RESOLVED, that the bid of B & W Maintenance Service, for the furnishing of a complete janitorial service to be performed, in and about the City Hall Building, located at 300 "D" Street, San Bernardino, California for a period of one year, in accor- dance with Specification No. 4317, on file in the office of the City Administrator, is the best bid therefor, and that the same be and is hereby accepted, and all other bids are hereby rejected. That the contract, in accordance with aforementioned specification is hereby awarded to B & W Maintenance Service. That the Mayor and City Clerk of the City of San Bernardin are hereby authorized and directed to execute in the name of said City of San Bernardino, the contract with B & W Maintenanc Service for a period of one (1) year. Str_t., San Bernardino, California, hereinaft.er called the .Contract.or.. 7 8 WIT N E SSE '1' H: ---------- WHEREAS, the Ci ty of San Bernardino, as part of i t.s municipal functions, owns and operates certain public buildings and in connect.ion therewith, desires to contract for a janitorial maintenance service for a public building, hereaft.er described as City Hall, located at 300 .D. Street, San Bernardino, California. NOW, 'l'BEREFORE, in consideration of the agreements here- in contained, it is hereby agreed by and between t.he parties thereto as follows, to-wit: 1. TERM OF AGREEMENT: That said City does hereby grant. and award unto said Contractor the responsibility of performing a complete janitorial maintenance service, more fully described hereinafter, for a period of one (1) year from and aft.er May I, 1972 or as soon thereafter as the building shall become occupied. 2. DESCRIPTION OF SERVICE: That said Contractor will, at. his own expense, provide sufficient t.rucks, equipment and personnel to perform a complete janitorial service. 3. LABOR STANDARDS: The Contractor shall furnish an adequate number of properly trained cleaning personnel together with sufficient competent supervision in order to provide proper service at all times. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 All employ... shall be thoroughly investigated and their police records checked before being permitted to work in the building. 80 persons shall be employed that has a poor record for security or moral unsteadiness. All personnel shall be in qood health, free from contagious diseases. No employee or person drinkinq alcohol or under the influence of alcohol shall be allowed on the premises or in the building. The Contractor agrees to illllllediatel remove any employee whose conduct and workmanship shall become unsatisfactory. Contractor will be required to provide distinguishinq standard uniforms for each and every employee assigned to performance unde the contract. Uniforms shall display naae of, or trade _rk emblem of the Contractor, as well as the first and last name of the employee. The work performed will be under the direction of a trained supervisor who will thoroughly understand the cleaning require- ments. He shall be responsible for the satisfactory service as well as proper completion of periodic work assignments. The supervisor shall _ke periodic cleaning inspections and upon demand furnish the City of San Bernardino a written report of all waxing, project cleaning or other special cleaning done. The Contractor shall be responsible for the cost of regular pay to employees as well as cost of vacations, vacation replacement, sick leave, severance pay and pay for legal holidays. The Contractor shall be responsible for; and pay to, the proper governmental entity, all Federal, State, County and City, payroll, and retirement levies, accruing to the employees of the Contracto . 4. SERVICE TO BE PERFORMED: Employees of the Contracto shall not disturb papers on desks, open drawers or cabinets, 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 use telephones, radios or television sets or tamper with personal property. Employ_s of the Contractor shall report the oceurrenc to the City of San Bernardino anything out of the ordinary such as unlocked doors, stopped toilets, basins, broken fixtures, lights out of order, etc. Upon leaving the building employees shall see that all doors and windows are locked. All except assigned night lights shall be extinguished. A. All windows to be washed the first week of the Jl\Onth and each alternate Jl\Onth thereafter. Note - exterior surface, or 801a glas8 building facade shall not be considered as part of re- quired window washing as per schedule, however all interior surfaces shall be scheduled. B. Desk counters and table tops will be cleaned in each building once a week. The Contractor will show the day of the week this will be accomplished. C. All lights and light fixtures lIIUst be washed annually in buildings requiring this service by specifications. The City Administrator is to be notified in writing at least ten days prior to this service. D. All floors requiring wax must be stripped and rewaxed with two coats within 120 to 180 days after contract is negotiated. E. The word .clean. in these specifications shall mean to the satisfaction of the City Administrator or his designated representative (s). F. Objects such as chairs, wastebaskets, etc., must not be placed on desks or counters without first protecting said desk or counter with padding. G. When the janitors are cOIIIpleted with their work, all chairs, desks, addinq machines, etc., llIUst be returned to their respective places. I. Standard services to be performed are as follows: SERVICE PEU'OIUIANCE SCHEDULES DAILY SERVICE - Five niqhts a week, Sunday throuqh Thursday. a. Blllpty and clean ashtrays, wastebaskets, and other trash receptacles. b. Remove and deposit all trash into desiqnated pickup containers. c. Dust all desks, chairs, tables, fiUnq cabinets and all other office furniture. d. Wash counters, using disinfectant in water. e. Dust mop all tile and linoleum floors plus stairs and lounqes. f. Vacuum trails in carpets. g. Spot clean qlass and doors at entrance. h. Clean and sanitize drinkinq fountains. i. Clean washroom fixtures and sanitize. j. Refill washroom dispensers. k. Wet mop washroom floors with detergent and sanitize. 1. Wash splash marks from walls around sinks and mirrors. m. Keep deodorant blocks in urinals at all times. n. Sweep porch, steps and sidewalks around buildinq. WBBKLY SERVICE a. Wash all desks and table tops that are clear of material. b. Wash all glass doors and aluminum casinqs on doors. c. Spot clean doors, walls and woodwork. g. Hose down steps and walks around buildinqs. h. Damp clean chalk boards. DI-WEEKLY SERVICE a. ReIlIOve all heel and other marks from floors, spot wax and buff. b. Wash wastebaskets. c. Damp clean telephones. d. Wash toilet partitions. Jl)N'rBLY SERVICE a. Dust all high and low \IIOldings. b. Wash all windows. b. Wash window sills. c. Wash splash marks from filing cabinets, office furniture and walls. YBARLY SERVICE a. Strip and re-wax all tile and linoleum floors, two coats, and buff. b. Wash all light fixtures. 5. CONTRACTOR SHALL FURNISH: All non-expendable equip_nt consisting of electrical scrub- binq and industrial vacuUIII cleaners (wet and dry pick-up), scaffolding and step ladders, mopping tanks, buckets and pail , 1 2 3 4 5 6 7 8 janitors' carts, mop presses, vacuum cleaners and moppinq dollies; all expendable it_s such as carpet sweepers, dust mops, wet mops, floor brushes and handles, counter brushes, dust pans, dust cloths, sponqes, steel wool, floor machines, brushes, puttykknives, rubber qloves, cei1inq brooms, waxes, floor lotions, floor dressinqs, deterqents, soap powders, porcelain and metal cleaners, scourinq powders, polishes, uniforms for employees, etc. 9 6. BUILDING '1'0 BE MADlTAINED, AS PER THIS AGUEMBNT. 10 CITY HALL LOCATED IN THE CENTRAL CITY PLAZA: 11 The City Hall shall include all six floors and basement area 12 occupied, each workinq day. Closets, equipment rOOllls 13 (electrical, machinery and storaqe, etc.) are not to be in- 14 eluded. A set of photo reductions of each floor, or level of 15 the buildinq, is hereto attached and shall be referred to as 16 -Exhibi t A-. The service herein described and outlined shall 17 be performed by the Contractor in all areas therein desiqnat 18 as unshaded. The areas therein shaded, shall not require 19 service performance by the Contractor and the square footaqe, 20 so represented by the shaded areas, shall not be included in 21 the square footaqes which are computed as basis for payment 22 due Contractor for the performance of his services. 23 7. SPECIFICS, AND ITEMS '1'0 BE FURNISHED BY THE CITY 24 The City of San Bernardino will furnish restroom supplies ie, 25 hand soap, towels, toilet tissue, toilet seat covers and 26 deodorant blocks. 27 28 8. SPECIFICS, AND ITEMS TO BE FURNISHED BY 'tHE CONTRACTOR The Contractor will furnish all equipment, all cleaners and 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 strippers, deodorants, wax, wood oils, and germicidal products, or products of any kind necessary to performance of the Contract. "'.11 material shall be first quality. All wax or polymer must be heavy duty, buffable, and of a non-skid variety. A germicidal product must be used in all mop and cleaning water. 9. WORK SCHEDULES: All work shall be performed in a high-quality manner by competent personnel, under strict super- vision. The janitorial cleaning quide, or specifications, shall be posted in plain view in the janitors' closet of eaoh building represented for observation. 10. ADDITIONAL SERVICE: Should additional service be required, IIIOnthly oharges will be negotiated. Purchase orders for this additional work will be issued on a month-to-lIIOnth basis The Contractor shall furnish the City Adainistrator a written report of his work schedule. 11. DEPOSITION 01' RBP'USE: That said Contractor shall remove, convey and dispose of all refuse in such manner as not to be a nuisance, menace, or danqer to public peace, health and safety and shall deposit all such refuse in containers pro- vided by the City located in the basement level, adjaoent to lower level of the public parklnq qarage. The containers so furnished will be emptied and the oontents therein disposed of by City Refuse Department, at the City's expense. 12. LICENSES, PERMITS, ETC. J That said Contractor hereby agrees to obtain all necessary permits and licenses required by Federal, State, County and City Governmental Aqencies and to comply with all other regulations as set forth from time to time by such aqencies, and shall hold a City of San Bernardino business license. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 13. PLACE OF BUSINESS: That said Contraotor agrees to maintain offioe and telephone servioe at a looation acoeptable to the City of San Bernardino. 14. . PAYllBNT: That for and in consideration of the faithful performance of the terms of this oontraot, said Con- tractor specifically agrees to the following sums as full and complete payment for all of his servioes incident to said servioe Payment to the Contractor shall be made from current funds on, or about the fifteenth of eaoh month, subsequent tc the first full IIlOnth of service rendered. Payment to the Contraotor shall be based uPOn 89,366 square feet, at the bid prioe, quoted by the Contraotor, as per speoi- fication number 4317, of .295 oents eaoh square foot. Any areas subsequently added or deleted shall cause adjustment in the monthly payment to the Contractor in aocordance. 15. WAGES AND EMPLOYMENT: THAT IT IS UNDERSTOOD AND AGREED that no workman, laborer or mechanic shall be employed more than eight (8) hours during anyone oalendar day, and no person shall be employed exoept native born or naturalized citizens of the United States. 16. NON-DISCRIMINATION CLAUSE: No discrimination shall be made in the employment of persons because of race, oreed, oolor or national origin, as set forth in the provisions of Resolution No. 7414 of the Mayor and Common Council of the City of San Bernardino. 17. FAITHFUL PERP'ORMANCE BOND: That said Contraotor shall furnish a surety bond in a oCllllpany satisfaotory to the City of San Bernardino, in the sum of $3,000.00, condit.ioned upon the faithful performance of said Contract. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 18. PUBLIC LIABILI'l'Y AND PROPER'l'Y DAMAGE INSURANCE: That said Contractor shall indemnify and hold harmless City and any of its officers, agents and employees fram any claims arising out of injury to persons or property in connection with the operations of Contractor; and shall provide and keep in force during the term of this agreement a policy of public lia- bility insurance against liability for injuries to persons or property arising out of the operations of the Contractor, or the performance by Contractor of this agreement, with limits of $100,000.00/$300,000.00 for injury or death to anyone person, $100,000.00/$300,000.00 for injury or death arising fram anyone accident or occurrence and $25,000.00 for property damage. The policy of insurance so provided shall contain a contractual lia- bility endorsement covering the liability assumed by the Con- tractor by the terms of this agreement and shall contain a pro- vision that such policy may not be cancelled except after thirty (30) days notice in writing, to be given to City. Contractor shall also carry a policy of Workmen's Compensation Insurance covering any and all of its employees. Copies of these policies or certificates evidencing the same shall be filed with the City Administrator of the City after approval of the City Attorne . 19. AMENDMENT: This Agreement may be amended or modifi only by written agreements signed by both parties and failure on the part of either party to enforce any provision of this Agreement shall not be construed as a waiver of the right to compel enforcement of such provision or provisions, nor act to release any surety from its obligations under this Agreement. 20. QUALIFICATION OF INSUltANCE AND BOND COMPANIES: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 That all bonds and insurance policies shall be subject to the approval of the City of San Bernardino and shall be in accordance with Ordinance No. 821, Section 2400, and the corporation issuinq said bond or insurance shall have a ratinq in Best I s JROst recent Insurance Guide of RAR or hiqher. 21. JUDGE OF PElU"ORMANCE: That said Contractor aqrees that the Mayor and Common Councilor the City Administrator of said City shall be deemed the exclusive judqes of the sufficiency of performance by the Contractor of any and all of the covenants herein contained or by reference incorporated herein. 22. ASSIGNMBN'l': That it is specifically understood that this contract is for the performance of a public service and in the furtherance of public health and that the riqhts and duties arising by reason of said contract and conferred upon said Contractor shall not be deleqated, transferred or assiqned, it beinq mutually stipulated that the services to be performed by the Contractor shall constitute personal services. 23. DAMAGE: THAT IT IS FUR'l'HER UNDERSTOOD AND AGREED that this Contract is in the furtherance of public health and that the cessation of said service will cause qreat inconvenience and damage to said City of San Bernardino, and that in the event of any cessation of service or violation of the terms of this Contract, except in the event of strikes, floods, acts of the enemy, or acts of God, then and in that event said City may re- cover in addition to the faithful performance bonds so provided for herein, such other additional amount of damages as said City may suffer by reason of said event or violation. It is specif- ically agreed that the Bum of $1,000.00 is the minimum additional amount of damaqes suffered by said City for such event or violati n. 1 24. CANCELLATION: This Aqreement may be cancelled upon 2 thirty (30) days written notice by either party to this Aqreement 3 The City shall reserve the right to oancel the Contract, upon 4 written notioe to the Contractor for reason of unsatisfactory 5 quality of work performance or nonadherence to requirements 6 indicated in this Contract or the specifications submitted to 7 bidder, (Contractor). 8 25. PRODUCT STANDARDS: The City shall retain the right 9 to periodically inspect any or all products used by the contracto 10 in performance of the service. Should it be deemed that the 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 quality of any products so beinq used, is inadequate or of such poor quality as to not deliver deserved service, the City may at it's descretion require contractor to purchase and use a higher qual! ty product or products. Required use of any such hiqher quality products shall not entitle contractor to a increase in payment due Contractor. 26. CONTRACT DOCUMENTS: The executed contract document shall consist of the following: A. This Agreement B. Invitation for Bids C. Specifications D. Signed copy of bid E. Exhibit A (Floor Plan) This agreement, toqether with other documents enumerated above are as fully a part of the contract as if hereto attached or herein repeated and form the contract between the parties hereto.
