Synopsis of Previous Council Action:
1/512004 - MICC approved Res. No. 2004-6 directing staff to prepare documents to
amend the San Bernardino Municipal Code Section 15.04.080(B)(2) to
allow fee waivers for expansions beyond the previously permitted square
footage of the damaged or destroyed structure.
Recommended Motion:
That said ordinance be laid over for final adoption.

Ordinance Amending Section 15,04.080(B)(2) of the San Bernardino
Municipal Code Relating to Fee Waivers For Certain Permits After A
Natural Disaster
Background: The San Bernardino Municipal Code, Section 15.04.080(B)(2) provides in part,
that no fees shall be charged for permits issued to owners for demolition or first rebuilding of
damaged or destroyed structures located in an area designated as a disaster area by resolution of
the Mayor and Common Council.
Portions of the City damaged by the Old Waterman Canyon Fire were designated as a disaster
area by a Proclamation of the Mayor and Common Council on October 29,2003. On January 5,
2004, the Mayor and Common Council approved Resolution 2004-6 which directed staff to
prepare documents to amend the SBMC Section 15.04.080(B)(2) to allow the waivers offees for
expansions beyond the previously permitted square footage of the damaged or destroyed
structure.
Financial Impact: Assuming that 20% of the homeowners request expansions of20% over
previously permitted square footage, fee waivers will result in an estimated offset in building
permit and plan check revenues of approximately $10,600.
Recommendation: That said ordinance be laid over for final adoption.

RESOLUTION NO. 2004-6
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO RELATING TO THE WAIVER OF FEES FOR PERMITS ISSUED TO
OWNERS OF PROPERTIES IN THE AREA BURNED BY THE OLD WATERMAN CANYON
FIRE AND DESIGNATED AS A DISASTER AREA UNDER SAN BERNARDINO
MUNICIPAL CODE SECTION 15.04.080(B)(2).
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
WHEREAS, the Mayor on October 25, 2003, issued a Proclamation of the existence
of a local emergency caused by the Old Waterman Canyon Fire; and
WHEREAS, the Common Council has ratified said Proclamation at an Emergency
Meeting of the Common Council held on October 29, 2003; and
WHEREAS, over 330 structures within the City of San Bernardino have been
damaged or destroyed by the Old Waterman Canyon Fire; and
WHEREAS, San Bernardino Municipal Code Section 15.04.080(B)(2) provides in
part, that no fees shall be charged for permits issued to owners for demolition or first
rebuilding of damaged or destroyed structures located in an area designated as a disaster
area by resolution of the Mayor and Common Council; and
WHEREAS, the construction of larger homes should be encouraged as it increases
property values of the individual home and those in the surrounding neighborhood and
increases property tax revenue to municipal government; and
WHEREAS, the Mayor and Common Council wish to further assist property owners
with the repair and rebuilding of their damaged or destroyed homes and structures.
NOW, THEREFORE be it resolved that the Mayor and Common Council hereby
direct Staff to prepare the appropriate documents to amend the San Bernardino Municipal
Code Section 15.04.080(B)(2) to allow fee waivers for expansions beyond the previously
permitted square footage of the damaged or destroyed structure.

Natural Disaster Damage - No fees shall be charged for permits
issued to property owners for demolition or first rebuilding of
damaged or destroyed structures, including construction beyond the
previously existing square footage of SaId damaged or destroyed
structures, located in an area designated as a disaster area by
resolution ofthe Mayor and Common Council. This exemption shall
apply only to property owners of record at the time of the disaster,
and not to persons subsequently acquiring the property. This fee
exemption shall be valid fora periodof7 (seven) years from the date
of the adoption of the resolutIOn."
