BACKGROUND Currently, the San Bernardino Municipal Code does not require alarm businesses to notify the police department of each new system installed or require any installation or alarm monitoring service transfer fees. The City currently holds approximately 7,700 valid alarm permits for both residential and commercial alarms installed in the city. Payment of a $25.00 installation fee on these alarms would have generated revenues of $192,500 over a period of five years. The Alarm Compliance Unit is notified of an average of 1,200 new alarm systems installed in the city per year. It is estimated that there could be as many as 1,500 new alarm systems installed in the city per year. Charging alarm businesses a one-time fee of $25.00 for each new alarm system installed in the city will generate additional annual revenues of approximately $35,000. We estimate that there are as many as 300 transfers annually of existing alarm system monitoring services from one business to another. Charging a one-time fee of $10.00 for each alarm system monitoring transfer within city limits will generate additional annual revenues of approximately $3,000. The total additional annual revenues are estimated to be $38,000. These fees will partially offset the staff time required to update the alarm files. Requiring alarm businesses to notify the police department of each installation will help better track alarm systems in the city and allow the department to bring those alarm owners not aware of the alarm ordinance into compliance. FINANCIAL IMPACT Requiring notification from the alarm businesses would enable the police department to generate both installation charges and permit fees for these new alarm systems. Estimated annual revenue from installation and transfer fees is $38,000. Additional permit fees are also expected to be generated. RECOMMENDATIONS That said ordinance be laid over for final adoption. 8.81.040 Alarm business registration. It is unlawful for any person, partnership, corporation or firm to own, manage, conduct or carry on an alarm business within the City of San Bernardino without first having registered with the Police Department. Registration is not required for any business which only sells or leases alarm systems from a fixed location unless the business services, installs, monitors or responds to alarm systems at the protected premises. Registration shall be accomplished by furnishing such information as may be required by the Police Department, including but not limited to, the full name of the business and a copy of its State issued license. The Police Department shall notify the alarm business at the time of such registration that a City business license is required. (Ord. MC-773, 3-11- 91; Ord. MC-236, 12-20-82; Ord. MC-125, 1-4-82.) (City Attorney Opinion No. 91-37) 8.81.045 Alarm businesses installation and transfer fees. Alarm businesses shall notify the Police Department of each new alarm system installed or assuming an existing monitoring seIVice in the City. A. Alarm businesses shall pay a one-time fee for each new alarm system, residential or commercial, installed in the City. B. Alarm businesses shall pay a one-time fee for each alarm monitoring seIVice transfer, residential or commercial, with the City. c. Fees will be charged at a rate set by resolution of the Mayor and Common Council. 8.81.050 Alarm agent registration required. It is unlawful for any person, including the owners of an alarm business, to engage directly in the selling, leasing, maintaining, servicing, repairing, altering, replacing, moving or installing of an alarm system in or on any building, place or premises within the City without first having registered his or her name and filed with the Police Chief a copy of the alarm agent registration card issued by the State. Nothing in this section shall require a person to so register in order to install, service, repair, alter, replace or move an alarm system on the premises owned or occupied by that person. Nothing in this section shall require a person to register who is merely a salesman for any business not required to obtain an alarm business permit under the provisions of Section 8.81.040, if the salesman does not engage in any other activities related to alarm systems apart from selling. No fee shall be charged, nor shall any application form be required by the City. The alarm agent shall be notified at the time of filing his or her State issued identification card with the Police Department that a City business license is required. (Ord. MC-236,12-20-82; Ord.
