RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AUTHORIZING THE MAYOR OR HER DESIGNEE TO
EXECUTE AMENDMENT NO.1 TO THE SENIOR NUTRITION CONTRACT NO. 04-
886 BETWEEN THE CITY OF SAN BERNARDINO AND COUNTY OF SAN
BERNARDINO DEPARTMENT OF AGING AND ADULT SERVICES (DAAS) FOR
SENIOR NUTRITION SERVICES.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor and Common Council of the City of San Bernardino hereby
authorizes the Mayor or her designee to execute Amendment No. I to the Senior Nutrition
Contract No. 04-886 with the County of San Bernardino Department of Aging and Adult
Services (DAAS) to amend Section III Contractor General Responsibilities Paragraph V and
Paragraph A and D, a copy of which is attached hereto, marked Exhibit "A" and incorporated
herein by reference as fully as though set forth at length.
SECTION 2. The authorization to execute the above referenced amendment is
rescinded if the parties to the amendment fail to execute it within one hundred twenty (120)
days of the passage of this resolution.

BACKGROUND INFORMATION: On March 22, 1972, President Nixon signed into law the
Nutrition Program for the Elderly Act, establishing the Senior Nutrition Program as part of the
Older Americans Act (OM). This legislation created the congregate and home-delivered nutrition
programs. These programs provide nourishing meals, nutrition education and counseling to
people 60 years of age or older and their spouses.
Since 1978, thE! Department of Aging and Adult Services (DMS) has operated Senior Nutrition
Programs for the County of San Bernardino. Senior Nutrition Services are procured through a
formal procurement process. On December 16, 2003, the Board of Supervisors (BaS) approved
and authorized the release of a Request for Proposals (RFP) to procure congregate and home
delivered nutrition services. As a result of this procurement and a subsequent solicitation, the
Cities of Montclair and San Bernardino and six other agencies were awarded contracts.
Each agency providing meals for the Senior Nutrition Program is eligible to participate in the
Nutrition Services Incentive Program (NSIP) from the Administration on Aging, previously funded
through the United States Department of Agriculture reimbursement. NSIP funds were
incorporated into each contract based on the number of meals served in the prior fiscal year.
Recently, the State received additional One-Time-Only NSIP funds for FY 04/05 from the
Administration on Aging to distribute to nutrition services providers for purchasing food. San
Bernardino County was awarded $72,819 of these additional funds for FY 04/05.

On May 10, 2005, the BOS approved amendments to six of the eight senior nutrition services
providers awarding an aggregate increase of $60,469 in One-Time-Only NSIP funds for FY 0405.
The City of Montclair and the City of San Bernardino required additional time to obtain approvals
and signatures.
Approval of these amendments will award thEl City of Montclair and the City of San BElrnardino an

provide congregate and home delivered meals to seniors for FY 04/05.
Contractor performance is measured by reviewing the required monthly reports and semi-annual
site visits by County staff to monitor contract compliance, fiscal and program eiements. These
contractors are in contract compliance and have met performance standards.
REVIEW AND APPROVAL BY OTHERS: This action has beEln recommended by the Senior
Affairs Commission on February 16, 2005. These amendments have been reviewed by HSS
Contracts (Lori Ciabattini, Contracts Manager, 388-0253) on April 21, 2005; and the Office of
County Counsel (Phebe W. Chu, Deputy County Counsel, 387-4725) on April 26, 2005. The item
has been reviewed by HSS Finance (John Hallen, Administrative Analyst, 388-0330) on June 9,
2005 and the County Administrative Office (Gary Morris, Administrative Analyst, 388-0356) on
June 8, 2005.
FINANCIAL IMPACT: Approval of these amendments will increase the total combined contract
amount by $12,350, from $220,551 to $232,901. One-Time-Only NSIP funds of $12,350 are
funded by the Administration on Aging through the State. Federal and State revenues fund
$188,401. Total local share of $44,500 is budgeted in the HSS administrative budget and is
funded 100% with Realignment revenues. Adequate appropriations and revenues of $232,901
have been included in the DMS FY 04/05 budget. There is no additional local cost.
Cost Reduction Review: The County Administrative Office has reviewed this agenda item and
recommends this action because the request involves funds awarded by the California
Department of Aging and is not subject to state budget reductions.

dividing the balance left by the number of months remaining in the Contract term. No advance will increase
the amount shown in Section V, Paragraph A.
