A RESOLUTION OF THE MAYOR CAN COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF SUBGRANT AGREE-
MENT WITH SAN BERNARDINO MUNICIPAL WATER DEPARTMENT FOR FUNDS
ALLOCA TED FROM THE EMERGENCY EMPLOYMENT ACT OF 1971.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is hereby authorized
and directed to execute on behalf of said City a Subgrant Agreement with San
Bernardino Municipal Water Department for funds allocated from the Emergency
Employment Act of 1971, a copy of which is attached hereto, marked Exhibit "AU
and incorporated herein by reference as fully as though set forth at length.

SUBGRANT AGREEMENT FOR FUNDS ALLOCATED
FROM THE EMERGENCY EMPLOYMENT ACT OF 1971
(SAN BERNARDINO MUNICIPAL WATER DEPARTMENT)
The CITY OF SAN BERNARDINO, hereinafter called "Program Agent",
and the SAN BERNARDINO MUNICIPAL WATER DEPARTMENT, hereinafter
called "Subgrantee", mutually agree:

1. That the City has been granted funds allocated under Sections 9 (a) (1)
and 9 (a) (2) of the Emergency Employment Act of 1971, Public Law 92-54, as a
designated Program Agent under Grant Agreement Number EEA 06-2-0050.
2. The Program Agent and the Subgrantee agree that the funds granted
will be used to conduct a program within the area covered by the application of the
Program Agent to the U. S. Department of Labor in order to provide unemployed
and underemployed persons with transitional employment in jobs providing needed
public services and wherever feasible, related training in employment services, to
enable such persons to move into employment and training not supported under the
Emergency Employment Act of 1971.
3. The Subgrantee agrees to:
(a) plan and conduct its program in accordance with the regulations
promulgated by the Secretary of Labor (29CFR55) for the Emergency Employment
Program under PL 92-54, In particular, the Subgrantee hereby warrants that the
program described in the Grant Agreement numbered EEA 06-2-0050 and only
as said Grant Agreement applies to said Subgrantee, will be conducted as required
by Section 55.6 of the regulations;
(b) administer or supervise, and assume full responsibility for all
activities and services provided under the Grant Agreement numbered
EEA 06-2-0050;
(c) use no less than ninety (90) percent of the funds granted for
wages and ftinge benefits for unemployed and underemployed participants, no more

than three and two-tenths (3.2) percent for the administration of the program, and

no more than six and eight-tenths (6. 8) percent for supportive personnel services
under Grant Agreement Number EEA 06-2-0050.
4. The Subgrantee certifies:
(a) He has authority to receive, expend, distribute and grant funds
7 for the purposes contained in the attached program summary.
(b) He has the authority by statute, or will have the authority by
agreement, to adhere to conditions and requirements established for the use of the
funds granted under PL 92-54.
(c) Funds granted herein do not exceed ninety (90) percent of the
cost of carrying out the program proposed by the Subgrantee, and the remaining
ten (10) percent will be provided in accordance with Section 55.16 of the regulations.
(d) Subgrantee hereby agrees to indemnify and save harmless the
Program Agent from any and all liability arising under the administration of the
Subgrant funds under the Emergency Employment Act of 1971, Public Law 92-54,
caused by any failure, act or omission of the Subgrantee under the Emergency
Employment Act of 1971, the terms and conditions of Grant Agreement Number
EEA 06-2-0050, the rules promulgated by the Secretary of Labor (29CFR55) for the
Emergency Employment Program under PL 92-54, including subsequent amendments,
and any other rules and regulations regarding the receipt, expenditure, distribution
and grant of funds pursuant to said program.
(e) It is acting hereunder as an independent contractor and not
as an agent of the Program Agent.
5. This Subgrant Agreement is hereby ratified and made effective on
August 26, 1971.
