TION/CIRCULA TION
TR-l. Prior to issuance of building permits, the developer will be required to pay a fair
share contribution to mitigate significantly impacted intersections under year 2010
with project conditions. These improvements with the project's fair share
contribution to improvement costs are as follows:
a. Waterman Avenue and Mill Street - Addition of a westbound left
turn lane - total cost of $50,000, with the projects fair share being
$3,500.
TR-2. The contractor shall time construction activities so as not to interfere with peak
hour traffic and so as to minimize obstruction through traffic lanes adjacent to the
site. If determined necessary by the Public Works Division a flag person shall be
retained to maintain safety adjacent to existing roadways.

IX. HAZARDS
H-1. The private water well near the northeast comer of the site should be
abandoned according to requirements of the Santa Ana Regional Water
Control Board.
H-2. Observation, environmental sampling, and testing of the soil should be
performed beneath the once existing Auto Repair Shop and in the vicinity of
it's waste oil storage unit. .
H-3. If during construction of the project, soil and/ or ground water
contamination is suspected, construction in the area shall cease and
appropriate Health and Safety procedures shall be implemented. If it is
determined that contaminated soil and/ or remediation will be necessary,
such activity will conform to the California Hazardous Waste Control law
and the contractor will contact the government agencies to provide
appropriate regulatory oversight.

(b) WHEREAS, General Plan Amendment No. 02-10 (a proposal to change the General
Plan Land Use Designation from OIP, Office Industrial Park to CG-l, Commercial General, for
approximately five acres located on the east side of Waterman Avenue, approximately 350 feet

(f) WHEREAS, the adoption of General Plan Amendment No. 02-10 is deemed in the
interest of the orderly development of the City and is consistent with the goals, objectives and

10 policies of the existing General Plan.
SECTION 2. Mitigated Negative Declaration
NOW, THEREFORE BE IT RESOLVED, FOUND AND DETERMINED by the Mayor
and Common Council that the proposed amendment to the General Plan of the City of San
Bernardino will have no significant adverse effect on the environment with incorporation of the
proposed mitigation measures, and the Mitigated Negative Declaration heretofore accepted by
the Environmental Review Committee as to the effect of this proposed amendment is hereby
ratified, affirmed and adopted.
SECTION 3. Findings
BE IT FURTHER RESOLVED by the Mayor and Common Council of the City of San
Bernardino that:
A. The proposed amendment is internally consistent with the General Plan in that it meets
General Plan Policy 1.19.1 0 in that it would allow for the expansion of an existing
commercial facility and the creation of new commercial facilities to serve the local and
regional needs.

The proposed amendment would not be detrimental to the public interest, health,safety,
convenience, or welfa.re of the City in that the proposed project will provide a unified

architectural theme, full parking and landscaping as per Development Code requirements,
and generally allow the developer to complete a project that would give that section of
Waterman Avenue a "face-lift" and improve the public interest and welfare.
The proposed amendment would not impact the balance of land uses within the City in
that the proposed change in land use designation represents a relatively small percentage
of the overall land uses within the City.
In the case of an amendment to the General Plan Land Use Map, the subject parcel(s) is
physically suitable (including, but not limited to access, provision of utilities,
compatibility with adjoining land uses, and absence of physical constraints) for the
requested land use designation(s) and the anticipated land use development(s) in that all
required utilities and public services can adequately serve the site.
SECTION 4. Amendment
BE IT FURTHER RESOLVED by the Mayor and Common Council that:
The Land Use Plan of the General Plan of the City of San Bernardino is amended by
changing the land use designation from OIP, Office Industrial Park to CG-1, Commercial
General for five acres located on the east side of Waterman Avenue, approximately 350
feet north of the Twin Creek Channel. This amendment is designated as General Plan
Amendment No. 02-10 and its location is outlined on the map entitled Attachment A, and
listed in Attachment B, copies of which are attached and incorporated herein for
reference.

General Plan Amendment No. 02-10 shall become effective immediately upon adoption
of this resolution.
SECTION 5. MaD Notation
This resolution and the amendment affected by it shall be noted on such appropriate
General Plan maps previously adopted and approved by the Mayor and Common Council
and which are on file in the office of the City Clerk.
SECTION 6. Notice of Determination
The Planning Division is hereby directed to file a Notice of Determination with the
County Clerk of the County of San Bernardino certifying the City's compliance with
California Environmental Quality Act in preparing the Initial StudylMitigated Negative
Declaration.

At the Mayor and Common Council meeting held on May 17, 2004, the following action was
taken relative to General Plan Amendment No. 02-10 and Conditional Use Permit No. 02-29, to
change the land use designation from OIP, Office Industrial Park, to CG-I, Commercial
General, and to expand a used vehicle dealership located at the northeast corner of Mill Street
and Waterman Avenue:
That the hearing be closed; that said resolution be adopted (Resolution No.
2004-134); that the Mitigated Negative Declaration and Mitigation
Monitoring/Reporting Program be adopted; and Conditional Use Permit No.
02-29 be approved based on the Findings of Fact in the Planning Commission
staff report, subject to the Conditions of Approval (Attachment C) and Standard
Requirements (Attachment D).
