Guy & Son, General Engineering Contractors, Inc. for Sanitary Sewer System Improvements for Proposed SR-2IO Freeway Extension at Macy Street and Madison Street from 23rd Street to 26th Street (SW 04-17) per Plan No. 10635. Back2round: On September 2, 2003, the Mayor and Common Council approved Utility Agreement No. 17064 with the California Department of Transportation (Caltran) for the relocation of the subject sewer main in connection with the SR-21O Freeway Extension. On September 15,2003, the Council approved this project as part of the 2003/2004 C.!.P. as Project No. SW04-17. The cost of this project is 100% percent reimbursable from Caltrans. The City must submit an itemized bill to the State within 360 days after completion of work. Plans and Specifications for Sanitary Sewer Relocation for the proposed SR-21O Freeway Extension at Macy Street and Madison Street from 23rd Street to 26th Street (SW 04-17) have been approved. Bids have been received and the construction project is ready to be awarded. This project was advertised locally in the San Bernardino County Sun Newspaper, F. W. Dodge Company, Reed Construction Data, Bid America Electronic online Plan Room, Construction Data (Hot Sheet), Construction Bid Source, the City's web site, and with the San Bernardino Area Chamber of Commerce. FOR SANITARY SEWER SYSTEM IMPROVEMENTS FOR PROPOSED SR-210 FREEWAY EXTENSION AT MACY STREET AND MADISON STREET FROM nRD STREET TO 26TH STREET (SW 04- 17), PER PLAN NO. 10635. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Ross A. Guy & Son, General Engineering Contractors, Inc. at 40680 Vista, Murrieta, CA, 92562 is the lowest responsible bidder for Construction of Sanitary Sewer System Improvements for Proposed SR-21O Freeway Extension at Macy Street and Madison Street from 23cd Street to 26th Street (SW 04-17), per Plan No. 10635. A contract is awarded accordingly to said bidder in a total amount of $184,160.00, with a contingency amount of $28,216.00, but such award shall be effective only upon being fully executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendment or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it within sixty (60) days of passage of the resolution.
