On January 24, 2000, the Community Development Commission authorized the Executive Director to prepare plan
amendments to reinstate eminent domain in the Central City North, Central City South, Central City East, Uptown and
Meadowbrook project areas.
On October 21, 2002, the Mayor and Common Council adopted procedures for the formation and election of a Project
Area Committee for the proposed redevelopment plan amendment for the Central City North Project Area and calling
for the formation of a Project Area Committee (PAC).
On October 21, 2002, the Mayor and Common Council of the City of San Bernardino adopted a resolution modifYing
the scope of the proposed plan amendment to reinstate eminent domain for all properties located within the Central City
North Project Area.
On March 16, 2004, Redevelopment Committee Members Estrada, Longville and McGinnis unanimously voted to
recommend to the Mayor and Common Council that the election results be ratified and a finding that all applicable
procedures were followed in the election of the PAC for the Central City North Project Area.

Central Citv North Redevelopment Project Area Committee Election
BACKGROUND:
On October 21,2002, the Mayor and Common Council adopted a resolution modifying the scope of
the proposed Plan Amendment to reinstate eminent domain for all properties located within the
Central City North Redevelopment Project Area. The State of California Community Redevelopment
Law states that a project area committee needs to be formed for the redevelopment project area if "a
substantial number of low-income persons or moderate-income persons, or both, reside within the
project area, and the redevelopment plan as adopted will contain authority for the agency to acquire,
by eminent domain, property on which any persons reside."
At this same meeting, the Mayor and Common Council adopted procedures for the formation of a
Project Area Committee (PAC). The adoption of a PAC is in accordance with Section 33385 of the
Community Redevelopment Law. The procedures outlined the make-up of the PAC, how members
are elected, eligibility requirements for PAC membership and their responsibilities.
On February 5, 2004, Agency Staff sent a newsletter, to all property owners and property addresses
within the Central City North Redevelopment Project Area informing them of the proposed plan to
amend the redevelopment plan to reinstate the power of eminent domain. The newsletter stated that
since the proposed amendment to reinstate eminent domain would include all properties, a project
area committee (PAC) would need to be formed. The newsletter also stated that there would be a
public PAC formation meeting and a follow-up public meeting for the purpose of electing members
to form the PAC. Approximately 1,500 newsletters were mailed out.
On February 19, 2004, Agency Staff conducted a public meeting for the formation of a PAC. Four
(4) individuals who had interests within the project area attended this meeting. Staff informed them of
the purpose of the PAC and what their responsibilities would be as members. Each person was given
the approved PAC procedures and encouraged to participate in forming the PAC. Subsequently,
Agency Staff received three (3) PAC applications
CURRENT ISSUE:
On March 11, 2004, a public meeting was conducted by Agency Staff for the purpose of electing
members to the Central City North Redevelopment Project Area Committee. The following were
elected as members of the PAC:

Residential Owner-Occupant
Residential Owner-Occupant
Property Owner
The adopted procedures state that a PAC can be established with a minimum of three (3) members.

Section 33385 of the California Redevelopment Law provides that the Common Council shall adopt a
finding that all adopted procedures for the formation and election of the PAC for the Project Area
were followed in the election of the PAC and determine the validity of all challenges within 30 days
following the PAC election. The law also requires that a challenge to the PAC election or the
electoral process must be filed with the Common Council no more than 15 calendar days after PAC
elections.
In closing, the procedures for the formation and election of the PAC for the Project Area were
followed in accordance with Resolution No. 2002-347, adopted by the Common Council on
October 21,2002. No challenges to the PAC election or the electoral process have been received to
date.

FISCAL IMPACT:
None.
RECOMMENDATION:
That the Mayor and Common Council adopt the attached Resolution.

A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO ACKNOWLEDGING THE RESULTS OF
AN ELECTION OF PROJECT AREA COMMITTEE MEMBERS AND
FINDING THAT ALL APPLICABLE PROCEDURES WERE
FOLLOWED IN THE ELECTION OF THE PROJECT AREA
COMMITTEE FOR THE CENTRAL CITY NORTH REDEVELOPMENT
PROJECT
WHEREAS, the Mayor and Common Council of the City of San Bernardino have
previously taken certain action to ensure that all applicable procedures are followed in the
election of the Project Area Committee for an Amendment to the Central City North
Redevelopment Project reinstating the power of eminent domain (the "Amendment"); and
WHEREAS, in connection with the proposed Amendment, the Common Council
adopted Resolution No. 2002-347 on October 21, 2002, thereby adopting the "Procedures for
Formation and Election of a Project Area Committee" ("Procedures") for the Central City North
Redevelopment Project and calling upon any or all residential owner-occupants, residential
tenants, community organizations, and business owners (including property owners) within the
Central City North Redevelopment Project to form a Project Area Committee ("PAC") to

consider the Amendment; and

WHEREAS, a public meeting was held on February 19, 2004, to explain the
establishment of, function of, and opportunity to serve on the PAC as well as accept
applications from those persons interested in serving on the PAC; and

WHEREAS, the election of a representative PAC was held on March II, 2004; and
WHEREAS, the Procedures adopted by the Common Council were followed in the PAC

election; and

WHEREAS, Section 33385(d) of the Redevelopment Law (Health & Safety Code

NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED AND ORDERED
BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, AS
FOLLOWS:

Section I.
The Mayor and Common Council hereby acknowledge the results of the
election of PAC members for the Central City North Redevelopment Project and find and
determine that (i) no challenges to the election of the Project Area Committee or to electoral
procedures were filed with the Common Council; and (ii) all of the "Procedures for the
Formation of a Project Area Committee" for the Central City North Redevelopment Project
Area which were adopted by the Common Council on October 21, 2002 were followed in
connection with the election of the Project Area Committee which was held on March 11,2004.
A listing of the Project Area Committee election results is the attached hereto as Exhibit "A,"
and each such person is hereby recognized and declared by the Common Council to be a
member of the PAC for the Central City North Redevelopment Project.
Section 2. This Resolution shall take effect upon its adoption and execution in the
manner as required by the City Charter.
