RESOLUTION NO. // tJ;< ~~ . - COUNCIL OF THE CITY TO ABATE A PUBLIC A RESOLUTION OF THE MAYOR AND COMMON OF SAN BERNARDINO, ORDERING THE CITY ENGINEER 5 NUISANCE. 41 WHEREAS, by Resolution No. 10947, the Mayor and Common 5 Council of the City of San Bernardino did declare the existence 61 of a publ ic nuisance in the City of San Bernardino, and the 7 existence of said nuisance creates an unhealthy and insanitary condition and a fire hazard to the inhabitants of said City, and the removal thereof is necessary to protect the health and safety of the inhabitants of said City; and WHEREAS, the district within which said nuisance exists 15 is generally described as fol lows: al I that territory included 14 15 16 17 18 19 20 21 22 25 24 25 26 27 28 29 30 31 32 within the corporate I imits of the City of San Bernardino; and WHEREAS, by said Resolution No. 10947, the City Engineer was ordered to post or caused to be posted in a conspicuous place on or in front of sa i d property a not i ce ent it I ed "Not i ce to Clean Premises", and a time for hearing of objections before the Council of the City of San Bernardino being set; and WHEREAS, on the 3rd day of April, 1972, at 9:30 A.M., a hearing was held before the City Council of the City of San Bernardino, and there being no protests the Council did find that due and legal notice had been given in accordance with the Ordinance, and that said nuisance does exist upon said lots. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO: SECTION ONE: That there now exists in the City of San Bernardino a public nuisance consisting of the existence of weeds, dry grass, dead trees, tin cans, abandoned asphalt or concrete, rubbish, refuse and waste material, being situated upon 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 II II I 11 2 3 4 5 6 7 sidewalks, vacant lots, parkways and other property, and that the existence of said nuisance creates an unhealthy and insanitary condition and a fire hazard to the inhabitants of said City, and the removal thereof is necessary to protect the health and safety of the inhabitants of said City. SECTION TWO: The City Engineer of the City of San 8 9 10 11 12 13 14 15 16 17 Bernardino is hereby ordered to abate said nuisance by having the nuisance referred to, removed, and he and his assistants or deputies, or any person, firm or corporation under contract to do said work, are hereby expressly authorized to enter upon private property for that purpose. SECTION THREE: That the City Engineer is hereby authorized and empowered to have said work in abating said nuisan performed by City forces. SECTION FOUR: That after the work has been done, the City Engineer of the City of San Bernardino shall forthwith make an assessment to cover the cost of abating said nuisance including all incidental expenses, and said assessments shall be in accordance with Ordinance No. 2022, and said Assessment shall thereafter be filed with the City Clerk and due notice shal I be given.
