HomeMy WebLinkAbout06-07-1989 Minutes . . . f City of San Bernardino, California June 7, 1989 This is the time and place set for an Adjourned Regular Meeting of the Mayor and Common Council of the City of San Bernardino at their Regular Meeting held at 9:10 a.m., Monday, June 5, 1989, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. The City Clerk has caused to be posted the Order of Adjournment of said meeting held Monday, June 5, 1989, and has on file ln the Office of the City Clerk an affidavit of said posting together with a copy of said Order which was posted at 2:30 p.m., Tuesday, June 6, 1989, on the door of the place at which said meeting was held. The Adjourned Regular Meeting was called Holcomb at 3:07 p.m., in the Council Chambers North "D" Street, San Bernardino, California. to order by Mayor of City Hall, 300 INVOCATION The Invocation was given by Phil Arvizo, Executive Assistant to the Council. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Phil Arvizo, Executive Assistant to the Council. ROLL CALL Roll Call was taken with the following being present: Mayor Holcomb; Council Members Estrada, Reilly, Flores, Maudsley, Minor, Pope-Ludlam, Miller; City Attorney Penman, Deputy City Clerk Lang, Acting City Administrator Robbins. Absent: None. PUBLIC COMMENTS - DUFFY STREET DISASTER Vickie Milligan, 2305 Donald Street, spoke regarding the trauma incurred by the residents of the area involved In the Duffy Street train derailment and pipeline explosion/fire. She complained regarding housing arrangements that have been made for the evacuated people, stating that they do not want to go back to the area. Mayor Holcomb adVlsed her that the Fire Chief has declared certaln portions of the area to be safe for occupancy. - 1 - oJ7lB9 . . . r ~ PUBLIC COMMENTS - DUFFY STREET DISASTER Paul Douglas Evans, Sr., 2634 Duffy Street, spoke on behalf of the Duffy Street neighborhood residents and requested help from the City regarding negotiat1ons with the CAL-NEV Pipeline Company. He complained regarding the language in a partial release from the company that the residents were requested to sign. Mayor Holcomb explained that the city 15 not in a position to represent the residents as individuals; however, the city is trying to persuade the responsible companies to do the right thing by the residents and to act as quickly as possible. He stated that the city will do the best it can on behalf of the residents. COMMUNITY DEVELOPMENT FY 1989/1990 - PUBLIC JUNE 5, 1989 This is the time and the recommended Community FY 1989/1990. BLOCK GRANT FUNDING FOR SERVICES - CONTINUED FROM place continued to for consideration of Development Block Grant Funding for the ( 1 ) In a memorandum dated June 7, 1989, Ken Henderson, Director of Community Development, provided the recommendations made by the Community Development Citizens Advisory Committee for Community Development Block Grant funding for the FY 1989/1990. He stated that staff concurs with the recommendations. Ken Henderson, Director of Community Development, explained that the Public Services funding recommendations have not yet been considered. The public hearing was conducted on June 5, 1989; however, these recommendations, along with final approval of the funding was continued to this date. Council Member Pope-Ludlam made a motion, seconded by Councll Member Reilly and unanimously carried, that the Public Services portion of the FY 1989/1990 CDBG funding recommendations prepared by the Community Development Citizen Advisory Committee be approved and adopted; and that staff be authorized to submit the FY 1989/1990 Statement of Objectives and Projected Use of Funds to the U.S. Department of Housing and Urban Development. CLOSED SESSIONS Senior Assistant City Attorney Barlow requested that the Closed SeSSlons on the agenda identifled as 2a, 2b and 2d, be continued to the meeting that was previously scheduled for Saturday, June 10, 1989, as there lS nothing to report at this time. o - ~ - 6/7/89 . . . Council Member Miller made a motion, seconded by Council Member Reilly and unanimously carried, that the following Closed Sessions listed on the agenda, be continued to 9:00 a.m., Saturday, June 10, 1989, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California: 2a - to discuss Code Section exposure to pending litigation pursuant to Government 54956.9(b)(1), as there is significant litigation; (Continued from June 5, 1989) (2a) 2b - to discuss pending litigation Code Section 54956.9(c), so whether to initiate litlgation; 5, 1989) pursuant to that Council (Continued Government may declde from June (2b) 2d - to discuss pending litigation pursuant to Government Code Section 5495b.~(a) to confer with its attorney regarding pending lltigation which has been initiated formally to which the City is a party as follows: Citv of San Bernardino vs. CAL-NEV Pipeline Companv, a Delaware Corporation and Does 1 - 100 - San Bernardino Superior Court Case No. 249735. (Continued from June 2, 1989) (2d) RECESS MEETING - CLOSED SESSION - CONTINUED FROM JUNE 5, 1989 At 2:30 p.m., Council Member Miller made a motion, seconded by Council Member Rellly and unanimously carried, that the Common Councll recess to Closed Session to consider personnel matters pursuant to Government Code Section 54957. (2c) CLOSED SESSION At 2:30 p.m., Mayor Holcomb called the Closed Session to order in the Conference Room of the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. PERSONNEL MATTERS - INTERIM CITY ADMINISTRATOR MARSHALL JULIAN - DEPUTY CITY ADMINISTRATOR JAMES ROBBINS Mayor Holcomb announced that action was taken in Closed Session to appOInt Marshall Julian as the Interim City AdmInistrator starting at the "A" Step and James Robbins as Deputy City Administrator at the "E" Step.
