Synopsis of Previous Council Action:
None.
Recommended motion:
A. Urgency Ordinance amending section 12.80.130 of the San Bernardino Municipal Code by adding
Paragraph "T" thereto requiring any person skateboarding or inline skating at a City-owned
skateboard park to wear a helmet, elbow pads, and knee pads and declaring the urgency thereof.
MOTION:
That said urgency ordinance be adopted.
B. An Ordinance amending Section 12.80.130 of the San Bernardino Municipal Code by adding
Paragraph "T" thereto requiring any person skateboarding or inline skating at a City-owned
skateboard park to wear a helmet, elbow pads, and knee pads.
MOTION:
That said ordinance be laid over for final adoption.

Ordinances amending Section 12.80.130 ofthe San Bernardino Municipal
Code hy adding Paragraph "T" thereto requiring any person skate-
boarding or inline skating at a City-owned skateboard park to wear a
helmet, elbow pads, and knee pads. (Agenda Item #SI)
The City of San Bernardino owns a skateboard park at Blair Park which is scheduled to be
open to the public by the end of March, 2004 for skateboard and inline skating.
California Health and Safety Code gl15800 permits operation of a City-owned skateboard
park as contemplated herein by the City upon adoption by the local public agency of an ordinance
requiring persons using such facility to wear a helmet, elbow pads, and knee pads and the subsequent
posting of signs at such facility advising the public of such requirements.
Section 12.80.130 of the San Bernardino Municipal Code is entitled "Park regulations" and
sets forth various activities which are unlawful for any person to do within the limits of any public
park or playground in or upon any facility or building located therein and owned or controlled by the
City. Adding Paragraph "T" to said Section 12.80.130 will fulfill the legal requirement of said
gl15800 so that signs can be posted at the facility advising the public of such requirements and will
permit the skateboard park at Blair Park to be open to the public by the end of March, 2004.
It is requested that the urgency ordinance by adopted and that the regular ordinance be laid
over for final adoption.

THE MA YOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
10 DO ORDAIN AS FOLLOWS:
II SECTION 1: Section 12.80.130 of the San Bernardino Municipal Code is hereby amended
12 by adding Paragraph "T" at the end of said section to read as follows:

"T.
Skateboard or inline skate at a City-owned skateboard park without
14 wearing a helmet, elbow pads, and knee pads. Use this facility for skateboarding or
15 inline skating if under the age of fourteen (14) years without being supervised by an
16 adult. Use any other equipment otherthan skateboards orinline skates at this facility.
17 Skateboard or inline skate during rain or wet conditions at this facility."
18 SECTION 2: Statement of Urgency.
19 California Health and Safety Code S 115800 permits operation of a City-owned skateboard
20 park as contemplated herein by the City upon adoption by the local public agency of an ordinance
21 requiring persons using such facility to wear a helmet, elbow pads, and knee pads and the
22 subsequent posting of signs at such facility advising the public of such requirements. Section
23 12.80.130 of the San Bernardino Municipal Code is entitled "Park regulations" and sets forth various
