Resolution awarding a contract to Laird Construction Company, Inc. for Pavement Rehabilitation on
Hospitality Lane from San Timoteo Bridge to Gage Canal (SS04-30 and TC04-I5) per Plan No. I0574A.

On September 15, 2003, the Mayor and Common Council allocated, as part of the FY 2003/04 Capital
Improvement Program (CIP), $592,900 in Streets & Street Lighting, and Traffic Controls.
This project has been identified in the proposed 2003/04 CIP, Item SS04-30 and TC04-15, to be funded from
Account No. 129-367-5504-7302, "Hospitality Lane Signal Modifications and Street Improvements."
This project consists of the following:
1. Construction of a dual left-turn lane from westbound Hospitality Lane to southbound on Carnegie
Drive 1-215 westbound on-ramps.
2. Removal and replacement of areas of failed pavement on Hospitality Lane between San Timoteo
Bridge and Gage Canal.
3. Cold milling and paving of new asphalt (1 y," thick) on Hospitality Lane from San Timoteo Bridge to
Gage Canal.
The Plans and Specifications for this project are complete. The project was advertised locally in the San
Bernardino County Sun Newspaper, F. W. Dodge, Construction Data Hot Sheet, Reed Construction Data
and Bid America, Construction Bid Source, the City's web sites, and with the San Bernardino Area Chamber
of Commerce.
Bids have been received and the contract is ready to be awarded. The following companies responded:

Subject:
Based on review of the sealed competitive bids received, staff has determined that Laird Construction
Corporation of Rancho Cucamonga, the apparent low bidder, has met the minimum requirements of the
specifications and bid guidelines and; therefore, recommends that the Mayor and Common Council award
the referenced contract to Laird Construction Corporation.
The estimated project costs are as follows:
Construction Cost (basic bid) $ 309,309.00
Insoection and Contract Administration $ 47,846.00
Contingencies $ 47,845.00
Total $ 405,000.00
Jurisdictional responsibility for this intersection is split between the City of San Bernardino and Caltrans.
Caltrans has maintenance of this intersection and has approved the additionalleft-tum lane onto their on-
ramp. A permit has been issued by Caltrans for work within State right-of-way.
If approved, this project is expected to begin construction in May of 2004 and be completed by August 2004.
Financial Impact:
Sufficient funds to cover the cost of this project are available in the FY 2003/04 CIP in Account No. 129-
367-5504-7302, "Hospitality Lane Signal Modification and Street Improvements."
Recommendation:
Adopt Resolution.

5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Laird ConstructiOI' Company. Inc., at 9460 Lucas Ranch Road, Rancho
Cucamonga, CA. 91730-5743, is the lowest responsible bidder for Pavement Rehabilitation
on Hospitality Lane from San Timoteo Bridge to Gage Canal per Plan No. 10574A. A
contract is awarded accordingly to said bidder in a total amount of $309,309.00, with a
contingency amount of $47,845.00, bUt such award shall be effective only upon being fully
executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby
o 14 authorized and directed to execute said contract on behalf of the City; a copy of the contract is

on file in the office of the City Clerk and incorporated herein by reference as fully as though
set forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not
take effect or become operative until fully signed and executed by the parties and no party
shall be obligated hereunder until the time of such full execution. No oral agreements,
amendments, modifications or waivers are intended or authorized and shall not be implied
from any act or course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute
it within sixty (60) days of passage of th... resolution.
