Legislative Review Committee directed staff to prepare a draft Urgency Ordinance for the full
Council.
Mayor and Common Council referred this matter back to the Legislative Review committee and
continued this item until meeting of December 15, 2003.
Mayor and Common Council tabled this item. Mayor created an Ad Hoc Committee composed
of Council members, Planning Commissioners, and City Staff to address this issue and report its
recommendations to the Legislative Review Committee.

SUBJECT
Resolution designating certain parcels within Building Safety Enhancement Areas as
defined by San Bernardino Municipal Code Chapter 15.11 due to damage or destruction
caused by the Old Waterman Canyon Fire.
BACKGROUND
On January 5, 2004, the Mayor and Common Council approved the Urgency Ordinance
Municipal Code 1162 amending Chapter 15.10 relating to Foothill Fire Zone Building
Standards and adding Chapter 15.11 to the San Bernardino Municipal Code to include the
Building Safety Enhancement Area Building Standards.
The purpose of this ordinance is to promote public safety and welfare by reducing the
risk of injury, death, or property damage that may result from urban conflagrations spread
by high winds. Chapter 15.11 of the San Bernardino Municipal Code provides a
procedure for the Council, by resolution, to designate certain parcels within Building
Safety Enhancement Areas to specific building standards that will help mitigate the threat
of future conflagration.
The areas designated on the proposed parcel list (Exhibit A) meet the criteria described in
Chapter 15.!1 of the San Bernardino Municipal Code. A copy of the map designating
parcels shall be available at the Development Service Department and during the Council
meeting for review.
Parcels included in the Building Safety Enhancement areas will be required to rebuild to
specific building standards outlined in Chapter 15.11 of the San Bernardino Municipal
Code. Property owners in the proposed Building Safety Enhancement Areas were sent
notice by mail of the pending Council action. The mailed notices included the date that
the public hearing would occur.
FINANCIAL IMP ACT
There is no financial impact to the City of San Bernardino.

Be it resolved by the Mayor and Common Council of the City of San Bernardino as follows:

WHEREAS, the Old Waterman Canyon Fire began on the morning of Saturday, October 25,
7 2003, and proceeded to bum a total of91,281 acres and destroyed or damaged 1,038 structures before
being 100% contained on November 5,2003, with 336 structures damaged or destroyed within the City
8 of San Bernardino, the majority of which were located in the north Del Rosa area; and
9 WHEREAS, the California Fire Chiefs Association Urban-Wildland Interface Committee
has analyzed contributing factors associated with structure loss during the Old Waterman Canyon Fire,
10 and has held meetings to develop recommend construction changes in the City's foothill area; and
11 WHEREAS, the Mayor's appointed Ad Hoc Committee, composed of three
Councilmembers, four Planning Commissioners and three City staffpersons, held two evening public
12 meetings and discussed and recommended adoption of a proposed Urgency Ordinance amending Chapter
15.10 relating to Foothill Fire Zone Building Standards and adding Chapter 15.11 of the San Bernardino
13 Municipal Code to include the Building Safety Enhancement Area Building Standards; and
14 WHEREAS, the Council's Legislative Review Committee held three public meetings and
discussed and recommended adoption of the proposed Urgency Ordinance and Regular Ordinance
15 amending Chapter 15.10 relating to Foothill Fire Zone Building Standards and adding Chapter 15.11 of
the San Bernardino Municipal Code to include the Building Safety Enhancement Area Building
16 Standards; and
17 WHEREAS, on January 5, 2004, the Mayor and Common Council adopted Urgency
Ordinance MC 1162 amending Chapter 15.10 relating to Foothill Fire Zone Building Standards and
18 adding Chapter 15.11 of the San Bernardino Municipal Code to include the Building Safety
Enhancement Area Building Standards; and

WHEREAS, pursuant to Section 15.11.040(a) of said Urgency Ordinance, after mailing
20 notices to affected property owners, the Mayor and Common Council held a public hearing on January
20, 2004, to consider this Resolution.

NOW THEREFORE be it resolved by the Mayor and Common Council as follows:

The Mayor and Common Council hereby declare those properties listed on Exhibit A,
24 attached and incorporated herein, identified by Assessor's Parcel Number, as being located within the
Building Safety Enhancement Area as defined by San Bernardino Municipal Code Chapter 15.11.

SECTION 2.

A map showing the designated properties in the Building Safety Enhancement Area shall be
made available for public review at the City's Development Services Department and Fire Department.

Re: Rebuilding After tbe Old Waterman Canyon Fire; Notice of a Public Hearing
of tbe Common Council to consider a Resolution designating certain parcels
within tbe Building Safety Enhancement Area as defined by San Bernardino
Municipal Code Cbapter 15.11, due to damage or destruction caused by tbe Old
Waterman Canyon Fire.
Dear Property Owner,
The City of San Bernardino regrets that your home and property have been damaged or
destroyed by the recent Old Waterman Canyon Fire. The Mayor and Common Council
encourages you to rebuild and has adopted Resolution No. 2003-288 on October 29, 2003,
which designated the areas burned as a disaster area under San Bernardino Municipal Code
Section 15.04.080(B)(2). This action allows property owners of record at the time of the
fire to obtain City permits for demolition or rebuilding without paying City fees for these
permits. On January 5, 2004, the Mayor and Common Council adopted Resolution No.
2004-6 which ultimately will grant property owners waivers of City fees for building
expansions beyond the previous square footage of the damaged or destroyed structures.
While we encourage you to rebuild your home, we also want to ensure that rebuilding will
lessen the likelihood that your home will suffer the same fire damage again. To that end,
shortly after the fire, members of the California Fire Chiefs Association Urban-Wildland
Interface Committee analyzed contributing factors associated with structure loss during the
Old Waterman Canyon Fire. Subsequently, they held a series of meetings to develop
recommended construction changes in our foothill areas. Members of the Committee studied
similar devastating fires in the past, both in California and other states. As Fire Marshal of
the City of San Bernardino, I met with the Committee on three occasions to provide input
for their consideration. The San Bernardino County Fire Department also attended these
meetings, since many of the homes lost were located in County areas within the City.
In light of the Committee's findings, the Fire Department recommended implementation of
the following building standards to reduce the risk of injury, death and property damage
from urban fires spread by high winds:
. Exterior walls are to be constructed of non-combustible (stucco) or I-hour fire-
resistance rated construction.
. Eaves are to be enclosed with stucco or equivalent protection.
. Vinyl window frame assemblies are required to meet specific requirements.

· Garage doors are to be constructed of non-combustible materials or fire retardant treated
wood.
· Vents are to be covered with 1/8" mesh metal screen. Roof-mounted turbine vents are
not permi tted.
· Paper-faced attic and ventilated spaces insulation is not permitted.
· Roofing material must be non-wood material with at least a Class A or B fire-retardant
rating. Open ends of high-profile roofs shall be capped with non-ignitable material.
Gutters and downspouts must be constructed of non-combustible material.
· Where wood or vinyl fencing is used there shall be a 5' separation between the fencing
and wall of the nearest structure, unless the property line does not allow the 5'
separation and the previous construction occurred under a previous code.
The City's Building Official estimates that the cost of these improvements for an average
size house is approximately $1,630.00.
At their January 5, 2004 meeting, the Mayor and Common Council of the City of San
Bernardino adopted Urgency Ordinance MC 1162, which requires these building standards
for construction within a designated Building Safety Enhancement Area. At their Council
Meeting on Tuesday, January 20, 2004 at 4:00 p.m., the Mayor and Common Council will
conduct a public hearing to consider a Resolution designating your property and
approximately 209 of your neighbors' properties for inclusion in the Building Safety
Enhancement Area. The Council Meeting will be held at San Bernardino City Hall, Council'
Chambers, 300 North "D" Street, San Bernardino, CA. You may attend and participate at
the Council Meeting, or if you are unable to attend, you may submit written comments to
the Fire Department, 200 East 3rd Street, San Bernardino, CA 92410. If you challenge the
resultant action of the Mayor and Common Council in court, you may be limited to raising
only those issues you or someone else raised at the public hearing described in this notice,
or in written correspondence delivered to the City Fire Department prior to the public
hearing.
