Medians/Phase I on "E" Street between 2nd Street and 4th Street (SS04-36) per Plan No. 10454B.
Backj!;round:
In December of 2002 the City and EDA proposed a beautification project on "E" Street in the
downtown area. The original design had streams with waterfalls in the center median. The entire
project was previously bid; however, all bids were much higher than the available budget. Staff
proposed to scale down the project and rebid as Phase 1. Phase I is the pop outs with landscaping
added in the angle parking areas. The bus stop next to the pedestrian bridge is proposed to be relocated.
Omnitrans had suggested relocating it south of 2nd Street, but may accept a location just north of the
driveway to the 3-level parking structure and south of 4th Street.
Phase II of this project, which will consist of median modifications and pavement rehabilitation, will
be recommended for funding as part of the FY 2004/05 Capital Improvement Program (CIP).
Plans and Specifications, for The Landscape Medians/Phase I on "E" Street between 2nd Street and 4th
Street (SS04-36) per Plan No. 10454B, have been approved. Bids have been received and the
construction project is ready to be awarded.
This project was advertised locally in the San Bernardino County Sun Newspaper, F. W. Dodge
Company, Reed Construction Data, Bid America Electronic online Plan Room, Construction Data
(Hot Sheet), Construction Bid Source, the City's web site, and with the San Bernardino Area
Chamber of Commerce. The following companies responded:

The bid documents state that the lowest responsible bid shall be determined based on the basic bid
only.

STAFF REPORT - Continued
The additive bid is for relocating the Omnitrans bus shelter. Unfortunately, the lowest responsible
bidder, International Pavement Solutions, Inc., bid more than double the engineer's estimate for the
bus shelter relocation. Although the total amount of the basic bid plus additive bid is within the
approval budget, staff feels that the work required to relocate the Omnitrans bus shelter can be
accomplished more quickly (within the next 30 days) and efficiently under a separate contract.
Therefore, staff is recommending that this contract be awarded in the amount of the basic bid only.
The estimated project costs are as follows:

Inspection and Contract Administration $ 10,000.00
Total $144,222.00
If this project is awarded, it is anticipated that construction can start in March of 2004, and be
completed by June of 2004.
Financial Impact:
Adequate funding for this project was approved in the FY 2003/04 CIP budget and available from a
combination ofCDBG, Account Nos. 135-378-5504-7322 and 126-369-5504-7322.
Recommendation:
Adopt Resolution.

BETWEEN 2\1l STREET Al'ID 4TH STREET (SS04-36) PER PLAl'I NO, 104548.
BE IT RESOLVED BY THE 1\1 A YOR AND COMMON COUNCIL OF THE
CITY OF SAI'l BERI'lARDII'lO AS FOLLOWS:
SECTION 1. International Pa\'el11ent Solutions, Inc., at 1199 Opal Avenue, l\lentone,
CA 92359 is the lowest responsible bidder for The landscape Medians/Phase I on "E" Street
between 2nd Street and 4th Street (SS04-36) per Plan 1\'0. 10454B. A contract is awarded
accordingly to said bidder in a total amount of 5114,222.00, with a contingency amount of
$20,000.00, but such award shall be effective only upon being fully executed by both parties.
All other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to
execute said contract on behalf of the City; a copy of the contract is on file in the office of the
City Clerk and incorporated herein by reference as fully as though set forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not take
effect or become operative until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTIOI'l 3. This resolution is rescinded if the parties to the contract fail to execute it
within sixty (60) days of passage of the resolution.
