I. That the Director of Development Services and the City Clerk be authorized to proceed with the
vacation ofa portion of Hazel Street, between "H" Street and the 1-215 freeway;
AND
2. That approval of Plan No. 10907 be given;
AND
3. That a request for a portion of vacation fees in the amount of$500 be denied.

Staff Report
SUBJECT:
Authorization to Proceed - Proposed vacation of a portion of Hazel Street, between "H" Street
and the 1-215 freeway, plan approval and request for a waiver offees.
BACKGROUND:
In November, 2003, this office received a request for the vacation of a portion of Hazel Street,
between "H" Street and the 1-215 freeway. The request was submitted by two petitioners, James
Ballard, owner of A VIS Plumbing, Heating, and Air Conditioning, Inc., located at 730 South
"H" Street, and Bill Jacobson, owner of the property located at 740 South "H" Street, which is
currently leased to Inland Computer Systems. The petitioners are requesting that the portion of
Hazel Street between the two properties be vacated, in order to reduce the amount of vandalism,
public dumping, blight, and unlawful activities, which have been a constant problem in this area.
The petitioners have requested this vacation to assist in the elimination of these problems, which
directly impact both parcels. The property owners are requesting a waiver of fees due to the
excessive amount of loss to both properties as a result of these public nuisances. Since this is not
a City-initiated vacation and there is no precedence for waiving fees for this type of action, staff
is recommending that the request for a waiver of fees be denied.
If authorization to proceed is given, all affected City departments, utilities and property owners
will be contacted for comments or any possible conflicts. Part of the proceedings will include the
determination of the future necessity of this portion of Hazel Street for public right of way
purposes.
FINANCIAL IMP ACT:
None. Applicant has paid the first half of the processing fees and will pay the remainder prior to
the legal proceedings, if request for waiver of fees is denied.
RECOMMENDATION:
Staff recommends that authorization to proceed with the proposed vacation be given, that Plan
No. 10907 be approved, and waiver offees be denied.
