Subiect:
Resolution authorizing the execution of Amendment No. 1 for the CAPS Program between the
City and the San Bernardino City Unified School District to amend Resolution 2003-235.
Back2round:
The Children's After-School Program for Success (CAP.s.) is a grant funded program
administered by the San Bernardino City Unified School District to provide before & after-
school programs at school sites. The city has been a sub-contractor to the school district in this
program since 1999. The school provides teachers and aides to teach educational and tutorial
programs. The Parks, Recreation and Community Services Department has been asked to
provide arts and crafts and other recreational activities to the youth.
The CAPS Program was offered at nine elementary schools when first implemented. The
program expanded to 15 schools in 2000 - 01. The agreement in June 2003 (attached) provided
two additional sites for after-school programs and 10 before-school programs; a total of 27
programs at 17 school sites for a period beginning July 1, 2003 through June 30, 2004. 'This
grant covers 100 percent of the costs for up to 8 part-time staff per site. We currently average 6
part-time staff at each site.
This amendment will allow the department to provide a maximum of 8 part-time staff per
existing program site, Monday - Friday. The district provides supplies and equipment for the
CAPS program. This increase will allow for additional staff at each of the CAPS schools.
The original Agreement was for $460,000 and the amendment increases the original Agreement
by an amount not to exceed $60,000 for a new aggregate total of $520,000. The term of the
original Agreement will remain the same (July 1,2003 through June 30, 2004). Therefore, the
department is requesting authorization to execute Amendment No.1.
The School District mailed this amendment to the Superintendent of Recreation in October 2003.
Due to an oversight a council action request was never completed.
Financial Imoact:
There is no financial impact to the City. Program supervision is provided by the existing staff,
which is already covered in the department's general fund budget.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of City of San Bernardino or her designee is hereby authorized
and directed to execute on behalf of said City, Amendment No. I for additional funding with the
San Bernardino City Unified School District to provide consultant services for The Children's
After School Program for Success (CAPS). A copy of said Amendment No. I is hereby attached
hereto, marked Exhibit "A", and incorporated herein by reference as fully as though set forth at
13 length.
0 14 SECTION 2. The authorization granted hereunder shall expire and be void and of no

further effect if Amendment No. I is not executed by both parties and returned to the Office of

AGREEMENT FOR CONSULTANT SERVICES IN COLLABORATION
WITH DISTRICT FOR THE CAPS PROGRAM
THIS AMENDMENT is made and entered into this 8th day of October. 2003. by and
between the SAN BERNARDINO CITY UNIFIED SCHOOL DISTRICT. hereinafter
referred to as the "DISTRICT". with its principal place of business at 777 N. MF"
Street, San Bernardino. California 92410. and. CITY OF SAN BERNARDINO _
PARKS. RECREATION AND COMMUNITY SERVICES. hereinafter referred to as
the "CONSULTANT" having a principal place of business at 547 North Sierra Way.
San Bernardino. California 92410.
R E C I TAL S:
WHEREAS. the CONSULTANT is authorized under the terms and conditions of the
original Agreement entered on the 25th day of June. 2003. to provide a variety of
learning experience in the area of art. fitness and sports skills; and,
WHEREAS, additional funds are needed to continue the mentoring program which
targets the population of elementary school students and provides a deterrent to
juvenile crime, gangs, and other delinquent behaviors;
NOW. THEREFORE. the DISTRICT and the CONSULTANT mutually agree to
amend the .existing Agreement as follows:

The amount payable to the CONSULTANT as specified in Section IV.
Subsection A: Payment of the original Agreement shall be increased by an
amount not to exceed Sixty Thousand Dollars ($60,000.00) for a new
aggregate total of Five Hundred Twenty Thousand Dollars ($520.000.00).

This Amendment is effective upon execution. All other terms and conditions
of the original Agreement shall remain the same.

At the Mayor and Common Council meeting of May 3, 2004, the City of San Bernardino
adopted Resolution 2004-117 - Resolution authorizing the Mayor or her designee to execute
Amendment No. 1 to the agreement for consultant services between the City and the San
Bernardino City Unified School District for the CAPS Program.
Attached are two (2) original agreements. Please obtain signatures in the appropriate location
and return one original agreement to the City Clerk's Office as soon as possible, to my attention.
Please be advised that the resolution and agreement will be null and void if not executed
within 120 days, or by August 31,2004.
