Synopsis of Previous Council Action:
09/02/03 - Mayor and Common Council authorized staff to proceed with preparation of documents and
appropriate Municipal Code amendments to impose a special tax district for the operation and
maintenance of the proposed Verdemont Fire Stanton on new development only.
12/15/03 - Resolution was approved by of the Mayor and Common Council of the City of San Bernardino
declaring the intention to establish a community facilities district for the ongoing operation and
maintenance of a fire station for the Verdemont area.
Recommended motion:

Subiect:
A Resolution of the Mayor And Common Council of the City of San Bernardino
Directing the Preparation of a Map and an Engineer's Report for Community Facilities
District No. 1033.
Backl!round:
The "Mello-Roos Community Facilities District Act" (Government Code Section 533 I I
et sea., the "Act"), provides in Section 53321.5:
"At the time of the adoption of the resolution of intention to establish a community
facilities district, the legislative body shall direct each of its officers who is or will be
responsible for providing one or more of the proposed types of public facilities or
services to be financed by the district, if it is established, to study the proposed district
and, at or before the time of the hearing, file a report with the legislative body containing
a brief description of the public facilities and services by type which will in his or her
opinion be required to adequately meet the needs of the district and his or her estimate of
the cost of providing those public facilities and services."
A Resolution of Intention to commence with the formation of a Community Facilities
District for the payment of a portion of the operations and maintenance costs of the
Verdemont Fire Station has been presented to the Mayor and Common Council at this
meeting. The Resolution of Intention also calls for a public hearing on the formation of
the Community Facilities District ("CFD No. 1033") for May 17,2004.
Accordingly the Mayor and Common Council have been provided a Resolution pursuant
to Government Code Section 53321.5, which directs the appropriate Staff members to
study the CFD No. 1033 area and cause the preparation of a report to be filed with the
City. The Report is to include a brief description of the services and operations and
maintenance costs to be provided within CFD No. 1033, and a justification of the
Community Facilities District Special Tax to be imposed within each zoning
classification of CFD No. 1033. Said report is to be prepared and presented to the City
by the date of the public hearing (i.e., May 17, 2004). This Resolution further calls for
the preparation of a map, in accordance with the requirements of the Act, depicting the
territory to be included in CFD No. 1033, and also directs the Staff to cause the
preparation of all necessary environmental documentation in connection with the
proposed inclusion of property in CFD No. 1033, in accordance with the provisions of the
California Environmental Quality Act ("CEQA").
Fiscal Impact:
The preparation of the report, map and environmental documentation will result in
expenditures of Staff time and resources, in addition to costs associated with the
procurement of consultants to facilitate the actions called for in the Resolution, which
costs are not to exceed $ I 2,780.
Recommendation:
Adopt Resolution.

A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO DIRECTING THE PREPARATION OF A MAP AND
AN ENGINEER'S REPORT FOR COMMUNITY FACILITIES DISTRICT NO.

WHEREAS, the City of San Bernardino, California (the "City"), is a municipal
corporation and charter city, duly organized and existing pursuant to the provisions of
the Constitution of the State of California; and
WHEREAS, the City has determined to commence proceedings to establish a
community facilities district ("Community Facilities District No. 1033," or "CFD No.
1033") pursuant to the terms and provisions of California Govemment Code Section
53311 et seq., sometimes commonly referred to as the "Mello-Roos Community
Facilities District Act" (the "Act"); and
WHEREAS, the City now wishes to direct the preparation of a map and a report,
pursuant to the provisions of Section 53321.5 of the Act, to provide more detailed
information relating to proposed CFD No. 1033.
NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED
BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO, AS FOLLOWS:
. Section I. The above Recitals are true and correct in all respects and are
incorporated herein by reference.
Section 2. The Mayor and the Common Council hereby directs the Staff of
the City to cause to be prepared appropriate boundary maps for territory which may
hereafter be recommended to be included within the boundaries of CFD No. 1033, in
accordance with the Act. The Staff of the City is further authorized and directed to
cause to be prepared all necessary environmental documentation in connection with the
proposed formation of, and annexation proceedings to, CFD No. 1033, and make
appropriate recommendations with regard to the formation of, and annexations to, CFD
No. 1033 as may hereafter be proposed or recommended in accordance with the
provisions of the California Environmental Quality Act ("CEQA"), as amended (Public
Resources Code Section 21000 et sea.). The City Clerk is hereby authorized and
directed to cause to be published any notices as required to further the actions as
approved hereto.
Section 3. The Mayor and Common Council hereby further direct the Staff
of the City to cause the study of CFD No. 1033 and, at or before the time of the public
hearing on the formation of CFD No. 1033, cause the preparation of an engineer's
report ("Report") to be filed with the City, which Report shall contain a brief
description of the services and maintenance of public facilities and the operating costs

thereof which will be provided within CFD No. 1033, which shall be the estimated
operations and maintenance expenses and which will be incurred as a result of
providing the services which will, in the opinion of the City officials preparing the
Report, be required to adequately meet the needs ofCFD No. 1033 for the next five (5)
years, and shall include an estimate of the cost of providing the operations and
maintenance expenses for the first five (5) years for each zone within CFD No. 1033,
including a brief explanation justifying the amount of the Tax for each zone type and
any increase or decrease thereof in subsequent years as well as the estimated In-Lieu
Fee that may be generated for each zone for all years evaluated in the Report.
Section 4. The Map and the Report, upon preparation, shall be submitted to
the Mayor and Common Council and shall be made a part of the record of the public
hearing on the formation ofCFD No. 1033.
Section 5.
This resolution shall take effect immediately upon its passage.
